the neighbor said the sister saw the suspect. >> she witnessed the officer being shot and the gunman actually smiled and was taking this like a game and ran off for a minute there, she believed that they were across the street directly from her house and then she saw him jumping fences in her neighbor's backyard. from what my sister said, she turn around and ran and just like -- in that split second said all she saw was him smiling. >> a s.w.a.t. team sent in a robot to give him orders to surrender. >> after about six hours in the house, duran did come out and he was arrested. now new details in a sensational cold case in 1996 murder of 6-year-old beauty queen jonbenet ramsey. >> annika has the story from boulder, colorado. good morning to you, annika. >> christie, miguel, the newly released documents show a grand jury in 1999 voted to indict

john and patsy ramsey in the death of their 6-year-old daughter. that never happened and dna evidence eventually exonerated the family. now new information is raising even more questions about what really happened the night jonbenet died. it's a murder mystery that remains unsolved after 17 years. who killed jonbenet ramsey? apparently a grand jury in 1999 believed her parents had something to do with the 6-year-old's death. a colorado judge just released previously sealed documents. four pages from a 1999 grapds jury indictment. the documents show the grand jury voted to indict john and patsy ramsey on two counts, child abuse resulting in death and being an accessory to the murder. yet, charges were never filed. at the time, then district attorney alex hunter said there just wasn't enough evidence. >> although the grand jury concluded there's probable cause, that is not anywhere close to the same standard as beyond a reasonable doubt.

>> reporter: all along the ramseys claimed an intruder killed their daughter. >> we think it was a pedophile, we think it was a male. >> reporter: the ramsey family was eventually cleared in the case by dna evidence. in response to the newly released documents, ramsey family attorney lynn wood released this statement, saying, quote, the released documents from 1999 were the product of a grand jury that did not have the benefit of the conclusive 2008 dna testing that led to the unequivocal public exoneration of the ramsey family by the boulder district attorney. nearly two decades after the heinous crime the search for jonbenet's killer continues. the dna evidence is still considered the biggest clue in the case, but no match has been found. the boulder police department confirms this is still an open investigation, but it's a cold case, meaning they are not actively investigating. a spokeswoman for the police department tells me they continue to receive tips but they have not received a credible tip for a very long time and she says right now

there are no solid leads. christie, mig until. >> that's ana cabrera in boulder, colorado, thanks. on to the obama care website which may be sick but tech experts say they have the prescription to fix it. >> the white house says the site should be running smooth ply by the end of next month, a couple months too late for some people. here's paul steinhouser. good morning, paul. >> reporter: when it comes to the new health care exchanges even president obama admits the rollout of the website has been a mess. >> there's no sugar coating it. the website has been too slow, people have been getting stuck during the application process, and i think it's fair to say nobody is more frustrated by that than i am. >> reporter: and you agree. only 12% of those questioned in a cbs news poll out this week said the process was going well. with almost half giving a thumb's down. the top republican in congress says the website problems are just the beginning. >> when you look at the problems with obama care, all the focus

police and parolee ended this morning in roseville, california. police had to try to arrest samuel duran but they say he took off on foot, shooting four officers got hit. duran ended up in a vacant house. police used a robot to coax him out. the white house says the obama care website will be running smoothly by the end of next month. the feds have hired an outside company to fix technical problems that left many americans frustrated and angry. republicans have hammered the president over the website's disastrous debut. some democrats want enrollment deadlines extended to give people more time to sign up. number three, contractors are tearing down sandy hook elementary school in newtown, connecticut, right now. it's expected to take several weeks, but workers are being asked to destroy all materials. just completely erase the building from the site. 20 children and six adults remember were killed in the shooting last december. a new school is expected to open in about three years. and for number four, we have a first for the fda.

the food and drug administration is taking steps now to make animal feed and pet food safer. they're focusing on protecting food from disease causing bacteria, chemicals and other contaminants. i did not know this, but there are currently no regulations over the production of most animal food. and at number five, jpmorgan agreed to pay $5.1 billion to settle claims that bank and other firms it owned misled fannie mae and freddie mac about the quality of home loans and mortgage securities it sold them during the housing boom. this is part of a larger settlement expected to top $13 billion. the former head of the nsa and cia may be getting a taste of his own medicine. >> seriously. michael hayden was on a train chatting on his phone when another passenger started tweeting everything he said. hayden was about -- talking about the nation's spying programs and the white house and it went viral on twitter, of course. cnn's brian todd is following this for us.

