i'm allison in for christi paul. >> i'm victor blackwell. 6:00 on the east coast. good to have you this sunday. this is "new day sunday." we're starting with breaking news. the florida teen beaten and jailed in jerusalem is to be released from custody. >> 15-year-old appeared in court in jerusalem a few hours ago. >> his family says he was outside the home of his cousin who was kidnapped and burned alive when ter reek was aattacked by men in uniforms. images show he has a black eye, his lip swollen, bleeding. his uncle says his nephew was shackled to a hospital bed and moved to a detention center. the video shows two masked uniformed men pummelling and kicking this 15-year-old in the head. and then they carry his limp body away. >> cnn's ben weedman spoke and ben joins us live from jerusalem. tells us latest about what happened in court this morning.

>> reporter: yes, we're outside the jerusalem magistrate court where we have been told by family and lawyers that teriq will be released shortly. he will be under house arrest for nine days he won't be allowed to stay in the family home in the neighborhood but rather in adjacent neighborhood. he will be released on 3,000 shekel bail, almost $900. and he has to inform the police if he leaves his home and if he does that, if he leaves the home without informing the police it's a 10,000 shekel bail fine. so he's going to be released and he hasn't been officially charged. according to the system here, the charges are in what's called a secret file, but if he's not charged with anything or the investigation comes to an end he will be able to leave the country as scheduled the middle of this month.

the u.s. state department says an official from the u.s. consulate general in jerusalem has visited teriq in custody, a state department spokesperson said we are profoundly troubled by reports that he was severely beaten while in police custody and strongly condemn any excessive use of force. we are calling for a speedy transparent and credible investigation and full accountability for any excessive use of force. >> in florida several of the teen's close relatives are speaking out including his aunt. she is furious about what has happened to her nephew and any allegations he attacked israeli soldiers are ludicrous. >> he was attacking them? they are geared from head to toe and bullet proof vests, heavy helmet, shields on their faces, holding shields, heavy boots in which they kicked him in the face with if you watch the video. how is he going to attack them. the beating happened while he was in handcuffs.

the case was going to be swept under the rug. there are other incidents where once black twitter gets a hold of something that is racially charged you get results. this is another example of that. that's number one. number two, the difference betweening a radio personality on air and being a public figure and taking that radio personality and expecting different results because back to what jimmy said in the parameters of a show you kind of expect the sarcasm or that riding of the line. where as in society when you start putting it out there, and you have genuine animosity and anger being fueled as an individual, it's a completely different -- it's viewed in a different way and should be addressed differently. i think anthony and even those that listen to the show saying that well, this is something he's always done, is inexcusable. he is a public figure. when you're a public figure there are certain things you cannot do in the public sphere. he is not paid as a private

citizen so it is what it is. no, he's paid because he has over 160,000 twitter followers, has a national following. you do something like this, the ramifications are a lot bigger. >> let me clarify something. i know there are people listening saying what is black twitter? it's not a different website. it's just when black people pick up an issue and through hash tags and retweeting and it becomes something carried by a group of people. i know even people who are black are thinking black twitter what is that. that's when black people specifically pick up an issue and carry. >> so let's talk about kumia for a moment. both of you agrees these tweets don't seem out of character. listen to one example from last fall. >> i'm not going to be convinced, i see things with my own eyes, and it's not -- i'm not blinded by this [ bleep ] media, by this cow towing and egg shell walking that we have to do as far as when black people are concerned in this

respect them as consumers. and that's the problem, that's reason why xm when you hire shock jocks you have that understanding that you can ride the line but once you start offending our customers at a high level you have to go. that may not be written in the contract but that is clearly understood. you are still selling a service, so how can you disagree with people, make them uncomfortable without offending your customers to a point or parts of your consumer base, to a point where it now is a disadvantageous relationship to have in place. that's something that is never going to be in print but understood when you have these type of contracts dealing with the media. and it is what it is. i understand that as a media personality and as a public figure, so the best one understand that relationship ride that line well, they can still go out and even people that hate them still want their picture, and still follow them on twitter. >> it's pushing the limits without going over the cliff. >> absolutely. they want you to be controversial but not too
