dictate how we feel. >> we are focusing on the wrong thing here. >> reporter: confederate flag images prominent in a few states across the country may soon be no mor. >> people use the flag as a symbol of hatred. >> reporter: the battle flag is part of the official flag the speaker of mississippi statehouse is calling for it to be removed. georgia weighing a redesign of sons of confederate veteran's license plate featuring the flag. governors in tennessee north carolina and virginia are already saying they will support pulling the plates from production entirely. >> today, i'm calling for actions to be taken from the removal of the confederate flag. >> reporter: this as ebay amazon and walmart are banning the flag from their shelves. it's unclear when the legislature is going to take up this legislation regarding removing the flag. we did speak with one republican

>> reporter: newly released footage from dashcams along with 911 dispatch calls give a fuller picture of the moments leading up to the capture of accused south carolina mass killer dylann roof. >> black hyundai, white male traveling westbound. >> reporter: police were on the lookout for roof after the killing of nine people inside an historic african-american church last wednesday. the next day, an officer in north carolina, some 250 miles away received a tip from a woman driving to work saying she spotted roof partly because of his hair. the officer then called 911. >> i know it's strange, but i just got a call on my personal cell phone. a lady called a friend of mine and said she was behind the car matching the description of the charleston killer. a south carolina tag, white male early 20s, with a bowl haircut. >> reporter: the dashcam shows police closing in ending the 14-hour manhunt.

they ordered roof to step out of the vehicle, placing his hands on the top of the car. he was checked for weapons, but none found on his body. a search of the car revealed he was traveling with a glock semiautomatic handgun in the backseat. roof purchased that weapon at a gun store in west columbia south carolina not far from where he lived. chris? >> thank you very much appreciate it. let's bring in dr. ben carson a republican candidate for president, as you know. he's the former director for pediatric neurosurgery at john hopkins hopkins. great to have you on the show. a lot of reaction to what you wrote about the situation. what is your message to those of the conservative wing of the party who, when this happened said why does it have to be called a hate crime? why is it about race? if it's a hate crime, it's

christians. why go after the flag. it's heritage not hate. what is your message to these people? >> it's obvious we have problems as a society and we need to start thinking about what we can do about it. when we moved into our home in maryland which is in a rural area one of the neighbors put up a big confederate flag on the barn. i guess as a message to us. one of our friends, a general, black general coming over. he came through the drive and he saw that. he turned around and said i'm in the wrong place. the interesting thing is all the other neighbors immediately put up american flags and shamed this individual and they took it down. that's what we need to be thinking about. we are social beings as human beings. let's send the right messages to each other and i think it will take care of a lot of our problems. let's not just turn a blind eye

to things. >> what do you see in that blindness. what do you think about the motivation to blame the media or the left about calling things hate crimes and making things about race? what do you see as motivating that? >> i'm concerned about what's going on in our society. we have a war on women. we have race wars income wars age wars religious wars you name it. people are, you know stoking the flames of controversy and division and it's almost making us look like we have a dysfunctional society. we are better than that. we the american people have to recognize that just because we might have a disagreement about something doesn't make us mortal enemies. it doesn't make us people who should be wanting to destroy the reputation or the business of our fellow americans. we already have people outside like radical jihadists that want

to destroy us. why should we engage in destroying ourselves? >> while you came out right away yes, you are the only african-american running for president right now, but you came out and called it what it is and saw the flag for what it is and what should be done about removing the symbol. a lot of competitors did not. they brushed it off as state's rights. governor huckabee said this is a distraction, a gotcha question. how do you understand those type of responses? >> i think everybody responds in a way that they feel is the most acceptable. i never tried to predict or analyze what other people are thinking. it's probably better just to ask them. but, i think, as americans, once again, have to keep in mind is that this is a pluristic society

