>> welcome to "new day." 8:00 in the east. donald trump raising the stakes higher possible? yes. telling a washington paper he would consider running as a third party candidate if the republican national committee is unfair to him. >> trump is expected to tour the u.s./mexico border this morning. this morning a possible snag in his plans. chief congressional correspondent dana bash is tracking trump live from loredo texas. what is the latest? >> let's start with the report from the hill the interview that donald trump did with the hill. what is new in there isn't so much that he is threatening to be a third party candidate. he has said that to anderson cooper and others. what appears to be new is a

threat to the republican national committee. don't push me too far, warning if they are unfair to him maybe that could be something that pushes him to run independent of the republican and democratic parties. the reason why this matters is because historically when somebody who could get a significant chunk of the electort runs it hurts the democrat and nautot the republicans. the reason why i am here and donald trump is coming here to laredo texas is to get a look at the border and have a photo opat the border. the whole issue of illegal immigration and his stance on it in pretty colorful terms to the point where he offended a lot of people is what actually helped him with some of the key voters in the republican party. they are ignoring the problem

with illegal immigration. that's why he is going to come here and highlight it and the question is whether he will get a tour because we are hearing there might be pushback. >> keep us posted on all of that please. about the third party run i had a chance to ask a group of supporters about the idea that he might be considering this third party run. here is what they said. >> i don't think he would want to hurt the republican party's chances. i don't think any other republican candidates can win therefore if trump doesn't get the nomination i can't see myself actively supporting someone else other than donald trump. >> why not say if he runs a third party candidate? you don't think he can win that way? >> then it splits the votes. >> so that made him think he would want to hurt the party by doing that.

today there is news that he is considering it. let's talk about the latest developments with a man who just had a long sit down with donald trump. anderson cooper is here. what are your impressions? >> i never made it out of the lobby of the trump tower. every interview has to be in the lobby of the trump tower for some reason. it's always interesting to talk to donald trump. it's a wide ranging interview. let's not talk for more than 30 minutes. nobody gives you a sound cue. it is sort of refreshing. it is like verbal chess. he has a set number of things which he tends to say and you try to get him to say some specifics. >> you make a move and he wipes the pieces off the board. >> i enjoy the entire process. and i tried to pin him down on specifics as much as possible. easier said than done. i did ask him about his trip to the border and does he have any

actual evidence when he keeps claiming that the mexican government is sending over this wave of illegal immigrants. here is that part of the conversation. >> you are heading to the border tomorrow. you made trips to the border in the past. you have been invited by a group of officers. you keep saying mexico is sending these people across. >> mexico is sending -- you said it properly. thank you. >> but you have offered no proof. that is what people say. >> you may have proof very soon. all you have to do is speak to border people. >> you talked to immigration officials who say they have never heard of that and no evidence of that. >> do you remember many years ago fidell castro when he emptied prisons very famous this is a much more sophisticated version of the same thing. mexico doesn't want to -- this

animal that killed kate he came across five times, five times. maybe he came across because he thought the weather was nice. maybe he was pushed across by mexico officials. mexico's leaders are much smarter and cunning than our leaders. they are doing ing things we don't know about. there are a lot of people very excited that i'm going to the border tomorrow. i may never see you again, but these are minor details. >> you are telling me one may not have a slip of paper to indicate? >> i think it is common sense. mexico doesn't want to house somebody for 30 years in a prison when the united states will do it. >> you keep saying everybody knows this is the case. >> i think the smart people know. i think the streetwise people know. you are going to find out what i have. obama, i never thought he was qualified to be president.

one thing i thought he would be good at is being a cheerleader for the country. he is very divisive. i hit them hard on the flags. finally he lowered the flags. i don't want to take credit for it. i hit him hard. why doesn't he call up the parents of kate? kate is an incredible young woman shot and killed by an illegal immigrant. they send staffs of white house people to other funerals. they never called the parents or brad the brother, of kate. why? why can't he put in one phone call to the parents or brother of kate? >> you didn't lower your flags until the same day the white house. >> they were lowered. i'm not the united states. you would think that would be automatic. >> the brother of kate said you

