husband, it is a situation we see over and over again with domestic violence and this couple has maintained this was a one-time incident. they both said this is 30 seconds of their life. they have known each other since high school. they have a child together and they decided to get counseling and move forward together, that is basically what runaway was te is basically what runaway was te -- ray said. >> i basically said, as far as people reaching out to me, i want to as a friend, a former teammate, let him know listening i am asking asked questions, i want to ask him truthfully. he said it is hard, because you have been in that locker room with them three or four years and you know what type of person you saw in that locker room. but with the video it kind of changes your perception on you

know, ray as a person. so it was hard to watch. but you know, what he and i talked about today briefly i'm intending to keep that confidential other than just to say you know, i just reached out to him to let him know hey, this is what i'm doing. and i didn't want anyone or him to see it and say well, what is derek doing? why is he talking about me or commenting on this? i felt as a friend i needed to do that. >> jeff, when you hear the commissioner, roger goodell, he said we didn't know what was on the tape. but anybody with brain cells can tell you if you're dragging an unconscious woman out of the vehicle you can get a pretty good idea of what happened inside the elevator. and the fact this video, i understand police may not be releasing it. they have such good security sources i wasn't sure the nfl could get it, but the idea the attorney had the tape and the attorney didn't say to rice's people give us everything you

have on this -- >> well, think of the leverage the nfl had, too, ray rice is coming to them, the attorney is coming to them saying please let us back in, please let ray rice play again. >> it is the most natural thing in the world to say in order to make the judgment you give us all the evidence in this case. so the idea that the nfl couldn't get this second video is just preposterous, but equally preposterous what goodell said in that interview, the second video didn't make a big difference, but, it made a huge difference because it was only them that they suspended indefinitely. so his position is incoherent at the very least. >> and his wife, with blaming them for him losing his position with the ravens --

>> of course it is his fault, but with the culture of domestic violence, it is something i prosecuted during my year as a prosecutor. i can't tell you how many times we prosecuted a defendant, she walks in on the day of the trial with the defendant and is supporting her boyfriend or husband or her man. so i think her reaction makes a lot of sense, quite frankly, unfortunately. it is something we see all the time. but it is really sad that the nfl somehow is saying that there is due diligence, that they did their job and asked the prosecutor and the police department. because that is the source that you trust. well, then just get it from the casino. the nfl has a team of investigators who investigate so many of these incidents. i know people -- >> as we say, we're going to have an independent review and

set up an independent review on how we handle this matter that didn't -- >> okay, but don't interview our witnesses or tamper with our witnesses, maybe they did say that but the video was the video. >> exactly -- >> so their position is just ridiculous. >> rachel, goodell is saying -- also he is not saying it is possible for ray rice to play, i mean, suspended indefinitely. he left it open that maybe ray rice is going to come back and play. >> i would expect him to play or at least give him the opportunity to play. we saw michael vick in prison and then come back and play. however horrific the offense is, in this country we don't generally say you can't work the rest of your life. ray rice will sit out at least a year, we'll see if he sits out anymore. the real question, is the league going to change, roger goodell going to change --

>> in your opinion, derek, does ray rice deserve another chance to play in the nfl? >> i think he does, i'm a strong proponent of second chances, to say that okay, after one offense or mistake or whoever -- whatever the case may be, not just in ray rice's situation but any other player i do believe they have a right to be allowed the second chance, now there are things he must do to get a second chance or before the league even hears him at the end of the season. but yes, he does deserve a second chance, now will he get it? we don't know. the commissioner might give him a second chance, are one of 32 teams going to pick him up? we don't know. it all depends, you give him a second chance but the other teams might say hey, we don't want this guy a part of our locker room. >> as much as ray rice's wife

wants to keep it private, and we can understand her position, you don't have a right to privacy on something like that. >> right. you know, one of the phrases that i think really misleads people when it comes to domestic violence is press charges, whether the woman decides to press charges. it is not up to the victim to press charges. domestic violence is a crime against the community. when you rob a bank, it is not up to the bank whether the case is charged. it is a crime that gets charged no matter what. and as sunny said it is often the case that the victim doesn't want to testify. there are some jurisdictions where they will arrest the victim in order to bring them in to testify. that is how serious they take domestic violence. you always hate to see that happen. but this is not just -- she is not the only victim. >> and the idea that ray rice's record can be wiped clean that he just has to go to some counseling basically, and it is

