technology they're hearing. a big wow on that one. good morning, everybody. welcome for "early start." i'm john berman. >> and i'm christine romans halfway through the week. 5:00 a.m. in the east. this morning, we're seeing dramatic new video which raises questions about what firefighters did after the deadly crash of asiana flight last summer. the video is from a helmet cam and a fire truck and it shows crews responding to the crash and directing trucks around the victim who is on the runway. the coroner said the 16 was lying on the runway but later died. it shows clearly from the video that there was someone on the ground. >> whoa, whoa, whoa, stop, stop. that's a body right -- there's a body right there. >> all right. right in front of you. >> the family of the victim is suing the city claiming the fire

crews were reckless. san francisco's fire chief said that the firefighters had to make difficult decisions. now to new developments to a shooting at a new mexico school this happened in roswell when police say a 12-year-old opens fire seriously wounding two classmates. and this morning, investigators are asking did the boy warn others about what he was planning? miguel marquez has the latest. >> reporter: christine, john, it has happened again. a 13-year-old girl identified as kendall saunders is in stable condition according to one authority. she was hit in the right shoulder. an 11-year-old boy doing much worse, in two surgeries now and still in critical condition. he suffered wounds to both his neck and face. authorities saying that at 7:30 in the morning at berrendo middle school in roswell, new mexico. the 12-year-old shooter walked into the gymnasium with a

shotgun, a .20 gauge shotgun with the stock of it sawed off. that's a smaller caliber shotgun than, say, a.12-gauge shotgun. a quick-thinking teacher stepped up during the shooting. police say his back was to the shooter. he turned as another round went off an walked towards the shooter. literally as the shooter was bearing down on him ordered him to put the gun down. the kid did. and an off-duty police officer came along and helped subdue the shooter. investigators are looking into the possibility that some students at berrendo middle school may have known this was happening. in other words, the shooter may have tipped some kids that this was going down. why it is they wouldn't say anything isn't clear. it's one thing that versuses are look into. and prosecutors are now considering how to charge a

12-year-old boy. christine, john. >> my thanks to miguel for that story. new revelations about the nsa and its spying program. still new revelations. i know it's hard to believe. "the new york times" says the agency has now implanted software and installed hardware in thousands of computers around the world. and the technology allows it to access machines even if not connected to the internet. the computers reportedly can be used to launch cyberattacks, but there's no evidence that any in the united states were altered that after the senate has been talking about spying a lot lately and whether the nsa program should continue. members making their argument that the nsa needs to be reformed. many senators agreed. >> this phone record program is not uniquely valuable enough to justify a massive intrusion on americans' privacy. >> president obama is set to make a decision about the future of the nsa spying programs by friday. meanwhile, nsa leaker edward

snowden has a new role this morning. as a member of the board of the freedom of press foundation. that group was founded by daniel elsberg who famously leaked the pentagon papers during the world war ii war. we could find out more about who knew what in the scandal over the closure of lanes on the george washington bridge. the port authority of new york and new jersey which indicates the bridge is set today to answer questions from the senate transportation committee about the closure now linked to two top aides to new jersey governor chris christie. christie, for his part, did address the scandal during, again, his state of the state address, saying his administration let the people of new jersey down. >> i'm the government. and i'm ultimately responsible for all that happens on my watch, both good and bad. without a doubt, we will

cooperate with all appropriate inquiries to ensure that this breach of trust does not happen again. >> state lawmakers are ramping up their investigation into the lane closure, and whether christie may have lied when he said he knew nothing about it. this as a federal probe is looking into whether christie misused a tourism ad campaign featuring his family. happening today in washington, big vote in the house on that huge 1. $1 trillion spending bill to fund spending into october. the senate house is expected to pass this big deal and the senate is expected to do that by the end of the week averting another government shutdown. hope is fading again for the 1.3 million americans who have lost their unemployment checks. the senate could not reach a deal to start sending the checks again. it failed. the senate could revisit the

