indoors and stay in touch, if you can. storms in galveston forced to close. let's start with cnn meteorologist jennifer gray. jennifer? >> i'm sure you notice a huge difference from now versus 30 minutes. the wind really picked up as well as the rain. we are getting some of the bands start to come through more frequently now. i'm sure the winds are up to 25 to 30 miles per hour with gusts up to 35 at least. so this is beginning. we are going to be in this for the next three, four hours. this storm should be making land fall around 8:00 local time 9:00 eastern. we are on the seawall here in galveston. this actually protects the city from storm surge. it was completed back in the '60s and has done a great job since. galveston was battered by ike in 2008. this is more of a flooding

event. flooding in houston, dallas and to the north. houston received more than 15 inches of rain in may. we could get another foot with tropical storm bill. that is definitely unfortunate news for all of texas and this will be spilling into oklahoma arkansas and points north. i was in the red river valley last week. they said the worst case scenario is if we get a tropical system. there you go. here it is. this is bill. it will cause 10-12 inches of rain. they are watching this closely. highway 87 just to the east of us has been shut down. there's already flooding. it's a low lying area. anywhere from high island down to the bolivar peninsula. folks are ready. emergency crews are ready. if we need to send people out, if we need to do what we need to do. this is going to be a flooding event. the winds have been increasing over the past 30 minutes. this is an angry gulf of mexico

behind me. normally a public beach. it is now completely washed up toward the seawall. the seawall has another good six, seven feet before we reach the ocean, so definitely doing its job. a lot of beach erosion as the tide is running four to five feet. you can see the sea spray coming up. >> the shore is now three foot crashing waves. be careful there. let's get to meteorologist chad myers. it's not just about texas. we are going to see flooding in an entire region of states. >> this is the area we are worried about here. from where it makes land fall south of shreveport to oklahoma city. that area is the main area of significant rainfall. that is where the rain is going to come down. we have a center of circulation and it's going to come on shore here. here is freeport. somewhere where there's not much going on. this is a swampy area. that's great news. farther to the north, from

freeport up to galveston. every time a band that jennifer was in every time a band moves through, we are going to get winds like she has, 40 to 50 miles per hour. eventually the storm lumbers over dallas. it takes 36 hours to get there. think of the hill country. all the areas on the west side getting pushed up. all this air here is a hill area hilly country. it's going to deal with the rainfall. it's going to walk back down through the rivers and valleys that have so much water in them already. back to you. >> somebody is watching that forecast very carefully is judge ed emmitt. he is the director of homeland security management. not only are you in charge of justice in that area but emergencies. you are concerned about what is going to happen there. judge, good to have you with us. what is your message to the

millions of residents in the eye of the tropical storm headed your way? >> the main message is be careful. this is a rain event. there's no storm surge with it. it's not a hurricane. we don't have those kind of winds. people need to be aware that places that have flooded before are likely to flood again. stay away from high water. if you don't have to go out today, don't. >> there isn't a strong wind but we know a short time ago, parts of texas were hit hard by dangerous and deadly flooding. your concern that the damp grounds are going to be worsened by tropical storm bill. >> the damp grounds are already full. a lot of watersheds are approaching being full. so we can't handle a lot more rain. we live on the texas gulf coast. it's a low lying area. the good news is this seems to be a daytime event, unlike the memorial day flood, which is at

night. >> we know it only takes six inches of moving water to knock somebody off their feet. have you been finding people are heeding your urging to stay home and stay out of the way? >> they are. if tlfls there was a good thing from the memorial day flood, it got everybody's attention. tragically, people died in that flood. i think we are getting lot better response to the message of do not drive in the high water, turn around don't drown. >> 23 people lost their lives. 37 trillion gallons of rain fell in your state in may. that is incredible. talk to us about evacuation plans. are there any under way or plans for that to happen in harris county? we know there have been voluntary evacuation orders for bolivar peninsula. >> the voluntary evacuation was because the peninsula gets cut

