lifetime ban is a lifetime ban. so i think that has already been decided. and yes, i do think that is the right decision. the next step is where do we go? you know, you think about him coaching a team right now and i actually don't know, you know, who to call. if i need something. you know? and so the quicker that this is done, the better for everyone. having said that it is going to take time and we all have to be patient. >> and could i also ask you just obviously the players, yourself, you're a very wealthy man. at the same time you're in a situation you're working for a man who has these views, how insulting is it to you as a human being to be working for a man who expressed these views? >> well, that is the difficult part. and over the last few days it has been very difficult. doesn't matter the wealth to be honest. you could be making nothing, you want to work for someone that at

least shares your values or respects them. they don't have to share them but they have to respect them. and that is difficult. you know, and especially when you're working in a company that when you do your job you have it on your chest. you know? i think that is hard. like i got to wear a suit and tie the other night. but i had a sense that that was very hard for the players. you know, they had to wear that. i think that was hard for them. i really do. >> doc, you said -- excuse me, you said that you were there film, and then you told them about the decision adam silver had handed down and you said what you needed to say to them. what did you say to them? what did you tell them? >> well, that will be private. a lot of it was just how much i admired them in how they tried to handle this. and just to let them know that this was some closure. but there is still work to do.

and you know, i just thought that they set a very good example around the league on how they conducted themselves. >> doc, you said you expected an amazing crowd tonight. couple of nights ago you -- have you gotten enough feedback between now and then? >> yeah, maybe i'm hoping. too. maybe that is part of it. yeah, i think the mayor has been great, by the way and what he said today. kevin johnson, you know, as jokingly, i like him again. it is amazing, like -- he has been great. he was great what he said today. i didn't know he could speak so well, so he will quentin-- eloq. and again, i go back to the 14 guys that we address, that are

players. they did nothing wrong, and they need support. and i think that that will happen. >> doc, would you like to see the clipper's name changed? >> you know, jim, that has been asked. honestly somebody asked me that today. it is the first time i heard it or thought it. i have no idea. i think whatever happens, whoever -- if there is a new owner or change of ownership i think all of those things would be the answer -- will be answered by somebody much smarter than me. >> last two questions? >> i just need some clarification on something you said before. i thought the union said that if they didn't like the resolution from adam silver, players would consider not playing. did your players consider not playing if they did not like the resolution? >> they had not discussed it. i think they had trusted that there would be. i am glad we don't have to find

banishment from the nba. we are joined by a one-time teammate of magic johnson, and the judge who is a consultant of the nba. and sits on the advisers of the atlanta falcons. i thought that was an amazing briefing from doc rivers. no notes, no prepared statement. just delivered it from the heart. among the things that have been said, he said the offended party is the one that gets called on for a response. he said in this particular case, adam silver responded for everyone. your reaction? >> you know, i think adam silver did give a response. he did for every person, past and current players. and those watching in high schools and collegiate-wise,

this will not be tolerated. any type of prejudice will not be tolerated in the league under his watch. >> judge hatchett, here we are in the middle of the nba playoffs. you heard the coach say this was bigger than basketball. >> absolutely. it is bigger than basketball. and the commissioner, i thought, was bold and swift today and did what was necessary. and i hope that the owners will take the next step to do what is necessary on their part. because the commissioner did all that he could do today. but it is bigger than basketball. and i think that some good things will come out of this. that there will hopefully be some constructive candid conversations that we need to have about healing and not just tolerating people. but understanding people. because it is our diversity. it is our differences that really make us strong. and we have to embrace that. >> you know, judge, to your

point, doc rivers was also asked if he had the opportunity to address the present team owner, although that may not be the case for long. what would you say to him? and he said i'm really not sure what i would say specifically, but i would like to change it. >> i thought that was a wonderful response. and i absolutely think the world of doc rivers. i have always since he played in atlanta a thousand years ago. and he has been absolutely marvelous throughout all of this. but isn't that what we really want? don't we want people to learn and grow and not get more divided with this conversation but for there to be some change and understanding which i think the coach really hit it when he said that. >> a.c., recognizing that the game itself is far less important than the subjects we're addressing tonight i nevertheless want to ask you, coach rivers said that emotion drains energy. how in the world does his team go out and play this evening?

