baseman claims he was duped into taking performance-enhancing drugs believing they were legal substances. an arbitration panel is hearing rodriguez appeal of his 200-game suspension. lance armstrong olympic cycling medal is back with the olympic committee. back in january armstrong was stripped of his medal after admitting to doping. the committee says the return of armstrong's medal marks the end of a sad chapter. >> how do you really feel about all of this? >> if you cheat, you have to pay the piper. a rocker in prison for an infamous performance. she has been on a hunger strike saying she has been mistreated and wants to be held someplace else. phil black is live near the

prison. what is her complaint? >> reporter: she has a long list of complaints about what it is like in prison here. after assuming water for the ninth day she has suspended her strike but is said to be in serious condition in the prison medically fast behind me but says she will stop eating again if her demands are not met. convicted criminals are said to fear this place. it is grim. decaying. often intimidating. she was sent here a year ago for her part in this famous performance. it happened in moscow's main cathedral a protest against vladimir putin. the punishment was two years

prison. she has less than six months left on her sentence but on september 23rd, she declared the conditions to be intolerable and began a hunger strike. so it's been more than weeks since you've seen her? >> yeah. >> reporter: her husband said her condition deteriorated sharply when she was moved to a prison hospital facility. >> she has -- she did start getting complications because basically it was her ninth day of hunger strike. >> reporter: she described life in the camp in an open letter. 16-hour working days and little sleep or food. violence and cruelty. this video was recorded by human rights activist just two days into the hunger strike. she says women in the prison are forbidden from maintaining personal hygiene. her description of life on the other side of the barbed wire, it's all drawn comparisons to the notoriously brutal prison

camps of years ago. the officials here say she is lying. she believes every word because she says she has lived here too and she was convicted of embezzlement. it's like torture, she says. the system between the administration and the convicts is not just based on subordination but hue mamiliati and fear. she also went on a hunger strike after the authorities said she could no longer see her children. she says the physical pressure applied to make her quit was more difficult than the hunger. maria, another convicted member of pussy ride protested conditions in a different remote pretty much camp and she drew attention and won concessions.

now she hopes she has done the same. she wants to be transferred to a different prison and wants a full criminal investigation into all of the allegations she has made and wants assurances that none of her fellow inmates those who helped her will be punished or imprisoned in any way and otherwise, she will resume the hunger strike. >> is she scheduled to be released soon? i thought i read maybe in march? >> reporter: that's right, as early as march. lots of people wondering why she chose to do this now. she had the option of keeping her head down and essentially surviving and enduring the experience. her husband said she couldn't deal it any longer. she says the nature of the punishment that goes on there is often collective. if one prisoner is said to break the rules, a whole group of them are often punished as a result. >> phil black is live for us.

facilities that provide a handup for low income families in cities across the country. >> reporter: this is a head-start center that provides 135 children from low income families. the 3 to 5-year-olds get meals and education and health care. the facility's funding ran out tuesday and supplemental funding runs out friday. after that, the doors shut here and at 16 centers run by mid florida community services in two other counties. >> that means 924 children in three counties here in florida will not get to attend head-start and that means 215 staff members will not have a job after friday. >> if they don't make this budget and get it together, we're the ones who are going to suffer and our children are going to be the ones who are going to, you know, be without food, be without education.

>> reporter: quite a few head start centers around the state had letter end dates for their federal dollars or other revenue sources. they are still open, for now. >> our thanks to john zarrella for that. >> those are the kids that need the most and studies show that early head start is so important for those children. morning today. the members of a church group and two others killed in a horrific crash. this was on a tennessee highway. a bus carrying mostly seniors were returning from a conference in gatlenburg, tennessee. it blew a tire and it crossed the media and slammed no a tractor-trailer and suv. the tractor-trailer burst into flames. investigators say they are not jumping to any conclusions. >> make sure the brake mechanisms if at all possible if this crash will permit that investigation to take place we will take a look at the braking system and make sure that the bus was functioning properly.

we also look to see if there is any possible -- any possible other mechanical failures that could have led to this incident. >> it's just awful. in total, eight people died. six on the bus and two in other vehicles. more than a dozen people were injured there. new developments in that frightening incident caught on camera here in new york city. charges have now been dropped against one of the motorcyclists accused of an assault on an suv on a busy new york street. the second biker, christopher cruz is now out on bond. a hundred bikers gathered outside of a hospital on wednesday in support of a rider hit by the suv as it tried to get away. edwin mieses is in a medically induced coma and paralyzed right now. some of the motorcyclists insist it was the suv driver who was wrong. >> i was behind the car. so i saw when he hit the person and everybody, you know, they err telling him slow down, stop.

