i'm pamela brown in for ashleigh banfield. it looks like it might be the royal baby's birthday today, july 22. the duchess of cambridge went into labor earlier this morning. we are waiting for word as to whether it is a prince or a princess. max, i can imagine it is quite a circus out there. it has been more than ten mourz since she arrived at the hospital. set the scene for us. what is it like? >> that is really the forefront of everyone's mind. she is pretty much into this process of labor. of course it is different for everyone. if we have an announcement today the only sign we will have is someone coming out of that. palace official will recognize them and will have a piece of paperer sent to buckingham palace. we know the queen is in resident

at the buckingham palace. she is there ready to see this notice delivered where the world will hear about it. certainly there is a big crowd with the public really gathering. the media literally from all over the world. we have all the german, french, polish networks are all here. this isn't a purely american story or british story. >> absolutely. it is still a waiting game as you mentioned. how long do we think it will take between finding out the birth of the baby and when the public will find out? how long for the public to find out more? >> reporter: well, i have seen a few of the senior palace officials. what will happen is once they have the baby we are making an educated guess here. we think william will bring charles and the queen. and then a list of people will

be notified before the public is told including the prime minister, all of the commonwealth realms. there are 16 countries in total. they all have to be notifie. only after that will the notice leave the hospital for the formal public announcement. >> do we know who is by her bed side right now? >> reporter: just william. he is the only member of the family there apart from the quite substantial medical team. this is a royal baby so there are royal surgeons in there as well as consulconsultants from hospital and mid wives. >> later we will go back to london for much more on the royal arrival. in other news this morning flash floods swept through parts of arizona monsoon rains pound the state and some areas cars were nearly swallowed whole by

floods. stephanie elam has more. >> reporter: raging monsoon waters flooded parts of the phoenix area on sunday leading firefighters to a series of dramatic rescues caught on camera. at least half a dozen people brought to safety. >> this is pretty bad. i think the worst i have seen so far. >> reporter: emergency crews braved the waters one rescue after another after another. watch as emergency crews rush to the aid of these two 19-year-old boys who crawled out of their submerged suv to a small patch of land nearby. >> natural instinct is get out of the vehicle. >> a helicopter hovers above lowering a harness lifting one of the teenagers to safety. the second snaps pictures of the scene, even appearing to take a

self portrait mid rescue. firefighters lowering a ladder to rescue this couple stuck in a pickup truck before following a safety line to land. just west in scottsdale a firefighter carries this woman to dry land as the water consums her car. a similar fate for this corvette. the driver rescued. >> he got out of the vehicle and was sitting on top of it. the water was so high but you couldn't see the vehicle at all. >> and stephanie is live there in arizona. chad myers in the cnn weather center. as we saw in your story there was very scary rescues. did everyone make it out okay? >> reporter: unbelievable when you look at some of that video. everyone made it out. no injuries reported. at this point everyone is in cleanup mode. you can take a look behind me

there is a big bull dozer pushing the mud around trying to get the streets cleared because it is a particularly dicy bit of land here. we are told this fence was actually locked. it was locked and closed and then the mud and the rain, all of that water came pushing through and broke the gate open and leading to a lot of the mud here. people being cautious but still a lot of mud to clean up. it is starting to get hot in here. it is supposed to be 99 degrees here today. more rain expected later. >> that's not good news. thank you so much. we appreciate it. now we check in with chad myers in the cnn weather center. is this one of the instant flooding, is that unusual? >> it happens all the time. it happens every summer. there are even places where these roadways, these streams and creeks are dry 363 days a year but then one storm sits on top of a mountain or on top of a

high ground and it washes into the stream beds and many places and in texas, too. there is only a bridge over it. you just drive down and back up the other side. because there is no point of building a bridge for two days. people are supposed to know not to go in the water when it is up. it came up yesterday in a lot of places. almost the entire state of arizona picked up rain yesterday. here is radar now. nothing showing up on it. i suspect rain today vegas back towards flagstaff and into the hills to the west of hollywood. there could be rainfall even in the hollywood hills area. it is monsoon season. this is the area that brings up gulf moisture across texas. these showers pop up and come and go and make dust storms. there have been a few storms. you have a big, they are called

haboobs. palm springs to the east of you, as well. high pressure over denver and low pressure to the west. this is where the rain will develop. a desert for most of the year but not all of the year. >> as we have seen. thanks so much, chad. a powerful earthquake rocked northwest china this morning. chinese media reported at least 89 people killed. it was a 5.9 magnitude quake. the area was also hit with several strong after shocks. david mckenzie has more from china. >> reporter: this powerful and shallow quake struck early monday morning followed by a series of after shocks that could have been quakes in their own rite. look at the security footage which shows the immediate effect of the quake. the tremors lasted for at least a minute causing people to rush out of their buildings for

