kathleen sebelius to step down saying i republican conference call this rollout has been a fiasco. i think some people should be held responsible but clay johnson a former fellow who worked on i.t. says the real problem is with the government contractors who built the site. >> i think they don't know how to measure success. i mean, the federal government wants to innovate so badly but it doesn't have the access to the right kinds of contractors that it needs to pull off these kinds of innovation. >> reporter: jim acosta, cnn, washington. mean tile, health and human services kathleen sebelius is under fire. sebelius sat down with our dr. sanjay gupta for an exclusive interview. sanjay asked her what the president knew about the issues and when he knew it. >> the president did say he was angry about this, do you know when he first knew there was a

problem? >> well, i think it became clear fairly early on, the first couple of days. >> but not before that, though, not before october 1st, there was no concern with the white house or hhs? >> i think we talked about having testing, going forward. and if we had an ideal situation and could have built a product, you know, a five-year period of time, we probably would have taken five years. but we didn't have five years. >> no one is more frustrated with the website rollout then her and the president. she's confident that an a-team coming in will look at those problems. >> it's a fascinating interview. a treasury department report reveals the irs over the past decade paid out $132 billion in earned income tax credits to people who did not qualify for them. the money is supposed to go to america's poor working families. the report says the agency was

authorities in greece are investigating nearly a dozen cases of missing children after a blond hair blue eyed girl was found in a roma community last week. cnn's george howell spoke to lisa's parents. >> reporter: october marks two years since lisa irwin went

missing, but now her family has new hope, thousands of miles away in europe. a girl only known as maria taken by greek officials from a roma family charged with abducting her. >> as a mother, when you look at that picture and the picture that we've seen from greece, what are the similarities, what do you see? >> i see the same facial structure. i see the same eyes. and also, you got to remember that, for example, i have a friend that has a 2-year-old daughter whose eyes are just now changing color. little maria's eyes are a little bit different in the color, but they're still in the same color family. >> reporter: this girl found in greece, could she actually be from kansas city? robert lowery from the national center of missing and exploited children said a full investigation is under way. >> we reached out to the fbi this morning, working by interpol. we're asking that the dna data be shared with our laboratories

here in the united states for comparison purposes to any of the missing children here from the united states. frankly, right now, it does not appear that this may be any of our children, but again, we want to confirm one way or the other. >> reporter: there's also the question of the child's age. dental records indicate maria is either 5 or 6 years old. baby lisa would only be 3 next month. >> the dental records that you just mentioned, that's kind of the first time we've heard about that as a for sure type of thing. >> and does that discourage you, or will you look at that? >> absolutely not, doesn't discourage me at all. because as i said, lisa is very big for her age. when she was kidnapped she was almost 11 months old. she was wearing 18 months and 2-t. she's a very big girl. >> reporter: the last night they saw her she was just a baby after she vanished from her bed after her parents say was a home

invasion in 2011. the mystery of what happened here captured national attention. the parents even captured by police at one point but they've also seen this community rally behind them, optimistic about any lead that comes in, desperately hoping this time it's a match. george howell, cnn, kansas city, missouri. four different types of explosives were found at the apartment of alleged colorado theater shooter james holmes. that's according to three fbi experts testifying tuesday at a pretrial hearing. holmes accused opening fire at a crowded movie theater, opening fire and killing 70 in that. prosecutors could use the discovery to prove holmes knew the attack was a crime. he's pleaded not guilty by reason of insanity. it's sentencing day for matthew cordle, the 24-year-old ohio man confessed on youtube causing a fatal crash in june.

the highly professed video went viral and cordle pleaded guilty for aggravated homicide. his attorneys have asked for a reduced sentence. cordle faces up to eight years in prison. two 0 colorado farmers pleading guilty tuesday. brothers eric and ryan jensen are caused with causing one of the deadliest outbreaks in food history. their listeria contaminated cantaloupes killed 33 people in 2011. each man faces six years in prison and fines up to $1.5 million. the tsa can now screen your personal records before you get to the airport. "the new york times" reports that fast travel plans, property records even car registrations could be fair game. the thorough background check will direct some to lighter screenings and more invasive ones. the government says they will

streamline screening. pet treats could be hazardous to your furry loved ones health. the fda said thousands have been sickened since 2007 and more than 80 pets have died. the fda doesn't know what's causing it. if you're concerned at all, we'll let you know coming up the names of those companies involved so you can try to maybe avoid that. a remarkable story to tell you about right now. a 28-year-old double-leg amputee biking across the country. rob jones is a marine veteran he lost both legs in an ied explosion in afghanistan. now, he's using determination to help other deserving veterans. >> i joined the marine corps in 2006 was a combat engineer went to iraq in 2008. afghanistan, 2010, primarily tasked with finding explosives on the ground.