>> well, you know, i think they go out and play thinking that hey, big brother really did step up for us today. we know that actually the league, this league, yeah silver has our back. and so i don't think that could have been said the last game up at golden state because it was all new, all fresh, and yes, they did make a symbolic move with the jerseys, but yes, they still knew who they represented and wanted to say more and do more. what was said out of new york, our leader in basketball, adam silver, stepped up and spoke for those who really couldn't speak at this time. so i think it is a new day, a new beginning for the los angeles clippers tonight. >> i think it shows -- i was just going to say that it also shows that the players have power. and they use that power. they were very clear through mayor johnson to say these are the things that we want. this is when we want it.

and for the commissioner to address that. so i think that we have to remember that there is obligation on both sides contractually. and if i were representing these guys in the league i would say listen, you can't have a hostile work environment. there has to be a place that we're doing what is right for the players. >> judge, is it a given that sterling gets out of the way? is there a likelihood here that he may try to stand his ground and fight? >> he may well do that. under the constitution of the nba, he cannot appeal the commissioner's decision today. he has a right to respond if the owners decide that they want to have a hearing. and he has a right to present evidence at that time under the constitution. but i will tell you, i don't think it is going to get to that frankly. i think there is going to be so much pressure for him to lead the nba altogether and not have any ownership interest.

because we have sponsors, we have fans and players. we're all watching. >> a.c. green, adidas and samsung already announcing tonight they're coming back to the clippers. is that premature? >> i don't think it is premature. i mean, i think they, too, were waiting. and they were making a statement that they're not going to stand by in silence and not have their voice be heard. and their voice is removing their physical support. their financial support of the clippers. and so i think them coming back now that they have seen the decision, i think it is a smart move. i really do. i don't think it is premature at all. once again, we have to stand for something. you have to step up and speak when you have an opportunity. and i think the sponsors have an opportunity, and some are making the decisions they're making. we're seeing the ramifications of that financially. >> a.c., let me ask you about your former teammate, magic

johnson, who gets swept up in this because of the comments. i'm not sure if this was not poetic justice, if magic johnson was the owner of the l.a. clippers, what is the likelihood of that? >> i think it is a strong possibility. i really do. i would love to see that happen. he is a great friend. a great leader in our community. just a great person from that standpoint. he and cookie, they only want good. they only have been trying to do good in our society as a whole. and even the comments that were even made about him that brought his name into it, it was because he was admired for what he has done in the community and opened up jobs and creating opportunities for people. and he and i share something so much alike in the fact that the message that all of this is really conveying, we're worried about what is it saying to our kids? what is it saying to our youth? and so that is why it was so important for a decision to be made. and magic, yes, i would love for him to be the owner of the

it is clear as a message to the league and the world that sports are color blind. now the next step will be the sale of the team. adam silver was definitive there was no place in the league for donald sterling. >> as for mr. sterling's ownership interest in the clippers, i will urge the board of governors to exercise authority to force the sale of the team and will do everything in my power to ensure that that happens. >> a man who knows the nba inside and out, the former over of the philadelphia 76ers says he knows someone who wants to buy the clippers and joins me now, hey, pat, let me remind everybody of your story. you started out as the team trainer, rose through the ranks. became a president and co-owner. the 76ers were the worst in the league in 1996 and 2001.

how much interaction did you have with donald sterling? >> michael, every board of governor's meeting, we had about three or four. so about 12, as well as any other events like all-star weekends or olympic events. so it was a very casual. not that we ran in the same circles, as a matter of fact my wife and i kind of joked he was like the guy in gilligan's island, one of those super rich kind of spacey guys in his own world. maybe that is why some of the despicable comments he makes, he doesn't know who they effect. >> it sounds like he was an outliou outlyer, but there was no sign that any of this was coming? >> no, i didn't know of any of his racist comments in the past. >> what do you make of the punishment meted out by adam silver.

>> no you know, i think it was fabulous, to levy a fine, okay, on a billionaire that is like me fining you five bucks. a lifetime ban on the sport, the nba basketball sport that you own, part of for the past what? three decades? that is saying something. but more importantly, i was shocked to see adam with such force and conviction, and the whole hammer down to that podium that he was going to urge the ownership to make donald sell his team. his beloved clippers, he was going to make him sell it. i was shocked and loved it. i stood up. >> hey, pat, it occurred to me, you got all the experience and expertise, silver was out in front of the owners in this regard. it doesn't sound like he polled them or worked that room. he went out and made a definitive announcement and now it will be on them to kind of tow the line. it would be hard for any of those owners not to go along

