ever. live in staten island, what is it like there now? >> reporter: well, christi, we're near the starting point. we're in the runner's village where 47,000 runners are getting ready for the race. you can see the way they are dressed it is a cold and windy morning in new york but not cutting down on excitement. remember, this race was cancelled last year because of super storm sandy and a lot of athletes had tried to complete the boston marathon but that race was cut short. the result is strong. this race is personal and here is how one of the runners put it when he spoke to us this morning. >> i wanted to come to new york, first, i want to honor the victims of the boston marathon and survivors and secondly, last year i came here to run the race and super storm sandy cancelled the race so i want to come back here and finish the business. >> reporter: bill with 47,000

other runners are subject to strict security measures this morning. it isn't cutting down on their enjoyment but they can't carry backpacks, water packs, no face mags ks and bulky costumes. just the reality of this race this year. victor, christi? >> alexander field there, the starting line of the new york city marathon. thank you for that. turning to another big story, new details this morning on how the attack at los angeles international airport went down. terminal three we know how reopened after friday's deadly shooting rampage. cnn yr nrks nrknn kyung has the >> reporter: prosecutors charged him with two felonies. murder of a federal officer and violence at an international airport. the details still being unravelled. investigators are still piecing together the tile line of what happened inside terminal three.

they don't know every step of paul ciancia's path but here is what they know. a roommate dropped him off here. he entered about 9:20 in the morning an entrance at terminal three. according to pictures like this one and surveillance video the gun was a two .23 caliber which ciancia concealed in a bag and approached hernandez standing there where those flowers are. this is a prescreening area and shot him point blank multiple times in the chest and got on this escalator. >> the defendant is allegeed to have begun walking away from the wounded tsa officers going up an escalator and then coming back down that escalator to return and shoot the wounded officer again. >> reporter: at the top of the escalat escalators is a security check point. at some point he wounded two and a passenger. this is the other side of the

sec cooersty check point from here the gunman made his way deep into terminal three. cell phone video captured the chaos as he neared the passenger gates. >> people were running and people getting knocked down and there was luggage everywhere and maham. >> reporter: we're speeding up this video to see the path as he wound through the terminal making his way to the goat. he had five-loaded magazine, a host of unspent ammo, enough, said the mayor of los angeles to kill everybody in this terminal. it ended around here when los angeles airport police shot the gunman, a handwritten note was found on him. >> we found a statement where he made a conscious decision to kill multiple tsa employees. he addressed them at one point in the letter and stated he wanted to quote instill fear into their traderous minds.

>> reporter: as the fbi works out the details of the murderous path the tsa is asking how in the post-9/11 era did a gunman make it this close to a passenger plane. >> this gives us great concern, so we'll look at what our policies are but it's all done in corporation with each airport police agency, and how we go about providing for the best possible security. >> reporter: because on this day in america's third busiest airport it failed to prevent one man with a gun from doing this. federal agents are also asking for the public's help, asking them to e-mail in any pictures or video of what happened inside this terminal at the fbi. christi, victor? >> thank you very much. let's talk about the suspect paul ciancia. he grew up in pennsville, new jersey and recently moved to l.a. he is 23. he attended an all-boys catholic

high school in wilmington, delaware between 2009 and 2008 and obtained ocho motorcycle mechanic certificate. his father owns a repair shop and he was unemployed. his mother died back in 2009 after battling multiple score row sis. >> he's the first line of officer to die in the line of duty. he joined in 2010 and leaves behind a grieving wife and two children. >> he was a wonderful husband, father, brother, son and friend. he would have been 40 next year. i'm fully devastated. we are all heart broken and we'll miss him dearly. >> two other tsa officers were shot in friday's rampage, as

well. they survived. airports in and around new york are stepping up security following the deadly shooting at lax. new york's port authority tells cnn it increased at jfk, laguardia and new york airports and local check points, as well. a spokesperson says this should not affect flight operations but passengers be sure to check with your airline for any delays just to be on the safe side. >> yeah, we saw some photographs of people passing through tsa at lax hugging the tsa officers trying to comfort them. moments of healing. we also saw beautiful moments at the red sox victory parade this weekend. >> it's something. you got to see the moving scene. i mean, people were just brought to tears at the finish line of the boston marathon. >> yeah, plus, he's known for helping boost the careers for stars like harrison ford, but now best-selling author scott toro is out with the latest novel. >> and he'll tell us about it