proposal, but the soonest that would happen is by the end of the month. all right. it was the best day of the year for stocks on tuesday. it's been a short year so far. and the momentum looks like it's carrying over to u.s. stock futures and across the world. the dow gained 115 points breaking that four-session losing streak. the nasdaq and s&p 500 each up 4%. in europe, markets in london, frankfurt, paris, all moving higher. stocks in tokyo closed after gain after a selloff on tuesday. apple stocks up 1.4%. apple shares up. iphone set to begin selling to china mobile. china mobile's chairman said there's already been strong demand in china for iphone orders. he as said the deal won't be limited to just hand sets according to "the wall street journal." it includes broad cooperation with the two. no details how broad that is. watch for apple today. breaking news right now.

secretary of state john kerry has now pledged $380 million to help those displaced by the war in syria. he's in kuwait to meet with international leaders including the u.n. secretary-general. that as the defense minister is issuing a big apology for what he said about the secretary of state. moshe had seriously criticized kerry for what he called, quote, misplaced obsession and furor over the peace attempts. president obama heading to north carolina saying he's committed to the economic recovery and saying it's all hands on deck. the president is expected to talk about a manufacturing hub in that state that he says san example of a private partnership that can help grow the economy and create, you know, good-paying jobs. >> that will be welcome news for a lot of people in this country.

let's get a check at the forecast, indra petersons is here. >> good morning. kind of rainy, that system is moving out of here and we're dealing with a couple more systems heading on in. let's take a look at the radar system and you can actually see the remnants of the system well offshore. but we know there are a couple behind it. so light, though. these are clippers coming canada, typically a very light moisture start. either way, we're going to walk you through them one by one, hearings the cloudy conditions as it makes its way through the evening hours to the east coast today. you look at all the rain, see the coastline, the rain, it is offshore. so for now, the forecast really just calling for cloudy conditions, but then there's another front behind it. yeah, temperatures will drop a little bit and then the next front making its way through. and notice how how this front is in canada. very moisture start a little snow coming across the great lakes. through the week, late friday,

he was the security guard at the westgate mall and he was one of the first people there as the wave of attackers came in. the four men, as you said are being accused of that attack. but partially accused of being part of the broader network of that attack. and the worry is this is the only authority brought into kenya network. and this authority is believed to be only in kenya but across the border in the north african region. nearly four months, the fact that these are the first four we're seeing in court, many of our security forces from the u.s. and uk, have been waiting with us an issue of some concern to them, john. >> there seems to be some series of discrepancies. there are authorities that say the attackers were killed at the mall. and many here at the u.s. believe they got away completely. so exactly what is the connection of these four men who are on trial today? >> reporter: well, the four men, two of whom were found to have

illegal kenyan documentation. they are from somalia. they had in their possession kenyan i.d. that's one of the charge that's kenyan authorities believe will stick. but the broader charges about the connection of those gunmen carried out in the attack, these are things that the kenyan authorities still haven't gimp us the sense that they have the proof to make stick. and as you said, these discrepancies, the nypd in an earlier report said they believe some men escaped. the fbi has said that they believe from the kenyan authorities that the four died in the attack. from what they know, based on what our team saw, that crime scene was not secured. that first day at that westgate mall, people were able to go right into that building. there was never a sense that there was any kind of alarm there. i find it hard to believe that anyone categorically can say that no one escaped.

it was just disarray. panic, terror, never a sense that the kenyan authorities had it under control. and the fbi also says they believe this would be a propaganda for al shabaab network implicated in this that woo come out and say we pulled this off and our guys escaped. no one, not the nypd, not the kenyan authorities have put together an argument that any more of the men involved in this. hopefully, that's what the kenyan government is seeking to prove in the coming days. >> not a lot of transparency. nima, thank you so much. this country, a retired police captain accused of opening fire in a florida movie theater is still in jail this morning after a judge denied bail for 71-year-old curtis reeves. he's charged with second degree murder in the shooting death of another moviegoer. police say it started because of

