i'm christi paul in atlanta. 6:00 here on the east coast. >> and 5:00 a.m. here in ferguson, missouri. good morning. i'm victor blackwell. >> good morning. we want to welcome our viewers in the u.s. and around the world. this is "new day sunday." at this very moment, as the state imposed curfew in ferguson comes to an end victor is there. this is in the wake of breaking news that violence again exploded more than a week now after the killing of an unarmed black teenager by a white police officer. what do you know happened, victor? >> hours ago christi, police used smoke canisters and tear gas in response to a shooting minutes into this five-hour curfew. the top security officer on the scene, captain ron johnson, says the show of force amid protest was triggered by a gunman who walked into the street near a barbecue restaurant. authorities first deployed the

smoke canisters to push back the crowd. >> then we got a report of a shooting victim near the kwik trip and barbecue, as they approached red's barbecue, they did deploy tear gas at red's barbecue at that point, that was the first canister deployed was there in an effort to move back and get to the shooting victim. also a police car at that location was shot at. >> captain ron johnson there, also said authorities clamped down on protesters in response to the shooting, not the curfew violations. seven people were arrested though not the alleged shooter. they don't know where the shooter is to my understanding just yet but we know the victim is a male in critical condition. right, victor? >> yes. that's what we're getting. male, critical condition. and for now the streets of ferguson are quiet. behind me you've got maybe a half dozen protesters who have

been here and as vehicles drive by they put up their hands and say hands up don't shoot but they are right across from the ferguson police department. of course, that curfew has expired and they are allowed to be here but they have been here for hours and the police here, because the state has come in, the local police have done nothing about it. effectively they have been taken out of the security equation. >> we should point out there have been very peaceful demonstrations and very peaceful protests here and there. missouri's governor, though, got to the point he had to issue an overnight clampdown that we've been talking about and declared a state of emergency. he did that yesterday, again this is one week after 18-year-old michael brown was fatally shot. you know his killing has sparked incidents, not only of protest but also of looting. this, what you're seeing here, one of the more peaceful

protests. but it has gotten nasty and you have to feel for the shop owners who now have a lot of cleaning up to do. victor. >> yes. they certainly do have a lot of cleaning up to do. they started after what we saw friday night. there are protesters you saw but also the agitators and early this morning, yesterday demonstrators t protesters here raised their arms into the air an action to symbolize what some witnesses say brown did before he was killed by darren wilson. >> there are reports he held his hands up and said don't shoot. a brown family lawyer announced high profile pathologist michael baden who testified in the o.j. simpson case, is going to conduct a delevar seyed mohammad reza autopsy on brown's body t revelation as the quest for answers in brown's death continues. we do not have a time line when that will happen do, we, that second autopsy? >> we do not have that time

line. that's something that we heard from the family's attorneys that michael baden will come in for the second autopsy. so, the situation here at this moment, the curfew ended, that ended at 5:00 a.m. local time, 6:00 a.m. eastern, and overnight we saw a return to what some hoped was gone, those tactical vehicles out dealing with some crowds, smaller this time, i want to bring in ana cabrera who will give us the latest and how that corresponds with what we heard from captain ron johnson earlier in the day. ana. >> reporter: overall i think things are improving, as you mentioned, the streets are quiet this morning, peaceful, it's calm. that curfew expiring and we're just seeing few cars out on the streets this morning. we know the protester groups last night were smaller than we've seen in days past and although there was some unrest, we didn't see the looting that we've seen some of the more

heightened escalated violence that we had seen in the past week. so, there are some things that i guess you could consider small victories in this bigger picture story. i know that many people here in the community are looking forward to returning to a sense of normalcy where they can get back to their lives as they know them. school is supposed to start on monday, so as we move forward the call for justice has not decreased, but peace certainly seems to be improving around here. >> after that warning police took action against a group of protesters defying an overnight curfew. >> they didn't agree to that. they felt they wanted to be out here and so they stayed and