that people were actually telling him. nobody was being -- until he ran people over. out of panic, out of what? nobody was being -- with him. when you hit someone, you're supposed to stop and that is the law. he did not do that. >> investigators are asking public for help identifying other people involved, putting out these pictures. the driver of the suv has been identified as alexian lien. he was dragged from the vehicle and his wife and 2-year-old daughter were inside. he was beaten. crews were able to rescue two hikers missing along the pacific crest trail in washington state after a snowfall stranded them. but two have not been found. one searcher who had gone looking for the hikers was grateful to have been found but really worried about the others.

football coach was convict of 45 counts of sexual abuse of ten boys. he is serving 30 to 60 years in prison. sandusky's defense says it plans to ask the state supreme court to now review the case. a southwest airlines pilot is out of a job after a dangerous hard landing back in july. the airline firing the captain who took the controls from his co-pilot just seconds before the boeing 737 sat down nose-first on a runway at new york's laguardia airport. the landing gear shattered and the plane skidded down the runway jurg several passengers. the official investigation into the crash is still snoongoing. >> a shocking find for police in warwick, rhode island. inside a two bedroom apartment a three-foot alligator in the bathtub and 13 snakes some up to 12 feet long. police say they were part of a

trying to encourage the passage of more of the spending and they are vetoing any more spending bills to try to open up government. we are trying to open up government as they say we won't negotiate, i think that is an untenable position. >> while washington squabbles, real people suffer. anderson cooper spoke with michelle langdon. she has a rare form of cancer and the shutdown means for her a matter of life and death. >> you've been waiting to become a part of this clinical trel and now because of the shutdown the approval process has been put on hold, is that right? >> that's correct. >> how long have you been waiting to get in? >> i've been waiting for probably a couple of weeks now. and i have actually just found this clinical trial and it was rather exciting to find there aren't many treatment options that are out there that are approved at this point, so i found it and i made contact and they were able to get back with me very quickly.

they had just begun the process of evaluating my records that were sent in when i was told that the shutdown was going to happen. >> what went through your mind when the person in the nih told you it would all be put on hold? >> so many emotions. i was upset and frustrated. this is a potential life saving drug and to be told that it's going to be postponed because a decision hasn't been made and the shutdown occurred was rather upsetting. >> on piers morgan, the financial consequences. piers spoke with mike burke who runs a statue of liberty cruise and is feeling the economic pinch after the closure of the national parks. >> it's just as outrageous for us, mr. morgan, coming on the heels of eight months of closure after sandy, only to reopen the statue of liberty on july fourth, we were in a pretty good economic hold to begin with. ellis island has yet to reopen prior to this closure. we are hopeful for october 28th,

frustrated beyond belief, the nation's leaders actually got into a room and had a discussion. didn't go anywhere but, at this point, maybe we should take anything we can get. senior white house correspondent brianna keilar begins our discussion. >> reporter: for the first time since the government shutdown, congressional leaders met face-to-face with president obama at the white house wednesday night. both sides emerging with no deal and no signs of progress to end the stalemate. >> the president reiterated one more time tonight that he will not negotiate. >> we are through playing these little games. >> reporter: republicans still demanding president obama accept a delay to his signature health care program. >> all we are asking for is a discussion and fairness for the american people under obama care. asperated, absolutely i am exasperated. >> reporter: in an interview with cnbc, the president reiterated he won't give in on obama care but will negotiate on

some issues, if house republicans first agree to reopen the government for several weeks. >> we have a situation right now where if john boehner, the speaker of the house, puts a bill on the floor to reopen the government at current funding levels so that we can then negotiate on a real budget that allows us to stop governing from crisis-to-crisis, it would pass. >> reporter: the president is probably right. but that's not happening any time soon. instead, house republicans held votes again on funding the government in a piecemeal way. the senate will surely reject. meanwhile, not far from the capitol, the world war ii memorial operated by the largely shuttered national park system has become a proxy in this battle. for the world war ii vets showing up at the memory i can't go, the ry, this offering to pay to keep it open. >> our veterans deserve to see this memorial and we are willing to pay the bill.