>> it is. and i think that probably helps with the laying of clues and red hairings because i'm fooling myself at the same time. >> how long does it take you to write -- >> usually three years between novels. i can't be as efficient as some of the other people who write in this genra that get them out every six months. >> and you're still a lawyer, right? >> yeah, i'm a partner -- >> that would have something to do with time needed. i know power and money are big themes in "identical". >> yes. >> what attracts you there, as well? >> there is a political race at the center of "identical." you want write about politics without money these days and the influence of money and how far a motivated billionaire can go to sort of alter a political campaign. these are themes there but it's not a political soapbox. it's a novel. >> i want to say

birth control. part of the court decision saying quote, they can eater abide by the sacred tenants of their faith, pay a penalty of over $14 million and cripple the companies they spent a lifetime building or become come police sant in a grave moral wrong. they were in the catholic faith. a company cannot have religious believes but the court said that the suit could go forward in this 2-1 decision, so this may be another tick mark on the wall, if you will of striking down part of the affordable care act. >> i know this isn't the only one. i mean, i know dozens of lawsuits are working their way through the courts across the country right now. how do you foresee this one sorting itself out? >> that's the point. by some counts there are some 75

federal lawsuits around the country, three appeals pending at the supreme court and no word when the high court might rule. this is another indicator of some of the legal thinking about all of this but with so many suits it looks very likely like it will be up to the supreme court potentially to take on this issue. christi, victor? >> good to see you and thank you for taking the time with us today on the obama decision. we appreciate it, barbara. here is a question to consider, could town leaders be able to resite a prayer before public meeting? the supreme court hears arguments on the case this week and the debate is certainly heating up. we'll continue to debate. your watching "new day sunday ". court christi just mentioned. at issues are prayers like this one recorded at a town hall meeting in greece, new york. >> jesus christ who took away the sins of the world, destroyed our death through his dying and in his rising, he has restored our life, bless it are you who has raked up the lord jesus. >> two women took the issue to court saying the town unfairly referred christian prayers and the prayers are unconstitutional pro meeting specific believes. a u.s. appeals court sicited unanimously with them. joining us are our two guests. i want to start with you pastor jeffers. good morning to both of you. you say, pastor, if the court sides with the women, it could have a huge impact on religious

freedoms. their claim, their hope is that that type of prayer would not come during a meeting. how would this affect religious freedoms so broadly? >> well, victor, first of all, it's interesting the obama administration is siding with the side of greece, new york along with half the states and 85 congressmen. the issue is what role should government play in regulating the content of prayers and the answer is absolutely none according to the constitution. the contusion simply says in the first amendment that congress is not establish a state religion. it has absolutely nothing to say in the first amendment about the prayers of the city counsel meeting. back in 1983 the supreme court already sanctioned what are call called legislative prayers but act protecting religious liberty not restricting and trying to muzzle the content of prayers.

>> yes but in 1984 there was lynch versus donnelly that says if there is anything perceived by reasonable person to endorse or dismiss religion its invalid. that prayer started with jesus christ, that would be something in a public meeting that i assume some would say endorse religion. >> well, i actually pray that way in our city counsel meetings when i'm asked to pray. remember, the founding fathers victor said congress cannot establish a religion. sandra day o'connor came with this test. they talked about establishing a state religion look. the first amend the is not about guaranteeing people from having hurt feelings, it's about guaranteeing religious liberty. words mean something. the constitution says establish, not endorse and i believe the supreme court will clarify that in this decision. >> let's bring amanda in.

the pastor brings up a point, the obama administration cited with them saying prayer is protected. you say that's wrong. >> i do. i think that no one is trying to regulate the content so much. we shouldn't even be having prayer at all for government meetings. >> no, that's not right. >> sir, you had your chance, plaets please let me have mine. the point is if you're going to need religion to do your job, do it before the government meeting starts, then anybody is infri e infringing on anyone. if you feel you need prayer before your job, do it before the meeting. if you're going to do this government prayer whether city counsel or in the house of representatives or the senate, then you need to open it up to everyone and one of the points the third circuit made, the town is not just religious institutions but individuals. you cannot discriminate but do it for everyone. so that means letting everybody

in so atheist or jus or wickens, even gets their version of prayer and we're not seeing that. when christians are challenged whether it's hindus in the u.s. senate who want to offer prayer or for example, this year in arizona when representative juan mendez gave a secular vocation, we see christians challenging that saying it needs to be god only that gets recognition in front of legislation. >> amanda -- >> victor -- >> go ahead. >> victor, it's important to point out in new york everyone was allowed to pray -- >> no, they weren't -- there was no public -- there was no public affirmation of it. they went through the phone book -- >> yes there was. >> -- to find the christian churches. >> i'm very comfortable -- >> everyone is welcome. they only said that after -- >> look, i am very comfortable with everyone having an opportunity to pray, whether it's people of the jewish faith.

i'm against government controlling the regulation and content of that prayer. the first amendment we need to return to simply says we cannot establish a state church, nobody is suggesting that we ought to be establishing a state church. this is about protecting religious freedom, not about -- >> religious freedom belongs to the individual and not government endorsed prayer and what we need to do is not have government prayers at all. government endorsing means if a reasonable person would have sat in on grease for more than ten years, it was more than christian prayer. so a religious person think the plaques they gave and the clergy that gave the prayers in greece, of course they thought it was christians and the only listings -- >> pastor jeffers? >> 90% -- >> last word. >> 90% of the residents of grease are christian did. >> not a town of christian institutions. you're a town of residents. >> it was open for anyone -- >> everybody -- >> and what --