like this thing never happened. >> it is remarkable. and i think what bothers -- has bothered me so much about the way this was handled by the prosecutor's office is that they allowed him to enter into a diversion program. and i -- in new jersey, i made a lot of phone calls. and it is clear to me that most of these cases, domestic violence cases do not qualify for pretrial diversion. they just don't equal. they didn't qualify when i was prosecuting cases. and quite frankly when you look at the law it was clear if there was an actual intent of violence this program is really supposed to err on the side of not including the defendant. so i can only say that i think that this is celebrity justice at work. and i know people are uncomfortable with that. that is what happened. >> also last night you pointed out if it was animal cruelty they wouldn't even be eligible for diversion -- somebody was spinning that reporting with the

but that didn't stop him from playing football again. today he plays to the canadian football league, alouettes. and just today, san francisco starter ray mcdonald was arrested for domestic abuse. the report was she started fighting and she received bruises on her neck and arms. the bee reports that his fiancee was ten week's pregnant. >> mcdonald was released on bond. >> can't say too much on it right now. everybody knows the kind of person i am. >> with the case pending the 49ers are talking tough. >> domestic violence is unacceptable. and certainly will not be tolerated. >> for mcdonald, it gives him the benefit of the doubt for now. he is still on the field. randi kaye, cnn report.

i want to return now to the nfl's claim on the news tonight by the league commissioner roger glene goodell, they tried to obtain all the facts they had. a lot of people had a hard time believing that. people are wondering how the league could have seen video of ray rice dragging his fiancee's unconscious body from an elevator and gave out such a mild punishment, even though league officials considered what might have done to her inside the elevator to make her in that condition. the former team executive insider joins us tonight. >> louis, the fact that the nfl commissioner goodell told us they had not seen video, we thought there was a video. we assumed there was, we asked for the video but didn't get it. what do you think of that? you played for the philadelphia eagles, do you buy that? >> you know, you have to take him at face value for what he is saying.

you don't want to start questioning somebody's integrity as far as whether or not they're telling the truth. i say that from my experience, the individual team security departments that i have worked for, some of these guys have been some of the best that there is. i notice that they have had great relationships with both local law enforcements, state law enforcement, with businesses throughout the area i have worked and specific cities. i can assure you these guys would have had this video for the baltimore ravens. in this case they would have had the video of what happened in that elevator. there would not have been any question as to whether or not there was something you know that took place in the elevator that would have caused any gray area. they would have known all the facts. i can assure you that. >> right, i know that hotel in atlantic city. it is so obvious they would have had camera inside the elevator especially once they saw the camera outside the elevator. you think it was then incompetence or willful

negligence? and they didn't want to actually see it because then they would have to take it more seriously? >> yeah, those are the kinds of explanations that you really don't want to believe. you don't want to believe that anyone would really go there. i mean, that is where we're having this discussion. that is why you know, the outrage surrounding this whole issue is what it is because you know that there are probably ways you could wind up obtaining this kind of tape. i know in my experience and the people i know that the tape would have been acquired and you would have been able to take a look at it. and the fact that he is saying that they did request it and they have requested it from multiple different law enforcement branches that couldn't get it, is -- it's just tough, tough to swallow, considering how violent and just how awful the video actually was. >> the first video, i mean, the nfl saw that of rice dragging his fiancee out of the elevator and she is unconscious, what do you make of the fact that that was not enough to merit more

serious action by the nfl and by the ravens? >> well, that is obviously something i've been saying over the past few days, i had a big, big problem with. the question i asked them and have repeatedly asked what did you expect it to look like then, when you eventually did see what happened inside? what did you think led to someone laying in the door of an elevator, lifeless on the floor. i believe her shoes were knocked off just -- and not moving. what do you think led up to that? did you think they were roughhousing in the elevator and somebody actually slipped and fell? you knew it was going to be awful. that should have been enough. in the places that i worked that would have been enough. and for myself, that is it right there. that is case closed as far as what you need to do in this kind of situation, it is zero tolerance, you put your hands on somebody like that, i don't really need any slangs, i don't care what your explanation is,

because this is just something that -- trans ends football, whether or not you're a good player or not. this tra . >> as far as exactly what you feel fair and the correct punishment is, my stance is if you do that one time you're out for me. i think players need to start getting it, that this is a privilege to work here, and it is not a right to be there. you can't act any way you want. i think that people are always going to -- to think people are going to make excuses for you,

