39 minutes past the hour. let's talk about politics and the ongoing divide inside the republican party between the establishment and the tea partiers. we want to look at what we learned from this week's primaries. tea party rents didn't do so well. they put up a fight causing the base to have a shift to the right to be competitive. >> let's bring in amy. she's in studio with us and editor of blackchic.com. i'm going to start with you. considering the results from tuesday night, is the tea party over? >> absolutely not. it's not over. we are still alive and look, they have actually the establishment hijacked our message. we have already won because we changed the political landscape across the country, especially
4:41 am
in washington, d.c. we changed the narrative. six years ago, nobody was talking about cutting spending and reigning in the massive debt we have. now, that's what both sides of the aisle are talking about. >> some of the decisions made by kentucky senator mitch mcconnell would not have come about if he didn't think he has a threat from the tea party challenger. if the tea party candidates cannot win, do they need to pay lip service? >> there have been tea partiers that won. ben in nebraska, a republican primary in west virginia. it may not be some of the high profile races, but look, the movement has changed. we are evolving. people are focused on local and state level. that's not journalism.
4:42 am
people are not reporting on that. there are victories across the country that people aren't talking about. we have won some of the high profile races and i believe we'll win more. >> we talk about the primaries and how they were a win for the establishment. maybe in the short term. what do you think that is going to have on the chance of taking the white house for 2016? >> well, i want to go back to what amy said. she's exactly right, if it weren't for the tea party, republicans wouldn't have been brought back to life in 2010. everybody forgets that. the tea party, like amy said, got us back on message, got us back to the party of principles known for reduced spending, less taxation. those are the tenants. because of the tea party and grass roots efforts started by people like amy, republicans were able to take on what? over 50 seats in congress.
4:43 am
unprecedented seat gain. the problem is, however, for the tea party now is they have to navigate the next phase. it's not enough to just challenge people. challenges are good. nothing noble saying you serve 20, 30, 40 years. mitch mcconnell is going to have a tough race against alison grimes. she represents the future face of america. she's a woman and young. it's something as a party, that's going to be the challenge for the republican party heading into 2016. we look very much like the face of white america. as you guys know, i talk about this all the time, the tea party, i think, was really instrumental in channelling candidates like alan west. we have to bring more people in. if you think about it, it's what the tea party was good at. bringing people who never ran for office into the fold of
4:44 am
conservatism. i think, as amy pointed out, as they navigate the next phase, that should be part of it. they are not going away. at the end of the day, whether you are a republican or conservative, we are picking the right candidates we feel can represent us in the races. >> i wonder if the republican party establishment would call allen west a one and done because when he came in, then a challenger came up and he lost. let's listen to what john boehner had to say. is there's not that big of a difference between the tea party and your average conservative republican. you know? we think taxes are too high and the government is too big. i wouldn't continue to sing that same song. >> i wonder if that was the same thing we are hearing from speaker boehner during the negotiations over the budget when we had to shut down the
4:45 am
government. my question to you, crystal first, then amy. do you agree there's not that big of a divide? >> no. i think -- look, speaker boehner is doing what he should do as leader of the house. he's trying to bring together the coalition, which is a problem. there's a divide where the tea party needs real work is once you are elected, the work begins with consensus building. we, as republicans can't have everything we want. what looked bad is when senator ted cruz, who was brought into congress through the tea party. we have good folks like rand paul as well, but when ted cruz stood on principle, take away obamacare, he got nothing out of it. they need to get more focused. push leadership to go for better policy, but government is about compromise. i think that's where the tea party falls short.