off with basically minimal flooding. there are no evacuation plans for harris county. typically, we evacuate for storm surge, but not a rain event like this. >> what is your top pry torty today? >> people's safety. making sure people are safe. for example, law enforcement have gone out and barricade the underpasses we know are going to flood so we don't have the situation like on memorial day where people drove into them. >> let's hope it's not that situation. judge ed emmitt we hope you don't have those merges to deal with this time around. thank you for joining us today. >> thank you very much. alisyn. the search for two escaped convicts out of new york. there is no sign of them. there is new information this morning. alexandra field is live with developments from up state new york. what do we know? >> reporter: good morning,

alisyn. joyce mitchell the woman that was supposed to drive the get away vehicle that never showed up. why did she change her mind and why did she play along? investigators are wondering, was she forced? that as they uncover details about the escape plan including a plot to kill that was never carried out. closely monitored behind bars officials say former prison employee joyce mitchell is calm and cooperative as we learn about her alleged deep involvement with richard matt and david sweat. >> it's apparent she's trying to be as truthful as possible. >> reporter: a source with detailed knowledge tells cnn mitchell has a sexual relationship with matt and in the past investigated for an inappropriate relationship with sweat. >> they will see a weakness in

someone and ewe whatever they can to befriend them. >> reporter: officials say she was sneaking both men certain supplies like glasses with lights on them a year and a half ago. she claims she had no idea the tools were going to be used to help them dig out of the maximum security prison. >> she was told they are using them to stay up late at night to paint pictures or to read. >> reporter: sources also say the escapees planned to kill mitchell's husband and she was aware, but unclear she knew the exact details. investigators say the possible murder for her husband lyle is one of the reasons she got cold feet and backed out of being their get away driver. officials say they can't imagine matt and sweat would go through something so elaborate and meticulous and rely on one person to get them out of town. they may have always had a better plan. last week there was a lot of confidence that authorities were

closing in on the two suspects somewhere in the area near the prison. this week a growing sense for many involved that the fugitives could be anywhere. we are checking every car as they come through check point right now. we are hearing from one person who is close to the investigation who says there is no clear sign the two men are in the area since last week when bloodhounds hit on a possible scent around here. chris? >> thank you very much. we have breaking news for you. a deadly balcony collapse killing five and injuring eight others. this happened overnight in berkeley california. a fourth floor balcony collapsed. the survivors injuries range. some are serious, some life threatening. it's not clear what caused the collapse. a top al qaeda leader killed in a u.s. drone strike. the terrorist group confirmed the death of nasser al-wahayshi.

there's other people that may be -- that may be arrested based on the information we continue to receive on a daily basis. >> that was clinton county district attorney andrew wiley suggesting the prison investigation may lead to more arrests. here to continue the conversation is larry levine a former federal inmate who served time in 11 different prisons over ten years. he's now director and founder of wall street prison consultant specializing in prison reduction. you were in 11 different

prisons. what were you in for? >> narcotics trafficking, obstruction of justice and machine guns. >> you don't learn a lesson very quickly? >> it's not a matter of that. the federal bureau prisons moved me around a lot because i wasn't a disciplinary problem, i was a management problem. i was helping inmates with legal work and administrative issues. >> you know a lot about the prison system and you take issue with the narrative that's come out of this investigation. for instance you do not believe they sawed their way out of the clinton correction alpha silty. what do you think happened? >> absolutely not. if you look at the cuts on the steam pipes, they are too even. they are too neat. they wouldn't have time to do that. there's reports coming out that they stole or borrowed power tools from outside contractors. if you look at the amount of

time they would have had to have done that because there's accountability on the tools, they would have had to have done it during the day while the tools were freely available. but during the day, they would be at their jobs working, not inside the walls cutting things. >> okay. >> at night, the tools would be checked back in and they would be locked down. so the time line that's being put forth by the district attorney doesn't work. >> okay. >> the tools would not have been accessible to them at night. >> your belief is somebody on the outside helped them starting from the outside in. now, what would be the motivation for somebody to help these two guys? >> money. maybe they were going to do something for someone on the outside. i'm not sure about that. they are master manipulators. behind the wall they have the cat walk area. again, look at the cuts. somebody goes and prepares these cuts for them.

