doesn't it concern you -- >> certainly i'm glad i'm a california. in california we definitely adopted obama care. let's make this work. we have an insurance commissioner. i actually went into covered california. get what, it's just a dollar different than what i would get in california, unfortunately i'm being forced into d.c.'s exchange, when i didn't know, but that's what obm, or whoever the personnel office decided for us. by the way, the aca, the obama care law actually grandfathered people like that to be able to keep them.

it didn't grandfather what companies could charge you for that policy. in the last three years i've seen the policies try to do 34% increases a years, 43% increases, 23% increases per year. i was the first one to sent a letter to them, to call them in, to talk to blue cross blue shield and say, listen, these are unacceptable. >> to make sure -- >> they have going to increase any of. the policies those people have -- >> just one question -- what happens if somebody ends up in january 5th in the hospital thinks they have count, don't have coverage. do they sue the federal government? i mean, when you have a big gap of a million lost policies, and

federal government is saying i'm going to find you and punish you. in my stays we've had thousands of people. because of the artable care act, it's not just individuals, but companies as well. they've got 1500 small businesses that get their health kay through this group set. that's no longer legal. it's now legal for chambers of commerce all over the country to actually help provide small businesses a way to get insurance. all of those are out. this is not some little plan i asked directly, but todd park, who's lating this could not answer me whether by the 15th of december they'll have the web side ready.

you know that, we know that, we're trying to bend that line. unfortunately, you know, your governor used to be a colleague of ours, so it's sad that your legislature and/or your governor, however it works decided not to put up their own exchange. now it gets pushed to the fed. there's a lot of people who are sort of dragging their family, not wanting this to work at all. i agree with you, this website should have worked correctly. no doubt about it. >> let me say one thing on it. i have to agree. it's basic oversight. when there's something in government that doesn't work as promised, we could do oversight. if you spend $600 million to create a website and it doesn't work, i think we should ask the basic question.

polls since the obomba carrollout show kay hagen, who's up for reelection and vulnerable next year, losing ground dramatically. so i think this is one of these, don't you have a sense that the pressure is growing to find some answer to this? >> well, again, i'll begin by saying this web side or whatever, there's no reason, if you know it's coming up in three years to nod have you had that done correctly. i get angry when an amazon website freezes up, you know, when an airline web side freezes up so people have a right to be angry, and we need to fix it. my convex is how -- will it be done right? can el get what i need? that's what we want. when you're saying, you know, should we stop the mandate?

it depends on whether we can get it up and running. >> let me ask one thing, which is -- there's a scale of the -- coming out of the glory days when the government shutdown put the republicans in a hole. the latest shows that the democrats have lost nine percentage points. doesn't this indicate what some of the pressure will be on friday for incumbents looking around say if this goes on for another month or two, and you end up with a couple who had insurance? december, i think that's why it has the potential to -- would you vote against upton? >> i -- i'm leaning to vote against it. i really do believe -- you've seen it in my district. i've worked so hard, newt, to get it right in my district, to

talk to them, go door to door, working, we've got extra funds from the california endowment fund to make sure we get this out. remember, in my district, 1 out of 3 people have no insurance. most people don't realize it. you guys are guys, you don't realize that. women over 50 in particular, but women. women there's sufficient a differential for the same age of a man and a woman to get insurance. a woman is 3 to 5 times higher premium. only because she's a woman. so there are great things, you believe, in the aca that we need to do. aca levels off, no bias. >> and if you pass the upton bit. if the house passes the upton bill, which it's not clear there would be democratic support. it's also not clear that some conservatives will go along. but on the specifics of the upton bill, allows insurance companies to keep offering some of those shell plans that

they've been offering before obama care passed. it means women can get charged more, it means it can discriminate against you for coverage based on preexisting conditions, all of these things, those are the plans that you're going to allow insurance companies to go back to. >> in oklahoma city, just in my area, that there are people who were involved in. >> if you pass upton, the premiums will go up. >> that's a fascinating -- wait, wait. that's a fascinating spin. i there was a president that used to say premiums would go down. >> most people they did. as soon as the website starts

working. >> here's the issue, hopefully -- but the problem is the reality of what we're dealing with right now. i can take you to thousands of people in my district contacting my office saying this is what my premium was, this is two times higher. >> and they're not getting subsidie subsidies, and are youing -- >> i'm well aware. >> and all people in your district are getting a better deal? >> we are hearing that some of those people were -- in our state plan before that are now being told that plan is being phased out. you have to switch over. some of those individuals are saying i liked this, the state was resolving this, i don't know who my doctors will be now, i don't know where i'm going to go for hops. for people in rural districts, some of the locations they have to go now are 50, 60, 70 miles away. they're now being told no. that's not right for the people.

that's my answer. >> you're making a very interesting point, but i don't think it's the point you intended. you're saying california is okay, because they have their website. oklahoma made the mistake of relying on the federal government -- now, wait a second. the federal from the time they passed the bill to today is actually a month longer than the united states and world war ii. from pearl harbor to the defeat of italy, germany and japan, took us a month less than it has taken them to fail to put up a website. and i'm telling average americans, if i watched a government in the age of amazon and craigslist and ebay and all the stuff, if i watched a government that couldn't even put up a website. >> i agree with my colleague, this website thing is unbelievable. and a lot of my colleagues on my side are saying that. but we have a date certain where

we want people to be insured. i voted for this law because i want people to have insurance and i want insurance that works. these other policies, these individual policies, several things happen. you have such a high deductible. they're catastrophic. you end up paying out of your own pocket. you don't have a capped amount for the annual. your preexisting condition, don't even get one unless you're a woman over 50. believe me they won't sell you one of those unless i think $1,500 or $1,600. when you get sick, guess what happens with that policy. you come walking through my front door and you say, i got cancer, congresswoman sanchez and now they tell me they don't want to cover me. and i have to deal with the problem. i have to push that insurance company to say what do you mean? explain to me exactly where that wouldn't be in this policy. i have to push them, i have to push them, i have to push them. the kinds of policies we want where people understand. they are standardized because people understand what they're

going to get. there is not going to be this, i'm not going to cover you anymore. there's not going to be you're a woman, xegt it. you're a preexisting condition because you could have babies. if you cannot have babies, you other hormonal. apparently i do support that. now as man i have to have coverage that gives me maternity coverage. the challenge of this is, now just pushing you into a centralized plan that's determined by the federal government. now americans are beginning to see when a central government will take care of all 300 million people and say come to us and we'll take care of this. we see the beginning phase of what health care will look like for decades now. not just the website. it will be every decision made on health care in the days ahead will be this low, this difficult and everyone yelling. >> help us. don't keep pushing back. don't keep -- >> after the break, it is an excellent discussion. i would love to dive in. so stay here. we're going to find something that we can all agree on.

particularly you two. so i'll leave it to you. is there anything you can agree on in. >> there are some issues we were talking about on the break. if the website isn't fixed by december 15th, we have to have something happen. we have 5 million people that will be without insurance come january 1st. diabetes patients, cancer patients that have insurance through their employer or the individual market that are getting cancellations notices and they won't have it. if there is not a way to get insurance, we'd better have an extension starting january 1 and some way to protect them. >> i believe that's true. i think the webb is the number one way for these people to sign up. if we can get that right we would look at extensions. or we might say okay, we'll have to do more one-on-one type stuff. i'm sure james would cough up some money for us to hire some people to go out and get to his people and say, listen, you lost your plan. let's figure out where you have to be. he doesn't want his people who received this paperwork to be out in the cold and be without