they've tapped a man that's known for facts and figures to now head up the rescue for healthcare.gov. it's a short-term assignment for jeffrey zients who is slated to take over soon as head of the president's national economic council. in the meantime, republicans continue to push back against obama care and see the real price tag is just now coming to light. here's casey wian. >> reporter: the state of colorado want everybody to know thieve's bros can afford obama care. shown with the tag line, thanks, obama care. kentucky is signing up for his state's version of the affordable care act. >> i guarantee you, they're going to look back at these critics, including these senators and representatives, they're going to say, hey, this works, i've got affordable health care. >> reporter: people with incomes that qualify for government subsidies clearly benefit from obama care. but many others are paying more.

a detail that some in congress said the administration doesn't make clear in public as part of the republicans' website launch. on oversight and government reform, sent is this letter to the obama administration demanding answers. it reads in part, we believe that the political decision to mask the sticker shock of obama care to the american people prevented contractors from using universally accepted best practices, in the development and rollout of this massive federal government i.t. project. it's easy to see why chaos would likely ensue. >> affordable care act's website which now totals about $600 million probably costs twice as much and it's not performing as it should if best practices had been delivered. >> reporter: the white house says the republicans are twisting the facts. however the administration has made changes in the website in the past two days that now allow consumers to type in their county and state at estimates price quotes, as well as

information about subsidies. something they couldn't do before without filling out to an application. >> there are problems and there were problems that need to be addressed. we're improving the experience for consumers every day. >> reporter: the concern remains the price tag, the website about $300 million. the overall cost, $1.4 trillion over ten years. >> the goal is for that spending to ultimately to lead to health care costs and reduced budget deficits in the future. that, of course, depends on how well obama care performs and so far it's been a rough start. republican leaders are calling for health and human services secretary kathleen sebelius to resign. she was asked about this in an interview with our dr. sanjay gupta. sebelius' first since the health caroleout fiasco. >> there's a lot of frustration in the country and no one probably knows this more than you and the president did you ever talk about resign to get

president? >> what i talked about is doing the job that i came here to do. >> if this persists, or even at this point now, would you consider resigning over this? >> i think my job is to get this fully implemented and to get the website working right. and that's really what i'm focused on. >> you heard there someone not answering the question put to her which is interesting. secretary sebelius said president obama did not know about the problems with the website until it went live. he will turn 80 years in 2016, but john mccain may have more political fight in him. the arizona senator said he's considering a run for a sixth senate. he's seriously thinking about giving arizonians another chance to vote for or against him. mccain lost his bid for the presidency in 2008. we're learning more about the student who opened fire in

sparks middle school in nevada killing a teacher and wounding two classmates before turning the gun on himself. the gun the seventh grader did come from his home. it's possible that his parents could be charged. in a meantime, a candlelight vigil is planned for the victims. >> reporter: newly released 911 tapes and eyewitness accounts paint a picture of what happened here here at sparks middle school monday when a student opened fire. the student opened fire and killed a teacher and wounded two students before taking his own life. >> somebody brought a gun to school that shot a teacher. >> the teach is down? >> yes. >> okay. we'll get somebody there right away. you're at sparks middle school. >> yes, they shot again. >> they shot again? >> yeah. >> you hi, this is lea, school police you guys have sparks middle? >> we do.

>> the 13-year-old recalls hearing a loud pop that he shot was a fire crashinger. >> i turn around and see a teacher approach a gunman. the gunman is pointing a gun at a teacher. he fired a shot and everybody started screaming and running. >> reporter: that teacher, mike landsber landsberry, a military man, those there wash show county are calling him a hero. >> mr. landsberry was fatally shot in the chest. mr. landsberry's heroic actions by stepping towards the shooter allowed students to flee the area. >> reporter: a longtime friend and national guard supervisor said the kids were always his first priority. >> he was a soldier with us but he was always a teacher. he just wanted to always be there for the kid. he loved them.

they'd tell stories all the time about him. and as a coach, too. he just did all kinds of things. we knew that he was there to protect them. >> reporter: officials have not released any information about the 12-year-old shooter, but they believe the weapon he used, a ruger .9 millimeter semi automatic handgun came from his home. the middle school student knew him personally. >> he was really a nice kid. he would make you smile when you were having a bad day. he'd just ask you if he could buy you something, he was really a nice kid. i saw him getting bullied a couple times. i think he took out his bullying on it. >> reporter: police say they still don't know why the boy did what he did. but kyle necum told jake tapper what he heard when he was running away from the scene. >> he was yelling a bunch of things when we were running? >> reporter: what was he