police shot tear gas over there, or some kind of gas, and it dispersed them, most of them left. >> the curfew comes after a tense community meeting at a st. louis church. >> i want to first start by thank youing all of the elected officials and faith leaders. >> missouri governor jay nixon, captain ron johnson and other community leaders attempted to address many of the concerns still lingering. >> i called on the department of justice to conduct an independent investigation of the shooting death of michael brown, an investigation i'm glad to say is beefed up. >> intensity escalated. >> you need charge the police with murder. >> the task that we have at hand, the task for which i have the task to lead, is the task first of all to represent the people of the state and the people of this area. >> what we're doing now is not

who we are. it's not who we are. yelling at each other is not going to solve that. we're all talking about the same concerns and the same passion. the frustration is in your home, it's in my home. it's in my home. >> we're hearing the police asked for security. what we're asking the police for security and we're not getting it. day after day after day. investigations don't make you feel safer on the streets. they can have a curfew. i don't feel safer because of that. >> reporter: so we know there is a rally planned for today, once again call for justice in the death of michael brown. let's talk about the investigation and where we go from here. we know there are about 40 fbi agents who are on the ground this weekend here in ferguson, planning to really focus their efforts and the canfield green apartment area making sure that they reach out to other potential witnesses who may not have been interviewed yet. they have been doing those

interview, they interviewed the police officer involved in this case twice now, initially right after the shooting and then a much more in depth interview maybe days later and still going over the autopsy results, the ballistics, the dna evidence that's been collected. i had a chance to speak with an attorney who has been familiar with similar cases like this, victor. he says he's known investigations to last up to six months in similar cases, so it's still going to be a while before we have answers. >> yeah. we'll see if there is patience for six months in this community to get answers to that shooting. thank you very much. christi, you remember that captain ron johnson committed as soon as the governor tasked him with taking over security that he would hold a news conference every day. he spoke about 2 1/2 hours ago. we'll see if another news conference is announced for later today. >> hopefully because at the end of the day, one thing that did come out is that we don't know

batting the militants on the ground and this is all for control of iraq's biggest dam. our cnn crew is near the area, they heard explosions, they have seen smoke, mortar and rocket fire. hundreds of militants are surrounding the dam, a kurdish forces trying to push them back. so let's talk to anna coren. she joins us by phone. thank you so much. first of all, is there any gauge how much progress these air strikes and kurdish forces have made in trying to get to the dam? >> reporter: there were about nine air strikes yesterday carried out by the u.s., and they have allowed the peshmerga special forces to regain quite a bit of ground. we've been with them for the last five, six hours, and there have been on the front line firing, heavy artillery, mortar,

rockets, missiles, toward the enemy. a lot of smoke on the horizon, obviously the targets that have been hit. but the isis militants have also been attacking. there has been incoming missiles as well. but the peshmerga would seem to have the advantage, they managed to push them back out of the town which we're looking down onto close to mosul lake which runs into mosul dam. mosul dam i might sad 25 kilometers from where we are. so there's a lot of territory between here and the dam before the peshmerga forces are able to capture it or reclaim it from the isis militants. we also know that the other dangers being posed to the peshmerga is these land mines and explosives that are laid

beside the road, inside buildings. we heard many explosions over the course of the morning and the commander said that is isis trying to drag out people into urban warfare and then cause a great number of casualties. obviously the peshmerga special forces, they are extremely equipped, though i must say christi, they don't have any of the u.s. weapons that we've all been talking about. meant to be arming the peshmerga taking the fight to isis, the commander of the special forces here says he has seen no evidence. >> he has seen no evidence that the u.s. has armed the kurds yet? >> that's exactly right. he said you know, that they are the leading division and they are operating with old weapon, weapons they had for years. if they want to defeat isis, they definitely need to be

better equipped. isis has u.s. weapons. they have seized what the iraqi army had when they deserted, when isis was coming in, especially mosul, iraq's second largest city. so isis has the superior u.s. weaponry. the peshmerga forces don't. >> right. one of the ironic painful twists. anna, thank you so much. glad you all are safe and we appreciate the updates. >> here is another story a lot of you are talking about. rick perry. well, he is furious about the abuse of power charges coming against him now. and he's promising, he's going to fight back.