now it's up to the president to let them in. >> brianna keilar, cnn, washington. we should tell you the national park service has now announced it will not stop veterans visiting that memorial, despite the shutdown. this shutdown is having a pronounced impact on thousands of government workers and many are off the job. others are not getting paid. that impact is spilling over onto those whose livelyhoods rely on those workers. one is allen niceler. he manageses a sand wish shop near the cdc facility in atlanta. since they are furloughed, they are not coming into his shop. he spoke to cnn. >> i've cut back my staff significantly. the people here rely on the money. a lot of my staff have young children as well so it's making an immediate impact and it's very significant. >> the shutdown is hitting the cdc pretty hard. its annual flu program has been

stopped. with so many of its experts now off duty, officials worry they may not be able to get ahead of the next major outbreak. day two of obama care was hit by many of the problems as the first day. the insurance exchange website has had all kind of technical glitches. good news nearly 5 million people flocked there in the first 24 hours. the bad news nobody is quite sure how many have signed up or for what. at least there's still six more months to sign up for coverage. a dream land of opportunity for foreign spy agencies. that is how the nation's director of national intelligence, james clapper, describes the impact of the government shutdown. with 70% of the work force furloughed now, clapper telling the u.s. senators this is a big opportunity for counterinsurgency. they are being eroded more and

more each day as the shutdown continues. according to "the new york times" it was designed to track the location of americans cell phones and worked by tapping into data from cell phone towers. it was operation agriculture in 2010 and 2011. the director of the national intelligence telling the senate that the nsa never moved forward with the operation after that. weapons teams are back at it again in syria today. they are trying to find catalog and destroy that country's chemical weapons stockpiles but the civil war is not helping them. there were intense clashes between the opposition and assad forces near damascus just as the team headed out for its first day of work. there may have been many fewer gunmen on a shopping attack on a shopping mall in nairobi, kenya. it shows that as few as four took part in the attack. 60 people were killed and al shabaab has claimed

responsibility on the attack. an activist group is pushing for vladimir putin to have a nobel peace prize as well. the group says putin, despite his backing of the assad regime in syria, works to promote, quote, settlement of all conflicts arising on the planet and says putin is more deserving than president obama because putin they say has steadfastly video military intervention overseas. a quick check of the weather. indra petersons is here with that. >> there are changes as we get closer to the weekend. >> just focus on today. >> block the next two days. don't look at them. still warm out there and temperatures 10 to 15 degrees above normal. you can see we are going to stay warm but notice i try to put clouds to show you in each city we are going to start the rain. something is making its way across the midwest and kind of

revenue, lockheed martin and united technologies and others closing with losses. the shutdown quickly making its way to the factory floor. 2,000 workers of united will be furloughed likely next week. they make the blackhawk helicopter. it could reach to 5,000 if the shutdown goes into next month. government inspectors are furloughed. you got to have these government watch dogs basically there on the factory floor and they went home without pay. remember when the president called these guys fat cat bankers? now they are in washington and on the same page with the president. more than a dozen wall street bank chiefs warning the white house wednesday a shutdown could do serious damage to the economy. a debt ceiling crisis might killed it and met with the president what they need is a budget pass defaulting and not paying all of its bills.

supposed to be solving all of this, no sign of that mapping the heads of the senate and house got together at the white house meeting with president obama, but at least one called it unproductive. neither side is budging. >> i would hope that the president and my democrat colleagues from the senate would listen to the american people and sit down and have a serious discussion about resolving these differences. >> if john boehner, the speaker of the house, puts a bill on the floor to reopen the government at current funding levels, so that we can then negotiate on a real budget that allows us to stop governing from crisis-to-crisis, it would pass. >> the house has been working to pass piecemeal funding pressures to keep the national parks and national institutes of health open but the senate says it has no plan to consider those bills. at the center of this entire battle maybe the man who could end it if he wanted to may be the man you heard from, john

boehner. his constituents in ohio have their own opinion of the job he is doing. here is joe johns. >> reporter: this is where john boehner came from, working class cincinnati. he has been in congress since 1990 and now at a pivotal moment in washington and in a bitter battle over obama care. house speaker john boehner has a 48% unfavorable rating which is an all-time high in cnn polling. >> nobody knows what the rules are. >> reporter: andy's cafe, which boehner's family owned, the shutdown was no big deal, though growth and bureaucracy is still an issue. when i asked jim griger, he wouldn't say if he was with boehner and the tea party. >> the government is big and they reduced the size of the government. however you want to take that, you take it that way. >> reporter: in boehner's district, they were more blunt about it. >> when john boehner lived here, he gave the message he was

