you say officers are being offered up as human sacrifice? >> yes. and great legal scholar, have opined on this as well and both have indicated that in their view that this decision by the baltimore prosecutor was politically motivated, that it was rushed over charged and done for crowd control purposes in order to help quell some of the riots. first of all, i concur with their findings and they're brilliant legal scholars i'm a cop. and i have a lot of time investigating homicides. i was lieutenant of detectives surprise homicides and i kind of know how these things operate.

i was astonished at the speed that this decision came out very quickly. and the thing that bothered me the most was when the prosecutor went down that political rabbit hole. they might be terms used in social justice but we're talking criminaljustice. >> i spoke with her right after her press conference and she said that she investigated it thoroughly to that point and believes there's enough evidence to support her charges. if these were not police officers but regular citizens isn't that how you're supposed to proceed here? >> i'm not saying she doesn't have the right to bring these charges but now she has to prove this beyond a reasonable doubt and these brilliant legal minds

i talked to said that isn't going to happen. but they are innocent until proven guilty. but she knew it was already charged. you want to take your time because you can't get any of this wrong. you don't get a do over when you issue these kinds of charges. i understand two people were misidentified and now these people with being harassed. it's those little mistakes that happen when you don't take your time. >> but by the time that this is all over -- >> and she comes out within 24 hours with this finding. it's virtually impossible to convince anybody that you took your time. >> but she has a chance to correct that. and you mentioned the no justice, no peace part of it, i asked her specifically about that. here it is.

voices or use the jargon used in the social justice movement. that would have been appropriate for the mayor to make some of those statements. the prosecutor is supposed to be neutral and not supposed to hear voices and not supposed to talk about some of the things that shy did. totally inappropriate for a prosecutor. last time we saw that was in the duke lacrosse case and we saw what happened there. >> do you see this as a black and white issue or a black and blue problem? do you see any problem in our currently being policed? >> no i don't see it either way. we send them in these impossible situation in the american ghetto. and some the result of a failed

these days and we in the media provide a lot of times going over their missteps. but we sometimes forget just how dangerous their jobs can be and that they're the first to respond to frightening situations because that's what we the public expect them to do. two police officers were killed in the line of duty in new york and idaho and we must remember that their families are grieving and as president obama reminded us police officers deserve our gratitude and prayers every day because of the dangers they face at any given moment. >> reporter: a small idaho community tuesday mourning the death of a police officer. he was kevin newen dofr's

tragedies. but i don't think we should mix apples and oranges. these are isolated incidents of people killing cops. when we're talking about unarmed african american men being killed by police we're talking about a system folks that work for the government, and they're doing what they do under the color of state authority and that's very different. so i do think country is mourning the loss of these officers and we ehave to remember that all lives matters, and including officers that protect and serve. >> do you think the out rage comes because they expect that police officers are going to be fair and honest and that's where the out rage comes from when it is deemed that they're not fair and honest, that they're supposed to be brokers of peace? >> absolutely. they're supposed to be that entity that protect and serve us

pup we have shown that these are bigger than the police agencies. >> and the most esrecent numbers we have violent crime is down. >> well part of the issue, don, if you go to the 21st century report it's even indicated in as much as crime is down, the relationship between police and community has not changed over the years and that's what we have to work towards in this country. but let me say something here real quick, police officers are recruited recruited, selected and trained, when they put on that gun and badge, they understand the chances they take and they go out there and protect us and keep us safe and they run towards twlubl the rest of us are running away from it so it is very important, don, that we recognize what they're doing.

because an attack on a police officer is an attack on society. and when they get killed in any city of america, us community leaders should acknowledge the fact that when they're assaulted and hurt that it effects all of us but at the same time too, i think it's important to note that we still have issues in this country, don as it comes to police and community working together in order to bridge things that have historically gone on. there's still work to be done but we have to support our police officers and the men and women putting their looivives at risk every single day. >> i don't think anyone disagrees with that. and i want to go back to crime and murder rates.

in the 1970s we wouldn't come here because of the crime rate and in many cities. if we were seeing those numbers from the 1970s would it be different? >> i don't think that's the issue. i think because of technology we're getting the witness what is happening on the streets in a way we never were. in the 1970s it was someone's word against the police and now we get to see, it not just dash cams and from citizens and they're showing us for the first time what's happening with respect to police and the communities they're policing. >> nobody is excusing police that abuse people -- >> and don kbroinow what here's the way i look tat -- >> there are problems with every

profession. >> and hopefully you weed those out but going back to the crime stats and i can talk specifically for new york city as a cop and the commissioner. the minority areas experience an 80 to 85% reduction in crime and they now know new york as it is today. maybe they didn't live through those times and like you said in the 70s and '80s people were scared to death to come to new york and that's a result of the police department in the city of new york and other areas. baltimore, los angeles, miami, major reductions in crime over the years and a lot of times cops don't get the credit they

deserve. >> the baltimore police department has asked them to investigation her department. could that benefit? >> if that's what the mayor is suggesting and the justice department agrees to it i think in the long run it will benefit that department, because at least what will be determined is how best to improve that department and what things are going on that we don't know and how do we negate things that may or may not be true. so over the long haul it certainly will benefit, should the justice department decide to come in. >> i want to ask about this idea of -- so the officers in baltimore are saying they're afraid to go out in the streets and they second guess themselves when coming in contact with someone who may be violent or a suspect.

is it necessarily bad to second guess, commissioner? >> i would say yes. a lot of times, don, take these two examples in the last few days. second guessing and i'm not second guessing either one of these cases, i'm not talking about these cops but you have a split second to make life and death decision and it could be their lives and i've had personal friends shot and i've been in gun battles and lost many friends as a result of gun battles. you only have a split stooekd make that decision and got forbid you make the right one. >> this is a boy, he's in police custody, they've not released his name they found him at omaha nebraska in a dumpster and

hospital? >> you know i'll be fair there was an altercation with his girlfriend and in that sense, and what happened was he was holding on to her so tight, not hurting her, he was so afraid he wouldn't let go of her. and the video shows some of that arrested him and off to jail he went for that battery that they suggested, rather than dealing with the real issue, which was the bipolar, which they were advised of not only an excuse but here is the medication. how much more proof do you need that a person needs mental health help and not a jail cell. >> they needed to be trained more andor that they should follow it more. i want to know what the family wants. i read your instagram message when you talked about it.