4:46 am
>> what do you think about the word compromise, amy? >> you can compromise, just not your principles. i disagree with crystal on the ted cruz because they knew exactly what was going to happen. they brought awareness to all the problems. >> right, but amy -- they knew what was going to happen. nothing was going to change. you are not going to get anything changed until we get a republican in the white house. what i would like to see ted cruz do is say focus on repealing, walking back the individual mandate, which we could have accomplished that. instead, it became a circus act around, let's repeal the whole law. you can't repeal something that the supreme court said is constitutional. you can make a good argument for pulling back on the individual mandate. the president already, you know, walked back on the businessman

4:53 am
will airlines money if these rules do change? >> well, they will still make money on the fees. i don't think fees will go away. they will try to charge you more and more for other choices you make. it is capitalism. if the passenger is willing to pay for it, they will keep doing it. if the passengers push back and travel demand drops, which i don't see, they may pull it back. one challenge two years ago in 2012, like you mentioned, they tried to, the government came in and said you cannot advertise a base fare without taxes and fees in that fare. they got that passed. now the airline transparency act is trying to get through congress right now. that is actually doing the opposite. it is going to make it so all the fees are broken down and it will make it more confusing for the traveler to choose which airline to fly based on price comparisons. you have two things going on at the same time.

the ability to disclose more fees in the booking process when it comes to baggage and seat selection and the airlines don't want that, but they are pushing for the rollback of the bundled fares with government taxes and fees. you have two things taking place. one is trying to make it easier to shop and one will make it more difficult to shop. >> mark, some of the airline officials are shouting hypocrisy. they claim the requirement in the act allows the government to hide the full extent of its taxation which says the airline industry says could run about 20% of the ticket price. that seems high. do they have a point? >> yeah. no, here's why. i'm not a big fan of getting taxed to death. i want to know when i'm paying taxes. that is disingenuous. the reason they like that is europe that looks like it is et

if progress is being made, they may postpone the vote. they may not. that is a decision they have to make as the story unfolds. i think they will continue to have it scheduled. that is part of the pressure that is being brought on the sterlings to sell the team. the more pressure you are bring to bear, the more likely you can hurry up and get the deal done. >> joey, the times is saying if shelly sterling is not able to obtain partial interest in the team, that deal falls through. is that possible? >> you know, anything is possible, victor, as you know. i think the nba is committed to having anything sterling removed from the team, whatever it takes. i think it is a good development that they move forward and try to do it voluntarily. why? because it avoids all sorts of litigation. we are not in court for
5:25 am
anti-trust violations. we know he hired anti-trust attorney. that voids that. it voids the issue of the internal arbitration. they may not have to take a vote if things go according to plan. there is a lot still influx as it moves forward. it is moving rapidly, at the end of the day, victor, as long as the nba gets what it needs, them removed, the sterling not impairing their brand, the fans are happy and the sponsors are happy and owners are happy. that looks good. >> gary, earlier this week, the "l.a. times" talked about destroying evidence related to the recording. you think adam silver used that tactic to get sterling to concede control and give control to his wife? >> first of all, that is an inflammatory way of characterizing it. these remarks are simply embarrassing and stupid.
5:26 am
and destroying a tape that is embarrassing is not an illegal act. he is not destroying evidence or engaging in a cover up. those are terms designed to make him look bad or worse than he already is. right now, the league is trying to put pressure on sterling in every conceivable way. remember, i did an interview a couple of weeks ago on cnn and said this is going to end without litigation. there may be a lawsuit filed, but the sterlings will sell the team voluntarily because it is in their interest to do so. >> to gary's point, there is nothing illegal here. it is not inflammatory at all to is describe a cover up. an internal preceding. not an fbi investigation. if the nba is conducting an investigation and investigators are on this and things get
5:27 am
destroyed, that is a cover up. that does not comport with good character. it is not inflammatory at all. this is a description. >> it depends -- >> gary, we have to wrap it up. joey jackson, thank you both. >> thank you, gentlemen. one of the big stories we are looking at today is something that happened overnight. these are some of the first pictures. a california college rocked by a mass shooting. this deadly attack left seven people and the gunman dead. sent seven others to the hospital. >> we are working to get new information and we will have that for you in an update next. my name is jenny, and i quit smoking with chantix. before chantix, i tried to quit... probably about five times. it was different than the other times i tried to quit. along with support, chantix (varenicline) is proven to help people quit smoking. it's a non-nicotine pill. chantix reduced my urge to smoke.