texas governor rick perry calling his indictment politically motivated and vowing to fight back. he is accused of trying to force an official to resign after she was arrested on drunk driving charge. perry's indictment -- >> i exercise authority to veto funding for an office whose leadership had lost the public's confidence by acting inappropriately and unethically. i wholeheartedly and unequifically stand behind my veto. >> perry's indictment is the first of a sitting governor in texas on such charges since 1917. that's according to the "dallas morning news." let's talk about president obama. he's going to be back in

washington, taking a couple days off of his vacation. the reason for his return that hasn't been announced. it's still unclear but he is scheduled we know to hold several meetings, and of course this comes as protests and violence in ferguson seem to be getting worse. let's go to renee marsh in washington. we know that the department of justice asked police not to release the video showing michael brown allegedly robbing that store. the federal investigation moving forward. do we have any indication what agents are focusing on now? >> we do know, christi, that new witnesses have been interviewed and that comes from captain ron johnson on the ground there in ferguson. we know that about 40 agents, they returned to the neighborhood where michael brown was shot and killed. they went door-to-door. they are continuing to look for even more witnesses and they will continue to do so over the next few days, looking for people who have not yet come forward.

meanwhile, the push for a second autopsy on michael brown continues. we know that the state already conducted one as part of its criminal investigation. but the family attorney wants another one done and he wants the justice department to oversee the process. remember, the autopsy results have not been released, so we still do not know how many times brown was shot. we know that the request for the second autopsy, pretty much begs the question, do they believe that the first one perhaps wasn't thorough or accurate? or the attorneys for the family, they were asked that question last night. here they are. >> the purpose for the autopsy that we called for was so that we could have information that we can rely on and that we trust and that we could put our fingers on once it's done. >> so they are not so much saying they don't think the first autopsy was accurate or

thorough, but essentially the goal is they want to verify the number of gunshot wounds, trajectories, we know they hired their own pathologist, michael baden. baden testified in multiple cases including o.j. simpson, drew peterson, but so far no official word from the department of justice as to whether they will, in fact, agree to oversee this second autopsy. christi. >> all right. renee marsh, thank you so much. we appreciate information. we are going back to ferguson after the break here. people asking about the shots fired as she was talking about in michael brown's death, and what role this investigation is going to take as it moves forward when we've got so many different agencies involved between police departments and now the fbi, 40 fbi agents there in ferguson. we'll tell you what's going on. plus, police say this couple not only kidnapped two amish girls,

it's the bottom of the hour. we're glad to be your wake-up call. let's get you your five things you need to know. one, it's not been a quiet night in ferguson. the curfew has been lifted just about a half hour ago. we learned seven people were arrested with police using smoke canisters. ultimately, police say they had to use tear gas to get to a shooting victim at a local restaurant. two, kurdish troops are battling isis militants in northern iraq trying to take back the country's biggest dam from the terrorists who seized it earlier this month. our cnn crew on the ground tells us they have seen explosions, smoke, mortar and rocket fire.

the kurdish fighters advanced toward the dam after u.s. warplanes and drones bombed isis targets. three, pro-russian separatists shot down another ukrainian fighter jet. this marks the third known military jet destroyed by rebels since the conflict began. ukraine's news agency says the pilot ejected and is safe. number four, investigators say the two amish girls abducted were sexually abused while they were held. a couple has been held and they are charged with kidnapping. the sisters were abducted from in front of the family's home. they were set free about 24 hours later. >> and five, a 53-year-old woman is accused of stealing about $60,000 of lego sets and trying to sell them on ebay. police say gloria house was arrested thursday after

