"ac 360" starts right now. good evening. thanks for joining us. tornados touching down in at least three states. oklahoma kansas and nebraska. warnings are in effect for parts of the oklahoma city metro area right now. i want to go to our meteorologist, jennifer gray who joins us live. >> we see very powerful, dangerous tornados and you can see tornado warnings still in

effect and we see warnings in some of the exact same areas that we saw them touch down a few hours ago. and just on the west side of chip sha, that's one area where weave rr seen a what are of activity. and we have had reports of it on the ground so it's moving to the northeast at about 50 miles per hour and new castle needs to be on the look outs for that one as well p.. we could be looking at places like moore and as well as the other side of oklahoma city. and continuing on as we go into the late evening hours and unfortunately, anderson you can't see them coming. so that's the danger in all of this. i want to show you the storm that passed through earlier. we were tracking it right between moore and normened and

as it heads off to the north and east. keep in mind this is stale very fluid situation and we have a very dangerous situation on our hands 25 reports and it's still going on. >> any reports of damage at this point? >> we've seen a couple of images of damage and in the wichita, kansas area. but we have had early reports of damage already. >> jennifer thank you. and more breaking news in the investigations of the death of freddy gray. when state's attorney announced that six police officers would be charged in gray's death, there was a sense of relief inside the city of baltimore, this wouldn't be another case of a young man dying without any consequences. tonight, new questions about her

investigation and the charges she brought. cnn justice correspondent, even perez has been working his sources in baltimore. and he brings me breaking news on a number of fronts. your sources are saying they have questions about the medical examiner's report. >> reporter: we're beginning to see the ways in which there were two separate investigations one done by the police department and homicide detectives there and by the state attorney's office to try to exploit the differences between the two investigations and perhaps weaken the state's effort to prosecute these six officers. we're told that the investigators of the police department were under the impression that the medical examiner's findings were going to be short of a homicide. if you recall, that's one of the key findings thrum state's attorney she said it was a ruling by the medical examiner,

which brought her to bring the most serious charges. we're told that the police investigations don't support the most serious charges brought. at most what they were looking at is manslaughter. now, i should add that medical examiner's office has told us that they only reached one conclusion in this case and that it was a homicide. they had police officers there getting briefed along the way but they only made one conclusion. we also got a statement from marilyn mosby's office and she defended this case. >> you're also getling detailting details about one of mosby's top investigators. >> he is a former baltimore cop. in 2009 he was demoted after he failed to follow up on some reports -- very serious crime reports in his central district here in downtown baltimore.

also in twun 9 9 2009 there was a drunken report and the s.w.a.t. team arrived and he had his gun in his hand. they had to use a taser to try to calm the situation. he was not arrested anderson. but the question that arises is whether he has any kind of beef with the baltimore police department and if that is why he was helping to bring these most serious charges against these officers. >> it's interesting that this information is being leaked out. people leak when they want to leak or stow raises questions about why would they be leaking this information out? are they just trying to discredit the investigator who is working for the state's attorney. and another person has filed a

motion to see the knife that he carried. >> absolutely. what you're seeing happening is how the defense lawyers for these officers are going to defend them and as you mentioned, again, this is a matter of the differences between the state's investigation and the police investigation. the police investigation found that the knife that was found on freddy gray was a violation of the city code. if you remember marilyn mosby said that whole basis of her case frankly is the fact that these officers had no reason to arrest freddy gray because the knife he had on him was not illegal in the state of maryland so that's a discrepancy that the lawyers are trying to exploit. two officers have filed these motions to try to get access to more information about the knife. and another lawyer has filed a motion to try to get notes from

the police investigation. again, they're trying to find oo way to exploit the differences between the two investigations. >> i want to bring in baltimore criminal justice blogger and also cnn legal analyst, sunny hostin who is friends with baltimore's mayor. sunny, sunny, i want to talk about the knife. we actually have two different knives here onset. one is spring assisted which you see the ease with which it flips out and then this uthder erother knife is not spring assisted. besides the size difference you can see why there might be confusion between the two. >> it's very important because under maryland state law, a spring assisted knife is legal. under the baltimore city code,

the ordinance, that type of knife is illegal. so if indeed it was illegal under bottle moir city's code that would still make an arrestable defense. so what the defense is trying to show is the police officers acted appropriately in arresting him. if that's correct, most f not all of the charges filed against the two arresting officers would fail. that is a problem, especially facing the criticism that she is facing that she rushed to judgment here. that would be very sloppy sloppy prosecutorial work. >> even if the knife was legal, the arresting police officers acted in good faith believing the knife was illegal, does that defend them? does that defend their actions? >> i don't think good faith

argument comeinize to play here. i think it's a factual argument of whether it was illegal under the baltimore city code or maryland code. if it's illegal, then we have a problem or she has a problem because in fact, that would in fact -- if it's legal, that would in fact inval date the search. if it's illegal, she's on safe ground in terms of the search and seizure. >> page do you agree that the police officers legitimately thought this knife was legal, it would would kbaunerate them? >> yes i do. even the fact that the police task force felt that this was knife that was illegal shows that there is a legitimate difference in opinion and the officer did describe the knife