did not call. >> i spoke to him numerous times. i spoke to him last night. he is a great guy. >> i had to leave a period of grieving. i don't want to call the day of the murder. i wanted to wait and i explained that to brad. i said i had to leave a period of grieving. the president could call immediately. the president could have called that day, the next day or the next day. i'm a private citizen. >> a private citizen asking for a very public office. did he talk about the fact that he would have to shift tone and shift the way he is acting? >> he did say he would shift tone if he became president. i kept asking is this presidential? he is giving out lindsey graham

graham's telephone number. he said this is a race and that he would shift his tone and operating in board rooms and a president trail would be different. >> what did he say about poll numbers? >> he mentioned they were high. he's doing well among republican voters. the washington post abc news poll started off talking to him about that. i also mentioned another survey that come out yesterday. he got upset that i mentioned it. >> unfavorability rater is higher. >> he and hillary clinton in free swing states have in a general election matchup have high unfavorables. >> do you think he has proof that the mexican government is sending the worst people he could find. >> if he had proof you are telling me he would not be waving the proof on day one.

>> he has people believing this. that is why it is important to push him as many times. >> i think he is impervious to facts. i don't say that in a disrespectful way. he is a very smart guy, but you can present him with all the facts and you haven't presented facts. i don't think among his supporters that really matters at this stage of the game. maybe later on in the race when he is on the stage against other folks from the gop and they are citing studies he will have to. at this point it doesn't seem to be hurting him. >> facts matter. let's get to someone to help. texas congressman laredo texas. good to have you with us. congressman, have you ever heard with a reasonable and rational basis a case to be made that the

mexican government is behind sending the worst it can find to america? >> that's not true. i think once he goes to laredo which is my hometown he is going to realize there has been people of mexican dissent living there for hundreds of years. he is going to find out laredo is the most hispanic city in the country. my parents were born in mexico and now their son has become a u.s. congressman. my brother is the sheriff there. he will find a city to go there for a learning reason. if you look at the fbi statistics he will find that laredo had three murders per 100,000. washington, d.c. had 16 murders per 100,000 which means it is more violent here where he wants to get a new job or compared to

new york city he will see that new york city for 100,000 is more violent. >> in terms of crime you have not seen this kind of wave that donald trump is talking about of criminality of coming across the border? >> again, like any other place there are problems but if you look at the fbi statistics rape murder assaults you will see using the fbi statistics that the crime rate across the border is lower than the national crime rate. if you pick my hometown where you are going he is going to see the murder rate for 100,000 compared to new york or washington, d.c. is lower there than what the crime rate is in my hometown of laredo texas. i hope he sees that 40% of all of the trade between the u.s. and mexico comes from one city. >> congressman, even if he does

agree that laredo is a vibrant community, how does that change his position which is that people shouldn't be coming here illegally? >> i believe in immigration reform. we have to have sensible border security not a wall. a wall is a 14th century solution to the border. we have to have a plan how to deal with the 12 million undocumented persons who are here. if someone is a criminal i will say that person should be kicked out of the united states. we don't want criminals here. we have to have a sensible immigration reform. >> in terms of the conversation happening since donald trump made the comments about the fellow mexican-americans i'm curious what kind of reception he is going to get there and i'm curious if you think that his comments will actually do more to drive latinos to the voting box. >> if he is looking at this on a

political sense he is not doing anything to win the hispanic vote. number two, he is going to find out people in laredo are caring people even though he has different opinions. people will treat him with respect even though he said very harsh things. there might be some protesters that might come in from outside the city or maybe from there that don't agree and will protest them. the laredo police made up of mainly hispanic officers are going to protect him. the border patrol agent is hispanic hispanic. he is going to find that laredo is a different city. he did make a comment i am going to the border. i might not make it back. he is a smart things and says things because politically it

trikes to certain people. he will see that laredo is a safe city. >> sanctuary cities taking trump out of the equation. they have been raised as the big reason that we are having so much trouble in america getting criminal illegal aliens what they are being called by this faction, off the streets. do you believe sanctuary cities are the problem or a reaction to the problem? >> i think in many ways it's not the solution to get the criminals. we need to inforce the law. ice has priority of anybody a threat to national security or public safety ice is focusing on kicking those folks out. i have said we ought to get those folks. i don't want criminals here. i don't want to see those people in our country. they should be deported. again, whatever our feelings are on immigration reform whatever

was requested by cosby. huff says when she was 15 years old cosby allegedly molested her at the playboy mansion. according to the complaint cosby invited huff to tennis club where he served them alcoholic beverages. after that huff said it was on to the playboy club where he assaulted her in the bedroom. cosby and legal response says allegations are absolutely false and that huff tried to extort cosby for money. the year was 1974 but huff has been allowed to bring this case because of california law allowing for possible extension of statute of limitations for child sex abuse victims. >> i just want to let everyone know that straight ahead we will be speaking with bill cosby's