allegedly stealing 800 sets of the toys from a long island storage facility. she's been arraigned on grand larceny charges now. christi, in ferguson it's a half hour since the state-imposed curfew ended. and it's pretty calm here. >> well, that's thankful because i know we have this wake of breaking news that police had to use smoke canisters and tear gas. i hear some of the pictures we're getting in, this is in response to a shooting just minutes into that five-hour curfew i should say. we know the top security official on the scene said a squad car was fired on as well but nobody else was shot, right, victor? >> yeah. there was that one shooting victim but no one shot in the squad car. captain ron johnson is the top official, he said authorities clamped down in response to the

shooting and he says not the curfew violation, he also announced that seven people were arrested and of course it's been in seven days that was saturday night, seventh day since mike brown was shot. >> yeah. these pictures are something else to see. the curfew we know as victor said, it's a week now after this 18-year-old michael brown was fatally shot by a white ferguson police officer. we want to let you know a brown family lawyer says a pathologist, you know him, michael baden, he will conduct a second autopsy on brown's body. but we do not have a time frame as to when that will happen yet. right? >> yeah. we have not received that information. the confirmation michael baden will do that autopsy, the second autopsy, came from the family's attorneys. but we know overnight during that period of curfew, midnight to 5:00 a.m., enacted by governor nixon at that community

meeting yesterday, what we heard initially from captain johnson was what we were going to see would be different than what we saw on friday night. and then on wednesday night the response using the gases, using the trucks, that tactical teams using the military style response, first, listen to the captain in his own words describing what will not happen and what was not supposed to happen overnight. >> tonight we will enforce that curfew, we won't enforce with it trucks, we won't enforce with it tear gas, we'll communicate. >> that was in response to all of the questions and the concerns that were shouted out during that community meeting. it was very contentious, what we know what happened overnight, let's listen to captain johnson about three hours ago explaining what he says his troopers, the officers had to do to control the security situation here. >> we got a report of a shooting

the investigation. having information that is reliable so the family can be clear as to what happened. so i think a step in retaining an independent expert and michael baden obviously he's renowned, very skilled at what he does, he is efficient. i know him well. i think you know, bringing in a person like that would be a good step in terms of getting fresh information that the family can rely upon as opposed to relying upon what they are told, victor. >> tom, our twitter followers have been sending in questions about ferguson and what's happening here. they are using the hash tag ferguson qs. one, were forensics, et cetera, done on the police suv? >> yes. that would be absolutely normal procedure in any case because you have this incident or encounter between officer wilson and michael brown happening at the police car, and the reports

that the first shot was fired at that police car, either within it or close to the door. so, the examination of the car would be necessary for looking for gunpowder res a do, or other physical evidence of where that first shot occurred. >> tom, we know you're not a medical professional but we're going to give this question to you anyway from our twitter followers. if punched in the head could a concussion distort the cop's judgment, that gets to the larger question of the reliability of his story and the actions thereafter. >> well, it depends on how hard he was hit and you know, the nature of that injury. it's enough to take nfl quarterbacks off the field for a while when they get hurt in the head. we don't know that it happened. but if it did, and if he was, you know, hit hard enough, and michael brown is not a small individual, so if he put full force into a punch in the head,

that's a good possibility. but we don't know that and we may really never know that. >> so joe, let's talk about officer wilson. darren wilson, the man who shot and killed michael brown a little more than a week ago now. preparation for charges. do you think that's something that's happening now and how does one prepare him or hersex for those charges? >> sure. i think it's very likely that charges will be forthcoming. briefly to the other issue that you raise. i think that if the door came back and hit him or someone punched him it could be that the argument is that he was upset and he retaliated so that certainly is something the prosecution will look at in the case. in talking about charging victor, i think it's important that obviously the investigation has integrity. i think they will look at a grand jury, presenting the information, but exactly who oversees that, will it be the county attorney, will ultimately the state take charge, or will the federal government take charge of this because at the end of the day you want to make

