. >> and a good friday morning to you. there is no shortage of action in the courtroom featuring florida versus george zimmerman. what you are watching right now is the prosecutor in this case. he has stood up for a second time this morning to examine the witness who is on the stand. this is what you call an eyewitness, folks. there have been several who have taken that stand in this case so far. this one gives an account that perhaps this prosecutor would prefer not to showcase. but you take your witnesses the ways you get them. that's how it operates. this is the kind of witness this prosecutor has to try the best he can to make sounds like he could be a prosecution witness instead of the defense witness. so far, not much luck. this is redirect.

your way. yesterday, that young woman named rachel emwas saying things like, i didn't say what are you saying because no one asked me. today this prosecutor is making this witness sound exactly the same. >> on cross examination, you said you had gone upstairs and i think you stated you looked out and you saw what you now know as the victim trayvon martin laying on the ground, is that correct? >> correct. >> at some point you saw the person you now know is the defendant, mr. zimmerman, standing up, correct? >> correct. >> then you saw one or two guys with flashlights? >> correct. >> do you remember that? >> yes. >> i will show you exhibit 677, states exhibit 677. do you recall win looked out, mr. martin looking like that? >> no, it was opposite view. so i would be looking the opposite way, yes, the body did look like that. >> the body looked in this position? >> i was stavengd over there looking that way, yes. >> my point is the body was face

the man is jonathan good. he has accounts he has been hearing from other witnesses. he's a prosecution witness, but his story doesn't necessarily follow the prosecutor's narrative. i want to bring you danny cevalos and mark kneejay, danny, let me begin with you, i did not expect to hear out of the prosecutor's witness, what i have been hearing. the prosecutor is doing a great job of making sure it's not all a lost case. how has he done it? >> what he's doing the trying to brik bring it back kin with the their theory of the case. overall, it's a great witness. he answers well, he answers professional. he is a good witness. which uconn for points they made aboutit unravels little by little the prosecution's case. >> to remind you, when a judge calls the sidebar the mix i mics go dead t. rest of the courtroom, including the gallery and probably george zimmerman. he won't be able to hear what's going on t. witness can hear it. to keep things fairly quiet. i want to do something unorthodoxed here. i will ask my man, michael, rather, if you could play f-4 for me, a piece of type that happened earlier. it is the crux of what this witness is talking about t. tussle and who was on top and who was on bottom. have a listen. >> it looked like a tussle. i could really only see one person. i think i described as possible

top, what could you see? >> it was dark. >> how about the color of clothing at the bottom? >> i believe it was a light white or red color. >> all right. so there's why this particular witness, while they're still on sidebar, are you not missing court action becomes very significant for the defense. i think we might have a picture handy of a piece of evidence entered into this try. it's what george vermillion was wearing. take a look on the banner, you can see the jacket, a full shot of what george zimmerman was wearing, this is a shot the night he was brought in. i believe this is the night he was brought in. i believe this was the night they photographed all of his clothing from the top right down to the boots. and the description that this witness has said is the person on the bottom is somebody who is wearing something with likely red on it. sidebar, mark kneejay, after the sidebar, i will ask you about

>> correct. >> all of those statements included some facts that were added to one or just not added to the other, correct because of the way the questions were being asked? >> i don't know about facts, but they needed more clarification. >> sure. then, of course, we took your deposition. i think that was 50 pages or so correct? >> correct. >> again, we asked you questions, you just answered the questions as best you can. >> correct. >> mr. de a rionda wanted to make sure the jury understands just the fact that you have statement one, statement two, statement three, statement four that, are not all exactly the same, you weren't lying, were you? >> no. >> okay. >> you were just answering the questions that were being asked, right? >> correct. some had more than the other ones, yes. >> as best you could remember that vent back then, correct? >> correct. >> and you even said that if adrenaline was flowing, wasn't it? >> yes.