safety. one of the poorest in china. one of the worst affected areas appears to be where many of the dead were found. tire buildings were destroyed and homes heavily damaged. it was the elderly and the very young who were affected the worst because they couldn't run from the debris as it fell in time. the chinese government and the red cross have mobilized hundreds of rescue and relief workers to the area to try to assist and find any of the missing. this area has seen torrential rain in recent days and more rain is forecast which could make rescue efforts and relief efforts that much more difficult. >> thank you so much david. take a look here is more scenes of the quake's destruction. you can see the damage in a grocery store. take a look at this, liquor bottles flying off store

shelves. checking other stories we are following. flames shot up 30 feet in the air after a natural gas fire caught on fire in a virginia neighborhood. firefighters evacuated nearby homes and sprayed them with water to keep the flames away. officials say the fire was probably caused by a lightning strike. a california mother is headed to court today on child cruelty charges after allegedly chaining up her 10-year-old son. he was found in the apartment complex court yard. the boy and his two siblings were taken by social services. the u.s. coast guard had had to shoot up the engine of a high speed boat. police seized $35 million worth of south american cocaine. a coast guard helicopter had to chase down and shoot out the boat's engine. police arrested four people. and new information this morning about the decomposed

at this hour cleveland police are working a gruesome murder case. a suspect is under arrest but there are fears there may be more victims. >> reporter: police and cadaver dogs scour an area in east cleveland, ohio where three bodies were found all wrapped in layers of plastic and taped up. neighbors are in disbelief. >> just very, very upset. >> reporter: mounting evidence that there could be more women, more bodies, more tragedy. >> i hope and pray that we do not find more bodies. however, we are dealing with a sick individual and we have reason to believe that there might be more victims. >> reporter: knew the foul stinch wasn't just a blocked up sewer. >> i couldn't put up with the smell. i didn't know if i wanted to throw up. it was that bad. it was a smell no one want to

smell. >> reporter: customers at his cable business had complained. he opened the door to search for a dead animal there were indications of something far more sinister. >>t that was my fear because the smell was that bad. i know an animal don't last that long when it is rotten. >> reporter: police were called to the scene. a young woman's body wrapped in plastic garbage bags. another body in an open field, the third in the basement of a building. police arrested 35-year-old michael madison, a registered sex offender and owner of the garage. the father of two is well known in the community. >> it is scary. it's heartbreaking to know someone that you think is close to you or your friend can turn out to do something like this. >> reporter: madison told police he was inspired by a serial killer who was convicted in 2011 of killing 11 women in cleveland

and is now on death row. the case was known as the house of horrors. >> joining us from cleveland. nice to have you with us. tell us what makes police think they might find more bodies related to this case? >> reporter: as you heard in that piece this is a man who is considered a serial killer in cleveland one of his idols. police received information from michael madison that perhaps suggests that there could be more bodies in east cleveland. the search for bodies will resume tomorrow. that is what we are hearing from authorities. just to give you an idea, one of the bodies was found in the basement of the abandoned house behind me. they have searched this area thoroughly. they will be moving to other areas. as far as information there is a

press conference that is about to be starting any moment now. we have crews that will be monitoring that coming in live. so we believe that police will be filing charges against michael madison who will be making a court appearance. we believe there will be a medical examiner at this press conference. that indicates that perhaps the identities of some of the victims might be revealed. some of the families of missing girls in this area, a number have gone missing in recent weeks and months handing out flyers looking for loved ones and eagerly awaiting to find out if the ones they love and who have been missing for quite a while are among the dead. >> you mentioned the number of missing women there in the area. according to the northeast ohio missing persons database, 27 missing persons reports filed in that area. do you know if there is anything linking these victims?

do we know anything more about the victims? >> reporter: unfortunately, we don't know anything about the victps. police have remained very quiet in relation to that. as i say, some of the family member s approached us yesterda. they handed out the flyers. a girl disappeared she is 18 years old. and they obviously have been waiting from authorities. we understand that the bodies of these victims were very badly wrapped in plastic. so the composition of these bodies not so good. it is going to take a while for the coroner to work out the identities of these victims. but certainly the fact that a medical examiner will be appearing at alt press conference certainly indicates

a week after a jury found george zimmerman not guilty of murdering trayvon martin protesters took to the streets across the country over the weekend. the demonstrations saturday came the day after president obama urged americans to try to understand the killing of trayvon martin case from the view point of african-americans. here is white house correspondent. >> reporter: in houston late sunday some tense moments as trayvon martin supporters marched close by a group supporting george zimmerman and stand your ground laws. earlier emotional rallies in some 100 cities echoing

