"early start" begins now. why some say the international spying agency is ripe for abuse. a diplomatic disaster on two continents this morning. a diplomat arrested and strip-searched here so was she mistreated or does she think she is above the law? the latest as the white house tries to calm there this morning. dennis rodman returning to career after a family feud shook

up the country's government. we are live. >> i'm john berman. >> i'm christine romans. it is 5:00 a.m. in the east. the startling advice being given to the white house over the nsa spying programs. that advice -- stop it, at least stop doing it like you are. a panel of outside experts hand-picked by the white house is urging the president to rein in the nsa's wide ranging data dragnet and restructure how the nsa is collecting logs of phone calls. all told, 46 recommendations in their report. chief national security correspondent jim sciutto has a look at what the panel said and the potential impact. >> reporter: the headline here is one of the panel members told me is accountability and that is accountability for the nsa to congress, to the white house, and to the public. you see that reflected in these 46 recommendations. for instance, they recommend that congress pass legislation to move all of that phone data

from the nsa's hands back to the phone companies to private hands where the nsa can access it when they need to, but they don't hold it all the time. in terms of the white house, they recommend that at the highest there level there must be improolve when the nsa is listening to the conversations of foreign leaders. you remember the outrage when it was discovered that the nsa was listening to angela merkel's conversations in germany. in terms of the american public a number of recommendations. one of them the nsa should be had heed next time by a civilian and send the message not as a military leader running it but a civilian there is more public oversight and the nsa restate its mission which is collect foreign intelligence on foreign targets so refocus there so not this impression they are listening to americans calls. now, the issue here is, though, the president doesn't have to take all of these recommendations. he will look at them now' decides which ones he wants to take and doesn't. a senior administration official told me he will look at them and

make hig decision probably by january but we already know one of the recommendations he has not accepted and that is from this panel they recommended that the nsa be split from the military cybercommand. the white house has already rejected that one. that said, the senior administration official told me the white house is aware, they have a trust gap here with the american public but also the foreign public and they want to address that. the president is going to really listen to these recommendations, make some changes and i'm told it's likely in january he is going to make a speech to the american public explaining his decision. john and christine? on wall street that taper tragedy, token taper as one of my sources calling it. ben bernanke saying the federal reserve would reel back its bond buying program by only slightly by $10 billion a month and assuring investigators the fed was in no hurry rate to raise the interest rates down the road. the best of both worlds for stocks. the fed with a lot of stimulus

in the system and acknowledging the economy is strong and european markets rising this morning in london, frankfurt. if you look at the big picture, yesterday's rally was even more impressive. the dow up 23% and the nasdaq up 15%. it was ben bernanke's last fed press conference. his term expires at the end of january. it's fitting he is also at the helm from the fed pulls back ever so slightly. >> our modest reduction reflects the committee's believe that toward the economic justice will be sustained. we will likely reduce the base of securities purchases in

further measured steps at future meetings. >> what has helped bernanke? the job market is improving and housing in the midst of a big rebound. auto sales are strong. for consumers the fed news means mortgage rates and car loans will likely go up gradual. that is a reason for a token taper. savings rates will go up too. the best thing a growing economy is good for job and income prospects. >> they seem to hit the sweet spot there. a lot of concern and worry but they seemed to nail it. >> nobody knew how you would withdrawal that $4 trillion. we have never done this before so it is unchartered territory. >> probably makes janet yellin's job easier. >> it does. >> all that is needed now is

president obama's significant. the senate proofito avoid a shu next year. nine senate republicans joined every single democrat to get this done. the bipartisan deal negotiated by republican congressman paul ryan and democratic senator patty murray eliminates some of the spending cuts and reducing the deficit by more than 20 billion over a long period of time. prisoners at guantanamo bay may be heading back to the country they came from. a deal to lift most of the restrictions on transferring detainees over overseas and a final passage of a bill in the senate this week and seen as a victory for president obama in his bid to shut down the prison. max balkus would take over a role of growing tension between the two countries following the recent dispute with japan over

air space rights. balkus has sevened in the senate since 1987 and he has not commented on the nomination. balkus was set to retire from the senate next year and could boost democrat's chances of keeping that seat though a tough hold for the democrats. senator baucus has been krit critical lately about the obamacare rollout. >> that is one of the most important jobs, i think. secretary of state john kerry is trying to calm the fury over new york over the arrest of khobragade who was taken into custody last week and charged with visa fraud and paying her housekeeper a fraction of the minimum wage. her lawyer told piers morgan police we wanted too far. >> she was handcuffed and put in

a cell with other people and treated like an ordinary u.s. citizen charged with the trim. the fact she is not an ordinary u.s. citizen but a diplomat with immunity and shouldn't have been treated this way. >> reported to us standard procedures were followed but we recognize this is a sensitive issue in india, we are continuing to review exactly what happened in this case. >> the u.s. attorney in new york says khobragade was given additional courtesies and said she was allowed to make multiple phone calls. india's foreign minister is pledging to bring khobragade back to india, in his words, restore her dignity. >> hugely sensitive between the two countries right now. it is 8 minutes after the hour. here is indra petersons with a check on the forecast. >> it is slowly getting better a couple of days. we are going to track a couple of systems. everything comes from the west. notice we see a system from the west make its way across to the midwest and then eventually over

