faces decades in a florida prison, but not for killing davis. >> that has everyone so riled up this morning. a jury convicted michael dunn last night each of which carries a minimum 20-year sentence and those have to run consecutively. he also was convicted of firing on an occupied vehicle but jurors deadlocked on that one big charge of murder. and that sent protesters to the street outside the courthouse calling for the ouster. >> more on the partial verdict and the fallout. elena, good morning. >> good morning, victor. the family representing jordan davis, the attorney representing jordan davis' family said they would like to be left alone to celebrate their son's birthday and even though this trial is over, their fight for justice is far from it. after about 30 hours of deliberations, the jury in the michael dunn murder trial

returned a partial verdict. >> mr. dunn, you having been convicted of counts two, three and four by a jury. >> reporter: guilty on four counts, including three of attempted second degree murder in the 2012 shooting outside a jacksonville gas station that killed 17-year-old jordan davis. but on the murder charge, no verdict. >> based on the jury's inability to reach a verdict on count one, i would declare that mistried. >> reporter: vowed to keep fighting. >> we will continue to stand and we will continue to wait for justice for jordan. >> i feel michael dunn has a minimum of 20 years and another 20 years on another count so he's going to learn that he must be remorseful for the killing of my son, that it was not just another day at the office. >> reporter: during the trial,

jurors heard from the three teens who were in the car with davis the night of conferenrontn over loud music turned violent. >> what did the driver do with the gun when he grabbed it from the glove compartment? >> he caulked it back. >> i'm looking out the window and i said you're not going to kill me [ bleep ]. >> reporter: surveillance video where you can hear the gunfire was requested by the jury. jurors had several questions, including this one. >> is it possible to not reach a verdict on one count and reach a verdict on other counts? >> reporter: suggesting they were having difficulty reaching a unanimous verdict on the murder charge as early as friday. the tension in the courtroom, palpable. >> those 30 hours were probably the most stressful hours of my life. i cannot even imagine what mr. dunn was thinking because he was the one facing the verdict. >> reporter: now, angela cory

has said that she has every intention to retry that first degree murder charge. victor and christi? >> thank you. now, if that mixed result of the guilty verdict on three counts of second degree and mistry on the first degree result in dunn trial, disappointed some people in the courtroom. the expert observers seemed unsatisfied, too. listen. >> what i find so appalling is that they could not reach a verdict as to the first count, which is first degree murder. >> i think that the defense clearly raised sufficient reasonable doubt as it related to the justifiable use of force. >> yes, i'm happy dunn's going away. he's going away and it's a life sentence, but, still, that count one is just hanging there in the air. >> angela cory, with all due respect, in deep denial.

is there that hope? i think there is." it was basically his way of saying, i don't want to talk about it. well, senior international correspondent nick payton walsh is in sochi and let's put the question back here to mr. putin. can he separate politics from the winter games? >> well, i think in many ways those might say that he's actually introduced it in some ways. the olympic charter says there should be no discrimination against individuals. now, before the games started he said homosexuals are welcome here as long as and he did in the last few days say that he hopes towards the cold war would no longer be influenced by cold war ideal. suggesting old tension from decades ago persists. so much of the leadp has been characterized in a global, political context. this has been about vladimir

the northeast? because you're about to get one in the next couple of days. look at these snowfall totals from yesterday in the overnight hours. sandwich, massachusetts, 11 inches and only an inch and a half in central park. not many of you complaining about that. not as much snow as you could have seen. snow working its way off of northern maine and we will see a couple weak systems try to pull on through and not much accumulation expected with that, but we have another system trying to brew in the midwest and that's going to bring a little bit of snow to the northern plains and places like chicago as we go through monday. snow totals for this system we're looking anywhere for three to six inches outside milwaukee, minneapolis, three to eight. but a shift in the pattern means relief for a lot of folks, especially in the southeast. warmer weather on the way. it will take a little while for the northeast to warm up and the south already getting started. atlanta, 61 degrees today. we'll be at 64 by monday. temperatures even in the

wall around their arena to block their protest. at one point they locked arms and turned their back to the protesters and prevented anyone from that protesting group to entering on to campus. so, strong movement. was very impressive and they organized it through social media. they were expecting about 5,000 students and they got a couple thousand, i would say. but it was about 28 degrees yesterday is why they didn't get as many as they expected. inside the arena last night, michael sam received a standing ovation from fans, sam and his missouri football team were honored at halftime for their cotton bowl victory over oklahoma state. you can see he's pretty fired up and great ovation from the fans and a lot of hugs and high fives and the first time we've seen him in the public setting since the announcement. nice, real positive reaction from his school last night, from his coaches, from his teammates and just a good moment. really nice moment. >> good to see the support. joe, thank you. >> you bet. starting tomorrow, you'll see a whole new version of "the