the one at the other end, where they popped out near the manhole -- >> yeah. >> -- if you go with the theory the government is putting on they had to cut from the inside. there's no way they made a perfect hole to get out. it didn't happen. the manhole cover that was, what 15 or 20 feet up? that weighs 150 pounds. there's no ladder in there. somebody would have had to climb on somebody's shoulders and pushed up on it. they would have broken the person's back. it's more likely they had help on the inside. then on the outside, there was somebody out on the street that had already opened that manhole cover up maybe put a chain ladder down or a ladder down. they jumped out, got in a car and drove off. what seven or eight hours later, the prison realized they were missing. it takes time. >> there's another theory you have. what happens once they came out

of the manhole cover, if in fact their ride didn't show up. plan "a" didn't work. you have an idea of how people can get out of town fast. what is it? >> well i mean she's lucky she didn't show up. she's a weak link in the system. if it had been me i would have killed her, got rid of her quick. she's unreliable. >> i'm talking your theory about at the gas station. what you would have done. >> okay, the gas station. the bloodhounds tracked them to a gas station. they lost the track there. had it been me i would have jumped in the trash dumpster waited there. they probably had a schedule. they had help on the outside coordinating. i'm sure she brought them in secure cell phones. got in the trash dumpster waited. picked up. boom there's no landfills in the middle of nowhere where the

tropical storm bill charging towards texas. some areas could see up to eight inches of rain prompting severe flooding. voluntary evacuations are under way. let's get to jennifer gray live on the ground in galveston. what are you seeing jennifer? >> reporter: we are seeing the angry sea behind me. this is the gulf of mexico. this protects the city from the storm surge. it's been doing that over 50 years. we are loorking at the storm's surge come up a bit. it is high tide now. the tide is running about four to five feet above normal.

what is normally a beach is not the case this morning. of course the water crashing up against the seawall. it has been doing so ever since yesterday. so we are going to continue to see conditions like this for the next several hours. it is expected to make land fall in the next two hours or so. then it will slowly start to back off. we have had off and on rain. periods of high wind. the winds will slack off like they are now. just about 20 minutes ago, the wipds were blowing at 35 miles per hour. we could see winds here as high as 45-50 miles per hour. the big story with this storm is going to be the flooding because texas is already received more than 15 inches of rain for may and now it is june. we could see another foot of rain with this michaela. it is something to watch, not only in the galveston area houston, dallas up to portions of oklahoma missouri and north of that. >> likely to go down in the history books as the wettest

2008 executive experience is another term for preparation and there is no substitute for that. we are not going to clean up the mess in washington by electing the people who either helped create it or proven incapable of fixing it. >> you can take that as a shot at hillary clinton. she's a creature of washington. you can also take it as a gentle marco rubio, ted cruz rand paul. we don't need another freshman senator. >> that is a strong argument that jeb bush will be able to make. of course he's going to have to play against marco in florida. he's certainly can try to say he's not washington. he's related to two presidents. it might be hard to make that argument against hillary clinton. >> margaret you covered the white house a lot.

this jeb bush is giving his speech. an issue is immigration reform. he say there is should be a path for legal status. he wasn't going to make a big deal of it, but -- >> by the way, just -- just so our friends know the next president of the united states will pass meaningful immigration reform so that will be resolved not by executive order. >> he handled it well. criticized president obama's executive order, but hurt himself saying meaningful immigration reform. to a port of the republican base that means amnesty. >> he's not going to be pushing for citizenship. what he's doing is trying to learn from his mistake on the iraq stumble to be prepared for what he knows is coming. we saw it on the europe trip last week where he seemed ready with the answer about the book he wrote in 1995 and whether it

was anti-woman and ready with the immigration one as well. what he's learned is it's important to have an answer and stick with it. >> have an answer and stick with it. good segway. hillary clinton is on the road. she's actually taking questions, which is a good thing. she sides with nancy pelosi not president obama on the trade deal. the president lost a big vote in congress. she says the president should go back and try to negotiate a better deal. she was asked a specific question should a president have fast track authority. should a president, she wants to be president, have the authority to negotiate the deals. >> tpa is a process. the issue is what's in the deal? i think this is a chance to use this leverage so that the deal does become one that more americans and more members of congress can vote for. >> if you are a school committee member or running for the city

