day. it is thursday july 2nd. 6:00 in the east. chris cuomo is off. john berman is joining us. so far so good. up first, there's a new warden at the new york prison implementing all sorts of new security measures. >> this morning we are learning what david sweat is tell investigators about the tools used to break out and why the fugitives finally split up. there are contradicting accounts about who wanted to kill joyce mitchell's husband. our coverage with cnn's correspondent jean casarez begins right now. >> reporter: the big looming question remains, can david sweat be believed? this morning a major shake-up behind these prison walls. clinton county correctional assigning a new superintendent along with new rules, including

weekly cell wall inspections, random bed checks and new gates that will now be placed inside the tunnels richard matt and david sweat used in their brazen escape. meanwhile, sweat continued talking to police wednesday. the convicted murderer claiming it was mitchell's idea to kill her husband lyle after escaping from prison. mitchell's attorney says she denies that allegation. sweat also telling investigators that he had no sexual contact with mitchell claiming instead it was matt who had the sexual relationship with the former prison employee. sweat confessing he and matt found a sledgehammer in the underground passageway possibly inned a inadvertently left behind to break down the wall. initially the two got along, but matt grew so tire edd.

after breaking into a cabin sweat, he said that he became so upset he split up. in the final days sweat pushed ahead getting to canada after hearing matt was killed. the former fugitive now recovering from two gunshot wounds to his torso at a lockdown center at this albany hospital. the medical director said inside two guards watch each patient and inmates are often shackled in their hospital beds. >> how confident do we feel that this patient is not going to escape from the hospital? i feel very confident. >> reporter: and that new superintendent the head of this prison his name is michael kirkpatrick. the first deputy superintendent in el myra correctional facility about five-and-a-half hours away from here. but even more than that he has been the head for the last four years of cert the ones searching for matt and sweat.

alyson? >> jean it will be interesting to see all the changes he implements there. meanwhile, beach goers are on high alert after a seventh person was attacked by a shark in north carolina. this is just in the last few weeks. the victim airlifted to the hospital and said to be recovering this morning. but what is behind this sudden rise in shark attacks at popular beaches? and how will it affect the holiday weekend? we are live at wrightsville beach, north carolina good morning to you, elena. >> reporter: good morning. the 67-year-old man said he felt the shark right before the attack suggesting he may have accidentally bumped into the animal before it bit him. authorities tell me he was alert, he was talking to first responders. even though he had severe puncture wounds from his hip down to his knee as well as several bites on his calf. now this attack happened in the outer banks. it is the seventh to take place off the north carolina coast in the past month. the victims of some of the other attacks include a 13-year-old girl and 16-year-old boy.

each of them lost an arm in separate attacks some 90 minutes apart just south of here on june 14th. the bites have also been reported in south carolina and in florida. now some experts say drought and water conditions could be contributing factors, but also a factor simply put, more people are heading out into the water. more people are out enjoying the beautiful beaches. and the higher the number of people out in the water, the greater the possibility that someone is going to have an encounter with a shark. now, as you mentioned, this is a busy holiday weekend ahead of us. it's the fourth of jewel weekend. many people are expected to head out into the water. if you're among them it sounds like common sense, but really the best way to protect yourself is to be aware of your surroundings. makayla? >> unfortunately you have to be aware of the sharks when most people are enjoying the beach. thank you. u.s. counter terrorism officials are laying out extra

precautions to keep americans safe. the big concern is isis and the call for attacks through social media. cnn's correspondent pamela brown is here withlatest the latest ahead of the holiday weekend. >> here's why officials are so concerned. first of all, fourth of july is a symbolic holiday to fall during the same time as the holy month of ramadan. isis is encouraging supporters to launch attacks during this time. also the way isis is using social media, very different from what it was doing last year around this time. and officials say it is growing increasingly harder to detect an attack before it happens. in addition to all of this there have been near simultaneous attacks around the globe. all of this as officials very concerned. and here's what john miller said about what nypd is doing in preparation. >> they are following the isis