with this. don't you think? >> michael, i think you're so right. i think he might have had a couple of the owners just to get their feelings of the pulse. but commissioner silver, he is a friend of mine. now he is commissioner silver, has that same oh, conviction to make sure the nba stays first and foremost in the pro ranks. and there is no room in his room for prejudice, for racism. i think it is fabulous. so he did, like his predecessor, david stern, he put that hammer down and you're right all the other owners are going to have to follow lead. tell me, you're going to go into a meeting 29 other owners besides the donald and you will vote yes or no? you have to vote. make them sell. otherwise you appear racist. >> i said at the outset. pat crochy knows somebody. i was going to say my suspicion is that it is you. are you in for this? >> i would love to owner the

clippers, are you kidding me? after the philadelphia sixers, i would love to have the clippers. they are on the up-swing. they have a great coach in doc rivers. but what would be real karma? magic johnson on the team. i'll do it with him. >> how does a transaction like this get put together and who needs to improve it? >> well, that is a great question. normally you would man on man, man on woman, shake hands, you have a deal. you follow the deal points and shake hands like any or transaction. and it is normally based on relationships, right? but then that deal has to go to the board of governors and that is the nba. and then they give you thumbs up or down. do you have the financial wherewithal, do you have the temperament to continue to make the franchise, the league grow and be supreme? but this is a little different.

if he is forced to sell, i don't know how that works. >> i can only imagine that that is a roomful -- they're all successful business people. and i can only imagine there is a roomful of very strong personalities. as a general lot do they get along, those owners? >> yes, michael, they do get along. they do get along, yes, the mark cubans might be outspoken and some of the others, but no, they all get along. that is what is beautiful about the commissioner, the commissioner can help to moderate personalities to get together in some consensus. that is why the league is so successful. i mean, you see every team does well within the nba and all the owners feel a camaraderie. that is what is so amazing, that commissioner silver was going to get the owners to oust one of

them. that is unheard of. >> hey, pat, it appears we recently celebrated the anniversary of jackie robinson breaking the color barrier in sports. it seems that sports can bring about necessary change in a way that sports are ahead of society. >> well said, michael. but what is scary about it is that there are still individuals who have this tainted mindset. this damaged heart where prejudice still resides. and you can see it. as president obama said, it is here. ignorance is showing itself. but as you are seeing right now with the nba and commissioner silver's sanctions it is not going to be accepted. and i love it. and hopefully others will follow suit, even in small towns and households that it is not right. >> i know that you continue, even though you're no longer in the ownership or management of the sixers and nba, i know you continue to be a fan. you go to games, i go to games. one of the great things about going to the nba games is the diversity you get in the audience.

frankly i think unlike some other major sports hockey comes to mind. if you go and watch a 76ers game in philly or a clipper's game in l.a., it is a very black and white represented demographicic kind of a crowd. >> michael, i agree. that was one of the primes of my life, passions when i ran the 76ers, is because black, white, young, old, male, female. it didn't matter. we all hugged together and celebrated together. we all got bummed out together when we lost, but when we won, it was just one big happy family. i do believe sports bring people together, i hope this issue, the unity that the clippers are showing, i hope that momentum and unity spreads. >> donald sterling, what you know from what you read recently and heard on the tape do you think he goes along with this? does he go quietly into that night? >> no, i don't think so, and i

would hope and i would pray and i would urge donald to admit his mistake. to admit his hurt. to recognize, to be remorseful and apologize and step up out of the owner's suite on his own volition, to say it would be better for the team and league and the nba if i stepped aside. then at least we could have respect for him. >> you ready to announce your bid tonight before you leave us? how much. >> no, listen, i don't have that kind of clink, but i know where i can get it. >> matt croce, don't look at me when you say that. and could she be in more trouble than the man who made her famous? plus, have investigators been looking for the plane in all the wrong places? one private company thinks that mh-370 could be found in an entirely different part of the world.

