with valorie jared among other top aids. newsroom with don lemon starts right now. good afternoon, everyone. top of the hour. don lemon in for brook today. a private conversation with donald sterling's girlfriend got him into this mess. now it looks like the nba owner is going to have to go to his wife to clean this mess up. shelly sterling is in talks with the nba to sell the los angeles clippers. she is esstranged from her husband. he has been under pressure to sell his team after recordings came to light nearly a month ago in which donald sterling told his girlfriend not to bring black people to the game. i'm going to turn to stephanie in los angeles.

what does this leave room for? a quick resolution here? >> obviously that's what a lot of people involved with this would like to see. the players, the nba association would like to see this as well. people trying to figure out what her stance is going to be on this. she has been married to donald for 50 some years. it has changed in recent weeks. she was previously sitting court side and now she has been up in the box. she said she wanted to stay but now this may make room that perhaps she will sell it.

>> she has said that she wanted to keep the team. she cares about the players very much. remember when it first broke and she said she called or actually doc rivers said that he had gotten a call asking if she could come to the game and being respectful. that was early on what does need to be figured out is since this team is owned by the family trust, how will that all be broken down. and if they get divorced in california, 50% of what's his is hers and 50% of what's her's is his. >> we will be getting back to you throughout the afternoon. this move to defer to his wife may not be a surprise to those who heard sterling speak exclusively on camera to anderson cooper.

listen. >> she has worked with me for 58 years, my wife. one wife, 58 years. and she loved the team. and always helped me with everything. if for some reason i can't have the team, i think she should have her interest, she didn't do anything. i brought all of this on her, the poor girl. i don't know how she can live and deal with this. thank god she has wonderful attorneys who will protect her. >> there is certainly a lot oto discuss right here. >> cnn legal analyst, sonny hoffman. i want to talk about all of this. this is just in from the nba. surrendering control of ownership to the la clippers. we continue to follow the

process set forth in the nba constitution regarding termination of the current ownership interest in the los angeles clippers and are proceeding towards a hearing on this matter on june 3. does this matter that he is giving control to shelly sterling? >> i think it does matter. we are in this weird place. i have spoken to many sports attorneys who say we are in a weird place. of course it matters that donald sterling is not the owner. i think it is being reported that he has transferred his ownership to shelly sterling who i have always said is the wild card here. >> the nba is saying it doesn't matter. >> sterling is saying that the team is going to be sold. that's the important thing.

they don't want it to be a phoney ownership. so this is huge. donald sterling is out of the nba. >> hold on. >> and that's a big deal. the nba has already spoken on this. donald sterling is the controlling owner. she may have a beneficiary ownership. >> as the -- he is not allowed under the contract to transfer the ownership without approval of the nba. >> that's what the players care about. >> hold on. both of you are talking at the same time. >> mel finish. >> i was just going to say -- >> finish your thought, mel. >> the legal mumbo jumbo. sterling has conceded that the team will be sold. that his wife is going to sell the team as soon as possible.

that's great news. i think that's the news that everyone was hoping for. it's the best case scenario not to have to deal with this guy fighting it legally or arguing that the wife should get to keep the team. i think this is a great scenario. >> okay. hang on. why transfer ownership? when the league is looking at a controlling owner, listen, the nba still has to accept that they have not accepted it. when i heard this news, i doubted that the nba was going to accept it all along. what if she says i am now the controlling owner of the clippers. and all of the sudden she says i don't want to sell it. he doesn't own it any more. >> that's a problem. >> yes. go ahead. >> they are still going to push her to sell the team. there is no question. it has got to be out of the sterling family. she has to sell the team. the nba owners will be just as aggressive to force her.

this doesn't count in my estimation, as him selling the team to satisfy the other nba owners and the players. this is only an opportunity for him to divest himself. she is also going to have to sell this team. >> don, i have said this from the very beginning. wait a minute, mel. we have said this from the very beginning. i think one of the mistakes donald sterling is allegedly not involved and now if you're the nba you can say i'm going to continue my process but the bottom line is -- >> they can still force it. >> it's not part of it any more. >> the owners have the ability to still force it under the same principles. all they have to do is take the vote and they can force her to sell it.