going to an amusement park is supposed to be fun and safe. that was not the case at six flags over texas. a woman fell to her death. the question is were the victim safety concerns ignored? >> the texas giant starts with a spine tingling drop. this is where witnesses say they saw rosy, sparsa fall. karman was next in line to get on the ride. >> she goes up like this. when it drops to come down that is when it released and she tumbles. >> reporter: some witnesses told local news media that she told employees she was worried that

the seat restraint had not connected safely. >> they were screaming when they came back and they were screaming my mom, my mom. >> six flags over texas hurricane harbor refuses to answer questions on camera but in a written statement says we are committed to determining the cause of this tragic accident. it would be a disservice to the family to speculate regarding what transpired. according to an analysis of amusement park injuries there were just over 1200 ride related injuries in 2011. industry observers say amusement parks are loosely regulated and that it is six flags that will be in charge of conducting the investigation, not an outside independent agency. >> whatever organization comes in, whom ever comes in their work is the property of six

flags. it will remain the property of six flags because there is nothing in texas or many other states that make them have to release that information. >> reporter: the texas giant wasn't the only weekend amusement park accident. in ohio seven people were injured when a boat on the shoot the rapids ride flipped over. joining me now is our legal team. thank you for being here with us. i want to start with you. if i understand this correctly there is oversight with inspections at these amusement parks but not with investigations for accidents like this. so what is the next step here in this investigation? >> as of now six flags is conducting the internal investigation themselves and the german manufacturer of the roller coaster has sent people in to investigate the roller coaster to see if there was a defect in the roller coaster when the accident happened. they are concerned about

accountability and liability in this case in terms of someone bringing a civil lawsuit or negligence and perhaps product liability. >> in light of the fact that six flags will be conducting the own investigation into the accident, what is the level of six flags liability here? >> in a case like this you will have a virtual jubilee of liability. not only is six flags liable this is many levels, many layers of liability. six flags is the manufacturer. if the plaintiff can prove that they negligently designed it there may be additional liability. six flags itself, if there is a problem with the roller coaster may be liable for failing to maintain or supervise. when you have an accident on this scale with this much corporate involvement you have what we call many potential layers of liability.

the most important is the potential warning to an employee by the deceased that she felt insecure. that will probably institute legal notice to the amusement park that there was a problem. >> faith, one victim says that the victim told a ride operator that she did not feel secure in her seat. how much of an impact will that have in this case? >> it can have a huge impact because there is a requirement that these operators that someone investigate and look at the rides every single day, make sure they are secure before people get on. they are actually required to keep a log of the inspections. now you have a woman who got on the ride and before she fell to her death she expressed concern. she expressed concern about her own safety in this ride and the operator apparently let her go on the ride anyway. that could have a significant impact on the liability going

forward. >> last question for you. as heard in the story more than 1,000 injures in 2011 alone on some of these roller coaster rides. do you think there should be more oversight of the amusement parks in light of the injury and recent death at six flags? >> probably. one thing to motivate them to have the oversight will be lawsuits like this. it's probably the smaller traveling rides that may carry less insurance, may not be as supervised. but a corporation like six flags absolutely has a duty to inspect as faith was telling us and there is going to be -- if there is going to be oversight we are going to see it with an industry like six flags. however, if they are allowed to conduct their own internal investigations those will be discoverable in a earnpersonal injury action. >> we will see what happens.

do we know where the rest of the royal family is right now? >> reporter: the queen is in residence at buckingham palace. she swept through the gates about an hour ago now. flurry of activity, police cars coming down the red gravel mall. i would imagine she is just as eagerly awaiting the news as the rest of us sitting by the telephone and waiting for the call. the duchess has been in labor for just coming up to over ten hours. it is a long time. it is incredibly hot here. the staff at the hospital second to none will be doing their very best to make sure the duchess is comfortable. william will be by her side helping to remind her of the breathing exercises they learned together and reminding her to keep calm. it is a regular day for prince harry. he will be kept abreast of the news by his brother. cumilla is on an engagement. it is business as usual for the royal family. the person who will find out

the mother of michael jackson returns to the witness stand today. katherine jackson's testimony was cut short on friday after intense questioning. the lawsuit against aeg blames the company because it hired dr. conrad murray who was found guilty of involuntary manslaughter. part of the strategy is to personalize the family. mrs. jackson says she was hoping her grandchildren would see their dad in concert. take a listen.