call. and the isis call as well as that of other terrorist groups has been to use what you have on hand. and that means if you can make a bomb you're ament boor. but if you can't, use a gun. and if you can't find a gun here's a knife. and if you can't find a knife, use a car. >> so nypd will have the so-called hercules teams, more bomb-snitching dogs out utilizing the cameras around the city putting in a lot of measures that we won't be saying come fourth of july up and to put this in perspective, officials are now tracking hundreds of potential isis followers. and just this year there have been 49 isis-related arrests in the u.s. and likely more to come. >> as you know one of the concerns is this comes on the heels of a series of other attacks around the world, tunisia, france, kuwait. and now we are learning that isis launched simultaneous

attacks on military checkpoints in north tunisia. here's the latest. >> reporter: officials are describing this assault in egypt taking place in northern sanai on wednesday. something they have not seen before. according to the egyptian military they say that at least 300 militants launched this offensive targeting multiple checkpoints, using car bombs and different kinds of weapons, heavy and medium. and we also heard from isis in a statement claiming responsibility for the attacks saying that they targeted 15 military checkpoints. also saying that they used at least three suicide bombers. now this assault was focused on a town in that region close to the gaza border. and residents there were trapped. they were caught in the

crossfire. and they really describe what sounded like a heavy battle that went on for hours. the egyptian military now says it is in control of the area after using its air force to carry out air strikes killing at least 100 militants, they say. 17 security forces killed but the death toll could be higher. and a lot of concern about what this means, if this is a new chapter in this insurgency that the egyptian military has been struggling to contain in the sinai over the past couple of years. alyson back to you. >> we'll be exploring that with our terrorism experts here. well, presidential candidate donald trump is continuing his attack on illegal immigrants in a new interview with the cnn. this as another company pulls its backing of trump.

david athena jones is here with the latest. >> reporter: donald trump believes voters should choose him to lead the country, but with many companies coming under pressure to ditch him, that success story is getting a bit of a rewrite. after macy's joined the ranks of big companies dumping donald trump over his derogatory comments about mexican immigrants trump is firing back. >> people can't handle pressure. and that's what they did, they did a total fold. and that's okay with me. that's okay with me. it's a very small business. let them do what they do. i never loved the business with macy's because the retail was in china. >> reporter: they decided to cut ties with trump after these comments. >> they are bringing drugs, they are rapists and some are good people. >> reporter: in light of the statements made by donald trump, which are inconsistent with macy's values we have decided to discontinue our business

relationship with mr. trump. but trump telling "entertainment tonight" he was the one who severed ties with the retailer not the other way around. >> they told me they were having pressure. i said you know what? have your pressure. i'm not doing it. hundreds of thousands is nothing. i have 5 million people between facebook and twitter. who knows why they did it. i don't really care. >> reporter: taking the dispute a step further, trump lashed out at macy's in a series of tweets. one reads, for all of those who want to make america great again, boycott macy's. but the fallout doesn't start there, four major golf associations are now distancing themselves from trump's controversy remarks issuing a joint statement that says in part in regards to his recent statements about mexican immigrants we feel compelled to clarify those remarks do not reflect the views of our organizations. despite the controversy, trump's two-week-old campaign is polling well coming in second in a new

cnn poll. trump trailing jeb bush by just 7% nationwide. and the hits keep coming. now a new petition on change.org calling for amazon.com to pull trump's books from its website. >> all right, we'll talk about this more ahead on the show. right now we have breaking news for you overnight. dozens are dead and rescue operations are underway after a ferry with 173 passengers on board capsized off the coast of the philippines. kathy novak has the latest on the rescue efforts there. kathy? >> reporter: well, we know that we're told by the coast guard that 36 people have already been confirmed dead. and fears for more who remain still missing. we are told that including the crew there may have been as many as 189 people on board, which would mean about 35 people are still missing. and it's getting dark right now in the philippines, so the rescue efforts are becoming much

