the decision is in. united states supreme court gives supporters of same-sex marriage a huge win striking down part of the defense of marriage act. 911 tapes will be played during george zimmerman's second-degree murder trial. we'll bring you the latest from sanford, florida. paula deen calls basic suizations that she's a racist horrible lines. i'm wolf blitzer. let's get to riveting news. george zimmerman second-degree murder trial is moving along quickly. jurors spent most of the morning listening to accounts from neighbor who is saw part of the

scuffle between zimmerman and martin. george howell is joining us from outside the court. tell us about the testimony from the two women that occurred today. >> reporter: wolf, absolutely. first let's start with jane. this is a neighbor that had a unit in this complex. she said she was in her bedroom, opened the window and heard two distinct voices. one she described as a dominant, aggressive voice. she said it could be the use of a young boy. the prosecution is trying to make this claim, make this argument. i want you to listen to this 911 call when jane called after she heard those voices. >> i looked out my window. and someone is yelling and screaming help. i heard like a pop noise.

>> you're not the only person. . there's an officer on scene an another on the way. >> i see the person right now. i see him walking. there's man coming out. he has a flashlight. i don't know what he did to this person. >> reporter: then in cross-examination the defense pointed this out. they said to the jury that it's impossible to determine with any certainty the age of a person screaming without seeing it. these are earwitnesses. certainly the prosecutors are relying on what they heard but the defense is saying that's not possible. also heard from another nabeighr there. she said he was in her yelling room and heard what are she described as howling and saw two people on the ground. she said that the larger person was on top and she said in court she believed that was george

zimmerman. the defense attorneys asked why did you think that's zimmerman and she said it's because she saw pictures early on of trayvon martin. these pictures that were released and put on television when he was 14 years old. he was a lot lighter than he was in 2012. we believe he weighed just a little under 180 pounds. george zimmerman right at 180 pounds. the two were about the same weight. trayvon martin was taller. now when you look at george zimmerman he's gained a lot more weight. he's right around 300 pounds. a bigger person than in 2012. >> he gains 100 pounds. that's a lot of weight. we'll have more on what's going on at the trial. historic decisions right here in washington over at the united states

supreme court. decisions that will affect millions and millions of americans. the court struck down key parts of the defense of marriage act. the justices dismissed an appeal over california's proposition 8. that means that same-sex marriage will be legal in the largest state in the united states. there's strong reaction to the rulings from both sides. take a listen to this. >> this is about equality and this means the marriages of people in my state and all over america between same-sex couples will be treated equally under more than 1100 pro visions that use the term marriage. it's great win. >> i think this is a rejection of the voters of california who have twice gone to the polls to uphold the natural definition of

marriage. they completely ignored them. >> let's dig a little deeper. huge victory for sex-sex marriage supporters. what about doma did the justices consider unconstitutional in that 5-4 decision. >> they said the act was unconstitutional because it deprived same-sex couples under equal protection and throughout history defining and regulating marriage has always been the province of the states and justice anthony kennedy wrote this opinion. he said doma rejected that tradition an that's not acceptable either. >> justice kennedy being the key vote. jeffrey you've been watching the supreme court. what do supporters have to do

now? where do they go from here? >> there's enormous practical and symbolic victories in both of these cases. there are all these federal benefits whether it's filing joint returns, social security benefits. those benefits are available to gay people who are married. if you look at the language of justice kennedy's opinion. it really does suggest that there is a constitutional right to be married if you are a gay person. there's certain to be new test cases in the 38 states that do not have same-sex marriage using it as a basis to have seame-sex marriage. that's the next step after california starts having wedding ceremonies in the near future.

>> there will be major legal and political battles in the days, months and years to come. the proposition 8 which was rejected for all practical purposes, why did the justices decide that for all practical purposes same-sex marriage will now be once again legal in california? >> he said the courts couldn't reach the merits because the people didn't have what's known as standing. it's a pretty simple idea. in order to bring case, you have to have a legitimate stake and a recognizable injury and the people who simply supported the law and went to court didn't have that. they vacated the lower court's ruling. >> we'll continue this analysis.