sure that whatever is done by the grand jury it can be relied upon. remember that the whole reason to have a grand jury is so that they can assess the evidence, they could get everything that they need, they could evaluate it and they could determine whether there is probable cause or a just base ties render an indictment. so it assures public integrity. i think charges could be forthcoming, what they are will depend upon the evidence that is presented to them, and what that evidence shows as to darren wilson's actions. >> joey, let me pass on to you a question that christi asked. the store owners who rightfully expected that police would protect their businesses from looters a couple nights ago, those officers did not step between the looters and those businesses, do they have some credible case against the law enforcement agencies that were there? >> generally not, victor. there is immunity that attaches to what law enforcement does. and while we certainly rely and

rerespect that law enforcement officers will do what they need to do, which is to protect the public, protect businesses, generally there is no cause of action or lawsuit that will lie against the police department in the event they are not successful in pushing back, you know, people who are termed looters and obviously we know that many people out there doing what they need to do peacefully, they are not damaging or affecting anything. but as it relates to those few people who do loot i wouldn't look to the businesses to actually have a cause of action against the police department for not preventing them from doing that. >> all right, joey jackson, tom fuentes, good to have both of you as we unpack both the initial, the primary investigation about the shooting and then the secondary concerns of all of the happening in the wake of the shooting and the protests. christi, back to you in atlanta. >> nice job, victor. thank you so much. you know the pope is making history again. we're headed to south korea

new images of pope francis in south korea. thousands greeted the pope on what is the second to last day of his historic trip to the country. the pope hasn't set foot in the

country for two decades. cnn's paula hancox is live in seoul. the pictures are awesome. i have to think the energy was something else, paula. >> reporter: absolutely, christi. south koreans are so excited to see the pope. we've seen hundreds of thousands of people that are coming to greet him, coming to hear his masses. we heard today he had a closing mass for the asian youth day. this is one of the main reasons he came, he wanted to speak to the youth of asia, thousands of them coming from more than 20 countries around this region because he knows that there is significant growth in south korea when it comes to young age catholics. he wanted to speak to the next generation of the catholic church. an interesting thing that happened, there was addition to his schedule. pope francis baptized the father of one of the ferry victims.

overnight. we're told there was a shooting, a man with a gun inside a restaurant. i want to bring in my colleague ana cabrera. she has been covering the unrest following the shooting death of michael brown. the governor's curfew did not go as planned. does it seem like i mean, this is now a reassuring presence from the governor especially considering the community meeting yesterday. >> reporter: of course he put that curfew into place in order to restore order to the streets of ferguson. but as you mentioned, one person was shot, we know that person is in critical condition. don't have a lot of detail about exactly what happened. but the missouri state highway captain ron johnson telling us that it was a protester who was shot by somebody else in the crowd. and as a result, we're told that's why police did have to move in using force, deploying tear gas as well as some smoke. however, i want to put this into some perspective compared to the

nights we've seen the past week where we saw looting and a greater sense of unrest and protesters, at least individuals within the crowds of the protesters getting more out of control. we know there were seven arrests last night. the groups that were holding ground so to speak after that curfew were much smaller numbers. our crews on the ground telling us there were a few dozen people who tried to maintain their presence on the street. and that those people tended to be of a younger demographic in their late teens, maybe early 20s. again, it's unclear exactly if they are ferguson residents since it's the weekend we know other people from surrounding communities have been coming into town as well. the governor seemed to say the right thing that his press conference yesterday afternoon in the sense that he said they are demanding answers, they asked for an expedited investigation. and is demanding peace but again w that curfew people weren't happy about it. i want you to listen to this

exchange. >> excuse me, governor. you need to charge that police with murder. >> the task that we have at hand, the task which i have the task to lead, is the task first of all to represent the people of the state and the people of this area. but also to make sure that we have peace and security. >> so you heard there was that interruption and there were a few other interruptions throughout that press conference, the governor not coming across completely in control of that situation even. which is unfortunate because this is clearly an issue in this community of unrest and a call for justice. i don't think people here are