charming man. charming and handsome and nice. they were our mutual friends, they were not just my friends. and i guess in retrospect i'm not really that surprised they didn't quite believe it. because they liked him. they loved him like a brother. i loved him once. >> looking back on it, does it -- i mean, did you learn from that? obviously, you ultimately left this guy. does it change the way you viewed domestic violence? did you learn? because a lot of people don't seem to absorb the lessons because it is kind of shocking, this person you love has done this to you. >> you know what? oddly, it took years and years for me to realize that a wrong was even done to me. >> really? >> i left and didn't want to be involved in that, too much drama. i was very independent. i didn't want anybody controlling me. but i didn't realize until years later that a crime was committed

against me. i didn't realize that until i was in my 30s. and i can't tell you why. one day i just suddenly sat up and said, you know what? that was just wrong. it wasn't my fault, no matter what he perceived that i did to him. >> and happening to young women in their early 20s, they feel -- they are easy to make -- feel like they played some role in it. >> well, it's your first relationship usually, right? 20 years old, you're immature, you think, oh, this jealous guy, he wants to fight all of these guys that are looking at you. he must really, really love you. you don't really realize that that is normal behavior that if you love someone and someone loves you back you both should be secure enough not to express anger when you're threatened by someone else. >> well, thank you for being on tonight, thank you, carol.

some more breaking news tonight, president obama told congressional leaders that he has the authority to carry out his planned offensive against isis in syria and iraq without their authorization, now whether the strategy that he will outline tomorrow night will -- last night on the program, a close friend steven sotloff and appeal spokesperson shared for the first time new details about how they believe the american journalist ended up in the hands of isis militants soon after he arrived in syria. the militants were said to have sold the friend to isis. he criticized the handling of the abduction and said the white house could have done more to save steven sotloff. last night in a statement, the white house said we understand the very real pain the sotloff family is feeling at this time.

our thoughts and prayers are with them as we hunt down the murderers of steven sotloff and james foley. today, the white house discussed the militants being involved in the capture. here is jim sciutto. >> reporter: president obama is preparing to address the nation on his strategy for defeating isis. which will depend in part on supporting moderate syrian rebels, so the allegations first on cnn aired by steven sotloff's friend were alarming. >> for the first time we can say that steven sotloff was sold at the border, we believe these moderate rebels, one of them sold him. >> barak barfi said that a moderate rebel group tipped off the situation, and then they swooped in at the lab

checkpoint. the moderate opposition, syrian opposition officials consulting with sources and activists on the ground also deny the story, however, the white house spokesperson acknowledged that there are lingering questions about who was trustworthy. >> this has been a difficult challenge not just for the united states but for other countries to confront. and that is vetting the individuals who are part -- elements of the syrian situation, to ensure the support that we're providing is going into the hands of the right people. >> reporter: today, the opposition is made up of some 12 different rebel groups, some moderate, some extreme, some in between. the reason that president obama has resisted arming rebels in any significant way. >> there are many groups, but

for the most part we mknow who their leaders are and who wants to implement an islamist government or whether they want secular governments. and we can pick and choose who our allies can be if the united states decides to fight the islamists in syria. >> reporter: to learn just how confusing the situation, they presented an entirely different allegation. the white house is reserving judgment on all of the questions until the fbi completes an investigation. jim sciutto, cnn. washington. i would like to welcome in our national cnn security analyst, fran town sesend. how do you determine how to

handle it? >> well, it involves how when they start to take over territory -- it would bring us -- we would go hiking for miles in the darkness. turned out to be often exaggerated and we were taking serious risks when we would do this. now, there were different armed groups and different armed factions. and as this conflict has gone on it had gotten more and more criminal. there are some groups that have grown more and more hard core. in other conflict zone, anderson, as things deteriorate the business of kidnapping rose and rose because people like me, people like steven sotloff, they become valuable targets that can

be bought and sold. the risk is that you can get grabbed and sold off to an ideological group such as al-qaeda and isis that could then do some of the terrible things that we've seen in these awful videos. that is the nightmare scenario when you go in and out of a conflict zone like syria, which is somewhat similar to what we saw in iraq. >> and to fran's point, the isis groups that kidnap and sell the person to other groups, do you believe that the u.s. knows exactly what happened to steven sotloff at this point? >> i done, anderson, and look for a lot of reasons i think we'll have to press the administration to be more transparent about what they do know. but not now. right? because we know that there are many americans who are kidnapped and who are being held. what you don't want to do is put them at risk. i think there is more questions than we have answers right now.