he is also a father. and this family lost someone who is very close to them and they deserve for these people to be held accountable if they were responsible for hiring conrad murray. >> do you think the defense team risks back lash if they go too hard after mrs. jackson. >> no. this is cross examination. the reality is that mrs. jackson has probably made many statements that make her ripe for cross examination. when you take a big step back jackson's testimony is not critical to the case. they have to prove that aeg employed this doctor and that they did so in a negligent manner. jackson's testimony here is critical as faith says. however it is critical for humanizing michael jackson and showing the jury the loss that

having him die caused to his family. when you take a step back, however, it is not that critical to the overall case and chief except to humanize michael jackson and make his loss much more real. >> in terms of what danny just said i think you have to be careful when you are cross examining a mother of someone who has died. i think the defense attorneys are aware of that. this is a jury trial. when you come across it being too compattive and hitting below the belt with someone's mother i think that can back fire on you in the end. >> she got very emotional in court. talking about critical testimony we heard from dr. murray's lawyer that he is considering testifying. how much of an impact do you think the testimony will have on the case. >> he has a criminal appeal. he is involved in right now. he has asserted his fifth amendment right. i would be surprised if he waved

it's a homecoming of sorts for pope francis and his first international trip. the pope is going to south america. no big surprise there. it starts in brazil where the pope will be met with plenty of excitement and anxiety. >> reporter: this morning pope francis on the road to rio and world youth day. millions of young catholics headed here, as well. >> we just landed here at the airport in rio. i am joined by a group from austin. how hard have you worked for this? what does this mean to you to be here? >> we have been fundraising for about a year now. it is amazing god's work has brought us here and all of the challenges we had to overcome to get to where we are. it is such an amazing feeling. >> translator: i don't know if there are young people in the square today. are there? >> reporter: in a papal teaser on sunday in rome when pope francis asked if young people were there, the response fit for

woman who was raped and jailed received a pardon. she was arrested for having sex outside of marriage and consuming alcohol after she reported she had been raped for her 16 month prison sentence led to international outrage. she said she will leave for norway as soon as possible. it was a violent weekend even for chicago. a city that's gaining a national reputation for violence. six men killed, 22 people wounded. the reasons vary, a fight, a gang related shooting and a memorial for a man shot dead in 2008, a 6-year-old girl wads wounded in the chest. rapper 50 cent is due in court to answer for a domestic violence charge. he attacked his ex-girlfriend last month. he allegedly trashed her los angeles condo. he could face up to five years in prison if convicted. new details are emerging about that deadly limo fire.

so the passengers wouldn't hear the art. the passenger said she was shouting about smoke but brown who spoke to cnn said they were asking about smoke but she thought they were asking if they could speak. we reached out to the d.a. but we have not heard back yet. the limo driver has not commented on this new report. faith, i want to start with you here. could the driver be held criminally responsible if this report from his estranged wife turns out to be true? >> could be but i think the outcome will be civil responsibility. we have information he was distracted by being on the phone when this incident was happening. we know that some of the passengers were able to escape and some were not. timing was a huge factor here. not only was he distracted and there's evidence there were too

many passengers in the backseat of this limo. where does that responsibility lie? the limo driver and the company. the passengers don't know this. looks like a clear case of wrongful death. >> given the fact he's a licensed driver, does he have more of a duty to protect the passengers here? >> well, you have a common carrier issue with the limousine. are they held to a standard of care that they have to make their cars safe, their travel safe for all of their passengers? that's going to be an issue. also at issue is california has no less than three statutes outlawing being on your phone while driving. when it comes to civil liability the question will become did the driver cause these deaths. there may be an element of proof that will be tough there because they have to prove his being on the phone while illegal did it cause the deaths of those people. it raises another discussion that we've criminalized using

your phone while driving but there seems to be a pass when it comes to enforcement for taxi driver and limo drivers. this will be an issue of public policy that will probably be addressed after more cases like these. >> you think there will be more responsibility there. faith, do you think his ex-wife telling the newspaper this story is enough to prove he was too distracted? >> this should have come out earlier in the investigation by the state who looked into this. one of the first things they would do is look at the phone records. now this is coming out because his wife chose to speak out about it. if he was distracted you're looking another negligence. he owed a duty of care to the passengers. did he breech that duty? >> you raise a good point because the d.a. office is saying it will review this and

police are saying they had not talked to his wife before now. are you surprised by this considering if she was on the phone you would think he would look through phone records. >> you have to believe but when this driver was asked he may not have responded that he was on the phone. your cell phone create wake of data. it will not be difficult to match up time of incident to when he was on the phone. now that they have this information it should be easy to find out the data from the cell tower and match up the times and prove whether he was on the phone at the time of the incident. >> we'll have to see if based on this new information if the families will sue this driver. thank you so much. thank you for watching.