this sunday. we're so glad to have your company. thanks for being with us. i'm christi paul. >> i'm victor blackwell. up first, two skiers are missing after an avalanche in lake county. that's in colorado. emergency management officials say rescuers will start searching the mountains as soon as day breaks there. now, this avalanche actually happened yesterday evening. three other skiers are in the hospital with broken bones and one with a collapsed lung. number two, a man's body was found in an airplane wheel well at washington's dulles airport. this was yesterday. now, local reports say the south african airways plane started before arriving in the u.s. investigators have not identified that man nor have they determined how he died. up now for number three, the british cruise ship that has just pulled into port ending a tragic cruise. listen to this, one person was killed friday when a ship was hit by a huge freak wave.

at least 14 others were injured. witnesses say the wave was so big, it smashed the windows of a restaurant three quarters up the way of the ship. and number four, take a look at this. 17 feet 8 inches long and 150 pounds and it's one enormous snake that is now in the record books. it's the second largest python ever caught and killed in florida. wildlife experts say she was about 15 years old when she was shot by bobby hill who apparently kills pythons for a living. i don't know how you get that job. that snake now on the university of florida to be studied. number five now, 60 years in prison. that's the anticipated sentence for the florida man convicted yesterday in the so-called loud music murder trial. michael dunn was found guilty of three counts of attempted second degree murder, but jurors deadlocked on the sole count of murder. prosecutors say they will try dunn again for the first degree

murder count. >> for more on that exclusive trial and really the unfinished business of it now, we want to turn to cnn legal analyst paul callan, thank you so much for being with us. >> good morning, christi. >> out of the gate, give us your -- are you surprised? >> surprised, shocked, stunned. i prosecuted murder cases and i've defended murder cases. this was a very weak defense that was put up on the board and the fact that a jury bought into it or at least that some jurors bought into this self-defense claim is really shocking to me and i think a lot of other observers of the trial. >> paul, here's what i don't understand, maybe you can reconcile these for me and this is what we're seeing on social media, as well. how is it possible that the jury convicted michael dunn of attempted second degree murder of the three he did not kill, but did not convict him of murder on the one person he did actually kill. >> i think people are going to have a lot of trouble understanding how that can be.

here's my theory, there were two sets of shots that were fired. the first set of shots that were fired were about probably four, pop, pop, pop sounds that you hear in a videotape that was taken from the interior of the convenience store. those were the shots presumably that killed jordan davis. the jury probably hung on the issue of whether he was firing those shots in self-defense or at least in a belief that jordan davis had a gun and it threatened him. the jury hung on that. however, after the suv that had the kids in it started to pull away. remember, three other kids other than jordan davis in the suv. he continues to fire. fires five more shots at the fleeing vehicle. i believe the jury found him guilty of the second volley of shots. finding that he was attempting to kill the other three occupants of the vehicle and that's why he you have what on

the surface appears to be a strange verdict, but it actually is logical on this fact pattern. >> okay, so, angela corey the state attorney is vowing to press forward for a new trial for this count one. being the fact that it's costly, for one. secondly, dunn's already going away for 60 years, it's expected. i'm sure some questions about an impartial jury and if they're able to find one. is it likely, do you think, that she will secure another trial? >> you know, i was surprised last night when she made that announcement that she would retry the case immediately. most of the time prosecutors will say, you know, we're going to have a look at the case and we'll make a determination about it to give themselves an opportunity to reflect and also to let public passions calm down a little bit. he's looking at 60 years in prison and i'll tell you something, he might be looking at 75 years in prison. there's a 15-year count

involving firing bullets into a vehicle that could lead to additional jailtime. so, if he winds up with 60 or 75 years in jail from a pragmatic standpoint, on the other hand if you're the parents of jordan davis and you believe, as well you should, your son's reputation has been by this defense-defense claim the family wants a retrial and that's something that a prosecutor has to consider carefully. hopefully she'll look carefully at the pluses and minuses of doing a retrial. >> we heard from the parents of jordan davis yesterday. we'll hear more from them, his mother saying that she will pray for mr. dunn. >> she's remarkable. just remarkable. >> we'll hear more about that. paul, callan, thank you for helping us unpack all of this. >> always nice being with you, victor. coming up on "new day" one

and you can imagine how shocked that such a hero could do such a thing. so, we know that he did kill her. the question is, was it premeditated as a murder or was it manslaughter. >> you spoke with reeva's agent and what did she tell you? >> she speaks about what an incredible person reeva was. she was so focused. remember she was only dating oscar since october. hadn't been a long romance and she wonders what the panic, what the fear, what was going on in her mind in those last minutes of her life. now, remember, she went to the bathroom with her cell phone which some people tell me is not unusual, but what is unusual is that oscar seems to have forgotten the code to his iphone. so, what has happened in the last few weeks is that the prosecution has solicited the help of the fbi to get apple to get access to the encrypted data. so, that's going on as we speak.