punches, it looked like punches. >> i'm sorry. >> back to clarifying, yes. >> the guy with the red was always on the bottom? >> correct. >> that never changed. >> that never changed. >> and the just to clarify, what was actually talked about with chris serino, investigator serino, what we will call the ground and pound investigation, what i want to do is put it in context for you and ask you if this is what you said to chris serino, okay? yeah, i pretty much heard someone yelling outside, i wasn't sure it was a fight or something going wrong, so i opened my blinds, i see kind of like a person out there. i didn't foe if it was a dog attack or something. so i opened my door, a, a, there was a black man with a block hoodie on top of a white guy,

now i find out it was a hispanic guy with a red sweat shshirt on the ground yelling out "help." then i tried to tell them, you know, get out of here, you know, stop, or wheefr, then, a, one guy on top in the black hoodie was pretty much just throwing down blows on the guy kind of mma-style. was that the context in which that happened? >> yes. >> and then investigator serino said a word that i have transcripts may differ, ground, couldn't figure it. maybe he said ground and pound. then you said, yeah, like a ground and pound on the concrete at this point. so at this point i told him i'm calling 911. >> objection. improper.

>> so, zimmerman on trial and there he is. he's been listening all morning long as an ear and eyewitness has given his account and let me just say this, it was nothing like yesterday or the day before. instead, the prosecution witness who has been talking today seems to back what mr. zimmerman told the police that day and has maintained this story all along. but that doesn't mean there wasn't good cross examination and then redirect examination, which seems like cross examination. very unusual. there is a small break in proceedings right now, which is a grit opportunity to go to cnn's george howl, who is covering this gavel to gavel. george, what a difference a day can make. i want you to sum advise, how it's changed. >> absolutely. so we started today with a technician who monitors under surveillance cameras and we are specifically talking about these

cameras outside the clubhouse in that jabd. there are cameras working. ones outside were not. the ones inside captured some sort of movement outside the windows. i think we will at some point come back to that video. it was admitted as evidence. right now, it is unclear exactly what the significance of that is. we will hear more about it. on the stand we have seen lately is john good. this is a neighbor who lived in that neighborhood he says he stepped outside, saw two people first vertical then horizontal on the ground. his testimony is important because he believes he saw a person with the red jacket of lighter complexion on the bottom, which would suggest that trayvon martin was on the top. this is in direct contra decision of what selma moore said the other day. she held firm that it was george zimmerman who was on top. i want you to listen to a bit of what he said in court. john good, take a listen.

bottom, suggesting that trayvon martin was on the top, holding him down, as he said, throwing strike, throwing blows. that's what he said in the statement before, today he is saying he cannot say with certainty if the person on the top was throwing strikes or just holding that person down. so that's what you see the prosecution doing, ashley, just a minute ago, they were certain to make sure that was stated on the record. the prosecution came out, de a rionda said did you see or hear any of this. mr. good said, no, i can't say with certainty. >> let me use more colorful language. in the words of john good, george, during his deposition that was taken, he said, i saw a black guy in a black hoodie on a white guy who i now assume to be a hispanic guy throwing down punches mma-style, that's mixed martial arts for those out there who may not know what mma is. such a significant moment in

this case. hold that, i want to play one more piece from john good, critical testimony. eye and ear witness, just like yesterday, rachel jeantel an ear witness at that very moment. what is significant about this is who he thinks was on top. have a listen. >> all right. if you could, could you tell at that time in terms of describing who was on top and who was on the bottom? >> i could only see colors of clothing. >> the color of clothing on top, what could you see? >> it was dark. >> okay. how about the color of clothing at the bottom? >> i believe it was a light, white or red color. >> to mark knee jay, cnn analyst, well known trial attorney in the florida yeah, now all around the country because of all the coverage you have been doing on the case and other high profile case, a big moment. that's the moment where people wondered, why did the prosecution call this man? >> i think it was a simard move,

ashleigh, because a smart move, ashleigh, if the state didn't call this witness, the jury will. he wants credibility and he wants to do his best to take the wind out of the sail of the defense. the last reason he would have called is you rempgsed it earlier. he was able loop back a little bit and show, try to give janelle a little bit of credibility showing she wasn't asked all the questions as mr. good wasn't asked all the questions and, hence, didn't give all the answers. i think it was a good strategy, however, with all that a said, in my opinion, it was the state that got grounded and pounded through this statement today from mr. good. this is entirely consistent with what the defense has been saying all along through their press conferences and by showing the bloody pictures of george zimmerman, that, in fact, it was zimmerman on the ground, he was being beat, his head was bashed