so why the sudden change of heart? who could be relieved? we're live. welcome back to "early start." i'm christine romans. >> i'm john berman. new pressure on the nsa this morning after a panel of outside experts hand-picked by the white house has told the president enough is enough. the spy agency they say should not have blanket authority to gather up phone records. and should make internal changes as well. chief national security correspondent jim sciutto has been looking into the recommendations. for the white house, they recommend that whenever the nsa is listening to the conversations of foreign leaders that the white house give approve right up to the president. for the public, a series of

recommendations. one being they want the next head of the nsa to be a civilian, that that would send a good message but also that the nsa restate its mission as it should have been which is to focus on foreign intelligence on foreign targets. now, the president doesn't have to accept these recommendations. he says he will look at them, pick the ones he wants to follow but i am told by a senior administration official they know they have a trust gap here both that the american public and foreign public and that in january it's likely the president will make a speech explaining what restraints they are going to put the nsa under going forward. >> our thanks to jim for that report. 32 minutes after the hour. the senate giving final approval to a bipartisan government deal -- while the debt ceiling limit could be hit and not shut down technical. the next stop for the budget is on his desk and he is expected to sign the deal.

>> today we are talking about new york city, 42. how does 69 degrees sound by the end of the weekend? probably a lot better. that is going to be the trend all up and down the east coast. 61 in atlanta and 72 by saturday. but it's not all sunshine. there is a little key there. watching a couple of storms make their way across. first one today watching it go into the midwest where overnight tonight from wisconsin through st. louis we could see some icing so freezing rain advisories are currently up and then it goes over the lakes and shifts into rain by the northeast by friday. so tomorrow. a new is a little bit stronger. remember i showed you how warm it is expected to be in the southeast? you combine that with the cool system moving across and we have a severe weather threat. the southeast heavy rain and isolated tornadoes cannot be be ruled out and that shifts into the carolinas back into florida for sunday and not the only story because you have that huge temperature contrast between the southeast and the northeast so for the northeast, it does mean the threat for icing as we go through the weekend as well.

police say perry's death is not considered suspicious. he has been ordered to stay away from campus. a harvard yuvert campus sophomore is said to be behind a bomb scare that all but shut harvard down. he is accused of e-mailing a threat to police and a claiming explosives were in four buildings. no explosives were found. they say kim did it to get out of taking a final exam. his lawyer calls kim remorseful and shattered. >> a 27-year-old man under krshl pressure. that much is clear. >> kim will live with his sister in the boston area and faces up to five years in convicted. big sur wildfire is 74% contained and a big improvement. the blaze has scorched 800 acres

and destroyed nearly two dozen homes and other structures. some of the passengers on a bus in seattle took matters into their own hands when a gunman stormed. this video surveillance shows a man pointing a gun out and robbed two people. when he pointed his gun at another person, it was too much. one of the passengers was robbed. and fought back. says they all did what they had to do. >> he came up to me and stuck the gun to me and took my phone. it was one of those things no one gave any thought to it once things started happening. >> the accused robber is a 19-year-old with no past criminal history and in custody and could face 15 years in prison. brave passengers. >> wow. imagine watching that unfold. imagine being strand odd a plane for five hours. that's what passengers at boston

logan airport say. five hours, two hours morning federal rules allow. the flight was supposed to be headed to frankfurt but caught in tuesday's snowstorm and those on board said the crew did little to make them comfortable. >> we boarded the flight at 3:30, came back at 9:00. >> told we can't put our seat back and can't use our cell phones, we can go to bathroom for emergencies but we can't loiter in the aisles. >> they offered us a little pacific cup of water and one little bag of goldfish crackers in the shape of airplanes. >> the plane was eventually brought back to the gate but passengers say it took another four hours to get their bags back. the agency that runs logan airport says it only accounts for about half of the five-hour delay and two and a half hours because of a broken snowplow. they were given a voucher for a hotel room. >> the goldfish in the shape of airplanes probably not enough. >> i spent eight hours on a plane one time before these new

rules were in effect. i was so thankful i did not have a baby with me. >> did you have a goldfish in the shape of airplanes? >> i had nothing but i didn't have a baby with me that was key. if you had a baby with you, that would be worse than hell! >> he is a reality tv show star but this morning, he is under fire for some comments that he made about african-americans and gays. phil robertson seemed to equate being gay with prostitution and he suggested that blacks in louisiana were happier under jim crow than they are now. robertson has been put on hiatus from the show and saying i would never treat anyone with disrespect just because they are different from me. we are all created by the almighty and, like him, i love all of humanity. in new york a man and dog will stay together after both tumbled on to the subway tracks and remarkably they survived.

cecil williams was worried he would have to give up orlando when the dog retires next year but they have received enough donations to ensure that orlando's needs will be taken care of and he can live on his life as a pet and williams will get another guide dog to replace him. williams praised his dog for helping him stay calm when a train was barreling in on him. >> angels i believe are here and that is what saved me. orlando is my best buddy. he's my pal. when we fell over, you know, he stayed down with me and licking my face and he was doing some things, you know, but he was there for me and always watching out for me and always looking for me. >> the train rolled over the top of both of them and both are okay williams only suffered minor injuries during that fall. >> that who whole thing is a