alleged texting. now a woman is coming forward saying reeves threatened her in the weeks before. also in the movie theater, reeves' attorney says he was in fear for his safety. in west virginia this morning, water is now flowing to more than a third of the 300,000 affected by the chemical spill in the elk river. officials are allowing people to turn their taps back on so it doesn't overload the system. they're doing section by section. many of the businesses in downtown charleston have reopened but state regulators are calling for more investigation. new details in the landing of a southwest airlines jet landing at the wrong airport. investigators are now asking were the pilots distracted by an airline dispatcher who had permission to be in the cockpit with them. the dispatcher had been put on leave after riding in a so-called jump seat on a flight. that flight that landed, instead, six miles away from

branson. investigators are reviewing the cockpit voice recorders. they plan to interview the crew to decide what exactly happened. >> there's a myriad of residence that are going to be looked at so the ntsb when they look at that probable cause will say how do we mitigate this so it doesn't happen again. >> drug and alcohol tests are now complete. more about the train in new york. the report came to no conclusions about the cause of the derailment that left four people dead and offered no suggestions on how to prevent it from happening again. but the report did disclose that the derailment caused $9 million in damage. in chicago today, thousands of pages of documents, thousands of pages, about the priest sex abuse scandal there. showing how the church handled the sex abuse complaints.

the files deal with 30 priests, 40 victims. the current head of the archdiocese cardinal george insists he never protecteded any priest to be a known abuser. it's very clearly a sad and heartbreaking chapter in chicago. this morning, the indication of a brain-dead texas woman who is pregnant is in the hands of the judge. the family has asked the judge to remove her. a texas law requires that a pregnant woman be kept alive to protect the life of the unborn child. her family says because munoz is brain-dead therefore she is not alive and the law does not comply. a new warning about acetaminoph acetaminophen, the pain reliever in tylenol. the suit reveals that doctors stop providing drugs citing the risk of liver damage. the agency says there's no data

taking that much acetaminophen provides that. >> the pills are 500 milligrams already. that number 375. not very high. i'd like to learn more about that. the supreme court is taking up a major case over abortion and the right to free speech. it involves ace massachusetts law that sets up a buffer zone to keep protesters away from clinics. the appeals court said the law was valid and balances the right of patients and workers at the clinic but anti-abortion group says the law violates their rights to speak with patients as they enter the clinic. this morning, same-sex couples in oklahoma are one step to becoming legally wed. a federal judge has ruled the state barring gay marriages unconstitutional calling it arbitrary, irrational exclusion based on moral approval. couples will not be able to wed as the state decides it will take the case to a higher court.

breaking overnight. mayhem at the biebers. a friend of justin bieber is now out of jail after being arrested. rapper li'l za was picked up by deputies. they're looking for surveillance video that might answer questions of whether the singer was involved on an egg attack on a neighbor's house. this videotape was shot and said that he saw bieber on his property. the sheriff deputies said that bieber cooperated with deputies but did not answer questions. in today's "road warriors," there's been a lot of talk about cell phones possibly being allowed on planes. don't get your dialing finger ready just yet. most of you don't want this to happen, that's according to a national poll, 59% are against in-flight calls compare that with the 50% who say they're okay with it.

new information this morning on what the shooter may have told his classmates before the attack. and we have breaking news this morning. a bomb blast killing dozens iraq, violence sending that country back into chaos. fears of civil war once again on the rise. we're live. welcome back to "early start." i'm christine romans. >> and i'm john berman. 31 minutes past the hour now. dramatic new video raising questions about what fire crews did in their spongs to asiana flight 214 last summer. that crash left three people dead, including a teenager who died after being run over by firefighting rigs. and the video obtained by cbs news finds that the victim the 16 was on that runway. the video shows she was alive at the time. crews were warned to be careful and mindful of her laying on the

runway. >> whoa, whoa, whoa, stop! that's a body right -- there's a body right there. right in front of you. >> the family of the victim is suing the city. claiming the fire crews were reckless. san francisco's fire chief has said the firefighters were making very difficult decisions. now, to a new development at a shooting in roswell, new mexico. police say a 12-year-old walked into a gym and opened fire, seriously wounding two classmates before the school day had even started. the boy is now in custody. the classmate is in the hospital. and the teacher, john masterson is being considered a hero for convincing the alleged shooter to put down his weapon. the town held a vigil to show it's solidarity, praise those who brought the shooting to an end and reflect on what happened there. this morning, authorities are asking did the boy warn others about what he was planning. some who knew the shooter say he may have been bullied. new allegations about the