yelling? >> he was yelling stuff like why are you laughing at me, why are you doing this to me? >> reporter: stephanie elam, cnn. hundreds attending a rally in merriville, missouri, demanding justice for the victim of an alleged rape. investigators have agreed to re-examine a case dropped by the prosecutors. daisy's family claims that's because one of the suspects comes from a prominent family. >> this is a grassroots effort. there have been people throughout the entire nation who have been working to try to find some kind of solution in some way to help. and that makes a difference. >> the special prosecutor says her office will review the case, quote, without fear or favor. florida police say they are looking at several suspects as they investigate who helped convicted killers joseph jen sin kins and charles walker walk

free. so far, no arrests. they say at least seven documents in attempts to help them escape. jenkins and walker were arrested in a motel in florida. the report says it was jenkins' second time to forge papers. he failed in 2011. >> you know, you might tip you off. a ninth biker was charged with the suv accident in new york city. court documents said he's seen on the video allegedly hitting lien with his helmet. a judge will decide whether a fund is indeed bankrupt. local officials said the city failed to negotiate with them in good truth. he could rule that detroit is not eligible for relief from $18

and could have built a product in, you know, a five-year period of time, we probably would have taken five years but we didn't have five years. >> sebelius said no one is more frustrated with the website rollout, also the president. and they are confident that an a-team of experts will come in to fix the problems. >> an a-team. all right, a report says the irs paid out more than $132 billion in bogus claims for tax credits over the past decade. agency's inspector general found more than a fifth of all earned tax credits went to people who didn't qualify. it fixed the problem after it was flagged by the inspector general. we're learning this morning about a shocking security lapse in an underground nuclear command post. i mean it when i say shocking. air force officers entrusted with the keys that could launch nuclear warheads have left the

blast door intended to prevent intruders from entering, they've left that door open, not once, but twice this year. the associated press reports those blast doors are never to be left open if a crew member is inside and sleeping. that was the case in both instances. two launch commanders and two deputies have been disciplined. later today pakistan's sharif meets with president obama at the white house. the tensions between the two countries remain over drone attacks with ex tremists. sharif calling for the end to those attacks on wednesday. two are focused on the afghanistan pullout. and secretary of state john kerry acknowledged tuesday that leaders of the u.s.-backed opposition have not committed to negotiate with president bashar al assad. the u.s. and ten arab and european nations are backing the

peace talks. an ominous prediction out of afghanistan this morning, the taliban is planning to carry out an unusually aggressive campaign of violence there this winter. the offensive, particularly aimed at causing disruption ahead of next year's presidential elections in afghanistan. a senior military officer said we may see high profile attacks targeting political official, rather than combat on the ground. wednesday is the anniversary of moammar gadhafi. rival islamist and western-backed are uniting turning political feuds into armed conflict. the result say vulnerable system where they have the potential to erupt into civil war. the prime kidnapped just last week. a rare protest outside the king's palace in saudi arabia over female drivers. over 150 clerics and scholars

taking part. they're blaming the u.s. for a campaign calling for women to drive on october 26th. since this campaign launched last month. saudi women have been uploading videos of themselves behind the wheel. though no law bans them from driving women are not issued licenses in that conservative kingdom. and new documents officially tying the dead bomber tamerlan tsarnaev to a gruesome murder. federal officials say he participated in the killings back in massachusetts in 2011. the victims' throats were slit. one of the victims was a friend of his, a man shot to death by an agent in florida told investigators that the older tsarnaev brother was involved in these murders. the filing is part of prosecutor's attempts to block dzhokhar tsarnaev from getting associated documents associated with that crime. he's awaiting trial for the bombings that killed people in april. seven minutes after the hour, let's get you ready to almost get out the bed to get

welcome back to "early start," everyone, a suspected al qaeda mastermind is back in tort. abu anas al libi is in federal court. prosecutors say they want to try him alongside two other al qaeda terrorists. al libi was captured earlier this month. he's accused of planning the 1988 u.s. bombings in tanzania and kenya. now his wife said that's not possible. here's brian todd. >> reporter: one of america's terror suspects back in lower court in manhattan, abu anas al libi charged with planning the 1998 u.s. embassy bombings in

nairobi and tanzania appearing before a u.s. federal judge. his wife tells cnn he's not only innocent, but he left al qaeda well before the 1998 attacks. >> translator: it is true my husband was a member of al qaeda, but he left al qaeda in 1996, two years before the bombings. he did not take part in any bombing anywhere in the world. >> reporter: another al qaeda member once testified in a u.s. trial that abu anas al libi left al qaeda's group in the sudan in the mid19 minutes. but there's no indication that he completely severed ties with al qaeda. and the indictment says he helped plan the embassy attacks before leaving. in the latter part of 1993, the indictment says, al libi conducted visual and photographic surveillance of the united states embassy in nairobi, kenya. cnn terrorism analyst paul crookshank cites the testimony of an alleged co-conspirator of al libi on what happened next. >> pictures were brought to bin

