classes at the middle school has been canceled as the community grieves. >> reporter: trying to make sense of a senseless killing. the small community of sparksburg, nevada, came together. >> they have one victory in the cafeteria, one in the hall. >> reporter: students were waiting for the more than bell to ring and then shots fired. >> people started running and screaming so i started running and we heard another gunshot. >> the kit started getting mad and he pulled out a gun and shoots my friend. >> reporter: the shooter, a 13-year-old student, allegedly using his parents' gun, wounded two fellow students. a teacher rushed to their aid. >> he walked up to a teacher and says, "back up." the teacher started backing up. he pulled the trigger. >> the teacher was trying to make him put it down but he took the shot right then and there.

>> reporter: a shot that killed 45-year-old michael landsberry, a popular eighth grate teacher. a former marine who served several tours in afghanistan and is now being called a hero. >> he was a very well-liked teacher by the students and other teachers. it's very unfortunate that someone like that that protected our country over there and came back alive, his life had to be taken. >> he loved teaching at sparks middle school. he loved the kids. he loved coaching them. he loved teaching them. he was just a good all-around individual. >> reporter: students are pouring out their grief on social media. >> having him for the math was best. it's too hard to even believe. no teacher will take his place. nothing is going to be the same any more. you are a hero and you will always be missed at sparks middle school. >> reporter: as for the student suspect, police say he took his own life with that gun. >> i knew the person with the gun. he was really a nice kid. he would make you smile when you're having a bad day.

i saw him getting bullied a couple times and i think he took out his bullying on him. >> reporter: it's still unclear what drove that child to resort to violence and blrnt he was targeting the students or the beloved math teacher who survived war, only to die what should have been the safe haven of an american middle school. stephanie elam, sparks, nevada. to the president now. his apology of sorts for the problem consumers have been having signing up for health insurance under obama care. the president has admitted things have not gone as well as he originally hoped. here is brianna keilar. >> reporter: an embarrassing moment for president obama forced to defend his signature health care reform program. >> you've probably heard that

insurance due to relatively minor preexisting conditions. >> osteoporosis, cholesterol things like that. >> reporter: you were denied how many times? >> three. >> reporter: on the day it law firmed many americans are still unable to enroll in obama care. come mid february, they could face a penalty if they don't have insurance unless that deadline is delayed. there is flexibility there in the law if folks -- >> i would simply refer you to a.j. for more details but we are working on it, they are working on aligning those policies, the enrollment period and time frame period. >> reporter: jay carney leaving the door open there. we have gotten word what kathleen sebelius is expected to testify before the republican-led energy and commerce committee. that is expected to happen next week. brianna keilar, cnn, the white house. >> the one jay carney left could be interesting if they change some of the dates on the policy here. supreme court says it will review state guidelines and set

minimum i.q. thresholds for skugs. in 2002, the court found it unconstitutional to execute those with intellectable disabilities. the case stems from florida. the court is expected to decide whether florida's law is constitutional and a decision is expected in july. back in court today, al libi is an accused terrorist with al qaeda and picked up in that daring raid in libya. he has pleaded not guilty. in the meantime the top war crimes prosecutor at guantanamo bay says he agrees with the government that a federal court trial rather than military tribunal hearing is the right way to go in this case. a not guilty plea from a california man accused of trying to join al qaeda. prosecutors say 24-year-old sin vin yo win confessed that he planned to be a trainer for

terrorist forces looking to fight in syria. he apparently had already been there fighting as a rebel against the assad regime. the judge in the case expressed some conceptism saying it did not appear the suspect had any special skills that would actually help the terror network. u.s. sent ten armored vehicles to destroy syria's chemical weapons. the nonproliferation and disarmament fund paid over $1 million for those vehicles. the u.s. has provided nearly $6 million in financial assistance to eliminate syria's stockpile of chemical arms. no one immediately claimed responsibility for this attack but it is the first outside the north caucuses region since chechen rebel leader called for

welcome back. a frightening story for you now from the skies over europe. two jumbo jets very close to colliding all because of a misunderstanding. here is chris lawrence. >> reporter: two jumbo jets came close to a catastrophic collision over scotland. somehow the pilots got so confused they nearly steered their planes right into each other. >> this is very hard to explain because it appears that two airplanes with two pilots in each airplane, everybody -- everybody got it wrong initially. >> reporter: both 747 he's were about to cross the atlantic. one climbed to a cruising altitude and put them on a path

to converge. air traffic controller told the plane on the left turn left. the plane on the right, turn right. but the pilots misinterpreted the orders and it did the opposite, they turned toward each other. 747s gone within three miles when the emergency order is given for one to go up and the other down. so were the pilots told one thing and all four of them heard the complete opposite? is that possible? >> the conclusion of the bridge investigators was that each pilot did what the other pilot was instructed to do. >> reporter: even though miles away at one point, one plane was a hundred feet above one another. >> the report says they are 1,000 feet vertical and they were clearly not separated by that much. >> reporter: british investigators found that the instructions the pilots received were clear. pilots confirmed they heard them. and their call signs were so