major day in washington. huge wins for those who support same-sex marriage. supporters are applauding these decisions. some of them started singing god bless america after the decision was announced. ♪ land that i love ♪ stand beside her and guide her ♪ >> our correspondents are getting reaction from locations around the country. it's over at the stone wall in in new york city. what's the reaction in new york where you are right now? >> reporter: people are thrilled. i'm standing in front of the birthplace of the modern gay rights movement. gay people, gay men and women and drag queens fought off

police officers. all day people have been gathering here, activists, people who live here and on vacation coming down here. they've been just showing up here. they are saying this is huge not only for gay people but for civil rights. why are you here? >> we're so excited. we're school teachers. we got very lucky. >> are you married? >> i am married. >> you're a schoolteacher as well? >> i am. >> are you open to your

students? >> i teach elementary school. it's a lot different. it's an amazing day. i'm a volunteer with hrc. this is something we've been working on so long. really excited for this day. >> let's talk to some of the other people here. inside folks are here. they are drinking. there was more here when the decision came down. it's getting later so decision is tastarting to trickle in. >> i had to come to stone wall to meet my friends. this is where i came. figured i'd have to come to a historical place to celebrate. >> i would assume you're gay. >> i am. >> what does this mean to you? >> i'm proud to be part of a

country that's striving for equality. >> thank you. continue to drink up. why are you guys here? >> i'm here to celebrate. >> when the decision came down what did you think? were you nervous? >> i started balling in public in front of everyone. no one got why either. it's so huge. >> thank you. wolf, this is happening probably in lots of bars around the country but here the birthplace of the modern gay rights movement it's extra special because this is where it all started. >> don, we're going to get back to you. lots of happy people over there where you are right now. i got a lot of e-mails from supporters of gay marriage. when they heard that news that doma was overturned by the u.s. supreme court so many of them started to cry. let's go to sdan simon.

give us a sense of how folks are reacting? >> this is one of the capitals of same-sex marriage. city hall here in san francisco, people very enthusiastic by this decision. some were a little upset that the court didn't apply same-sex marriage to all 50 states. people are excited and what a road it's been for same-sex marriage supporters here in california. back in 2008 you had marriages take place and they were halted. now that the supreme court said yes people very excited. here is what some people are saying. >> i'm thrilled. it's kind of what they said and what we expected. you never feel it until it happens. we're happy we got up early to be with the representatives in city hall. >> we've been waiting. we got married in massachusetts to have it recognized federally. i think that's where it hits the

roads with taxes and benefits and we're happy. we're happy. >> i think we got what we could have gotten. it's great. now we're able to go state by state and get equality everywhere. >> the question now becomes when will same-sex marriage resume in california? the thinking is it will happen sometime in the next 30 days. just the way public opinion has changed when this passed back in 2008 it was passed by a narrow majori majority. if you were going the take a vote it would go down, 60% according to the los angeles times. you can really get a sense of terms of how much public opinion has shift in the last four to five years. >> it certainly has. dan simon thanks very much. coming up, supporters of same-sex marriage have a lot to cheer about.

nothing at all. there are a number of things he could have been charged with. we're waiting to hear what that is. he's still at the police department in the town where he lives which is about a five to ten minute drive away from the town where the district courthouse is and that's where i'm reporting to you from. just a few minutes ago his lawyer arrived at the courthouse and they usually do have arra n arraignments at 2:00 in the afternoon. he could be here in advance of that. we did see one of his lawyers over at the police department with him earlier. it's believed that he's currently being processed at this time over there. his lawyer may also very likely would have met with him and we'll find out what will happen next. at his first appearance what is the charge and then is it a

bondable defense? shotgun where he might be able to post bail and be free pending the trial. wolf. >> what are the patriots saying about all of this? >> reporter: well, they issued a statement and i can read it to you in part. it says a young man was murdered last week and we extend our sympathies to the family and friends who mourn his loss. it goes onto say words cannot express the disaappointment we feel knowing one of our players was arrested as a result of this investigation. these two men were friends. the body of the victim in this case was found less than a mile from hernandez's home. hernandez's home was searched twice by authorities and during the second time they took away several bags of undisclosed items. it's entirely possible according to legal experts that the district attorney's office who is in charge of this case has been busy carryfully analyzing

they have and thought the time was right to make the arrest. they showed up just before 9:00 in the morning. he was handcuffed and let out. he was wearing t-shirts and shorts and taken directly to the police department. a stunning turn of events. >> didn't the patriots say he had been fired? >> reporter: they did. they also said he had been let go at this time. we also got a very short statement from the nfl saying they found the whole matter troubling in their words. >> very troubling. you'll let us know what he the charge is or charges when they come out. thanks very much. coming up, the nsa leaker edward snowden still holed up in a moscow airport. russia isn't stopping him from leaving. ...is the crackle of the campfire. it can be a million years old... cool. ...or a few weeks young. ♪

we know where he is. the question is where will edward snowden go next in he's at the airport in moscow. he flew there from hong kong on sunday. russian officials say he's in the transit area of the airport