laden in sudan. and bin laden looked through the pictures and then decided where he was going to put a truck bomb. >> reporter: but the plan was put on a shelf for five years. all u.s. officials seem to know now al libi was simply, allegedly, a scout for the operation. bit time bin laden had ordered the embassy bombings, al libi had joins another group. >> it's possible that he had no knowledge that bin laden will green lighted the operation. that bin laden used his photographs to attack the embassy. >> reporter: of course that didn't mean that al libi wasn't part of the plot originally. contacted by cnn neither the intelligence would comment on the remarks by al libi's wife that he's innocent. brian todd, cnn, washington. accused colorado shooter james holmes had four types of explosives at his apartment, according to fbi agents who testified tuesday at a pretrial hearing. the 25-year-old is accused murdering 12 and injuring 70 more in the 2012 massacre.

his trial is expected to start in earnest next year. holmes has pleaded not guilty by reason of insanity. the ohio man who confesseded on youtube to causing a fatal dui crash, he will learn his fate today. 22-year-old matthew cordle pleaded guilty to aggravated vehicular homicide. after his much watched video confession went viral, cordle said he was not looking to get off easy but his attorneys are in fact looking for a reduced sentence. he faces up to eight years in prison. a warning now for pet lovers and pet owners. jerky treats, you know what your pets enjoy? it could be making your dog or cat sick. so far more than 3,000 cases of sick dogs have been reported to the fda since 2007. and more than 580 pets have actually died. most of these brands originated in china, necessarily 3ur per rena, canyon creek and milos

cnn's joe johns following that. >> reporter: sources in and outside the government who spoke to cnn blame the problems with the website on a variety of issues, leading up to the launch, especially the lack of a true point person. a true project manager who could give cms what one insider called a no-bs assessment of how imperfect the rollout would be. the white house is hoping to solve that problem by naming a fixer, jeff zients. >> he's an expert in the field of effective management. and hhs will be tapping his experience and expertise, as they address the challenges that have come up with the administration of the website. >> reporter: what may have made the rollout worse is failure to manage expectations. sources said they were aware of capacity problems. when confronted with reality that the website was going to underperform, a source at higherups circled the wagons with any promise that the glitch

wouldn't be that bad. the health and human services secretary was actually on cnn downplaying the capacity problems the day the website rolled out. >> i think the volume-related issues are ones that we welcome, quite frankly, it shows how many people are eagle tore get real information. >> reporter: a source familiar with the situation told cnn a subsidiary of verizon has been working on the network capacities. as far as the government itself goes, sources say the government did not know what it wanted in the first place and kept changing the goals or revising the plan to make it extremely difficult for contractors to deliver a product but a former manager of the contract said contracts should be discussed either. >> i had a feeling had health care.gov wasn't going to go the way everyone wanted it to to go. when you look at the history of i.t. projects they almost always

result in failure. >> clay johnson said they should hire smaller more agile companies. we asked verizon for a statement of this story and they declined to comment. joe johns, cnn, washington. kathleen sebelius would be the fall gal for that failed obama caroleout, she was asked for the possibility of resigning during an exclusive interview with dr. sanjay gupta. >> there's a lot of frustration obviously in the country. no one probably knows this better than you and the president. did you ever talk about resi resigning to the president? >> what i talked about is doing the job i was brought her to do. >> would you consider resigning? >> i think my job is to get this fully implemented and getting it right. >> secretary sebelius said president obama didn't know about the problems with the health care website until it went live. as for delaying the launch,

sebelius said that's not an option. so he's not ruling it out, arizona senator john mccain said he's giving serious thought to a run for re-election in 2016. mccain, as you know, lost his bid for the presidency back in 2008. authorities in sparks, nevada, do not know why a middle school student opened fire killing a teacher, wounding two and turning the gun on himself. 911 recalls the chaos and the sheer terror inside of that school. >> 911 emergency. >> somebody brought a gun to school, they shot the teacher. >> the teacher's down? >> yes. >> okay. i'm going to get somebody out there right away. you're at sparks middle school? >> yes. they shot again. >> this is a student at sparks middle school.

can you please send police out here? there's a kid with a gun. >> these children are absolutely terrified. the young man brought the handgun from his home. his parents could now face charges. some students have suggested the shooter was a victim of bullying. police say, though, it's too early to determine if that was a motive for the shooting. hundreds of people attending a vigil in maryville, monissour in support of a teenage girl daisy coleman who claims she was raped. protesters are calling for justice. >> this is a grassroots effort. there are people throughout the entire nation working to try to find some kind of solution and some way to help and that makes a difference. >> special prosecutor said the office will review the case without fear or favor. one of two victims who