different, it would be hard to get them mixed up. now, as scary as this was, one thing that american flyers can take comfort in, no u.s. airlines have had a mid air collision since 1978. chris lawrence, cnn, the pentagon. >> that is is so weird. you know what it reminds me of? i'm not making light of this but i had a soccer coach say kick it with your left foot. and when you kick it with your right, no, the other leg p.m. they just didn't hear it? >> when you think how many planes are in the sky at any given time. >> thousands of people lives at stake there. i'm glad they are all okay. two of the three men held captive for a decade in cleveland are writing a book about their ordeal. amanda berry and gina dejesus. they were kidnapped by ariel castro who hanged himself in his

prison cell in september. a settlement between casey anthony and a group that went out searching for her missing daughter. a lawyer for texas equisearch decided not to take the case to trial. caylee anthony's body was found six months after her disappearance. casey noin was later acquitted of her murder. celo green is face iing charges. she claims the singer drugged her before they went back to her hotel. green has pleaded not guilty to the drug chars. in missouri a mother is facing a fine for something she said she had no choice about to go. she doubt her 6-month-old to jury duty. she tried to get out of jury

duty but the judge face her with contempt charge and now she faces a 500 dollar fine. >> since i'm a stay at home mom, we don't have child care. it's not right. it's not fair for us. we are just trying to do what is best for our children and we shouldn't be penalized and fined for it. >> the judge did offer her a chance to pump during breaks but she says her baby won't drink from a bottle. he also asked somebody else to watch the baby at the courthouse but she said that was impractical. she will be back in court to face the judge. she says it is very scary because she has never been in court before. >> a couple of felons on the run there. >> i hope there is some reasonable way. edward snowden causing another black eye for the white house and the nsa. this one has president obama trying to mend fences with a key

welcome back to "early start." france is demanding answers after allegations that america was eas chief national security correspondent jim sciutto reports the obama administration is in damage control mode, trying to repair the relationship with an important european partner. >> reporter: france is a close ally, critical in recent years, in dealing with syria, libya, and iran, but according to documents revealed by edward snowden in france's le monde newspaper they were in the cross-hairs of a massive nsa surveillance. in december 10, twelve, january

8, 2013. targeting the paper reports both individuals who suspected links to terrorism and prominent leaders in business and politics. france's outrage was blistering. >> translator: these kind of practices between partners that violate privacy are totally unacceptable. >> reporter: even secretary of state john kerry arrived there to explain. >> i think that is appropriate and our goal is always to try to find the right balance between protecting the security and the privacy of our citizens. >> reporter: any new balance will have to be struck with a long list of allies now revealed by snowden to have been targets of nsa eavesdropping, including germany, britain, brazil, mexico and the european union.

is this damaging to mexico and other countries who protest it? >> potentially, yes. you've got this political sphere, this public sphere, this aspect of trust and, you know, there's impact, you know, when, all of a sudden, you have these things exposed. >> reporter: the france revelation comes just a day after the german magazine reported, again, based on documents relieved by edward snowden, that the nsa systematically eavesdropped on mexico including the e-mail account of the former president. however, the administration has shown no signs of significantly reining in the nsa surveillance either international or at home. jim sciutto, cnn, washington. promising of more prorvesheprorvbrorv bombshells.

glenn greenwald has many stories to tell and he is vowing to report on every document of what he calls public interest given to him by former nsa contractor edward snowden. imagine how sweet this would be. to see someone for the first time in ten months. this mom near pittsburgh is about to find out. her son sergeant calvin munoz gave her the ultimate surprise where she worked at walmart. >> oh, my god! being i can't plain it, how happy my heart is just like jumping inside me right now! i mean, i can't explain it. i can't. oh, my gosh! >> what a beautiful moment.

the sergeant had to plan that surprise two weeks and it took that long to plan it and as you can tell, mom was very grateful and it took a gigantic bouquet of flowers to hide behind and look how moving for everybody there at the walmart. you know that kind of moment will last forever in all of their minds. >> these moments are so incredibly emotional and wonderful to see. >> they really are. >> it just gets to the sacrifice you get from so many soldiers. >> that is what we talk about the soldiers oftentimes. it's the families too. this is their mom whose son made a decision to serve their nation but it's hard to see your baby go off and face that kind of danger. >> 13-year-old boy pulls out a gun inside his school. minutes later, two beam are dpe dead and two others wounded.