so, i view this as a positive development. >> i have the transcript here. he said i understand the position of mrs. sterling's owner is in essence that she still owns the team. if the owners ultimately decide and him doing something. >> of course it has bearing. >> and we will see it in court. >> two-thirds ownership. and here's the other thing, don, i think -- >> she is going have to sell the team. >> he also said on tuesday that they still own the team and that it's their team to sell. and that he would love to see

huge tax situation. >> a billion dollars? >> if you just use common sense and you have multiple people bidding. i think the reason the sterlings are doing this is they know they will get a far better price if they sell it quickly and if people have to deal with shelly and not donald. i think we will see something far north of a billion dollars. the way this will go down is when they have the deal it has to get approved by the nba. shelly can try to hold on to a small interest but she -- that deal may not get approved. the nba has to approve whatever transaction and they have to anoint the new owner and the new owner signs a franchise and ownership agreement and signs that constitution, don. so it's not a done deal.

>> it's never acceptable and of everything and anything that you possibly can do, treating anybody differently for race, religion my point in saying this is i do. i will go to the other side of the street. but to me, that makes me a hypocrite in some respects by trying to hold somebody else to a different standard. >> let's bring in cultural critic and writer lighting up your screen. that was a second interview that we had not seen. why tweet this second interview out. >> i think he wanted to give context. all along i was encouraged by his clungy ironic insensitive remarks because i think it was an honest attempt to have dialogue about the complexities of race. >> i thought we were going to

my perspective. i had no idea what happened. it was gnarly looking. >> a left turn. >> renae marsh is our aviation correspondent. >> don, it has happened again. two planes with passengers on board get too close in the skies and we now know the faa is investigating. >> turn right. right turn. >> two more passenger planes get too close in the skies. on may 9, united flight 601 and united 437 took off from bush international airport in houston at roughly the same time. shortly after take-off, flight 601 is told to turn right, putting it in the path of the other plane. moments later the controller seems to realize the mistake. >> 601, stop the turn right there, sir. united 601, stop your climbing, stop your turn. >> the two planes came within

nearly a mile of each other. the roughly 300 passengers on both flights may not have been aware of the close call but the pilots were left with questions as to what went wrong. >> 601, you know what happened there? >> basically crossed directly over the top of each other. that's what it looks like from my perspective. i had no idea what was going on in the tower but it was pretty gnarly looking. >> it was supposed to be a left turn. >> this is the third incident in recent weeks where passenger planes got too close for comfort. all involving passenger planes. >> don, the faa tells us the controller involved was in training. he realized the mistake immediately and corrected the plane's course. we should note there was a trainer who would have stepped in if needed. for the big picture we looked at faa's latest numbers and we

looks like the nba owner is going to his wife to clean it all up. >> in an exclusive interview with anderson cooper earlier this month, donald sterling said she would not be his puppet if she took full ownership. >> i really don't care. if i, for some reason, were unable to keep the team, which i can't -- i don't imagine, but if there was a reason i couldn't, if she does -- has nothing to do with me, that's fine if she wants to do it. it's fine if she sells it. whatever she wants to do. >> sterling has been under pressure to sell his team after his racist comments came to light nearly a month ago.

the league is moving ahead to get the nba owners to vote on kicking sterling out of the league. could this mean the owners won't have to vote? >> what it means is i think the sterlings are hopefully setting up a situation where they can extract themselveses with a little bit of dignity left in tact. if they do, coming to some kind of an agreement about selling the team, perhaps it will allow the nba owners to be off the hook in terms of voting against one of their own. it could be the set up for a possibly happy solution to a pretty awful problem. >> you know in the official charge, the nba says this. if the board of governors sustains a charge, the ownership interest will be terminated. if she is named, is there a

difference between donald steriling and shelly sterling selling this team? >> i do think there is a difference. i do think that if it is true that he has transferred his ownership to shelly sterling, i think that matters. adam silver although he has handled this situation in such a terrific way, the one misstep i think he made is when he said all of this only has to do with donald sterling not with shelly sterling. now that shelly sterling is the sole owner, i'm not sure that the nba has the grounds to extricate the team from shelly. >> what if adam silver said you know what? in the official legal language, does that make a difference? if he said i misspoke? >> i think the nba is in a very dif cushion situation here because the nba constitution has