and it is not clear that frankly the administration has the answers we're looking for. look, it could be that he was sold out by his translator and pass around. i think it is likely he was passed around some of the different groups inside syria, but which ones is not at all clear. we have to be careful not to rush to judgment until we know more. >> ivan, how do you actually vet who you're working with? >> that is really hard, i have heard accounts from other sources that they had relationships with a commander, for example, for the better part of a year. and then the commander suddenly turns on them and then tries to make a few bucks off of somebody who had been a guest. there is also the really frightening scenario of kind of working with someone, an activist who could then sell you out. so my personal situation has been, as the kidnapping got

worse and worse in northern syria i just stopped going. different people than me would go and sometimes there were terrible, terrible results, anderson. >> and your friend last night on the program, obviously, mr. barfi, the family spokesperson said that so-called rebels sold sotloff. the fact that he called them so-called moderate rebels, to you, does that implicate the free market or leave it open? >> you and i don't know what mr. barfi meant by moderate opposition. certainly you and i wouldn't consider al nusra a front. the other thing, anderson, the white house has a whole inter-agency working group. i supervised it when i was in

lines of ray rice and his attorney, if you're ray rice's attorney, and the attorney would have probably said knowing the contents of the video, he would have said we're not going to show it to you, we don't have to and we're not going to do it. because i think if roger goodell had seen the video at the time, knowing what we now know, if he had seen the video at the time and object given him two games i think there is a good chance that you know he would have been you know -- extremely scrutinized by his own owners. >> and can goodell survive this? there is no indication he is going to appoint an independent investigation on how to handle this, to correct the problem. do you think he will survive it? >> i think he will survive it, anderson. you have to understand this. i think the powerful owners in the league realize that roger

goodell has been in the league for eight years. and during that course of time he has been asked to keep labor peace with the union. well, in 2011, they got a contract with the players through 2020. so that is a home run. every time he goes to the bargaining table with the television networks, he hits not a home run but a grand slam. >> so he is popular -- >> i think he is popular with the owners because he is enriching all of them. >> sure, he is popular because he is making the owners rich. but that is not how they advertise the nfl. the nfl advertises they said as part of america, i mean, shouldn't we expect more from the commissioner than just lining the pockets of the billionaires who are already rich? >> no question about it. i think there are owners who will have hard questions. they want to know from roger goodell, what did you know and when did you know it? did you ever see that tape?

and i think that some owners have asked him that directly. and he is going to have to convince them. but i believe he will be able to convince them and i don't think his job is in danger as of how. >> and rachel, you were talking about it as you were leaving. there were other players playing right now who have been convicted, well, one of them is appealing the conviction, he is still allowed to play. there is no video of him allegedly dragging his wife room to room, but that is what he has been convicted of. >> i would love to see all of this collective outrage being thrown out right now at ray rice, who is suspended. as far as the nfl is concerned right now. thrown at the process that is allowing greg hardy of the carolina panthers to play in the nfl. there was no video of what hardy did, but i want everybody to imagine the video of this. court documents. he threatened loudly to kill her, explaining to her that the assault weapons and handguns

that he had spread out on a couch were all loaded. then threw her onto that couch, landing on those weapons and told her several times she was going to die. she then later had to get medical treatment, of course, press charges. he was convicted. discharged but convicted. he is now appealing for a jury trial. >> and they're therefore giving him the video of the doubt. >> imagine there was a camera there, how are we not outraged, there didn't have to be a videotape for the nfl to act. tmz doesn't put the video on line? ray rice is still with the ravens, tmz doesn't expose some of the stuff they exposed earlier in the summer. the nfl should not be led by tmz, that is an outrage. >> does the nfl really take domestic abuse seriously? because there is another case of another player who was been suspended for a year. >> today, anderson, we had one

a lot of attention, a sports analogy, back in january, president obama gave an interview to dave remnick with "the new yorker." during the interview, president obama was asked about the 2012 campaign. he pointed out the flag of al-qaeda was flying in iraq and several factions in syria, to have the president responded quote, the analogy that we use, if a laker puts on a uniform that doesn't make them kobe bryant. in response to last week, the president said the jv comment was not a reference to isis. >> long way, long way from when you described them as a jv team. was that bad intelligence or misjudgment? >> keep in mind, i was not specifically referring to isol, i have said that regionally there were a whole series of organizations that were focused primarily locally.