what shall you wear today? will it be cold? will it be warm? will it be raining? indra petersons answers that. >> i suggest a good suit and a red tie. >> an umbrella? >> depends where you are. in the northeast today, that system that was here today, notice, well offshore right now. so we're kind of in between that system and the next cold front that's making its way in. very easy to see that. you guys are all meteorologists now. notice on the system how dry it is. it's going to continue out east and goes over land. really cloudy conditions is all that's expected. you can actually feel that itself as it makes it's way off. the bulk of moisture stays off the coastline. the extra clouds is the big thing there. cooler temperatures but not a huge change. only a couple degrees with the next system. the next system is bringing cold air from canada. keep in mind, as this system

breaking news from iraq where dozens are dead after a reverse of attacks in baghdad and baqubah. the violence is growing closer to them. michael holmes is there. what's the latest? >> reporter: six car bombs in a couple of hours in baghdad alone. you mentioned baqubah, an ied went off during a funeral event. this is becoming a daily thing.

it's happening every day. it's still not the open-arms sectarian conflict that everyone has been feeling during the attacks but everyone's worried it's headed that way, i was talking yesterday to the former prime minister and said they're running out to of time. >> michael, a top leader says the iraq government is following americans' advice in dealing with this crisis. how involved is the u.s. right now in what's happening in iraq? >> reporter: yeah, you're talking about the deputy prime minister here in washington. as we say, a sunni blaming nuri al maliki for the blast. also urging washington to get more involved. citing they had a legal and moral responsibility. it's fair to say the u.s. is more involved now than they have been according to critics. and the u.s. has pretty much

into the elk river. officials are allowing taps to be turns on in sections so as not to overload the system. many businesses and restaurants in downtown charlton have now reopened. a federal investigation into that spill is under way. more questions this morning about the landing of a southwest airlines jet at the wrong airport. investigators are now asking were the pilots distracted by an airline dispatcher who was in the cockpit with them. the dispatcher has now been placed on leave. and had permission to ride in the so-called jump seat on the flight from chicago to branson, missouri. that mistakenly planned, instead, at a county airport six miles away. investigators now reviewing the cockpit voice recorders and plan to interview the crew and the dispatcher to get to the bottom of what happened here. >> there's a myriad of reasons that are going to be looked at so that at that ntsb hearing when they come up with that probable cause will say, okay, how do we mitigate this so this

doesn't happen again. >> drug and alcohol tests are now complete for the crew. the results are not yet in. this morning, there are no clear answers to a deadly train derailment in new york. now the ntsb has issued its preliminary report on what happened. the report came to no conclusions about the cause of that derailment that left four people dead. it offered no suggestions on how to prevent it from happening again. it did disclose that the derailment caused $9 million in damage. we could find out more today about the priest sex abuse scandal in chicago. the archdiocese there plans to release historical files of attorneys to victims showing how the church handled the abuse complaints. the files deal with 30 priests and 40 victims. a major case about abortion and free speech goes before the supreme court today. it involves a massachusetts law setting up a buffer zone to keep

protesters away from clinics. an appeals court said the law is valid and balances the rights of protesters, patients and workers at those clinics. but anti-abortion groups say they should have the right to talk to patients walking into health care facilities. recognition of same-sex marriage in oklahoma. a federal judge there has ruled that the state's amendment barring gay marriage is unconstitutional. they called it an arbitrary, irrational exclusion based on moral exclusion. his approval is pending an appeal. gay couples will not be allowed to wed. he's still in jane this morning. the sfurn-year-old former police captain accused of opening fire in a movie theater and killing a man. curtis reeves was denied bail during the first court appearance. police say an argument between the two men started because the alleged victim was texting. now, a woman has come forward to say reeves threatened her for