completely for the people, the citizens of the country. since he has been in washington, i don't know. it just seems like some times he goes completely the other direction and sometimes he stays with us. >> reporter: so what makes boehner tick? he comes from a catholic family of nine boys and two girls, went to moeller high school. a linebacker at one of the famous football schools in the state. his coach is a legend in ohio who went on to lead the notre dame fighting irish. faust told me i never found a better team player. he always put his teammates ahead of him and insisted driving when hurt. >> we have seen john come back from trouble many, many times. he keeps chugging at it. he's a team builder and because he is an eternal optimist, i think he can get up every day and go back to work in a very, very difficult circumstance. >> reporter: for boehner's constituents, the question is what he stands to gain in the

shutdown. >> now did it back in '96 is when they reopened, you know? didn't improve anything or do anything else. they are back in the same mess right now. >> reporter: john boehner comes from one of the most republican districts in the state of ohio so there are people here willing to give him the benefit of the doubt but republicans and democrats alike who are truly annoyed with both parties in washington and that includes the speaker of the house. joe johns, cnn, near cincinnati, ohio. a hors terrific trash on a tennessee highway and eight are dead this morning. this is unreal. a church bus carrying mostly seniors was returning from a conference in tennessee. it apparently blew a tire on interstate 40 and went over the media and slammed into a tractor-trailer and a suv.

>> they will make sure if at all possible this crash will permit this to take place, we will look at the braking system and make sure that the bus was functioning properly. we also look to see if there is any possible -- any possible other mechanical failures that could have led to this incident. >> six of those killed were on the bus. two were in the other vehicles. more than a dozen people were injured as well. new developments this morning in a different frightening incident that was all caught on camera. charges dropped against one of the motorcyclists accused in an assault on an suv on a busy new york street. the second biker christopher cruz arraigned on reckless driving charges and now out on bond. a hundred bikers gathered outside a hospital on wednesday in support of a rider hit by the suv as it tried to get away. edwin mieses is in a medically induced coma and paralyzed right now. some of the motorcyclists insist it was the suv driver who was in the wrong here. >> i was behind the car.

so i saw when he hit the person and everybody, you know, they were telling him, slow down, stop. that people were actually telling him. nobody was being -- until he ran people over. out of panic, out of what? nobody was being aggressive with him. when you hit someone, you're supposed to stop and that is the law. he did not do that. >> investigators are asking public for help identifying other people involved, putting out these pictures. the driver of the suv has been identified as alexian lien. he was dragged from the vehicle and his wife and 2-year-old daughter were inside the vehicle. he was beaten. dr. dobbins is out on bond after pleading not guilty to endaengment charges in kentucky. david collar says he was heading home when he noticed an erratic driver and took out a camera to

record the license plate. that is when dobbins is seen apparently, you're looking at it right there, pulling out a gun and aiming at him. >> a terrifying sight right there. air search for two missing hikers in the southwest part of washington state. crews able to rescue two other hikers missing along the pacific crest trail after a massive snowfall on monday stranded them. alejandro wilson and christopher zitowitc have not been found. others have been located but they are consent at any rating on the others. easement it was a good feeling. it was a relief. i was worried about their condition. i hope they stay dry and get a good shelter and last out. >> he is concerned for the others. the weather in the area is expected to be better today, allowing for more extensive search by air. authorities say they are trying to ping the missing hiker's phones in an effort to find them. >> i hope that works. a judge says no to a

confessed child murderer getting out of jail. he was arrested in 2012 after a tip led police to him for killing etan patz. hernandez's attorneys said getting to was taking too long. the judge ruled the 52-year-old should remain behind bars. >> in new trial for jerry sandusky. a three-judge panel deciding unanimously no mistakes were made during his trial last year. the former penn state assistant football coach was convicted of 45 counts of sexual abuse of ten boys. he is serving 30 to 60 years in prison. sandusky's defense says it plans to ask the state supreme court now to review the case. for the first time in more than five months, a grand jury investigating a notorious ohio rape plans to meet again. this is a says of a 16-year-old