going to feel good about anything until they have some answers. and we do know that those answers could still be a long time coming in the sense that we have separate investigations on the federal level and on the local level. we know there are some preliminary things that are complete but again, just preliminary as far as the autopsy, we know that evidence has been collected and that investigators are going through ballistics, through dna evidence, are still reaching out to other potential witnesses. we know 40 fbi investigators were sent to the scene and we're told are going to be in the area where michael brown was shot and killed. we know the police officer involved in this has been interviewed twice now by investigators at the federal level, first to have his initial take and then a more thorough investigation and interview a few days after the shooting. we know there are still perhaps two more autopsies to come as the family attorneys are conducting their own autopsy and

have also asked the justice department to do one as well, victor. >> yeah, they announced from the family's attorneys that michael baden who testified during the o.j. simpson trial will conduct the second independent autopsy as part of the family's investigation. so we'll see. there are so many investigations happening now, what the family and what the community wants is results, some answers. thank you so much for being with us. let's bring in the author of "rise of warrior cop" the militarization of america's police forces. the past few days including what we saw last night, the streets of ferguson in some ways looked like a war zone. the growi ining militarization been a concern for years. we look at wednesday night and friday night, and to a lesser degree what we saw last night, is this too much? what do you think? >> well, i think it is too much.

we want the police to be adequately prepared to respond when there are actual indications of violence, but that initial protest in ferguson on sunday afternoon was peaceful and it was still met with riot gear, met with snipers, and i think that set the tone early on for confrontation. i think it said to protesters, you know, this is not a safe zone for free expression. i think people are reacting to that. i also find it interesting that when the state police came in and we saw the head of the state police hugging protesters and talking to people and sort of treating them like human beings, that night was fine. there was -- it was peaceful, people were still protesting but there was kind of a feeling that things were getting better. and then the next day you imposed a curfew i think creates unnecessary confrontation, it sort of gives people something to rebel against.

so, you know, i'm not sure why the curfew was necessary and it looks like that's exactly what happened last night as we saw things flare up again. >> to be fair -- just to be fair the curfew was enacted after that night of looting and shooting and the resistance from some of the agitators, not just those who are protesting. so that i guess would be their argument for why they enacted that pro -- that curfew. >> that's great. great clarification. thank you. i wanted to read something, the aclu had regarding a statement they issued. they say our neighborhoods are not war zones. and police officers should not be treating us like war time enemies and yet every year billions of dollars reveal -- worth of -- sorry, billions of dollars worth of military equipment flows from the federal government to state and local police departments.

departments use these war time weapons in every day policing, especially to fight the wasteful and failed drug war which has unfairly targeted people of color. again, this statement was made after the initial couple -- first couple of days of i guess what we would call this crisis there in ferguson. do you agree with that statement, radley? >> yeah. i do. and the aclu put out i think a very important report a couple months ago, documenting militarization across the country. when you militaryize the police this way it puts the police officers in the mind-set of being soldiers instead of peace officers. it's not -- this is a comment on police officers or on their you know, their talent or capability, it's a very human reaction. when you give somebody a military weapon and you dress them in military outfit, train them to military tactics, that

fosters that kind of mind-set. from the perspective of the community it makes them feel like they are being occupied or oppressed by an outside force instead of being represented in the police by members from their own community. i think this is also where the racial, the disproportionate racial makeup of the police department also fosters i think that mentality on both sides. the police can't see themselves in the community i think that's a problem and the community can't see themselves in the police. that's also a problem. >> radley, stick around. we thank you and we're going to be right back. let's bring back radley t author of "rise of warrior cop." radley, there was a veteran who was on yesterday who talked about watching what's happening here in ferguson over the past week and he highlighted that even they didn't use tear gas, namely when they were fighting overseas because it's banned by the geneva convention as a tool in war but it's used here on americans in ferguson. talk about that, about using some of these tactics that even as they get some of the resources from the military, not tear gas but the equipment, and the military doesn't even use some of these on foreigners in war. >> yes. so a lot of police departments across the country through this pentagon give away program where