in by mr. martin. we have to see who else says what. this play noose exactly what the defense has been saying. as i have been saying for the last year, whoever can be proven to be on the bottom crying for help, they were, in fact the other person was going to be deemed to be the perpetrator the dominant in force that, is the benefit of those on the ground screaming for help. >> if i were going up against you in court, i seen plenty of fights that go like this, bang, bang, bang, knockout punch, so it's probably not surprising we are hearing neighbors living just doors from each other giving completely differing accounts of what they hot they saw in the shadowy figures, significantly, we will talk about this after the break. it was knockout punch that perhaps the prosecutor made when he said, could you see their mouths moving when you said you thought it was george zimmerman calling out for help. he answered, no, so there has been a lot of stuff been done today that was done yesterday to two varying accounts, everybody hold your place for a moment, if

think one side is winning. the next minute, you wait for the answer. the camera goes when the judge says we are didn't for a moment. that's where we are. we are done for a moment. we are watching it the minute it is active. it's a great opportunity to tell you the other big stories that are happening. in fact, police were back searching that home of the fired new england put as aaron hernandez this morning. it does not get worse for this young man. they only left a few hours ago. all of this as authorities are now looking into the possibility that he may, in fact, be linked to an unsolved double murder last year. remember, he is in jail charged with the murder of a friend. we are talking of a whole other set of murders now. again, they're just investigating that at this point. elena cho is outside the home, i thought it was a stereotypo, i thought, that can't be right. they must have this confused

with another case. they do not have this confused with another case. >> no. you are absolutely right, ashleigh. it is an entirely separate case we are talking about. there has been no shortage of developments over the past 24 hours. i should tell you. in fact, we are in front of aaron hernandez' home right now. police as you mentioned were here in the overnight hours. they entered the house at around 4:00 in the morning, left at 5:30. it didn't appear they took anything. we believe they took a lot of photos inside, they are investigating and looking for clues in that still unsolved double murder that happened in boston last year. as you mentioned, aaron hernandez is now being investigated in connection with that double murder. important to the point out, that this is an entirely different case of than the one that we're talking about that we have been talking about over the past couple of weeks. he is already charged with first-degree murder in the death of 27-year-old odin lloyd.

what is very interesting, ashleigh, this morning the boston globe reporting that odin lloyd may have known about hernandez' connection to these double murders and perhaps that speaks to a motive. ash leak. >> wow. then there is also somebody else that they put out an apb on. do we know much about that in. >> reporter: that's right. now, remember, if you go back to this most recent case involving the killing of odin lloyd, authorities and prosecutors believe hernandez was with two other people inside the car when lloyd was killed. let me tell you that late last night authorities put out a bulletin. they are looking for a man named ernest wallace, who is being called an accessory after the fact in the killing. he is believed to be in his 40s, heavy build, last seen driving a silver chrysler 300.

we just got word that authorities have actually recovered that car but not earnest wallace. i should mention, ashleigh that, wallace is being called armed and dangerous and, in yet another development, a third man, a man by the name of car loss ortiz was in court today in connecticut. he is also being investigated in connection with the murder of odin lloyd. not sure what that connection is yet. we do know this. he has been charged with a single weapons violation and interestingly enough, ash leak, for that single weapons violation, he is being held on $1.5 million bail, which says to a lot of people that this the a very, very important person to police. >> yeah. you don't often see bail that high for a mere weapons violation, but as is often the case, too, you try to squeeze information anyway you can. and we can also see other charges be added later on, too.