and we have to live together. that means we have to identify things that are wrong. we have to call them what they are. because you will never be able to deal with them if you are not willing to call them what they are. recognize that we do have a problem and let's work on solving it. >> doesn't that also go by extension of analogy to people fighting the ideas. isn't a part of leadership saying to people who don't want to call what happened a hate crime, calling them out on that and showing it is not a time to play politics saying race is too much of a public discussion. >> obviously, i want to make sure that people understand i do recognize -- >> you certainly do from what you have written and said sir. >> i think, hopefully, others will come to that understanding. let's talk about it. it is going to be our civil discussions that help us through all of these various issues of division in our country. if we don't address them we

wind up with more people like dylann roof. >> let me hold you to your own test here on a different level. many people are equating what the confederate flag stands for with the gay pride flag and saying hey, that flag should be taken down too. all it represents is hatred toward christians. do you see an equation between the symbols? >> i decided that i really wanted to talk about the confederate flag during this time. >> you just said doctor you cannot avoid these difficult situations. that's how they fester. you must deal with it. that's part of leadership. you said that about the other issue. >> like i said if you want to talk about that let's do it on a different segment. >> the discomfort of that it's just something you don't want to handle? >> let's do it at another time

and specifically address that issue. >> all right, we will leave it for another time. you may find yourself on a stage with donald trump. one, are you afraid you may pass out from lack of oxygen because he's on the stage with you, and two, what do you think he offers to the debate? do you think you need donald trump in your numbers? >> i welcome donald trump. he's a man of significant accomplishment accomplishment. you know, we have a process where by a lot of different individuals will have an opportunity to place forth their vision of what america should be. we can analyze that vision with respect to what they have done in their lives and make a decision. that's the beauty of the american political system. >> are you surprised the donald is in second place? he is. he can't believe he's not in first. are you surprised he's in second? what message does it send to you and the other candidates?

blades inside frozen hamburger meat. we are learning she convinced the guard to pass the meat through without going through a metal detector. from what we hear his client was duped by mitchell. we are hearing she tried to gain favors for the inmates by offering pastries to guards at the prison. at one point, a law enforcement source tells us he may have asked to have david sweat's cell moves near matt's. the inmates may be barefoot. i spoke to a law enforcement official that says that is unlikely. the terrain is so difficult to move around even when wearing boots. it certainly would have slowed them down. it would have been hot if they were barefoot. investigators are hoping the men are caught soon. chris? >> we'll stay on it. there are questions about the

final moments of freddie gray's life. "the baltimore sun" obtained a copy of the autopsy. he suffered a high energy injury. what does that mean? we have it for you. cnns joe johns is with us in washington. tell us. >> well chris, with six baltimore police officers charged in this case who pleaded not guilty the report will be carefully scrutinized for what it says and does not say. it hasn't been released publicly as part of the evidence but it was leaked to "the baltimore sun." they said it was ruled a homicide the injury occurred inside a police van. gray suffered a single high energy injury like those seen in shallow water dive incidents. it could have been caused when the van stopped. the most significant injury was to the lower left part of his

head. the injury may have resulted when he got to his feet and was thrown into the wall of the van. his wrist and ankles were shackled. his his death was deemed a homicide. the officers failed to follow safety procedures up colluding putting him in a seatbelt and getting him timely medical attention. >> we are going to talk about what this could mean. thank you for bringing that to us. we now turn to the weather. look at this. a possible tornado caught on camera in new jersey sending debris and even the camera man flying. trees and power lines are down in several states maryland included where one person was killed while driving.

so we are learning more about freddie gray's death this morning. a copy of the autopsy report obtained by "the baltimore sun" says he suffered a high energy injury inside the van he was riding in. we are going to break it down with a forensic scientist at john jay college of criminal justice and legal analyst, a criminal defense attorney and former prosecutor. gentlemen, i know you both had a chance to look at this. this is something "the baltimore sun" got their hands on. i have to get you to define some things for us. this high energy injury explain to us what this means in

layman's terms. >> it's not easy to break three cervical vertebra. it takes force. >> great force? >> great force. there was an injury that fractured three vertebra and severed the spine. >> they say it's a similar injury to something that somebody that would have had a shallow water diving incident right? >> that's correct. >> is that a fair comparison given what we know to the injuries he suffered? >> there was always the question in my mind as to whether the vertebra had been fractured prior to him getting into the van. >> the takedown? the arrest et cetera? >> yes. i think what we are reading about in the article hypotheses, surmiseing.