brian? >> christie and miguel, the irony here is that the man who once led the nation's eavesdropping program had the tables turned on him, and it's become a political hot topic. tom matsy says he was sitting on the acela train from d.c. to new york listening for an hour and 20 minutes to man speaking brashly on a cell phone. >> i didn't like what he was doing. >> reporter: it wasn't just any passenger. it was former nsa and cia director michael hayden, speaking to reporters, giving his take on the nsa spying scandal, insisting, matsy says, he be referred to as a former senior administration official. that's when matsy, a former progressive activist, started live tweeting what he overheard from the former spy chief. quote, hayden was bragging about rendition and black sites a minute ago and michael hayden on acela giving reports disparaging quotes about administration. remember just refer as former senior adman.

>> aren't you throwing him under the bus with that one? >> i thought it was the wrong thing to do for an official of his sfats -- stature to be making those sorts of comments and not taking accountability for them. >> reporter: they weren't in the quiet car and matsy says hayden wasn't trying to muffle his conversation. matsy here, hayden here two rows back and matsy said hayden was, quote, the loud guy on the train. in a statement to cnn, hayden, a cnn.com contributor, said i didn't criticize the president. i actually said these are very difficult issues. i said, i had political guidance too that limited the things that i did when i was director of nsa. matsy admits his bias. he was previously with moveon.org, a left leaning political group. hayden was appointed by george w. bush, but also served in the obama administration. >> you'll be accused of partisan mudslinging here. what do you say to that? >> if some people are saying i'm

responding to all of this? >> well, miguelle, there's some degree of remorse coming from the administration and i want to play for you a comment from jen sa , the spokeswoman for the state department. here's what she had to say. >> it's no secret over the last few months a series -- these unauthorized disclosures of classified information have, of course, led to criticisms of our intelligence activity by many of our friends and partners. it's created significant challenges in our relationships with some of our partners and has been a public distraction as you saw over the last couple days. >> has ordered an internal review of some of these practices and lisa monaco, an adviser to him, put out a statement yesterday sort of defending this, but also expressing some remorse as well. here what's she had to say. today's world is highly interconnected and the flow of large amounts of data is unprecedented. that's why the president has directed us to review our

columbia, south carolina, montgomery, alabama. well in the forecast, there's an area of low pressure that's sweeping across the great lakes on the backside of that, more cold air blowing in, so minnesota, dakotas, it will be brisk, temperatures very cold, but along the eastern seaboard you will see the sunshine, but those temperatures not going to be warming up terribly much. the temperatures that we're seeing overnight or early this morning may not be record-setting temperatures, but they are exceptionally early. boston, reporting 38 degrees right now. philadelphia, 39. into the southeast, birmingham, alabama, 34. 28 in charlotte. charleston, west virginia, reporting 31. and louisville, kentucky, 32. and yesterday, in jackson, kentucky, they saw the first snowfall ever for the date of october 25th. they have never recorded snow on that date. a lot of people seeing this deep freeze or the exceptionally cold

♪ ♪ . heard about rap super star jay-z getting some unwanted attention lately, landing in the middle of a battle over racial profiling. following two alleged incidents at new york's barneys. >> jay-z has a deal to launch a holiday collection with the retailer next month and now he's under pressure to cut all ties with the store. nick is following the story for

us. >> no stranger to social issues. jay-z and his wife we saw him at trayvon martin rallies and he's preparing to launch a high-end collection at barneys but there's a lot of people asking the rap mogul to reconsider. ♪ >> reporter: next month, jay-z is set to sell a new fashion line at barneys, but a change.org petition is calling for him to end all partnerships with the new york retailer because a second african-american college student has come forward to allege racial profiling, saying undercover officers stopped and questioned her after she bought a $2500 celine bag at barneys new york. >> i had good intentions. i went and bought my favorite bag. i wanted this bag. i deserved that bag. and then to find out, you know, i'm being accused of using someone else's card, i just really felt the need. >> reporter: 21-year-old kayla phillips came forward after

19-year-old trayon christian made headlines saying he was racially profiled after purchasing a belt at barneys in april. both shoppers want damages from the store and the new york police department. >> undercover cops that have regular clothes on stopped me from the left side and asked me i got a call from barneys saying your card is not real. >> reporter: in a prepared statement, mark lee, ceo of barneys new york, said, quote, no customer should have the unacceptable experience stib scribed in recent media reports and we offer our deepest regrets and sincerest apologies. barneys new york has zero tolerance for any form of discrimination. our mission is to ensure all customers receive the highest quality service without exception. the new york police department says it's investigating the incident. jay-z's representatives have not commented but kayla phillips hopes they do. >> when he hears about it or when he gets involved in it he knows it's not right and will make the right choice. >> reporter: and jay-z isn't the only star caught in the middle of a high-end store controversy.