more difficult. we're seeing some of the video of the frantic rescue efforts going on. and you can see the small boats that are going out in these choppy waters and people being pulled from the water including little children. these are people from all walks of life who have been on this boat. my family is from the philippine philippines and i have relatives who live in this province. i can tell you this is very regular for a boat to go between islands ferrying people. people are bringing things like groceries. and we are told by our colleagues in cnn philippines that they may be getting an idea of what may have caused this. they say the coast guard has told them that the boat may have left port to too quickly and the boat balance may have been thrown off suddenly. we'll continue to bring you updates as the search continues. we have more breaking news 5,000 residents are under a

mile-wide evacuation order in tennessee. that after a csx freight train carrying flammable and toxic liquid derailed and caught fire. this happened around midnight in the town of marionville south of knoxville. we are told 12 emergency responders are being decontaminated after coming into contact with the liquid. the justice department is investigating major u.s. airlines for possible collusion. american airlines delta and southwest control 80% of the airlines. the airlines say they are cooperating fully with investigators investigators. back to our top story, a new prison soupuperintendent is in charge at the clinton correctional facility. so what changes will be made? we have a former officer of the correctional facility here with

us michael palmer, thank you for being here. >> you're welcome. >> you have an interesting history at the clinton prison. you worked there for 12 years and were a visiting room guard. you have guarded the notorious prisoners like tupac, son of sam, known as the preppy murderer. you know a lot what went on in this prison. what do you think of nine prison staffers including the three top guys the superintendent now put on leave because of corruption? >> well, i can only assume because i haven't been to work here i don't know the circumstances behind who they are, the officers i can only speak for what i know about when i worked here. >> and what did you see when you work there had? what sorts of corruption if any, did you see? >> i imagine it's the same type

of corruption, except we had money, we had towers we had all kinds of security that was taken away from us. and i think that's a lot of the reason that things are going on the way they are in dannemara. because the guards that work here work their butts off. and they do the best they can for each other. >> yeah i hear you. you think they are generally good guys. and yet there's this prison culture that happens that those of us on the outside don't necessarily understand. for instance you said that guards often do favors for prisoners. such as like what? >> well, not so much favors but, you know you can warrant information if you hear there might be drugs or weapons hidden somewhere. maybe an inmate will come up to you and ask you for a tv privilege or sandwich off the food cart. and if you want to find out those things so people don't get hurt inmate or guard, you try

to do the best you can and do that. >> i understand. so in other words, it's not favors it's just a quid pro quo. what is the harm in giving them a sandwich be they are going to give you some information about a weapon or drugs? >> well, i don't see any difference between that and a detective on the street having snitches. you know it's a rough job. people think it's an easy job. i have seen people stabbed, i have seen everything from stabbings to poured oil on people's faces. i have seen it all. you know i have worked six different jails and they are all the same. >> so you worked with jean palmer the prison guard who has been charged in this case now for possibly helping to smuggle weapons to these two escapees. what was your impression of jean palmer? >> my best friend for 12 years

in a band i sang with him and worked with him in prison. he would be the first person i want want there if anything was happening with me or any other guard. i have spoken to many correctional officers now who said the same thing. gene is a great officer. and i just think he got mixed up. when i worked here there was a hobby shop where you could buy things such as those paintings that gene had. they don't have that anymore because of some law or whatever there was no hobby shop here back in the day. >> in other words, prisoners can't make money on their arts and crafts anymore. >> that's correct. >> do you think gene palmer knew what he was doing when he passed those weapons in the frozen meat? >> i don't know that gene passed any weapons. and if he did, the meat i

secretary of state john kerry is in the middle of the discussions with iran right now. can a deal with struck by july 7th? the first deadline was june 30th. so where are we right now? what are the latest on the negotiations? here's a man who knows, the deputy of secretary of state, tony blanket is here. >> thank you for having me. >> june 30th was the deadline. where i come, a deadline is a deadline. the july 7th rock solid or bust right now? >> we have been at this for two years and it was worth taking a few extra days to lock in the commitments iran has already made when we announced the basic elements of the deal a couple months ago. and that's what we're working toward because the single best way to prevent iran from getting