i think there were questions. >> let's get to that. i want both a scientific and legal perspective on that. this from the baltimore sun, the medical examiner's report gives two scenarios. one, the m.i. surmise that gray not being belted in could have stood up while shackled his wrist and ankles and a sudden movement a sharp movement of the transport van, either an acceleration or deceleration would have been an unrestrained fall and that could have caused the injury. >> obviously, they didn't seatbelt him. that's crucial. however, they put him in the van on his stomach. of course he couldn't move around. in that position even if the van had accelerated, decelerated, changed positions, he could not have broken his neck under that he has circumstances. >> he could have gotten to his feet and fell.

that could have resulted in that kind of injury. >> that could have been the force needed to break his neck. >> he could have wriggled around while prone on the ground you think it's less likely? >> i think he could not have broken his neck that way. >> when you see this report from the baltimore sun, what does it tell you? does it change the culpability of the police officers in. >> it demonstrates how complex the case is. it's a complex case with an unusual theory. usually in cases like this the cop shoots somebody they don't have justifyication for it. >> you can look at ballistics or other things. none of that evolved here. >> here you have freddie gray in the control of the police over an extended period of time. a lot of police officers are coming in and out of the picture. the prosecutor is going to have to prove for each of these officers they should have known that freddie gray was injured

and that freddie gray needed medical assistance and he should not have been shackled and cuffed in this dangerous, careening van. >> he should have been belted. >> who is responsible? is it the driver the lieutenant or the lower ranking officers who were there? >> let's say you are having to defend all six officers pleaded not guilty. if you are going to defend them given all those variables and now given this leaked medical report how do you defend? i know it's going to vary depending on the driver or the offending officer. how do you try them? >> it's difficult. even if you are suing for money damages in a civil case if a doctor leaves a sponge in after surgery. you don't know if the doctor or the nurse left it. the law says you are all responsible. the patient is unconscious. he doesn't know who did it.

that's how it works civilly. it doesn't work that way criminally. you have to go beyond a reasonable doubt. you are going to see the lieutenant who ordered the arrest. the two officers are going to say, hey, we were following orders. why were we charged for doing what we were told to do? they will all split up. i did not know he was an extremist. i am not responsible. depraved heart murder. that charge can that hold up? it seems to me this is not a willful intent to kill. this was somewhat of an accident. >> it could be negligence. >> a lesser charge might make more sense. >> depraved heart is almost the equivalent of intentionally killing. >> they have to meet that level? >> it is so clearly, grossly neg

so lawmakers in south carolina are agreeing to debate an initiative to remove the confederate flag from the state capitol. this is a week after nine people were murdered at a black church in charleston. states like new hampshire, virginia and maybe florida may have discussions like this

because of representations of a confederacy in their own state symbols. on the other side the businesses have gotten involved. ebay amazon target and sears not only expressed their feelings but they themselves will no longer sell the confederate flag merchandise. joyce mitchell admitting she hid hacksaw blades in frozen meat to help two convicts escape. mitchell had another guard pass the meat to richard matt. she used baked goods to get them to do favors for the inmates. boots were left in a cabin where the dna was found. a california biker colliding head on with a fire truck. this is not easy to see. amazingly, the biker survives.

dispair into purpose and action? >> racist terrorism. strong words. both strong words put together by hillary clinton. she wants to have a conversation about race. she wants to have a conversation about guns. it's starting. we don't know where it's going to go. south carolina is talking they are going to have a legislative action to take the flag down and move it off the state grounds. ebay walmart, amazon sears saying we are not going to sell products with the confederate flag. mitch mcconnell saying his state capitol maybe take the jefferson davis. maybe that should taken from our capitol. he was born there, but there's no historic reason to have it. where do we go? >> we have gone further than i thought we would. i don't think the protesters thought it would go this far

this quickly. you have strange bedfellows here. people who are really liberal and the business community, which has, in a couple instances with same-sex marriage and religious liberty laws they have come out and been against republicans. this is the race conversation everybody thought we should be having that obama should have started but it's been started by other events. clinton gave a race speech saturday. she gave part two of a race speech yesterday. echoes lyndon b. johnson's speech in 1963. she's done something interesting, she called on white americans to do soul searching themselves. we talk about the racial soul searching we need to have. white people need to have conversations among themselves. >> there's an overreaction pc is running amok. if you want to buy a confederate flag you can't go online and buy it.