. we're learning more about the jail death of sandra bland. for perspective, duane charleston former justice of the peace, first african-american justice of the peace ever elected there and he knew sandra bland. thank you for joining us. i'm sorry it is under these circumstances. the family rejects what was supposedly written by sandra on the form about what she tried to do to herself in 2014. why? >> well thank you for letting me have a word. i want to let the bland family know that we still are in prayer for her and the whole community is in mourning. i read a little bit about that. that drives me crazy about what they are saying about what she tried to do in 2014.

i do not believe for one moment that sandra bland committed suicide. if she did commit suicide she would have done it in the care custody and control of the sheriff smith. if anyone would leave their child to be baby sat and they paid the salary and found the child hanging in the kitchen, in the bedroom and bathroom with plastic trash bag, would they keep that baby sitter? not only would they keep the baby sitter but would they let other people be subject to the care custody and control of the baby sitter? i think it is irrelevant from my perspective because the main issue is that she was in his care custody and control. they had maybe information about her mental state. it doesn't matter. she was in his care custody and control and he bears responsibility. >> i understand what you are saying but there is concern

about whether or not this was suicide or homicide and this being offered up as proof of a past of trying to hurt herself. you raise a different point that this is the sheriff's fault. what do you think of the fact that if that jurisdiction receives information that someone may be of harm to themselves which saying you tried to kill yourself in 2014 with pills may qualify, they were supposed to alert a crisis center. that seems to not have been done. what does that mean to you? >> i think it plays right into the skaircenario that black lives don't matter. if i want to get to the point of it we can be very transparent like lieutenant governor said. we can call on the judge who went into the cell with her, the judge who did the inquest and within days can have a formal inquest hearing and call out

every single jailer and the medical examiner. he can call out the mortuary who transported her body before he went down to houston. we can have a formal hearing. it can be transparent in the court within four or five days before everybody has a chance to synchronize their arguments. >> you are saying you don't know why that isn't happening. that goes to the idea of what will change in the after math of this. the police came out and said the officer involved wasn't following their protocol. he is off the street. is that enough? what else needs to happen? >> he needs to leave. i think that ultimately he was symptomatic of what occurs every day. you have a half a mile of stretch of street that leaves the campus. it's patrolled by five different

her in 1974 when she was just 15 years old. we want to bring in monique presley, an attorney for bill cosby. thank you for being on "new day." >> thanks for having me. good morning. >> it has been a challenge for the past nine months to cover this story without hearing from bill cosby. so what does mr. cosby say about these now more than 25 women who have come forward to accuse him of sexual assault and rape? >> i'm not certain what you mean by saying that you never hear from bill cosby since through his attorneys he from the very beginning has denied repeatedly the accusations and allegations that have been lodged against him. >> we have had written statements from the attorneys. you are the first person we are able to speak to live. we haven't heard from bill cosby personally. i'm wondering what has he told you about the accusations? >> i'm not going to reveal

client confidences. when his attorneys speak we are speaking for him. when we speak and say that he denies all of the allegations and accusations then that is the statement of bill cosby. when you look at the recent filings just as recently as two days ago in another case in pennsylvania those are the statements of mr. cosby. it's not necessary for him to do anything more than what he is doing which is relying on able counsel to speak for him in a situation where he has neither been charged with nor convicted of any crime. even though we hear excerpts from accusers and see headlines that discuss things like calling him a rapist or saying he has committed sexual assault the case actually is in a civil court and there are no criminal charges filed. i think it is important no matter what manner the attorneys are speaking for him or the media is covering it that that's a point that stays clear. >> not just excerpts from

accusers. we have heard mr. cosby in his own words. these are revelations that have come out of the deposition. one of the big headlines from that is that bill cosby admits that he got seven prescriptions for the powerful sedative called qualluude so he could give them to women that he wanted to have sex with. we have heard from the accusers that he did give them the powerful sedative so powerful that they could not consent to sex with him. what is your response to that revelation? >> and it's not really a revelation that qualluudes were used in the '70s as a partying drug and used to increase sexual arousal. mr. cosby admitted in his deposition to offering one person who he was in a relationship with qualluude