between the arrival gates and passport check point. ecuador is considering his asylum request. for the time he's biding his time at that airport in russia. what's the latest on snowden's travel plans if we know what's going on. is he likely to stay in russia, leave any time soon? what are we hearing? >> it's an inbetween. i know that can sound confusing but it doesn't look like he's going to be staying inside russia and it doesn't look like he's going to be leaving that transit area any time soon. officials are giving an indication from the u.s. side they believe that russia looks at edward snowden as a problem. somewhat of a hot potato and they are not inclined to help him on his journey. the russian authorities and the russian government has been very frank about not handing him over

to the united states but right now he looks to be a man who is stuck. one source told our foreign affairs that basically time is on the u.s. side. they think at this point that russia looks at him as a hot potato and not inclined to get him to a country that would necessarily protect him. in other words, if he has to go to a country that would hand him over to the u.s. then that's something the russians might not at this point object to. >> what about ecuador. it looks like the government might object. >> they say they are under no indications right now they would

move any faster with edward snowden. he appears to be stuck. one source said the u.s. is not going very hard on the ecuadorian government. they are holding off on the threats until they are sure that the government is going to offer him asylum. right now ecuador is weighing all of its options. they are looking at the potential risks. parament on that is a trade product. they would be in direct jeopardy if ecuador were likely to give him asylum. >> have you heard anything about iceland maybe being in the mix? >> all of those are in play but again right now russia has said he's in the transit area of the airport which technically is not

we'll talk to him shortly. let's get the other perspective. a lot of people will be affected by the two rulings from the supreme court today. the justices struck down a key part of what's called the defense of marriage act. they also cleared the way as i said for those same-sex marriages to resume in california. joining us now from new york is the reverend paul and his partner of 27 years and their 7-year-old daughter. thank you for joining us. what's your reaction to today's two rulings at the supreme court? >> well, a lot of joy. we're just overwhelmed. we're so excited about being able to take this next step with your family. it's interesting to me because in 1986 when the supreme court actually went in the total opposite direction i was

downtown, we were blocking traffic and protesting that decision and now 27 years later i met joe just a few months after that protest, we're here with our daughter and our love and we're going to get married. >> yeah. >> congratulations. >> thank you. >> joe, tell us what this means to you. >> incredibly exciting day. paul has been the love of my life for 26 years and we've always felt married in our hearts with the exception of benefits and protections. now we've got it all and we can move our lives forward. i think there's permission to be more ourselves, share more of who we are, of our relationship. so thrilling. >> you're a presbyterian pastor. you've waited. you've waited until now to get married.

why the wait? >> well, first we waited until it was legal. we were living in new york a year and a half ago. i was just about to be called to this church in california. the presbyterians and new yorkers were figuring out the gay issue simultaneously. the church cleared the way for the ord nation of partnered people. we had to have the conversation do we try to get married quickly before we move to california. we didn't want to do that because we waited this time. we waited for it to be possible and so we wanted to give it its proper respect and due. we thought if i don't get this call and we stay in new york, we'll get married in new york. if i do get this call, we'll move to california and we'll

wait and pray and know that this will become law in california and then we'll be able to get married there. >> i'm sure it will be a lovely ceremony. joe, your daughter is there. she's got two dads. tell us what it's like for ellie to have two fathers. >> ellie. i think for her it feels like the air that she breathes. it's what she knows and were part of very loving, welcoming communities that accept us and our whole family. i think for young people it's not anything that they have to navigate in any particular way. certainly not where we have set up our lives. she said to a friend a few months ago, they said you don't have a mom. you have two dads. she said i have two dads. i have a birth mother. don't you get it.

>> she's obviously pretty smart little girl over there. both of you should be very proud of her. congratulations on your upcoming -- is there date already? >> no. >> we've got a lot of questions about when we're doing this. takes a while to plan a wedding. >> we're like everybody else and get to have all that stress and those discussions and about arguments about when and where. >> i assume you have a little flower girl. >> she's been waiting for that for years now. >> thank you for joining us and your daughter. thanks to you ellie if you can hear me. >> i can hear you. >> appreciate you joining us. let's bring in austin. he was the co-counsel on the california proposition 8 case. you lost effectively in that

case. tell us what your reaction is when you heard that decision. >> i completely disagree with your characterization. our objection was to defend proposition 8 and it's the law of land in the state of california. the supreme court said we didn't have standing to defend proposition 8. prop 8 is the law of california and remains so as of right now. >> won't be people of the same sex be able to get married starting maybe within a month in california. >> it makes it clear that marriage is only one man and one woman. the four plaintiffs ta brought this lawsuit have a right to get licenses issued to them. it does not apply statewide. proposition 8 is the law in california. because there's no decision holding it unconstitutional, under the corral corral constitution which controls this