been private. we just learned about it and they have not ever had to deal with this. so i think that they are making their position very clear. but i don't think in my view that it is legal challenge is precluded. i would agree that the best thing for everyone is for this back room deal to be taking place. but i'm not so sure that the nba constitution has the team to make it take place. >> how do you think that fans are responding to this news? is this a good sign? do you think they will be happy about this? >> yeah, i do, actually. it was a pretty terrific season for the clippers. it was clear when the tape first broke that the fans were going to have their say as were the sponsors and the players.

it was going to be quite the situation for the parties that have an interest in how the clippers do for the sterlings to remain owners. >> who do you think is going buy it and how much do you think? >> well, we know what forbes has estimated, $575 million but it could be worth as much as a billion and everybody's excited about the idea of some super power sko like oprah and magic. >> i am team oprah but i wonder if shelly is going to try to retain some ownership message.

as well as just have a passive ownership. i don't know that it will work. is there anything up for negotiation besides what you said? that huge tax liability? >> i think that there are things that are open to negotiation. especially considering that the i wonder if this transfer of ownership is the first move in this masterful legal chess match that could -- i think we could see shelly sterling retaining an itty bitty piece of ownership. >> i think we all agree this is a drama that is playing out live. thank you, robin. thank you.

second interview. interview on race you probably haven't seen but here it is. >> my uncle was the superintendent of the dc school districts in the 60s. all right? and i remember us sitting down and him being very clear to me that the way we think in this family is that everybody's equal. that if you go back and look at the history of people who have been oppressed, it's never been for a good reason and it's never valid and never acceptable. and of anything and everything you can do, treating anybody differently for race, religion or any other reason is wrong. but that doesn't mean you're not going to have those thoughts from time to time. we all succumb to those thoughts and you have got to realize when you have those thoughts, they're wrong. my point is i do. i will go to the other side of the street but to me that makes me a hypocrite in some respects by trying to hold somebody else

to a different standard. >> joining me now live, author and professor of legal studies, good to see you again. host of nba inside stuff. can we all agree that he at least started a conversation. >> that he started this conversation? >> that he started a conversation. he got people talking. >> oh, absolutely. the prejudice -- stereo types can often -- i think that the point he's trying to make is he's not going to be a hypocrite when it comes to his vote and that the nba is going to hold the ownership and he's being realistic about the expectations he has not only for donald sterling and his own personal

feelings on the matter as well. >> is this a foreshadowing on how he is going to vote? rsh that's the mystery. the timing is disturbing in some ways. he is trying to conduct a classroom discussion about race. the fact that he ig nights a conversation right at the moment when we're about to have a crucial vote on a guy that we have decided has been in the wrong, it's just bad justment. >> you know, he used a couple of examples. a hoodie and white guy with tattoos. i thought it was unfortunate the examples that he did use. >> but what he said is a great ning to be saying. the more we talk about it, the more honest we are, the more

open we are, even the parts that are not so attractive, the worst thing is to beat up on him so agrezively that he doesn't say anything the next time. we ought to all be talking about this. some people may want it both ways. we need to faulk about race but when someone starts to talk or is onnest they want him to shut up. what gives here? >> i agree. many of us reacted. the hoodie is a bad tell. it does not tell me this is somebody to look out for. the idea that you use race as the tell, that is a problem as well. the idea that race brings it to our attention and let's us think about it again is important.