the nuclear weapon will be done soon. we will know whether iran has the political space to do what it said it will do or if it doesn't. as you heard the president say the other day, if it is not prepared to make good on its commitments, we'll walk away. >> cnn just received a statement from the vice president of iran. it sounds like they have a different take on this not surprisingly than what you're saying. they say hopefully the deal will be finalized and signed. all of this depends on the demands of the 5-plus-1 countries. >> we are looking at the challenge, it has been taking the basic elements that were clear and translating them to a details agreement. when you do that that's when the differences e merge. >> such as inspections. the u.s. would like an international group, iaea to go

in to see if iran is keeping their promises. however, the iatola said they would not allow this near the military sites. is that an inspection that america would be willing to give up? >> no. if we don't get them we won't make the deal. there's a lot of posturing going on people playing to different audiences and constituencies. but at the end of the day, we don't have the verification the transparency and the inspections we need to make sure iran is not developing material for a weapon we don't have a deal. >> so what inspections would you be willing to give up? >> this is exactly -- we're not going to give on anything. we need to lock in in detail exactly what the inspection regime would involve. >> does it have to be military sites? >> any place that the iea is

worried about has to have inspections in place. there are people places documents that the iea needs access to. all of that is being negotiated right now. and if the details are not there, we won't have a deal. my sense is that the iranians have invested a lot to get to this point. now we'll see if they are prepared to do what is necessary to lock everything in. >> you think ultimately they will allow free inspections? >> tell >> tellwell if they don't, we won't have an agreement. the president is clear on this. if we don't get what we need the international community is not satisfied for us to tell the world that iran is not going to develop material for a nuclear weapon there's no deal. >> let me ask you about a place where we have a deal already, cuba. just opened up diplomatic relations with cuba and the embassy going to be in havana. the embassy in washington a cuban embassy, but will there be an actual ambassador to cuba

from the united states? marco rubio says not on my watch. it remains what if anything has been achieved since restoring these ties. >> i do hope we get an ambassador. we are looking to restore the diplomatic relations. we sent a letter from president obama to mr. castro yesterday as well. we shattered our embassy before i was born. this is a relationship that had no diplomatic relations. what we are hearing overwhelmingly from the cuban people this is what they want. they want the relationship to be reestablished. we aught to listen to them because that's a quicker path surer path to more freedom and democracy in their country.

they will have an ambassador here. it would be unfortunate to penalize ourselves without an ambassador there. most important, we have an ability to engage war with the cuban people from our embassy. have our diplomats travel arounded the country to hear their voices. all that will be much more effective with an ambassador in place. first things first, the embassies will open toward the 20th of july. and then we'll move from there. >> we want to ask you about isis with attacks near tunisia and kuwait. it feels like isis is expanding their attacks. what do you think? >> isis' core has been decimated. but what has happened over the last decade is the problem of groups springing up in different parts of the world, including the groups you just mentioned. and isis is the new force in

town. so we put together a coalition of 60 countries to deal with the financing, to cut off the foreign fighters. >> but it doesn't seem to be working when we see the brutal attacks. >> it is working but it's going to take time. let me give you an example, we get a lot of bad news and sometimes lose focus on what's happening. iraq over the last year since we had the coalition in place, the territory controlled by isis is down 35%. thousands of their people have been killed much of their material has been destroyed, so they are actually moving backward in iraq. >> backward into ramadi. >> you're right, ramadi is in anbar province. the sunni province. you had predominantly shia military going in to alien force -- the prime minister is trying to mobilize more sunnis and they will fight for their towns and cities and for their lives. that's the trajectory in iraq moving in a better direction,

equipping forces in the area is helping the cause. new details this morning about transasia flight 235 that crashed in taiwan in february killing 43 people. investigators found the captain switched off the plane's one working engine after the other engine lost power. the plane was designed to be able to fly on one engine. the captain also had trouble with simulator training less than a year earlier, struggling on how to respond to an engine flameout. well, the women's world cup final is now set. >> i can't even watch this. >> heartbreak. after england's heartbreaking 2-1 loss to japan. england's own player knocking in the game-winning goal. that is something i would do. the u.s. women will play japan sunday for the championship. it's a rematch of the 2011 title match when japan beat team usa in a penalty.

