petersons with a check of the forecast. >> we have one day with a breather but by this morning you are seeing on the current radar snow already falling around philly. we are a few hours away from new york city to start seeing some of that snow fall. eventually we will start seeing snow pretty much from the northeast really back all the way through new england and even the mid-atlantic. so that is the story today. you can see that winter threat extending pretty much along that immediate coastline there as the low is expected to form today. as far as amounts, around new york city, around boston now up to a little bit more from yesterday and looking for maybe as much as 2 to 4 inches. a pretty good system will be out there farther to the north around portland we could see as much as 6 to 9 inches of snow. pretty good storm maker is out there and we will talk about the timing a little bit. you can see this morning as we start to see it especially during the morning commute hours making its way into the city here. then by the afternoon, especially late afternoon, look at new england. we are starring to see the snow coming down and impacting everyone. think about your commute home tonight that could be a problem for a lot of people out there.

behind that, we are actually looking for when does the low form? this is key. where it forms means who is going to get more snow and how much snow they are going to get based on the position so we have to watch that through tonight and tomorrow if boston gets more than it's expecting or maine gets dumped on so it's up in the air a little bit. >> but a lousy commute home? >> yeah, not good. the latest developments involving the nsa phone surveillance programs. president obama is meeting today with executives of eight high tech companies who called for changes and how the government spies on phone and e-mail records. this comes a day after a federal judge declared that part of the nsa's programs are likely unconstitutional. this judge saying that collecting phone records like the nsa does probably violates the fourth amendment protections against unreasonable searches and seizures. the judge with harsh language called the program almost or -- in its scope and he also said the founding fathers would be

aghast and writing the government can't cite a single case where the nsa surveillance actually stopped a terror attack. the journalist glen greenwald said in his words that it's further proof that the american people needed to know what the nsa was doing. >> the nsa screams the word terrorism to scare people but there is no evidence. say the people in the know, this court, people on the intelligence committee, that these programs actually stop terrorist plots. >> edward snowden who leaked a lot of those documents to greenwald as he stole the documents, of course, said the ruling justifies what he did, writing i acted on my belief that the nsa's mass surveillance programs would not withstand a constitutional challenge. the secret program authorized by a secret was exposed to the light of day found to violate americans rights.

this bill and seemingly giving it more than enough votes to pass. a key vote is scheduled for ooed. the department of homeland security has a new leader. jay johnson will become the secretary taking over two months after janet napolitano left to become the head of university of california. johnson is a former federal prosecutor and the vote in his favor was pretty overwhelming. 78-16. the family of a missing former fbi agent robert levinson is renewing its calls for a meeting with the head of the fbi. levinson disappeared on a trip to iran in 2007. but new revelations published last week show he was working as a cia contractor. the family says fbi director has repeatedly delayed meeting with them. a law enforcement official telling cnn the bureau is hoping to arrange a sit-down with eleveninson's family soon. the pentagon's top sexual assault prevention officer is stepping down.

koreans with missile testing? >> the police are on high alert and expecting further provocations and something south korea does when there are times they must prove their might. the americans have come out and said exactly the same thing, that they are expecting a nuclear test or a rocket launch in the coming weeks, if not months. this is of grave concern. we know north korea wants to expand its nuclear program and will do whatever it takes to make that happen. you have to a couple of months ago when north korea was threatening to rain fire. we know what is coming is there will be real stability here on the peninsula in the coming months, john. >> anna koren for us on on the peninsula clearly a tense

investigating claims that the was made being involved the special forces involved in this accident where she died was interesting in itself. but they have had unprecedented access to all of the paper work, they say, and there is no credible evidence that the sas was involved in the death of diana or dodi fayed saying it's a drunken driver and paparazzi here. they are knocking it down and it knocked down one of the main conspiracy theories that are out there around diana's death. this is a story never been really laid to rest. a huge frustration to the royal family, of course. they will be pleased that at least the metropolitan police saying nothing in there at all. >> does it put the conspiracy theories to rest? sometimes you get a final conclusion and it doesn't put it out of the minds of people who want to think something else

happened. >> no. among other things them is mohammed fayed, dodi's father who thinks there is more to this. his latest comment this was the latest whitewash in a 16-year cover-up. he says he is disappointed but not discouraged so he is going to continue to try to prove there was something behind all of this. but really it was -- if if you look at the way the story started it was always questionable because a newspaper found out that the allegation came from the family of an estranged wife of a former sas soldier. so it was never that credible, but credible enough to look into. so at least it allows those who think there was conspiracy to have some reassurance that it was just an accident. >> max foster, thank you. a lot of people asking could this be the end now for antibacterial soap? the fda is proposing for the first time that companies that make antibacterial soaps and

body washes have to prove their product is safe for long-term use and more effective than plain old soap and water. the agency saying there is some evidence that using them could actually cause health risks. >> there were more and more studies showing that these soaps were not more effective than regular soap and water. so it was one of those things that we kind of dub our stupid uses of a chemical if it's not doing any good, then why we put putting this potentially harmful chemical in our homes? >> some 2,000 products contain the antibacterial agent but it the study did not cover wipes or hand sanitizers. former university president of university of pennsylvania and two others face criminal charges that they lied to