you have a radio show. he wrote this in an e-mail this morning. the american left has running through it the same total yan streak that ran through the -- decides to force u taupe ya on the world. making the case the left is trying to erase history, remove the flags and monuments. that seems, to me to be going too far. we don't know where the debate is going. i think it's wrong if you erase history. is it not legitimate on the public grounds, taxpayers pay to maintain the ground of the south carolina state capitol. that seems to be a fair debate. >> you are seeing a lot of bipartisan support whether it's state capitols or store shelves to remove the confederate battle flag to get the banner off. the conservative reaction is interesting to watch because they are frustrated with the way they think the media is handling

this. they are being put into a corner to change what they think is a symbol of history. they are with charleston. they are standing with charleston. whether it's caitlin jenner or the confederate flag the country is changing. the country wants to see the flag moved. >> in this case, as you note business interest align with republicans. a conservative governor of south carolina. mitch mcconnell a lot of republican leaders involved as well. part of it could be let's see what happens. we voiced skepticism that congress would muster the votes. remember back in 2013, pat toomy, the governor tried legislation in 2013. they fell a couple votes short and it collapsed. senator toomey saying try it

again. is charleston, newtown once is charleston now the gal v nizing moment we could pass new background checks? part of that conversation was to deal with the mental health aspects. >> you heard people talk about it. if they could carve out something narrow. four republicans voted for the last bill that failed. perhaps this is a gal vonizing issue. it's doubtful. we'll have to see. >> it's going to be difficult because you need in this congress republican control to have the political capitol to push something through. will speaker boehner take this up as a cause? doubtful especially as we approach a presidential election. you see toomey seeking out the votes. are the votes there? >> they all voted no. let's see if one of them decide to change the debate here.

let me try to get ahead. i don't see it happening, but it will be interesting if a republican says take it with the bill address concerns. we'll keep an eye on that. a poll out in the state of new hampshire, we have seen this. when you announce your candidacy, you move up in the polls. this might surprise you. the suffolk university poll donald trump in second place at 11%. scott walker 8, rubio at 7 and ben corson 6%. everyone else is below that. trump made note of the poll. he says it's not enough. >> i did get that great poll today. i can't believe push is in first place. some people are thrilled. i'm not thrilled. how could bush be in first place? he can't negotiate his way out

of a paper bag? >> i said in february he's running. he's hired a lot of people. he has a populous message. he may be awkward, but he's connecting. >> he's in second place. he's not happy, but it's saying something. >> in a crowded field, it's got an impact. >> if he's getting 8%, 6% or 11%, he's probably not going to win. >> knocking somebody else off. >> the race is about to get more crowded. bobby jindal the governor of louisiana is going to get in today. a tough pass for him. where does he find room with carson and huckabee. jindal has to find a way back. itis going to be tough. >> christie is probably going to get in within the next month. we are waiting on scott walker. that should round out the field. that would be 15 or 16. >> can you imagine them on a debate stage going at it? >> i would love that.

political analysts suggest haley may be considered a potential vp voice for 2016. >> my hope is by removing a symbol that divides us we can move forward as a state in harmony. >> ana, i want to ask you what might happen today. there's a legal loophole that would allow the governor to take down the confederate flag that flies over our shoulder temporarily without the approval of the general assembly. what do you think is going to happen? >> we don't know for sure. we have been making lot of calls to the governor's office and many others inside the capitol. there's a section part of the constitution that would allow her to remove the flag or to replace. perhaps she could use that to take down the flag. it doesn't sound like that is going to happen. we don't know for sure just yet. i think it's worst mentioning while there's such a positive response both parties