the ideology of the democratic campaign. not so much to win votes. he may do that in the meantime but why is he going to minnesota and wisconsin? that's where liberalism is. >> a real threat? >> not a real threat to hillary clinton's campaign. but the true believers want somebody they can truly believe in and bernie sanders remits a totally guilt-free snack. he's not going to be the nominee. you can support him whole heartedly and give him a small donation but do so without the burden of thinking he's going to be the president of the united states. >> so what does hillary clinton do about the guilt-free snack? does she come out against hummus she has $45 million in the bank that we learned yesterday. has she spent any of that against bernie sanders? >> it is hard for the candidates running on reform and campaign finance reform to have $45 million of our dollars in the nk baa. and then to spend it against bernie sanders, that is just

going to anger the troops even more. >> you don't want to stomp uncle fluffy to death. the point is she really needs to build up for a general election. she's focused on the general. she doesn't need to overcompensate for the left. she's already probably the only figure to bridge the divides. and more importantly, a reality check. she is probably the most liberal nominee. >> she is not the nominee yet. >> no she would be. not only is she in favor of marriage equality but she's tactic on gay rights issues and running on a progressive plank. and whether it makes the de blasios happy in the world is irrelevant. she has to walk that line to represent the democratic party. >> let's talk about george pataki who was running for president came out to write a letter to the other republicans saying we have to stand up against what donald trump is

saying about mexican immigrants here. what kind of problem is trump creating for the other people running right now? >> well, i don't think trump is creating a problem at all. it will flame out very quickly. his financial disclosures will be a problem. and i think he's a flash in the pan. i think he's peaking early. but when iowa voters and new hampshire voters who are serious people they get in front of the candidates multiple times, six or seven times in their own homes. this guy, great soundbytes kind of. except they are racist. so not so great. but they understand there is actually no substance there in terms of the policy solutions. is this guy going to be a responsible president? i have a lot of faith in the republican primary electorate. they are not fwloung to pull the lever for donald trump when it comes to iowa and new hampshire. >> new poll numbers, a new set of polling on the confederate flag. we have been talking about it a fair amount here. 55% of people support the removal of the flag. i think we have the polls from

government property. yet 57% of the country believes the flag is a symbol of southern pride rather than racism. what do you make of that? >> well, i think that the country is majority white in terms of its population and the conversation we're having about the confederate flag has been around moral empathy, seeing the flag through others' eyes. i think for folks who grew up we had a debate about "the dukes of hazard" being removed from tv land. people say it doesn't express the history or impact it had on people's ancestors directly impacted by the tyranny rebellion and civil liberty. so that's still a conversation being had in the country. but the recognition it has no place across the population on a state capitol grounds is a steep in the right direction. but this is a longer historical process in a country dealing with racism. >> there's another -- cnn has a new poll that also suggests the

support for renaming streets that are named after confederate leaders. 26% of whites support that 33% of blacks support that. but are we sanitizing now our entire history? >> looking at the polls, african-americans on whether you should take confederate leaders off street names are evenly split. here's the difference between the flag and confederacy. the flag was put up on the statehouse in south carolina during integration because people didn't want -- they didn't want to have to deal with public accommodations and wanted to continue what was a very contemporary racism. right? that isn't heritage that's racism. and so the flag on public grounds versus what you could actually potentially make of the heritage argument with the confederate army generals general lee -- >> they really existed. this was part of history. are we supposed to sanitize this? >> no. the four most important words in politics is up to a point. and the question is what is that right bounce? i think when we resort to banning things as a first course

>> reporter: good morning. so many changes here, we have just learned the body of richard matt right now is in transport to buffalo, new york. his family is claiming the body. meanwhile, david sweat is being asked so much by authorities. the question is can they believe it? >> this morning a major shakeup behind the prison walls. clinton county correctional assigning a new superintendent along with new rules including weekly cell wall inspection random bed checks and new gates that will now be placed inside the tunnels inmates richard matt and david sweat used in their brazen escape. meanwhile, talking wednesday -- the convicted murderer claiming it was mitchell's idea for the duo to kill her husband lyle after escaping from prison. mitchell's attorney says she denies that allegation. sweat also telling investigators that he had no sexual contact with mitchell