5:28 am
that helped me quit smoking. some people had changes in behavior, thinking or mood, hostility, agitation, depressed mood and suicidal thoughts or actions while taking or after stopping chantix. if you notice any of these, stop chantix and call your doctor right away. tell your doctor about any history of mental health problems, which could get worse while taking chantix. don't take chantix if you've had a serious allergic or skin reaction to it. if you develop these, stop chantix and see your doctor right away as some can be life-threatening. tell your doctor if you have a history of heart or blood vessel problems, or if you develop new or worse symptoms. get medical help right away if you have symptoms of a heart attack or stroke. use caution when driving or operating machinery. common side effects include nausea, trouble sleeping and unusual dreams. my quit date was my son's birthday. and that was my gift for him and me. ask your doctor if chantix is right for you.

this is cnn breaking news. >> well, a very troubling and frightening situation in california overnight. we are glad to have you with us. i'm christi paul. >> i'm victor blackwell. this holiday weekend turned into a deadly weekend in california. the college community of santa barbara was rocked last night. six people were killed in a drive-by shooting. >> the rampage happened in the town of isla vista. multiple shots fired from a black bmw. these are the first pictures we are getting from the scene. that black bmw allegedly sped through the city streets and the sheriff labeled the incident, quote, mass murderer. >> let's talk about that term. we have jeff gardere on the
5:32 am
phone. the investigators are still looking into other attributes and other possible pieces of evidence. a mass murderer. tell us someone who goes on a rampage for ten minutes, what it takes to go on and plan something like that. >> well, certainly someone who has a lot of rage, cold and calculated. from a what we have seen from previous profiles, these are individuals who blame society for being isolated, who have very poor social skills and see themselves as being superior, but cannot understand why they feel they are being rejected all the time. therefore, they are hellbent on revenge. at the same time, christi and victor, they do want to die. they want to commit suicide after they wipe out as many people as they can. >> jeff, i am wondering about
5:33 am
the folks who saw this, the witnesses and victims here. they are waking up after just thinking they will go out for a nice stroll on a friday evening at 9:30. you are in the middle of graduation for the college and in the middle of finals for this college. what would you say to people who are trying to recognize to people as they wake up what happened last night? >> the only thing we can tell them, of course, this is yet another episode in this sort of random violence we see. there is no way at this point from the patterns of all of these mass killers to actually predict when this might happen to a general population. we have to allow people to talk about what this feels like. they may not be feeling safe right now, but we have to let them know that they are safe at this particular time, but they have to talk about their
5:34 am
feelings, especially the families and people who are affected by this directly. >> sure. let's get back to this suspect. the sheriff described him -- not just as a mass murderer, but him as a mad man. they are looking at videos and written statements from that suspect. would somebody who does something like that be intent in documenting it prior to the incident? >> yeah. for the simple fact that what we know from these mass shooters is that they do want to let the world know how angry they are and how they feel superior and now will take their revenge. for a very long time, someone like this looking at the profile may have felt he was slighted, that people didn't like him and that he was considered less than and this is his way of now becoming a god by being able to
5:35 am
take lives just at his own whim. yes, this is a mad man. maybe not a mad man as in a schizophrenic, but a mad man who is a severe personality disorder and who has delusions of grandeur. >> jeff, let me ask you this, from the people around him, would there have been any outward signs he would have been planning this or anything people could have seen or picked up on in audio? >> this is the issue every time. we do see people again fitting the profile who may be isolated and may have poor social skills and who may not be able to interact in normal and healthy manner and who do feel they are victimized. we cannot take every single person like that and say they are going to become a mass murderer. i think what we have to do is
5:36 am
this thing called triangulation from family and friends and we see this is someone who is at risk for doing something extreme, especially if there is a slow, quiet, seething rage that seems to be developing as part of that person's personality. >> that is part of the investigation, as we know, in santa barbara county. jeff gardere with us as we cover the breaking news in the town of isla vista next to uc santa barbara where seven people are confirmed dead. that number including the alleged shooter. also seven people in the hospitals from traumatic injuries and gunshot wounds. these are the first pictures coming in from the scene. we have in studio with us hln analyst mike brooks. we will talk with him about the nine crime scenes. this is going to be my first question after the break.