interpretation it remains the law of that state. >> i must tell you your interpretation of what this decision was as far as proposition 8 is concerned, the practical implication of the decision is different from all the legal so scholars that we have been hearing from that saying gay marriage will go into effect in california perhaps as early as a month from now. what i hear you saying is gay couples could not be allowed to get married in california. is that what you're saying? >> what's clear here and we need to be very clear here. there's no appellate court decision that holds proposition 8 unconstitutional and that's very important because a single federal judge cannot clear a state initiative in california unconstitutional statewide. there were only four people that brought this lawsuit. they are the only four people to whom it applies because it's not a class action. unless there's appellate court ruling, california law professors can tell you this

striking down an initiative, it rem remains the law of the state. the supreme court did not strike down proposition 8. they said we don't have standing to defend it. there's no appellate court decision. >> what will you do if folks get married in california a month from now? >> what we fully expect is government of california will honor the law of california. those voices deserve respect. their voices are still standing. it's the law and the constitution of the state of california. we don't just ignore constitutions because we don't like the way they read. the law of california is clear. because the supreme court didn't impose same-sex marriage, californians have the right to decide marriage like the steps of the other states.

>> the lawyer on the other side, he opposed you. he was smiling and cheering. they were delighted by what happened at the supreme court as far as proposition 8 is concerned. what do you say to david? >> i say that we've been disagreeing with him since the day the lawsuit was filed. we've had very different takes on this lawsuit, the nature of proposition 8, the arguments associated so nothing has really changed in the fact that we disagree on what should or shouldn't happen. the law in california is clear. there's no decision striking down proposition 8 so it remains the law of california. that's been established law for a very long time. it hasn't changed and the supreme court didn't try to change that. >> there will be legal experts that disagree with you but that's the nature of this decision by the supreme court. we'll continue to follow it. we'll see what happens on practically speaking if gay cups will be allowed to get married

just heard from austin, one of the lawyers who was opposing any rejection of that proposition 8 in california. the governor of california issued a lengthy statement. he said after years of struggle, the u.s. supreme court has made same-sex marriage a reality in california. the state's counties must begin issuing marriage licenses to

same-sex couples in california as soon as the nineth circuit confirms it's lifted. that coming in from governor jerry brown. let's get with chris kluwe. he's become an advocate for same-sex marriage through social media. give us your reaction. >> i'm happy to hear it because it means same-sex marriage partners can benefit under the laws they weren't previously allowed to benefit other. those are american citizens who pay their taxes and serve in the military. if you discriminate against them it brings us down as a nation. >> what's your understanding? we have a debate on what this means for same-sex marriage in california. >> i think your previous guest kind of had a last ditch gasp of

trying to make things appear better than they are. i think the legal grounds are people will be able to get married in california pretty soon. the problem is that on proposition 8 it doesn't only apply to california. the supreme court didn't make a sweeping ruling. there's plenty other states where we'll have to fight to get the right so they're still working to get down there. >> we did some math. this decision by the supreme court today given that if same-sex marriage does go into effect we now say that 30% of the u.s. population in california being the largest state, 30% of the u.s. population will be eligible for same-sex laws that have been applied across the country. the 30% includes california. there's 13 states that will allow same-sex marriage but there's a whole bunch of others

that won't allow it. you're thrilled by what happened today but from your perspective a lot of work that needs to be done? >> right. it's not just same-sex marriage. also the issue of 29 states you can be fired from your job because of your sexuality. that's something that needs to be addressed as well. with the way our economy is that's a very troubling thing to worry about. the mere fact of who you are you can get fired. >> what's been the reaction that you're seeing as far as your online postings are concerned? >> people have been excited. they have been very happy. they realize this is a landmark moment that california is recognizing their benefit under law. it's sad it's taken this long. we'll take it.

as you know the 29-year-old claims he killed 17-year-old trayvon martin in self-defense. jurors have been hearing compelling testimony today from neighbors who saw part of the altercation between zimmerman and martin. listen here as one of the witnesses describes what she heard and saw. >> the yells for help that you heard at that time, could you identify whether it was the dominant, louder voice or the higher pitched one? >> in my opinion, i truly believe, especially the second yell for help that was like a -- you know, a yelp, it was excruciating, i really felt it was the boy's voice. >> one is on top of the other. the one on top is moving his hand. >> you're describing something with the hands. you're demonstrating to the jury, i should say, moving something with his hands. can you tell exactly what the person was doing on top with his hands? >> like he's hitting him. >> what is your opinion as to who was on top? >> i really think it was

two major decisions today by the united states supreme court. one overturning the defense of marriage act which president bill clinton signed back in the 1990s that prevented the same-sex couples from receiving federal benefits. also proposition 8 in california. apparently overturned for all practical purposes. the governor of california, jerry brown, just issuing a statement saying that he expects guy marriage to resume in