a 13-year-old student opened fire at a middle school killing a teacher and wounding two fellow students before turning the semiautomatic handgun on himself. the shooting happened just before the morning bell on monday. witnesses say the teen pulled his weapon and started to fire. that's when a teacher, 45-year-old michael landsbury tried to intervene and convince the boy to put that gun down but the former marine who served several tours in afghanistan was shot and killed. he is being called a hero this morning. the motive behind the shooting is still unclear. some are saying the boy may have been bullied. >> he always had a smile. he was always, you know, just a very nice boy to everybody and so it's just -- you know, i just find it difficult to get that, you know, he got bullied, but he didn't have anybody to talk to that he didn't have anybody to go to in the school before he decided to do this. >> the teen apparently took the handgun from his parents.

reno police say it's too early to say if he was targeting anyone in particular. in washington, the president is promising a fix is in the works for the website that americans have been trying to use to sign up for health insurance coverage but with so many contractors saying they knew the site was not ready for its launch on october 1st, the question really remains how did this happen? here is casey wian. >> way more glitches than i think are acceptable. >> reporter: glitches? >> the website launch was rockier than we would have liked. >> reporter: rockier? >> we are working out the kinks in the system. >> reporter: kinks in by now it's clear that stronger words are needed to describe the web law firm of obama care. >> it's been a fiasco. >> reporter: the white house struggled to answer questions what many said were inadequate testing prior to the launch of the website. >> do you know whether the website was beta testing? >> in terms of the type of testing, i just don't want to pretend to be an expert in -- what i want to say is that, you

know, the -- the system has not worked as effectively as efficiently as we obviously wanted it to the secretary of health and human services kathleen sebelius says the online marketplace needed five years of construction. in reality, she said, quote, we had two years and almost no testing. >> it's not a surprise initially. i think the fact there seems to be so much ongoing problems noted is more of the surprise. >> reporter: the largest obama care contractor is cti group, a canadian firm that developed much of the website's architectu architecture. they are working around the clock for the improvement of the system that is complex and ambitious and unprecedented. we remain confident in our

ability to deliver continuous improvement in performance and more positive user experience but that is not enough for some critics. >> send air force one out to silicon valley and load it up with some smart people and bring them back to washington and fix this problem. >> reporter: one of those smart people from silicon valley. >> they say you can have it fast, cheap, or good. pick two out of three and it sounds like they went for the fast and cheaper. the launch day was probably picked politically and the software and everything else is backed into that. >> reporter: we may funed out what happened. several contractors are expected to here on thursday and secretary sebelius is expected to testify next week. casey wian, cnn, los angeles. we are hearing from the mother of an american held in north korea days after she finally saw her son. he went to pyongyang hospital

charges. after his arrest, police say he confessed to sexual abusing and smothering the little girl and leaving her body in a cooler near the highway. he has since recanted. the judge in the murder trial of new england patriot aaron hernandez refusing to step down. prosecutors argue she is biased against the dda. office. hernandez pleaded not guilty. >> to many who scratching their heads about how it happened, new revelations how two convicted murders in florida may have contained the forged documents that set them free. in an exclusive interview with nick valencia, said seven inmates tried to release fraudulent documents since 2009. five of them at the same prison

and caused a great deal of outrage and now we are learning the jets fan who was caught on camera punching a female patriots fan in the face at metlife stadium here in new york, that that man has a criminal record. he served three years in prison in 1990s after convicted in a fatal stabbing but his mother, who was at sunday's game with him, says her son was only acting to protect her from the woman who she claims was the aggressor. you watch that video. >> it's hard to watch. >> there shouldn't be punching among fans at any football game during, before, or at any time. >> it's football. leave the aggression on the field. a federal lawsuit in tennessee is demanding that all married couples in new york or california saying tennessee is violating their constitutional rights by refusing to honor their out of state marriages. tennessee has a voter approved constitutional amendment that defines marriage as being

between a man and a woman. same-sex couples tied the knot in missourinew jersey, chr christie dropped his legal challenge aimed at stopping gay weddings in new jersey. his spokesman say the state supreme court spoke clearly when it denied the stay and let marriages go forward. even though christie disagrees with the ruling, his spokesman says it was the governor's duty to abide by it. virginia's newspaper saying they don't like any of the candidat candidates. the paper writes the republican and democratic candidates have, quote, earned the scitizenry derision. >> nothing like that except umbrage. strike for workers for the bay area rapid transit is over

hours after a 13-year-old student opened fire and killing a teacher and wounding two other students before turning a gun on himself. the shooting happened just before the morning bell on monday. witnesses say the teen pulled his weapon out and just started shooting. that is when a teacher, 45-year-old michael landsberry tried to talk the boy into putting the gun down. this teacher was a former marine and served several tours in afghanistan and was a hero as a teacher and as a marine. he was shot and killed and, again, today being hailed as a hero. the motive this morning is still unclear but some people are suggesting that the boy may have been bullied. >> he always had a smile. he was always, you know, just a very nice boy to everybody and so it's just -- you know, i just find it difficult to -- to get that he, you know, he got bullied, but that he didn't have anybody to talk to, that he didn't have anybody to go to in the school before he decided to do this. >> the teen apparently took the