baez in new york. paul, let me start with you. i know you have a theory to how dunn could be found guilty on the attempted murder of jordan davis' friends, but not of murdering jordan davis, which is the thing that people are having such a hard time wrapping their heads around. how did this happen? >> you know, christi, people are stunned by this verdict and i think they're particularly splized by tspliz surprised by the finding that dunn acted in self-defense in shooting and killing jordan davis, but how could he be guilty of attempted murder if that's the case? remember, two volleys of shots. pop, pop, pop. four shots first. those presumably were the shots that were fired at jordan davis. now, the jury hung on those counts. the other attempted murder counts had to do with the three other young men, teenagers who were in the vehicle. he was charged with attempted murder on each of those counts. now, the jury, i believe, fougu on those counts because the

vehicle was fleeing at that point in time. he wasn't acting in self-defense. he had no reason to be using that force. so, i think that's why what appears on its face to be a strange verdict is actually probably pretty logical with respect to these facts. >> so, jose, with the three counts of second degree attempted murder, there's 20 each that have to run consecutively. 15 years minimum. 15 of the additional and 75 years in prison. michael dunn is going to die in prison. are you surprised prosecutors are already announced they're going to try again to convict him on first degree murder. what's the point if the man is going to die in prison? >> fiscally, i don't know what the point is. however, if you look at the situation, they've got three counts that are one right after the other. he's going to die in prison. and the main question is, what was the split? how many jurors were in favor to acquit? how many were in favor to

convict? we really don't know that answer yet and until you get that, i think it's premature to say what mistakes the prosecution made during this time that they can correct the second time. the likelihood of a conviction, those are things they need to consider. aside from that, it's a prumature decision. >> a lot of people are thinking that the fact that dunn testified might have been a game changer here. i had a lot of people, i was covering it when it was happening on twitter and some of them were saying, i want to hate this guy. but i'm finding myself believing him. what do you make of that? did you find any part of what he had to say believable? because his girlfriend, his fiancee still, i think on one of the major parts that's hard for people to understand was completely, had a completely different story. she said, he never told me about a gun. that he saw a gun in his car.

>> we're all stunned by this verdict and i think even people who have been involved in a lot of murder cases as i have through my career, i was quite surprised by the verdict. particularly, christi, the point that you raise. you know, after firing these shots, the fiancee gets in his car, they go to a bed and breakfast where they order pizza and spend the night like nothing happened but she testifies he never said anything about seeing a gun in jordan davis' car. now, wouldn't that be the only thing you're talking about? they pulled a gun on me, they tried to kill me. you'd be obsessed with talking about it. he said he never raised it. hard to believe that any of the jurors might accept the self-defense claim. now we get to your point about how did he do on the witness stand. jose will agree with me on this. it's rare that you put a defendant on the stand in a murder case, especially a murder case that goes in weak, but sometimes you do. you think he's going to do well. and he did very well on the

stand. and, you know, they did something subtle that i thought was very helpful. they put him in a sweater, which softened his look and made him look like sort of a nice, ordinary person. and he came across as soft and kind of likable as opposed to, you know, someone with a temper who would just open fire and kill a teenage boy. obviously, he didn't convince all the jury, but he convinced enough that this was a hung jury on that critical first degree murder count. >> jose, you mentioned that it is premature for the state to say that it's going to retry dunn on the first degree murder charge, partially because they haven't identified any mistakes that the state has made with its case. have you identified any mistakes in the state's case? >> well, this kind of goes back to what paul was saying. i'm not surprised by the verdict and that's because we have such a terrible time being able to cover these trials that there are things you see in the courtroom that the camera does not catch. and that the camera does not see. and that is the subtle nuances

of when a lawyer makes a point that the jury is able to identify with. the repore that some -- that the camera just simply will not pick up. so, i don't know if the prosecution made any mistakes here. i think they will if they're truly self-evaluating will be able to sit back and make that decision. but to make it right off the bat like that, i think was really more a play for the cameras than it was anything because simply not knowing what the split was should tell you that they're making this decision based on emotion and not something that they actually thought through, whether they can actually accomplish. >> we'll see if it actually happens. jose baez and paul callan, thank you for joining us this morning. >> thanks, gentlemen.