robert brown filed a lawsuit against macy's. brown says he, too, was the victim of racial profiling. he says police accused him of using a fake credit card and detained him back in june. and for its part macy's says it is investigating but doesn't comment on ongoing litigation. back to that petition, only 5,000 signatures. there are arguments to be made for him to back out of this but it's still not the groundswell movement. >> it had to be have been a huge deal for him to take, so it will be interesting to see if he fights any of this. >> for new yorkers and many cities across the country, it really puts that back in the spotlight again. >> the attorneys for one of them saying this is shop and frisk. these two that are making these allegations were stopped as they left the store. they had made the purchases, leaving the store and, you know, attacked, they say, by undercover cops. this is a big deal socially. >> that makes it tough. the store has said you bought it, we cleared it, you're good to go.

week on the wall street markets shrugging off any leftover concerns over the government shutdown it seems. >> the dow gained 61 points on friday, up about a percent for the week and the s&p closed at an all-time high on friday, good news for your 401(k) and speaking of that, a new study found more and more americans could be entering their retirement years in the red. a firm called hello wallet looked at people who have already -- who already have accounts like 401(k)s. they found a majority in their 40s and 50s are still racking up debts when they should be focused on saving dough and retirement. which could mean a lower standard of living in your golden years. and jpmorgan has agreed to pay 5.1 billion, with a b, to settle claims that the bank and other firms it owned misled fannie mae and freddie mac about home loan securities it sold during the housing boom. this is part of a larger settlement expected to top $13

billion. and apple giving you two new choices if you're in the market for a tablet computer. this week it unveiled the lighter, thinner, faster ipad air. the tech giant has revamped its ipad mini. >> the changes come as apple faces increased competition in the tablet market and questions about its relevancy as customers looked at cheaper alternatives. apple downplays that threat but take a look at the numbers here. according to idc, apple's control of the tablet market dropped from 60% in 2012 to 32% right now. 50% drop. want to bring in c-net editor tim stevens. thank you so much. apple's ipad air may be thin and really fast but what about it is really new for consumers? >> really, there's not a lot that's honestly that new about it. it is faster and lighter and thinner, which are nice upgrades for sure. the biggest change is that it looks new. last year when apple introduced the fourth generation ipad it looked like the generation before which looked exactly like

the generation before it too. consumers looking for something truly new it was difficult to show off they bought a new tablet. we are seeing consumers resonate with things better that look new. i think that should help them to some degree. there isn't really any new functionality added here. the incle annual updates we've come to expect. >> is it an innovation issue for apple? i have my ipad here and i can't imagine giving it up at the moment for what i see out there. is it just increasingly difficult to innovate in this competitive world? >> tim cook has said that innovation is not about change, it's about improving quality and that's what apple has been focused on this year, increasing the quality of their devices and making them smaller and lighter and faster. there are a lot of consumers out there expecting things that are a little more different, radical, much larger devices or battery life stith the stylus or

other interesting functionality. that's what apple needs to look at next year, they try to capitalize on this increasingly growing market and try to catch up with the other competitors like samsung who are doing much more interesting things with their devices these days. >> remember, people at the same time, they're concerned about cost and are they going to get something new or some competitors out there that may give them a better price. what is apple possibly doing wrong here? >> apple has been focused on higher priced devices with high margins. they're ult patly offering these as pir rational devices that are quite a bit more expensive than the competition. you can get a great android tablet under $200. the cheapest ipad air is $500. they did lower the cost of the mini down to $299. that is great tablet but still, that's not really what apple is going for, the lower cost. they're trying to offer high-end devices that people want to spend more for. if that costs them a bit of

market share apple seems to be okay with that. they've done quite well in that regard. >> they still have a huge slice of the market for a single company and the 5c did not do very well, the iphone. what are other competitors out there bringing to the market? apple brought in the sexy products and everyone else seems to be running into the market. what is everybody else doing out there and who are their biggest competitors right now? >> samsung is the biggest competition for apple and samsung has seen incredible growth over the past several years and shipping three times as many smartphones as last year. what samsung is doing really well is offering a suite of devices that capitalize on the different market niches out there. there are cheap small devices, big devices for professionals, devices with great performance and with low cost and devices that hit every kind of niche in between those groups. so samsung has shown they're able to iterate very quickly. they launched a smart watch called the galaxy gear. it's not very good but within a few months samsung will have a