this is cnn breaking news. >> 20 minutes until the top of the hour now. we are following the breaking news out of isla vista, california. a small town next to the uc santa barbara campus where we know this morning from the santa barbara sheriff, bill brown, seven people are dead, including the alleged shooter who killed the other six and shot at least some of the seven who are also
5:41 am
in hospitals this morning. 14 people, including the shooter, some injury or death related to the incident. it happened at 9:30 west coast time last night. we have hln law enforcement analyst mike brooks with us here this morning. mike, my first question to you, this happened off campus. in isla vista near campus. do you think the shooter who we know is male, that's all we know. he chose to shoot off campus because he would have more freedom and ramp up the body count? >> absolutely. i have been in the area before. it is congested on a normal weekend, but on a holiday, school is getting out and there are a lot more people. that is the reason he chose this area if he wanted to wreck havoc on an area, it would be off campus. >> the fact it lasted ten

minutes. this guy driving around and able to get away from anybody who may have been trying to stop him for ten minutes. that's a long time. >> it does seem like a long time. you have to kind of find out exactly what is going on. gunshots. then you report people down. but he is mobile. it is not like it happened in one area. he is driving around. you have nine different crime scenes. that, in and of itself, will tell you this guy was on the move quickly before he was either brought down by sheriff's deputies or killed himself. he had a gunshot wound. they don't know if it was an exchange of gunfire with deputies. if you look at the car, the windshield is shot out. we don't know if a deputy killed him or he killed himself. it does seem like a long time, but for law enforcement to get a handle on that. when i was hearing, people were told to stay off the streets. they were not sure if it was a lone gunman or not. they believe he was acting alone
5:43 am
by himself. >> the sheriff said they recovered a semiautomatic handgun. that is all they detail. are you expecting we will hear more or surprised by a single handgun thus far? >> you can do a lot of damage with a single handgun depending on the capacity of the magazine or magazines he had. i'm sure with this many people, killed and wounded, he probably reloaded. when you are riding up on somebody in a car and shooting people on the sidewalk, shooting people through windows of shops there, you are very close proximity to the sidewalks. fairly narrow streets in isla vista. i'm not surprised at all. you know, we may find another gun, we may not. he probably had to reload a number of times. >> with 14 people shot, how do you go about getting all of those witnesses together and determining who you need to talk to and who you don't?
5:44 am
>> that's number one. notifying people who are injured and next of kin. people on the streets. i'm sure people who were there are more than happy to give information to law enforcement about what happened. the other thing we have to consider also, this person, the gunman. where does this person live? does he live on campus? does he live nearby? i can guarantee you as we speak, they are at his residence trying to find out exactly what the motive for the shootings were. >> there have been some reports of a second person in the vehicle. the sheriff says that this shooter acted alone. in your experience, does your experience tell you that there's usually another person there or it is a lone guy in a vehicle in a drive by? >> it depends on what is motivating this gunman. i usually see something like this and someone who is this troubled, something happened within the last 24-to-48 hours to just push this person over the edge to make this person act in this way. whether or not there was a person -- sometimes that doesn't
5:45 am
make a difference. was this person there and tried to talk this person out of what he was doing or planning to do with the mass shooting. the sheriff said he was acting alone. i'll go with the sheriff said and maybe this was a lone gunman. >> with nine crime scenes to reconcile, how long will it take and how much manpower? >> that whole downtown isla vista will be shutdown for some time. it will take a lot of manpower. i would not be surprised if the sheriff brings in the fbi and their evidence response team to help collect evidence because it is such a vast area outside of campus there. it will be a while before they collect all the evidence. >> we received the update that the department of justice criminalist will be involved as far as collecting and managing the nine crime scenes. the state highway patrol is involved. if you are just joining us and see the breaking news headline.