counsel, maybe that's a process question. you are running to be president of the united states of america. this is a question of what do you believe your authority should be if you win the job? should you have this authority? why the cop out? >> i think it's something that a annoys a lot of democratic voters. she sounds slippery saying it's a process issue. jeb ran into the same issue dodging questions. she's going to have to figure out a cleaner way to state her positions on the issues. right now, she's trying to please the union and her base. clearly, this is something that she advocated for as secretary of state. >> 40 something times. she had a boss. she was the secretary of state and she has a boss. she thinks, in theory it's a good thing the devil is in the details. this is a question should the president have this authority. she's running, i think, for president. >> a year from now, maybe a year and four months from now, she

will be firmly in favor of this. firmly in favor. >> use zing executive authority? senator obama criticizing george w. bush then became president. are you saying people say one thing when they run, then do something else? >> the white house is not surprised. when given the chance to repeatedly press harder or ask for more. she's running. >> they called her out on this issue. you are seeing tension there between the white house and the clinton run. >> because of her position the president's been unable to twist arms on capitol hill. a lot of democrats say the current leader of the party, hillary clinton, doesn't want us to do this. >> john boehner is going to save president obama from this predickment. >> that's what makes presidential politics so delicious. every day there's something else. i'm sure you are strapped in waiting for the donald's decision.

today, hopefully with fresh eyes? >> we've got to reorganize our approach. we have to create a conversation. what i'm attracted to in this bill it makes important changes to the hipaa law that allows adult children to be cared for by the parents, family members that already care for them gives them access to information that will allow them to provide better for their children. >> the typical problem, congressman, is that the family knows there's a problem. they can't make somebody get treatment. they can't do anything to keep them safe. what powers would you give them now? >> this would be for the family with caregivers. they could provide information like when is the next appointment? what is the treatment plan. the lack of understanding they have a problem or lack to follow up. we know the loving family member

ought to have that ability to help guide them through it. they never stopped loving their child because they have an illness. we think it's an important part. america will believe that too. >> there's been resistance. you can't change the hipaa laws you are going to take away someone's privacy and create an imbalance of personal rights and wind up having people forced into treatment. this is about choice and freedom. what do you say to that criticism? >> your choice is not to die or watch your children die or family members die. here is the thing. in the 19th century, we were institution based system in our approach to mental health. now, we are going the other direction. we have gone from where we took people's civil rights away to one where we have given them the right to die. i don't think it's what they expect to provide for their loved ones.

>> judges sometimes say it's not against the law to be crazy. it's not against the law to have a heart attack or have alzheimers disease. we step up and help someone who cannot make decisions for themselves. compassion demands this. reason demands we make changes. not just hipaa, but providing for them more hospital beds, sounder research making sure federal dollars are spent wisely. we haven't been doing a good job. that's not just me saying that. we have to change this for the sake of family's lives. >> who's saying no? you have been fighting this fight for a long time tim. it seems like they are not saying it to your face so much as killing it somewhere behind the scenes so you can't get it made into law. what is the resistance? >> some organizations don't watt psychic hospitalizations. you should never tell someone they have to be in treatment. they don't, in some cases, they

are against psychiatry and medication. this is not the same field as it was 20 30 50 years ago. things have advanced. there are a lot of things we can do to help. those who are adhering to old worries, we have to move forward. congress needs to do this too. it's a matter of having the political will and coming together politically. quite frankly, in this nobody with mental illness, it doesn't matter the party or income or race it's a matter of how to work to get it done. >> congressman, you have been living this situation. clinically you have been living it in your family and as a professional. senator, you as well. you can't force people to get treatment, it's not fair to them. what would you say from your own experience? >> you don't want to watch someone you care about die. you don't want to watch them kill themselves. that's essentially what you are doing. people have to -- so many people