let me start with you. he goes into what the kids were like with tear dad and all the rest. that was a long time ago. those pictures were from a long time ago as well. i'm not so swhur it has to do with who is responsible for the death of michael jackson or is this more about getting sympathy for the family? >> no, what it is, they are trying to kind of draw out what is called emotional damages, this is a wrongful death claim. it's a civil charge. so, obviously, one of the ways in which they are saying the family was damaged that, is catherine jackson and the three children who are the plaintiffs here is emotional t. only way to do that is to show what was the emotional connection between the children and michael and how have their lives been different or altered or impacted since he died and so i think t.j.'s testimony today does that and what he does is he lets the jury understand what the family was like, what the children were like when they were with michael and when they weren't with

michael and how their lives have changed significantly since he died. >> and danny, maybe you with weigh in on the issue that t.j. testified, it was sort of unusual testimony. i'm going to lay it out for you. he suggested that michael jackson had told him that he thought he was going to be murdered. and he actually said it happened on a couple of occasions. once again, it seems hyperbollic. it seems dramatic. is it germane to the actual case at hand? >> good point stepping back, you look at the plaintiff's burden. you look at aeg directed the doctor. this is not a particular delays you and i might be familiar with. the paragraph is trying to sew that aeg directed the doctor to do this. we know the death wasn't intentional. i wasn't charged as an intentional killing. nobody is saying aeg tried to kill michael jackson.

it is true that michael jackson's subjective belief that people were trying to kill him isn't germane or probative of the plaintiff's burden. it certainly is compelling. it certainly will affect. and pull at the heart strings of the jurors. >> yeah, well, it's fascinating to watch. i'll give you that. i keep wondering, what does this have to do with the ultimate question, who employed and paid the doctor? thank you, hold that thought for one moment. we have been sort of hop scotching from the country. from california to florida t. live look inside the zimmerman courtroom. trained right on the great seal of the state of florida. yes, it's the great seal, not the seal of the great state. great seal of the state of florida. i have always wondered what it is, every state has it. it's on that shot. because there is a break in the courtroom. are you not missing any any of the testimony. are you going to see some of the most critical testimony coming up in just a moment.

trayvon martin seen here in these photos because this is all we have left of trayvon martin. a 17-year-old young man who was getting skittles and a drink one night in a rainy, dark complex, apartment complex when he came into contact with george zimmerman. only one person survivored that encounter. now there's a second-degree murder trial in how that encounter ended up in the death of that young man. all of those neighbors who started to hear the fight begin or hear it mid way through and hear the shot fired and perhaps see who was where. many of them have differing accounts. some of the accounts who looked like trayvon on the bottom and some have the account of it was george on the bottom. have a listen to this witness who just got off the stand named john good, a neighbor who saw and heard a lot.

>> in regard to the person who said help, if you can, was it help, help, help, continuous or how would you describe it? >> i believe it was one or two. >> after that what happened? >> that's when they moved up on the sidewalk. >> at that point what's happened? >> that's when i saw them in the straddle position. i saw it getting serious and said i was calling 911. >> critical to this witness. the person on the bottom was the one who was screaming. here is what he wasn't able to do. he wasn't able to see their mouths moving. that's something this prosecution hammered home in redirect. i want to bring in our attorneys. you're both defense attorneys. i'm sure the thing if you would at defense table you would have cringed to see play out in

court. >> this prosecutor is skilled. what he is supposed to do is poke holes in what this witness is saying because what he is saying is not helpful to the state's case. >> i'm going to argue to you. that's the defense's job. the whole thing flip-flopped. >> he did a good job. he didn't try to berate him like another attorney did yesterday. all he did was focus on the facts and point out what he did or did not see. if you can't see the lips moving or the mouth moving how can you be sure it's george zimmerman. i think he did a good job of extracting that information. >> danny, jump in here. he was able to keep or the defense attorney mark o'mara, it's a bit backwards, he was able to keep this witness on track with the same person was the person yelling all throughout the fight i saw and the guy on the bottom. at least he was able to say it was consistent.

>> absolutely. there's some good points for both. both toerps aattorneys are doin terrific jobs. remember, the defense needs to come forward with just the barest evidence of self-defense to merit a jury instruction on self-defense. what we've heard so far, have you heard the barest of evidence of self-defense. it seems to many probably so. that raises the question, think about george zimmerman even have to testify. they probably already earned that instruction on self-defense. >> yeah. you know what i keep waiting for, will george zimmerman mount case. i know that's weird to say that. sometimes we get surprised. if that defense team doesn't feel like the prosecutor's have met their burden, sometimes it's better not to say anything at all. i want to thank you for your time and analysis today. we look forward to having you both back. also want to let people know