league. >> did commissioner silver save the nba brand? we're joined by a crisis management and mel roberts who is a cnn commentator and defense attorney. mel, you were ahead of the curve and said this guy ought to give up franchise rights. but you know what i took note of? the comments. and many comments added to the piece say this was not right. this guy was expressing himself privately. were you surprised by that level of reaction? >> you know, i was surprised because 90% of the comments in the reachout that i got was all people upset that how could a private conversation result in something like that? and the fact of the matter is you can bark about the first amendment all you want. and you and i as attorneys care very much about it. but in this particular case, regardless of how the audio got out there, it got out in the public. and sterling's behavior is actually under the guidelines of the by-laws of being a franchise

owner in the nba. so people can be upset about the first amendment and what i have to say about that michael is look, he chose to be with this kind of woman. she claims that he knew she was even taping him. as far as i'm concerned once a bell is rung you can't unring it. >> i don't know if this guy could be rehabilitated. my hunch is that he never could be. but you worked with impressive clients over the years. and i guess the question is in light of what mel just said might the opening for him be to point a finger at the way in which all of the came to light? >> i don't think so, michael. i think that you have to show contrition in order to start the rehab process. he has made no statements or said nothing that would lead you to believe what is on the tape is nothing but a reflection of his views. and therefore, i think he would

need a lot of years and a lot of hard work to try to rehabilitation his image. and i don't think from what i have seen so far that he really cares to do that. >> you have provided counsel to michael vick and john edwards. is type of the essence in a circumstance like this. is the fact that this all came to light friday night. and here we are having this conversation on tuesday, already too late for him? >> well, it is not too late had he taken a position. but he didn't take a position one way or another. he let the story come out without an official response. and i think now that the commissioner silver has made his ruling, at this point there is little that he could do, unlike mike's situation where he chose to you know, he paid his debt to society. he decided to affiliate with the humane society and do good work in the community and spend years kind of showing that he had

learned from his mistakes. and this particular case, i have doubts that mr. sterling has an interest in doing that. and given that the story has already been out there and he has done nothing to put any context around it, i think it would be very difficult for him. and i hesitate to say that because in the public relations business we tell most clients that yes, if you -- if you're intent on changing the way that people look at you there is a path for doing so. but in this case i'm not sure there is. >> but adam silver laid it out, michael. i mean, one of the things that was so interesting today is that this has been a story defined by hatred. and as of today it has been a story defined by humanity. and i think so many of us were moved today to see adam silver stand up. what he did was so powerful. is because adam silver was so

unwavering, because he was so forceful and because he basically said the the world, to the owners and players and donald sterling himself. this is what the nba stand for and what you said is not going to be tolerated. >> well, i think you're right. and i have in my hands the statement that commissioner adam silver delivered. it would seem to me this is textbook straight out of your industry. >> it is. that doesn't make it any less powerful, however. and this was one of -- i was trying to think of other defining moments by commissioners in sports history. and i could come up with two that parallel this. one would be bart giomatti's decision with pete rose. and the second in 1990, the decision to ban the white sox that became the black sox scandal as a result of betting. there really has been only a couple of instances in sports

history where a commissioner has taken an action as firm as the one that commissioner silver took this afternoon. >> now, is it possible that the net of all of this is that the wife becomes the new owner? have you thought about that process? >> i have actually thought about that. because i have heard people say she is a co-owner. that is actually not true. if you look at the documents for the ownership, donald sterling is 100% owner. now, i understand they have been married for 50 years and there is common law property. so if they get a divorce and go through a separation, if the asset is sold she will of course get a portion of that. if donald were ruined because of the financial liability, she would not be ruined. if there was a share for her, i think she will be welcome at games. adam silver talked about that today. but my assessment of the situation so far is that no way is her interest or her marriage to him going to impact their ability to boot him. >> i read today the complaint that she, the wife, filed

against the mistress, the alleged mistress, let me cover the basis for cnn. a little too coincidental that that was filed just within the last 35 days, and all of a sudden now this tape comes to light. i think there is a whole part of this that is still to be played out. >> well, for sure. and i know you're intellectually curious. it is one of the reasons why i love you as a journalist and a talk radio show host. i know where your head is going, there has to be a lot more to the story there. and tmz says she has hundreds of hours of tape with sterling and that he consented to this. that is not proven yet. but we haven't heard the last of the story by way of the mistress, but surely this is the end of the story. >> and mel robins, we appreciate you being here. just when the investigators thought they were zeroing in on the search for flight 370, a

time now for headlines, the headline that got the story half right. first up from the guardian, harper lee agrees to ebook version of "to kill a mockingbird." so stunning this was the only book ever authored by harper lee, came out in 1960 and sold what? 30 million copies. everybody remembers gregory peck playing the attorney, in alabama, defending a black man who has been charged with the rape of a white woman. and now, here is harper lee who just celebrated her 88th birthday. and after all of these years has finally agreed to the release of this fabulous book. that is the good news, we want people to read that fabulous book. the sad news is that it is still relevant today. so you remember that headline? the headline that reads, the