he is probably a very good fellow and the idea that a good fellow thinks about issues like this in their deepest recesses is important to know. it's just the timing that gives us a little discomfort. what's this leading up up to. are we trying to protect someone? >> do you think his comments were racist? >> to give him cred, i think they were genuine in terms of what he thinks in the deep recesses of his mind. some of us who grew up in black neighborhoods we can't walk in the middle of the street all day. that's the world he lives in so i understand that. >> do you think the comments were racist? >> i don't think so. i think he made a good point in

saying that preconceived prejudices don't necessarily mean racist but we are all coming into this world of preconceived notions of what may happen. it is poor timing with this vote. it's not necessarily a hot topic conversation. it's a word that is going trigger conversation and a lot of feeling. >> so he gets it now. he gets what the hoodie means to many people in this country. the question is about what he said and why people are so upset by it, right? he is saying that his comments had nothing at all to do with donald sterling. he was asked about race, how he

conducts his business and he said in a business if someone is bias or prejudice, i don't get rid of them and send them back out to society. what i do is i try to offer them diversity training so they can think better and expand their minds about certain prejudices that they have or biases. what's wrong with that? i think that's a good thing. >> absolutely it's a good thing. it's honestly a grown up way of looking at it. it's so easy on the subject to just be completely black and white if you will excuse the expression and put everyone into the cad gorry of good. let's be honest. why should we not discuss it right now because over people are interested and insensitive. let's get in there and talk about it. >> i think it's interesting how sports is really leading the discussion and leading the

culture. people forget that sports has been in the forefront of the sieve rights movement and breaking down those barriers and here it is once again. >> we start with jackie robinson. that comes before brown versus board of education. cuban is extending conversation in a way that could fizzle out that has happened so often in this country. he apologizes. he is using the hoodie differently in the future. that's progress. >> i think you're right. i wonder where we go from here. maybe mark cuban can start a national conversation or continue this conversation. appreciate all of you. up next, two planes come just sects from slamming into each other in the sky. >> you know what happened there? >> basically crossed directly over the top of each other. >> of course the questions are

i had noed in what was going on. it was narly looking. you could tell there was urgency there. the faa says the controller involved was in training and recognized his mistake in telling one of the planes to turn right instead of left. there was also a trainer standing by to jump in if needed. so joining me now, senior aviation analyst, the fourth incident in rekren weeks. is it too many planes? human ror? >> you are sitting there in your seat and you listen to the traffic controller get all panicked. turn turn turn. i fly small planes just for fun. the whole point is to be calm, cool, and collected. when you hear that kind of tone in a controller's voice, it is

extraordinary and you listen and follow instructions very carefully. >> how close -- it says they came within a mile horizontally and a mile vertically. >> each plane can be going in the neighborhood of 200 miles per hour. they were not exactly heading right into each other. if you have to walk a mile it's not so near but planes are supposed to be no closer than three miles apart in that kind of a setting. >> anything under three miles is too close. is there a penalty. there was a trainer there. is this part of being trained? >> any time you have a system where there is a set of rules, you're not supposed to get closer than a certain distance you will have cases where people go over the line. there is enough margin of safety

built in that there have not been collision in recent memory. this would be a very bad day should it ever happen. so this kind of thing will become even more rare and hopefully will never happen. >> in the last one we reported on the system told one plane to pull up and another one pulled down. it does that automatically. the pilot does not say oh my gosh there is a plane coming and steers. by the time you see it, it's too late. >> the cars won't let you hit the car in front of you. and obviously with aviation, systems are more sophisticated than that. with more information and technology -- >> it happens more than we think, doesn't it? >> unfortunately. >> appreciate you. a reminder for you. we are awaiting an event at the white house. you see the white house there.

>> welcome back. we are getting you live to the white house now. it should start any moment. the president will make some major cabinet announcements. and standing by, our white house correspondent is there. jim, what can we expect? >> john, what you're going to see is the president name the second latino to his cabinet. this will be san antonio julian castro. he has been talked about as a potential running mate to hillary clinton. i talked to the former mayor of

san antonio who was also the hud secretary and he said this is a spring board. that is one thing you will see. shawn donovan who will be tapped as the next budget director he is also seen as a close aid and top official. and all of those started because of the problems with the obama care website that led to the departure of kathleen sabilias. i think i'm keeping all of this straight. what's interesting is that the president is cleaning up this mess at hhs with this cabinet shuffle but he's got another one on the horizon.