to say good-bye. calling hours will be held sunday night, her funeral will be held on monday. dan vers high school is shut down two days after ritzer's body was found in the woods off campus. students returning to class on friday say they found a very different place from the one they left on tuesday afternoon. >> yeah. pretty much just shock, you know. just trying to return to some sense of normalcy. >> did you know miss ritzer? >> yeah. i had her in class for a little bit. she's a real nice teacher. i think we all loved her. >> reporter: that was one danvers high school student speaking to cnn's pam brown. while the building is back open, a second floor bathroom will remain closed indefinitely where police say colleen ritzer died. her 14-year-old student philip chism has been charged with killing his teacher with a box cutter. >> i think people just have such a hard time wrapping their head

around the fact that a 14-year-old is charged with this. what do we know about him and what's next for this suspect? >> well, christie, right now he is behind bars. he's 14 years old. if a grand jury returns an indictment on a first or second-degree murder charge he will be tried as an adult. he's behind bars being held without bail. at the same time investigators are trying to learn a lot more about that is freshman student, a 14-year-old who had transferred to dan vers high school from a school in tennessee at the beginning of the year. at this point a source close to the investigation tells cnn that reports that chism may have had a crush on ritzer seem unfounded. prosecutors have not laid out a motive. they aren't required to. they're just required to present the evidence, but they will, of course, spend the next few weeks learning everything they can about this 14-year-old. >> my goodness, alexandria field, thank you so much for giving us the latest. we appreciate it. still to come on "new day" good news for pet lovers. detiles why the first time ever

well, good news for you pet owners out there. believe it or not, there are currently to regulations over the production of most animal food, but now for the very first time the fda is taking steps to make the food you give your

little buddies safer. cnn's rene marsh has more. >> reporter: christie and miguel, the food and drug administration is proposing new rules for companies that make dog and cat food. the rules would require the same methods that keep human foods safe like better sanitation. the goal, to protect animal foods from bacteria, chemicals and other contaminants. the head of the fda says the announcement, quote, addresses a critical part of the food system. if you remember earlier this week, the agency reported more than 3,000 pets may have gotten sick from jerky treats made in china and the u.s. right now, there are almost no rules on pet food safety, but the fda has issued multiple recalls in the past few years. just last year, a salmonella outbreak at a facility in south carolina led to a recall of 30,000 tons of dog food and cat food. 47 people across the country got sick from handling that food.

firefighters raced to save one of the most iconic stores this new york. a fire break out at macy's flagship stores. that sent smoke billowing into the store. macy's was evacuated. the fire was put out and no one was hurt. >> amazing pictures. new details in a sensational case. the 1996 murder of jonbenet ramsey. we have the story from boulder, colorado. good morning. >> the newly released documents show that a grand jury in 1999 voted to indict john and patsy ramsey in the death of their daughter. that never happened. dna evidence exonerated the family. now new information is raising more questions about what really happened the night jonbenet

died. it's a murder mystery that remains unsolved 17 years. who killed jonbenet ramsey? apparently a grand jury in 1999 believed her parents had something to do with the 6-year-old's death. a colorado judge just released previously sealed documents. four pages for a 1999 grand jury indictment. the document shows the grand jury voted to indict john and patsy on two counts. child abuse resulting in death and being an accessory to the murder. at the time the district attorney said there wasn't enough evidence. >> although the grand jury concluded probable cause, that's not anywhere close to this the same standard as beyond a reasonable doubt. >> all along the ramseys claimed an intruder killed their daughter. >> we think it was a pedophile. we think it was a male. >> they were eventually cleared by dna evidence.

the released documents for 199 were the product of a grand jury that did not have the benefit of the conclusive 2008 dna testing that led to the unequivocal public exoneration of the ramsey family boulder district attorney. er in lie two decades later the search for the killer continues. the dna evidence is still considered the biggest clue in the case. but no match has been found. the boulder police department confirms this is still an open investigation. but it's a cold case, meaning they are not actively investigate fg. they continue to receive tips but have not received a credible tip for a long time. christi? >> all right. thank you so much. in a couple of minutes i'm going the talk live with this man. the former lead investigator in the jonbenet ramsey murder case.

