friends, the testing of our faith produces perseverance. hello, you are watching cnn news room. >> we would like to welcome our viewers in the united states and around the world. at this time a massive rescue operation is under way off the coast of south korea after a ship carrying hundreds sank. we are looking at live pictures right here at a massive gym where those who have been rescued are gathered together, many people are injured and many people shocked. a lot of people unaccounted for and two people are dead at this hour. we will go now live in seoul. it has been about seven hours now since this ship started to

sink and more than 100 people are still unaccounted for, a real concern. how hopeful are rescuers that they will find passengers and crew. >> let me recap from my recent scenario, things looking far grimer than previously. there were 477 persons aboard the ship when it went down, of those 295 remain unaccounted for, as you said, seven hours now after the ship founded off the southwest coast. if you see from the pictures, weather is good, visibility is clear and there are a large number of vessels on the scene. what happened to those unaccounted for, are they lost, have they been taken to different locations or are they

trapped in the hull. some of the school teachers said some of the teachers when they heard the crash when the ship hit something were ushered to the upper deck. some passengers say there was an announcement over the passenger system telling people to remain in sit you, not to get top side where they can get rescued. things looking rather grim as well as chaotic. >> certainly a real concern when you are talking about nearly 300 people unaccounted for. tell us what authorities are saying may have caused this. you talked about some of those eye witnesses suggesting a bump before the ferry began to sink. >> yeah. no one is really talking about the cause right now for very obvious reasons, people are focused on rescue efforts but it

is in the back of their minds. it appears to be an under water collision with a rock or reef under the water but this is highly unusual given these are very, very well charted waters so, why a ship hit a rock is very, very odd indeed, it is a question that will be address in the coming days. right now, as a said, people are very much focused on the rescue operation which is under way as we speak. >> from seoul, south korea, many thanks. the under water search for malaysia airline flight was cut short tuesday, again resurfaced

because of a technical issue it is now back in the water. meanwhile 14 aircrafts and 11 shifts. >> we are live now in perth, what were the technicaler error >> we are waiting to hear more specifics on that. we understand they took the blue fin back on ocean board h downloaded the data, i think it is a good sign they put it back in the water. many people have been questioning whether or not blue fin 21 is up to the task at hand given it is operating at its depth capacity. engineers analyzed it and believe it can go some five

police station, now the barricades are cleared away and the real local police are back in place but won't talk on camera. a tide of local hostility have gathered near the airfield, shots fired in the air as local men, one perhaps drunk, tried to aproproach the newest arrival. ukrainian troops was flown in, no reports of casualties. what has happened here has become an attraction for locals to come and look at and also a chance to voice their displeasure by this latest action by the ukrainian government. >> we don't recognize that government's authorities when normal people without arms came in on helicopters shot at peaceful people.

out of the region around jeju island. low clouds kaindicated in the dl white and gray colors, it will clear up but there will be another one in the next 24 hours. sea temperatures about 50 degrees farenheit. typically any time you are in that water one to two hours you will reach exhuastion and one to six hours is survival time. water reduces body heat 25 times faster than the same temperatures in the air would. and of course the amount of

more than a week he won't take the stand. >> his gruel cross examination ended yesterday. there are still witnesses left to call. but will it matter, let's listen in. >> where the accused is at or in custody. for that reason it will often take precedent over the matter where the accused is out on bail. in coming to my decision, i've taken that into consideration as well as the fact that counsel have made themselves available for this trial way beyond the time that was initially estimated. in addition to the above, i've considered the degree of progress which has been made in this case, the record runs into almost 2,000 pages and that excludes the bail application and bailiffs exhibits.

much of the evidence is technical evidence from expert witnesses, there's a lot of reading to be done and we will use the break to work on the record. i urge counsel who will be going on holiday and take the record with them and find some time to to do some work. in many i view that will some what occ curt tail the time to t a judgment. lastly, it is so that an accused is entitled to speedy justice, that however has to be weighed together with other equally important considerations such as those stated above. one consideration in this case is that the postponement is only for seven working days, which period is not unduly long in my

view, that can hardly cause the accused prejudice, especially that he is out on bail. i'm satisfied a case has been made for the postponement and for that reason the application sought by the state is granted. >> as the court pleases. >> as the court pleases. >> i just want to mention one other thing, the date of the seventh of may is election day but we are pressed for time so we cannot take longer than seven days. mr. dixon, you are still under oath. >> yes, my lady. >> thank you very much. >> we have been listening to the judge there ruling on the adjournment application, they

this time to get ahead of their work schedule. she has the need to expedite the trial and get it finished in the full front of her mind. >> she did mention that so far the record of this trial is more than 2,000 pages and the evidence is very technical and she wants to go through it with two assistants. meantime, this trial does continue. after the gruel examination, there is a perception that he is in trouble, he did more harm than good by taking the stand. what is your take on all this? >> from a legal perspective it is absolutely simply too early to make that determination. what we can know is he did some damage but whether he did more damage than good we are not in a position to assess that yet because it is right at the beginning of the defenses case

and the judge, when she evaluates how pistorius performed on the stand will evaluate that in the context of all the evidence presented. for example, parts of his testimony or performance now that may appear irregular may be subsequently explained put forward from the defense fx so we don't know that yet. we can't make that winners or losers evaluation or the outcome of the trial. >> how can the defense reverse the impact of the prosecution's brutal cross examination, do you think? >> well, we have started getting a view to that with their next expert witness on the stand, so what they're doing is brirnging

the conversation away from some of the confusion of the last five days and bringing it back of physical evidence and core parts that are being contested. for example, one might believe mr. pistorius was evasivevasive inference is he is lying and therefore guilty, one inference is he was cracking under the pressure of cross examination and was confused, so the judge needs to contract his performance with cold hard facts. so what did neighbors hear? the sound of screaming? that is pivotal to the state's case. the case has put forth strong

evidence it was her and the defense are now claiming they have strong evidence to prove that those neighbors must be mistaken, so they have sound tests and their own neb neighbors on the stand and only then can we get a view of the significance of different core points of contention in the state's case. >> and kelly, you were talking in the court, the deaf wfense g through some of the evidence, taking out the magazine rack, i know you are great at getting into the areas we should be careful and where this was all heading, but i'm curious, from south africa's point of view, how is pistorius being seen in the eyes of most people there? >> well the whole of south africa seems to be utterly

gripped by this trial. if you see reviews of social media activity, chat lines on the internet, newspaper editorial discussions, it is a wash with debate on pistorius. while there are polarized views, i think from a public perspective mr. pistorius came out negatively from his time on the stand. one has to separate legal from social perspective and socially people are drawn to the drama of his character where from a littlel he perspective those issues are certainly a difference, as they should be. >> thank you kelly our legal analyst outside the oscar pistorius trial. that trial under way. >> absolutely.