eversion of to kill a mocking bird? what i would have written, atticus finch is still needed. this is abc and the washington post with a brand-new survey that among other things documents that the president's approval ratings are the lowest that they have recorded. 41% only approve of the job that the president is doing. and so the thinking continues to be among the experts that 2014 will be a big year for the gop. that republicans in all probability will maintain control of the house and might even take control of the senate. but i read this survey. and when you get to the internals, there are some very interesting things that go on. when you ask about particular issues it seems like the democratic candidates are better aligned on the issues than the republican candidates. for example you ask who is better suited to help the middle class? when you ask opinions about the minimum wage or same-sex

marriage or climate change it is the democratic position, not the republican position. so what then explains the fact that the d's are better aligned on the issues with the american people and yet it is expected to be a big republican year? passion, and passion drives people to the polls. you remember the headline? the headline that said public preference for a gop congress marks a new low in obama's approval? what i would have written? turnout wins. and the last headline is from "the washington post." get ready for this. kindergarten show cancelled so kids can keep studying to be college and career-ready. really? this one has gone viral. the interim principal at the harvey primary school in elwood, new york, cancelled a school play. the reason stated? the time was better spent preparing kindergarten kids for college and careers. look, the easy criticism is to

say yet this is another example of what happens when the curriculum is too standardized and everything is geared towards standardized testing. but in addition to that i would say the best lessons that so many of us learned from our early years came from things like play, and recess and art class. there was even a best-selling book written on this subject. you remember the old headline? the old headline that says kindergarten cancelled so kids can keep studying to be college and career-ready, really? here is what i would have written? all i needed to know i learned in kindergarten. is it possible the missing plane is thousands of miles from the current search area? one company says they have a serious lead and the investigation is heading in the wrong direction. also, cliven bundy, paula dean, and the short road it took donald sterling to join them.

are the scrapes searching for malaysian airlines flight 370 looking in the wrong part of the indian ocean? a company claims they have found wreckage in the plane in the bay of bengal in india. although they say it is not sure if it is flight 370. the director of the company spoke this morning with cnn's new day. >> it doesn't seem logical to us at all. and the pings coming from the satellite is basically a 50/50

chance that it was heading on the northern corridor or the southern corridor, not saying we have actually found mh-370. we have found what we think is a lead that should be investigated. >> malaysian officials and the australians leading the search say they're confident the plane is in the southern part of the indian ocean where they're currently looking, the region of the southern arc. geo-residents and analyzing the electromagnetic field that are air borne by the multi-spetric images, we're joined by the pilot and author, everything you need to know about air travel and by cnn's safety analyst, david souci of why planes crash. so david, i read that intro, but i don't quite understand it. what exactly does this company do and how does it work?

water is going to be another monumental task on top of the difficult of finding the play to begin with. and even if we have the boxes, that might not tell us what happened. so there have still these questions and meanwhile it's getting later and later and not looking good. >> this is the week that richard quest was told by the prime minister that there would be a release of a preliminary report. should be eminent by the end of the week by sure. what do you expect to come of that information? >> if it's done properly and it's not a redacted too much, then we should get some information about the transfer between one region to the other vie john. we should get information about when it was transferred, when it wasn't, when it was expected and the subsequent search and how long it took to get there. so that would be great information. i'm not real hopeful that's going to happen though because it's going through the international committee and others are going to have to say what's going to be redacted.

the nba for life and fined him the max of $2.5 million. there have been other recent incidents of celebrities behave yog badly. in a deposition, paula deen admitted to using the "n" word and doing a southern style wedding for bubba where the whole staff was middle-aged black men. i'm sure bundy would have been thrilled to receive an invitation to that. she lost her food network show, her relationship with qvc and target, other brands. let's not for get duck dynasty star, fill robertson it was he who made his own ridiculous comments about blacks. in his case a&e initially suspended the star but then suffered a backlash and lifted the suspension in fine days

before any episode was affect pd. i've got two observations. each one punished appropriately because society would not stand for their instole rans, that there was a consensus in such a polarized time. second, they're old and the view points that they espouse will largely pass with their generation. not entirely. but largely this is evidence of a generational divide. it reminds me of something that the president said against bice toward gays. the president said it wouldn't dawn on him that somehow their parents friends would be treated differently. it doesn't make sense to them and that's the kind of thing that prompts a change in perspective. my kids are the same way about gays and race. it would occur to them that people could be persecuted for such thing. in their eye, racism and bigotry are words from the olden days. yes, those voices are still