as spring assisted the task force appears to have agreed with that. at the very worst, he acted in good faith that it was assisted and therefore, it would by dangerous for the prosecutor to bring charges like this based on a mistake by the police officers. this is one of my fundamental problems with the charging of the two arresting officers for not having probable cause. you're setting precedent that any police officer can be civilly sued and criminally charged. these are peep who are not lawyers. lawyers disagree judges disagree and as long as officers are acting in good faith, not planting evidence it is going to put a chill in the whole police department and that's why i said i wouldn't want to be a

baltimore police department right now over making a mistake over what is probable cause. >> and is that germane at all to this is is that trying to slander one of her investigators or kind of discredit him? >> i think could be germane, certainly because if she is peg her case to this investigator's findings on cross examination, even during a preliminary hearing or a trial, all of this will come up so i think that is something generally that a prosecutor would look at prior to making this person one of the chief investigators. i also think though ethat we have to keep in mind that this young man was fine. he was running, he was able until he became in police custody and now he's dead and so to be sure something happened. the question really is whether or not the charges that were

brought are aproippropriate under these circumstances. >> one major criticism is that she over charged the officers. what do you think? >> i don't think she over charged because by bringing the murder charge in terms of second degree depraved heart, all she has to prove is that there was a high risk of danger that was brought by the officer that was charged and he more or less ignored that and in fact did not act upon it even though he was aware of the difficulties that mr. gray was in and she could have brought, if you went to first degree murder you'd have to talk about intent and malice you would have to be talking about premeditation, this does not require specific intent. this is a charge that she can make basicallioon type of gross negligence argument and i think that's the same with the

involuntary manslaughter and the same with the false imprisonment. that's extremely interesting because that's the first time where we see a circumstances where officers are charge would violation of the constitutional rights of the defendant. in this case, the person that they were apprehending that they did not have probable cause, then that charge also be made. >> i want to bring in page. because you have been very critical of the state's attorney. do you think there was politics involved here and that she just basically wanted to calm the crowd? >> well i can't read her mind and don't know her at all but my position has been that her rush gives that impression. when she stood out there and said i've heard your call no peace, no justice, i'm going to give you justice. that gives the impression that she was rushing to get charges to have some impact on the

crowd. what would have been more appropriate and ethical, the comments that she made really crossed the prosecutorial boundaries. she should have said i receive thtds police report yesterday and now i'm going to take this evidence to the grand jury and we're going to leave no stone uncovered until i get the truth and when i come up with charges, you can depend on my to bring the most appropriate charges. instead, there was a rush. >> a quick reminder. make sure you set your reminder. the nfl commission report on deflate-gate is in and it said they probably deflated balls on purpose and that tom brady probably knew about it. what the team is saying next.

major development in the world of sports involving one of the most successful franchises. the new england patriots and their quarterback, tom brady. today the nfl released their findings for the scandal known as deflate-gate. and tom brady, in a press conference that became notorious, they were adamant that they didn't deflate their footballs. the findings of the nfl investigation, basically opposite. >> reporter: prior to quarterback tom brady leading his new england patriots to a super bowl victory over the seattle see hawks asked if he was a cheater. >> i don't think so. i would never do anything to fwlak break the rules. >> reporter: this was after a

charge of deflated footballs p. >> i didn't alter the ball in any way. i don't want anyone rubbing them taking air out, putting air in. i have no knowledge of anything. no knowledge of any wrong doing. >> reporter: but today, an investigation ordered by the nfl said something else. the report said brady was at least likely aware of the inappropriate activities. the report stated it's more prob probable than not that the gym mcnally and an equipment assistant were responsible and there's no smoking gun but circumstantial evidence including mcnally removing game

balls from theficial officials locker room and text messages where they talked about brady's unhappiness with the amount of air in the game balls. and i'm going to make that next ball a blanking balloon. he actually brought you up and said you must have a lot of stress trying to get them done. could those two have done all of this without tom brady knowing. the report states that it is unlikely that they would deflate game balls without brady's knowledge or approval. and brady declined to make available any documents or electronic information that we requested, even though they were limited to the subject matter of

happens. >> so that was unthinkable for you? >> hard to see. >> reporter: roger takes us through a manual scenario and that the flight likely did not do this based on the controlled descent. it's uncomfortable. >> it is. in fact let's take it out of this. >> reporter: even in a simulator, for something we've asked him to do for purposes of this story, the pilot, cannot stand it. >> reporter: is it human instinct to pull up to the stick? >> i'm thinking about my safety and the safety of the crew and the airplane. >> reporter: is that why this incident has so disturbed the people in your profession? >> it's unthinkable that a pilot would take an airplane and drive it into the ground. it's not something we would think about. >> unthinkable and yet it

happened. and they believe the first officer was rehearsing his deadly plan on the out bound flight to barcelona. so richard, the co-pilot changing the altitude to 100 feet is there any doubt in your mind that that was a rehearsal? >> there is a certain doubt because we don't know. was it ae a rehearsal or practice and was he learning how the airplane would handle dialing in 100, would air traffic control notice would the aircraft fight himp in in doing it. was this actually an attempt at doing the suicide run and an a attempt that he started and failed at. and the final result was the same on the return flight but