>> it appears they are standing up in the white house and the president is walking in. the bt about to make some announcements to his cabinet, which jim told you about julian castro and shawn donovan getting new positions in the obama administration. you see the president and i believe the vice president in the room as well. >> biss were shedding 800,000 jobs a month when i took office. our def stit we're heading towards a trillion dollar a year. ef member of my cabinet had a tough job in frobt of it. few had a tougher job than shawn

donovan. badly hurt millions of responsible hard working americans. home values had fallen 20% from the year before. new housing starts had fallen nearly 80% from their peak. construction workers were out of a job and a record number of people were behind on their mortgages. five years later, things look different. home sales are up nearly 35%, construction is up by more than 120%. new foreclosures are down by nearly half. and while we're not anywhere near where we need to be yet, millions of families have been able to come up for air because they are no longer under water on their mortgages. $50 billion settlement by the big banks means justice has been done for hundreds of thousands of homeowners who were unfairly

targeted. and all of this is in part because of the outstanding work of shawn donovan. now here's the problem. when you're good at your job, people always want you to do even more. that's why today i am nominating shawn to be the next director of the office of management and budget. to take his place at hud, i am not nating an all star in san antonio over the past five years, major julian castro. before i talk about julian, i want to embarrass shawn a little more. over the years, shawn has taken an agency with a $40 billion budget, he has made it smarter and he has made it more efficient. he has changed the way hud uses data to save taxpayer dollars.

he has helped build strong sustainable neighborhoods. he has helped reduce homelessness among our veterans and helped 4.3 million families buy their piece of the american dream, a new home. shawn has helped us navigate unexpected challenges as well. when hurricane sandy slammed ashore it was personal to shawn. he was born in new york, married in jersey, raised his kids in brooklyn. he once took his driving test on a road that was wiped out by the storm. he understood what this def strags meant. so when we were looking to somebody to lead the recovery and rebuilding efforts i knew shawn was the right person for the job and he has come through. he has helped the communities

not only rebuild but rebuild smarter and better. shawn is somebody who knows how the decisions we make here in washington affect people's lives all across the country. that's why i'm absolutely confident that he will do a grade job and help more hard working americans get ahead. my guess is that shawn is grateful to the team for leaving behind a deficit that they have cut by more than half since i took office. i'm just saying that's helpful. now, obviously we have also got to make sure that as we move shawn into a new position that we have got somebody who is going to do an outstanding job at hud and that public servant is julian castro. for the first time most american

s heard this man speak is when he gave a speech at the democratic national convention. a pretty good speaker, not bad looking, talk about how america is the only place where his story could even be possible and i watched and i thought that's not bad. but, the people of san antonio have known about julian and his brother congressman wakim castro who is here along with leader pelosi they have known about him for a long time. julian has been focused on revitalizing one of america's most wonderful cities, planning thousands of housing units.

he has build relationships and become a leader in housing and economic development. today companies are choosing to create jobs in san antonio and the east side is named a promise zone, a place where citizens and the federal government are working together to remake the community family by family and block by block. this speaks to the fact that julian cares deeply about the people he serves and aty that he loves. it is also a reminder that he has never forgotten where he came from. his mother came from mexico and worked as a maid, a cook, a baby sitter, whatever she had to do to keep a roof over her family' her a home is more than just a house.

. and maybe one day the kid grows up in that home and is able to go on and get a great education and become a member of the president's cabinet. julian -- [ speaking in foreign language ] and it's precisely because he's lived out in the american dream that he'll work his tail off to make sure more people can follow that same path and earn their own dreams as well. so i want to thank shawn's wife, liza and her very during a super bowl game i want to thank them for them sharing husband and dad with us a little bit longer. i wanted to thank julian's wife erica and this adorable young

lady who gave me a hug before we came in for agreeing to let julian take on a new challenge. i'm absolutely confident that these two individuals are going to do a great job because they have done a great job in everything that they have done in the past. they are proven leaders, proven managers, they are going to be effective and, most importantly, they have a huge heart. they are involved in public service for the right reasons. and for that reason i hope that the senate confirms them both without games or without delay. and with that, i want to give both of them an opportunity -- >> all right. that's president obama in the east room. what he's doing is very simple. he's nominating now his current housing and urban secretary shawn donovan is going to become the office of management and budget and also the mayor of san antonio, julian castro, will