today. >> the avalanche happened yesterday evening. three other skiers are hospitalized with broken bones, a collapsed lung. of course we'll be following the developments on the story all morning and bring you updates as that happen as that search begins at daybreak. let's go to florida and the strong reverberations for what some have called the loud music murder trial. >> late yesterday, after four days of deliberations, a jury in jacksonville convicted michael dunn of three counts of attempted second-degree murder, each of which carries a minimum 20-year sentence. those have to be served consecutively so that means 60 years in all. >> dunn also was convicted of firing on an occupied vehicle, another 15 years possible there. but jurors failed to agree on the big charge, murder in the killing of jordan davis. davis was 17 when he was shot to death outside the convenience store where he and his friends were parked next to dunn who asked them to turn down the music. dunn swears he feared for his life, but police and prosecutors say the teens were unarmed.

today would have been davis' 19th birthday. >> a lack of a murder conviction sent the young man's supporters to the streets though. this was outside the courthouse, and they are calling for the state attorney's ouster. >> hey, hey, let's go. mccarthy's got to go. >> let's bring in somebody who knows florida law so well, attorney and cnn legal analyst mark o'meara. >> mark, good to have you with us. >> good morning. >> you defended george zimmerman successfully in the trayvon martin case, but you always said the dunn case was different and are you surprised by the verdict from this jury? >> it's different in a number of ways. primarily it was different because there was absolutely no altercation or argument or fight, physical fight between dunn and jordan, and that type of evidence that existed in the

zimmerman case suggested that there really was a reasonable fear for at least injury and not great bodily injury in this case. the problem with the dunn case is that although there was the verbal altercation, there was back and forth, there were so many opportunities to get out of the scene so certainly he could have backed up the car. one primary issue. probably the biggest issue and difference and what led to a differing conclusion was that dunn left and never called police. if there was one fact that gave the juries the concerns that they had to have in this case is if you shoot into a car with anybody, four males or anybody, you then call a copyright away. you don't wait a day so that's the biggest significant difference. as to the verdict itself, i'm not surprised with it. if you really look at it, and we can't blame the jury for not coming up with a verdict, because i think they did their job when they did everything

they could and could not come up with a verdict. if you analyze it this way. those three counts where they found dunn guilty of attempted second-degree murder is a perfect response to what he did. i think to focus on the last three shots saying nobody anywhere has a right to shoot at a car as it's leaving with three kids in it, and that's where you got the second-degree murder. it wasn't first degree because i do not think the state presented enough evidence of that pre-meditation. this was at best a second-degree case, and we have to look at it that way. as to why they didn't decide on guilt on the jordan davis case, i think we have to almost congratulate the jury because what they said to us with that failure to acquit or convict is that neither the state nor the defense came up with a sufficient amount of evidence to make a decision. >> knowing that and knowing people are calling for angela cory to step out of position.

overturned in virginia recently, but then in kansas we have this proposed law that would protect businesses who want to discriminate against gay couples based on their own religious preferences. first of all, i'm assuming, i could be wrong here, so i want to ask you, do you support same-sex marriage itself, and how do you view this changing political landscape these days? >> well, of course, i personally believe in marriage equality, that people should be treated equally under the law, and i think that we are seeing sizable change across the country where people are concluding that this is simply not an issue for us to fight over in government but that we should allow individuals to make their own decision. in the context of their own family beliefs and their own faith, and that's hopefully where we're going to head in the future. i'd like to see our elected leaders not fight over divisive social issues but instead focus on the national debt, the poor economy, holding government accountable. these are issues that we elect

people to solve in government, but they have been distracted, and they have been fighting on these divisive social issues and not getting things done for american people i think we need to change the conversation and refocus our efforts. >> carl, you might have heard this, that the president of the national organization for marriage has said that you're a trophy candidate that they, republicans, can point to and say to the media, see, we're progressive, too. we're evolved. i know that eric cantor has donated to your campaign. other leaders in congress. what about it that sentiment that you're a red herring to solve a problem for the party at large? >> well, you know, i think that the most unique part of my candidacy is not the fact that i'm gay. i think the most unique element of my candidacy is that i've gotten major reform done in government. politicians talk about reform all the time. i've actually been able to turn the city of san diego around from the brink of bankruptcy, get national attention for my pension reform plan, so, you know, i think that really what

i'm trying to do is change the culture of the republican party so that we're a party that stands on principle, is positive and constructive with solutions and actually gets reform done, doesn't just talk about it. we need to shake things up in washington, and i think that's the biggest element of my candidacy that i'm most proud of. >> so what kind of support have you had? >> you know, the support has been pretty overwhelming. obviously within san diego, this has not been an issue. i've had the support of social conservatives and also a good number of democrats. nationally we're seeing growing support of people who recognize that the party has to change its tone and its tenor, that we've got to get off the divisive social issues. let people decide those on their own. get government out of way on that issue, but focus on fiscal and economic reform and offer a constructive message. so so far the support has been pretty overwhelming. there are some nay sayers. we fully expected that, but we don't let that get us down.