all we know for a fact is that he did make these adjustments. he changed the target on the altitude and the rest, as they say, is history. >> it does show a certain amount of forthought and that this was not a completely impulsive act, that this was something clearly he had thought about at least somewhat before. >> and no question about it. and if you take twhathat with the further evidence of ripped up medical notes and online searches for sueicides and researching cockpit doors and the locks on cockpit doors, i don't think there's any doubt we're talking about the actions of a very sick and deranged mind in what he did. but what we won't know and will never know is were the crew able to use the emergency override to

get into the cockpit or did they not do it? there's no evidence on the cockpit voice recorder of the noise that you would have heard if they had tried to do it but again, we don't know how he locked them out. there's a whole load of issues that we will never know. unfortunate lay, the core fact remains that a very sick man was allowed to fly an aircraft and that will be the subject of the investigation going forward. >> and of course i should have said not only suicide but mas murder as well. would any on board been able to have felt at all that he was testing these things out? >> no and this is the reason. when he set the autopilot altitude to 100, the plane was already descending. and it doesn't matter if you've asked it to descend to 10,000 or

100. it will still continue the trujectry, unless you changing the speed or one of the other parameters. he didn't do that on the test. it's carrying on its descent, but instead of descending to 10,000 or 20,000 it's descending to 100. that was in some ways when i say the cleverness the trickiness of what he did when he did it. he chose to test it out when the plane was already in descent so no passengers and not incaptain would have been any wiser. >> and nobody in air traffic control for the very same reason. and the latest on the tornados that are putting millions of americans in danger tonight. those are live pictures. 25 twisters touching down in three states.

. we are watching severe storms threat angening a wide band of central plains. and photos of the damage starting to come in. this is a hotel in norman oklahoma. take a look at the video shot by a man in nebraska. incredible pictures of the tornado there. and jeff is on the phone who took this video. what was going on when you first saw this tornado? >> caller: basically, we saw the nishiation of the storm just east of a small town named hardy, nebraska. it quickly took shape and we saw it destroy a farm stead just northeast of the small community.

>> was it move towards you or were you worried? >> caller: no we were at a safe distance in the opposite direction of the movement of the storm and you can see it's not rain. we're honestly we're just recreational or amateur storm chasers and luckily or unluckily, we got on this storm. >> when you say it's rain route, explain what that means. >> caller: basically in a rain wrap situation it's as simple as it sounds. there rain surrounding the entire storm and you can't see it. >> it makes hard to tell which way it's moving. >> caller: exactly. thankfully because of technology and social media, you can see the immediate impact. >> and you said a homestead that is was damaged. did you see much else? >> caller: no basically just a

of my children and i would never do anything to hurt -- >> reporter: a public statement from a man who has good reason to hide from the spotlight. cal harris is accused of killing his wife. that time the couple was living together on their 200-acre estate in upstate new york living separate lives while trying to finalize their divorce. at steak cal's million dollar net worth. >> divorce was ending on friendly terms and ending on cal's terms. >> reporter: michelle harris was last seen on the night of september 11th 2001. and cal called the nanny who found mrs. harris's vehicle at the end of the drive way. he went to work that day.

>> he just thought michelle was out with her boyfriend or out drinking like she had done before. >> reporter: and prosecutors charged cal harris with second degree murder back in 2005. investigators believe they found what they believed to be 10 drops of blood in the house and garage. they suggested he struck his wife and then got rid of the body and the weapon he used. cal harris was convicted in 2007 but five months later, a stung reversal of that verdict. the judge overturned it after this man came forward claiming he thought he saw michelle harass in her driveway with another man, the morning after cal harris allegedly murdered her. >> there's a man at the back of the pick up and a woman who i

believe is michelle harris. >> reporter: and two years later in 2009 he went on trial again for his wife's murder and he was sentenced to 25 years to life in prison but after serving about four years, the new york court of appeals overturned that conviction granting his defense team's appeal that one juror had preconceived notions about the case. the court ordered yet another new trial for cal harris. michelle harris's family says she feared for her life and sleeping with her car kieeys for a quick escape. and she made it home evidence shows, where the only person who ever threatened her was. >> we know our dad had nothing to do with her disappearance. >> reporter: in february he returned for his third murder

. i want to show you some live pictures. we're watching tornados in three states. oklahoma kansas and nebraska. you see some of the damage there from kfor and some of the damage on the ground. i want to bring in our meteorologist, jennifer gray. what are you seeing out there? >> we have seen pictures coming in like that and unfortunately, some of the areas we've seen we're seeing more storms coming through the same areas p. and this is the newest one and it includes oklahoma city, the downtown area and wood lawn park and of course, we still have this tornado warning a little bit to the southwest of that and that is going to continue to push to the north and east. this includes grady counties bridge creak and now we're seeing more storms come through that same area. huge concern is going to be the