they give away surplus military gear to police departments have gotten things like machine guns and tanks and armored personnel carriers that shoot 50 caliber ammunition is a good example. the military has restrictions when they use it. it will go through 8 to 10 city blocks. this is not remotely appropriate for civilian policing. this is stuff that's designed for use in a battlefield and in this case even limited use on the battlefield. being given to, again, to domestic police departments for use in domestic settings. you talk about drug raids. the way the drug raids are conducted in this country i've talked to people who have both conducted and trained raid teams in afghanistan and iraq who have watched some of these s.w.a.t. raids and told me people would be court-martialed if they did that during these raids that the military conduct to look for insurgents. i think there is something to

that. i talk about the militarization of police departments. i had people in the military tell me that they agree with the general premise and the problem but object to the term militarization. even the military in some cases gives people greater respect for their sort of civil rights than the people get in the united states. >> so radley, we have about a minute left, the pentagon stands by this armed sales program, there surely has to be some sort of mandated training program for these departments. how concise and how thorough is it? >> there isn't. this equipment gets transferred to police departments with no training requirements from the pentagon at all. it's basically left to the police departments to do their own training. in some cases with the applications for the mraps and the pentagon requires the police department to come up with training or argue what kind of

we learned that pro-russian separatists shot down another fighter jet. this marks the third known military jet destroyed since the conflict began about six months ago. ukraine's news agency says the pilot ejected and is safe. also ukraine now says that the convoy of russian trucks that showed up on the border is in fact humanitarian aid.

there was question about it. initially there was no idea who or what was inside the vehicles, where they came from. no word when the supplies will be transferred to the hundreds of thousands in need there. kurdish troops are taking the fight to isis, militants in northern iraq now, they are trying to push the extremists back from the country's largest dam. i want to show you new images here from the scene. the battle is raging right now after u.s. warplanes and drones pounded isis targets. our cnn crew is on the ground near where this fighting is going on. and they tell us there have been huge explosions, rocket and mortar fire. cnn's ana koren is in mosul. is there a gauge into the progress the u.s. and kurdish forces had in this fight thus

far? >> reporter: in the last hour we learned that peshmerga special forces in kilometers of that. the problem is what's on either side. so they are currently clearing out the area that has been battled. we've been since early this morning and they have been aggressively targeting the militants with heavy artillery, lots of smoke has been on the horizon, lots of loud explosions. it was seen that the militants have retreated, the problem is they have gone and laid land mines explosives along the road and certainly in a number of buildings. we also believe that there are snipers along the main road from us to where the dam is, mosul dam. we're in mosul province, we can see mosul lake and the dam, obviously flows on from there. yes, we do understand that

peshmerga soldiers are within kilometers of the dam having a brutal battle with these isis militants who certainly are digging in. >> and how resourced, how prepared are the kurds because as i understand it, isis is fighting with american weapons, the kurds are not so well equipped. >> reporter: yes. that's exactly right. obviously the air strikes the u.s. air strikes have been a huge shock to the forces on the ground. there were nine air strikes yesterday. we heard the jets, the drones circling. we understand that they hit targets and also around mosul dam. obviously not near the facility because the other information that we are learning in the last few minutes is that the militants are laying mines around the dam, we already know

that it's unstable. we heard that from the u.s. army. from civil engineers, it's called the most dangerous dam in the world, the reason being because of the shaky foundation. it has to be grouted where they pump in bedrock to keep it stable. the concern obviously with isis in control for the last couple of weeks is the maintenance hasn't been undertaken the way it normally would be. there is also the concern that isis could use this as a weapon, they could blow it up, they could open the flood gates which would inundate mosul and baghdad, killing thousands. it would be catastrophic. isis knows that they have this bargaining chip, the u.s. is very aware of it as are the kurdish forces which is why the situation is so sensitive. >> anna coren we appreciate it. we'll keep you informed as well as we get more information