there is a killer on the loose. >> absolutely. >> i don't know who it is. i don't know if it's a he or a she. but if i were arrested in boulder, i would tell my friends to keep -- keep your babies close to you. there's someone out there. >> who could forget that? jonbenet ramsey's mother back in 1997. it's been almost 20 years since someone killed her daughter. newly released documents showed

they were going to indict her parents. again, back in 1996. no one has ever been charged in this case. but james is the former lead investigator of it. he's also the author of the book "foreign faction: who really kidnapped john jonbenet?" ? >> they had the same evidence police investigators considering at the time. based on their new documents about the indictments, it seems to me they berealieved the fami was involved in some fashion and decided to diet on the two charges considered. >> so we know the charges, child abuse resulting in death and accessory to the crime. what evidence was missing that

kept the d.a. from going forward? >> well, that's a very complicated question. i think there could have been a lot of things that could be considered missing from the d.a.'s perspective to be able to bring them to a threshold of prosecuting beyond a reasonable doubt. i think there's been a lot of discussion about the threshold for indictment in saying this probable cause that an officer would have for arresting someone. but they have a higher standard when they decide to prosecute someone for events. >> well, i know the attorney for jonbenet ramsey issued the following statement. this only serves to further defame him and his late wife. so a lot of people are saying why release the documents now? is it fair? >> it's an important miss of the history.

the grand jury considered evidence and decided to indict on two charged. the prosecuting attorney decided not to file two charges. the record stands there was sufficient grounds to arrest or at least charge and that's why they signed the indictment back in 1999. >> so what were in the other documents and why not release them all at this point? >> that's a question i think that everyone is asking. alex hunter at the full-time could have indicated that the grand jury did find -- on two charges. he chose not to do so for whatever reason. he could have indicated that perhaps he felt there were no sufficient grounds for him to prosecute. >> you know, number seven of the grand jury say they knew who did it but covered it up.

they looked at 30,000 pieces of ed. dozens of witnesses. 13 months. did you see evidence of a cover-up? >> i think it's extremely unlikely that an intruder was involved in the situation. what's frustrating for me is the dna evidence continues to be told proof that an intruder was involved. >> so who do you think was involved? >> i do not think an intruder was involved. there was more than one sample of dna that was discovered over the course of an investigation. touch dna that was done late in 2008 and 2009 revealed additional unknown, unidentified samples of dna. if you look into the totality, there are six unidentified

samples of dna. >> i believe this was warranted by investigating family? . >> there were three people in the home that eventing. investigators need to look at all three of them. >> do you think -- boy, at this point do you think this case is ever going to be solved? >> it's very unlikely, unless there's a confession or someone else comes forward that has information that has been shared with them. there is one other possible lead that i propose to the boulder police department and the d.a.'s office over the course of writing. and that was another grand jury inquiry. and calling for ramsey.

to get the answer by spying. saying everyone doesn't won't get us off the hook. on the other hand, countries need to understand the u.s. will do what it needs to do to protect itself. i don't particularly feel bad about that. >> what is most at risk after the fallout? >> what is most at risk is the transatlantic relationships, particularly with germany. germany is the key country in europe and we have to figure out a way to go to the germanss and say we apologize. you want to make them realize we recognize their concerns. we'll do something about it. and this won't happen again. >> and we know that france and other countries have a fairly aggressive spying operation, for at least industrial espionage in the u.s., and clearly it happens.

going to be stop twg the background checks are going to be criminal. the issue is more complicated than that. that is the people who benefit from the most from owning b guns are poor individuals who live in high crime urban areas. larly u minorities. and if you want to raise the cost of them getting guns by making it so they can't go to this gun shows or other ways, imposing taxes or fees, in many states it's hundreds of dollars or 500 plus dollars to go and get a gun in dc. you're basically. you're krpricing out of the market. the individuals who need it for self defense. unless you go and deal with the problems of the existing system, simply going and try to extend it to other ways that people go and buy guns is just going to disarm law-abiding citizens.

benefits for the different types of rule there is. everybody wants to stop criminals from getting guns. the problem is extending the current system before you get it fixed is almost going to entirely stop law-abiding good citizens who need the guns for self defense. >> not true. >> go and read the annual report. in 2010, the last year we have data for. there were 76,000 initial denials. of those 44 were prosecuted. 36 convictions. 36 out of 76,000. it's not because president obama is not trying to enforce the laws. those are false positives. when the president says 2 million prohibited people have been stopped from buying guns from background checks it's false. with the correct terminology should be is there are 2 million initial denials. like senator ted kennedy.