during that time period and that person accepted it. when we see excerpts saying it is a powerful sedative but not talking about the fact that it was also commonly used party drug during the '70s. >> i have interviewed 11 of the accusers none of them were qualluude users. none of them consented to using qualluudes. they accepted a drink sometimes a cappuccino and became unconscious. >> the interesting part about you saying that you have interviewed them and accept what they said is true however when you listen to the denial of the accusations by mr. cosby through his attorneys from the beginning that is looked at -- >> why did he get seven prescriptions for qualluudes? that sounds like more than just one woman that he offered it to. that sounds like he wanted to give them to women. in his own words he says they

were for the purpose of giving to women. >> and what you are discussing is not a crime for a person to offer a substance in a consensual relationship to a person with knowledge and for them to choose to accept it is not criminal. it isn't new. >> they said they had no choice that he slipped it to them. what is his response to that? >> as he said a number of times that's been denied that he ever slipped without a person's knowing male or female a drug of any sort to them and that there was ever between him and any other adult nonconsensual sex. if you look at the manner in which the people who are lodging the accusations have done so we are seeing cases that come forward 10 20 30 and even 40 such as the california case 40 years later where it leaves the very precepts of our justice

system unable to be followed through. we go to a court of law to determinedom how to meet out justice and figure out what is true and false. we can't do that in these cases. >> the statute of limitations has passed for these women. that is true. they say at the time -- >> they chose to not come forward until after the statute of limitations. >> they say they did try to get attention for what happened to them and they told friends and employers and lawyers and all of them advised them don't mess with one of the most powerful men in the world. let me ask you this. why do you think in that case if you don't believe any of these womens accounts why do you think more than 25 women would be coming forward to tell this very private and very upsetting account? you think they are all lying? >> here is the important and critical fact. it's not about what i believe or what i think.

it's not about even what the truth of the matter is 40 years later when we have no way of accessing witnesses who can verify the fact. the important matter is that in our system in the united states and i love this about our country, we have a way for people who are accused of a crime to actually step forward and defend themselves. and for people who are accusing or bringing allegations to prove them in court. and when that system doesn't work -- >> times are different now but you say it's not about the truth of the matter. it is about the truth of the matter. do you believe these women or do you think they are liars? >> i am here as counsel for mr. cosby. i am not here to assert a personal belief nor am i here to call them names. i'm here to say in this country mr. cosby is innocent until proven guilty and because of no fault of his own these women did

not come forward there will not be an opportunity for him to disprove claims that are four decades old. i think that the fact that the sheer volume of the number of people who have come out is increasing others' ability to be tag alongs and say if one is getting away with lodging accusations with no proof then perhaps two can and then perhaps ten can, but that does not make it so. >> next month mr. cosby will have the opportunity. the civil case of sexual assault, a judge is allowing this to move forward. this is the one that involves a 15 year old who she claims was sexual assaulted at the playboy mansion. her attorney says that she expects to depose mr. cosby in the next 30 days. will he appear for that deposition? >> i read the press release and i understand that that is her

hope and her intention. what this california supreme court did was really just put this case at the beginning posture that it was in. they were ruling on a technical issue about whether the filing could be amended or not. they said that would not be heard. >> if called to do a deposition will he give a deposition? >> i will not reveal, strategies tactics or intentions of my client to testify or not or advice of counsel about the matter. we will deal with that with the council in california. >> you have been saying this has to be aired in a court of law. this is the opportunity next month for this to happen in a court of law. this is what you say mr. cosby has been waiting for. >> and i what i said to you is that through the court system when court cases are brought appropriately then it is handled by the defense and by the plaintiffs in the manner that it is supposed to be. that means that they make all of

the decisions that are available to them in a court of law. that doesn't mean i will sit here and tell you what i advise mr. cosby to do or what his los angeles counsel would advise him to do. it means that's the forum. the forum is not headlines from 70 years ago with one question and one answer from a deposition about the use of a party drug. instead, we will see in the courtroom and in this case and in others whether a defamation suit can hold up for a person who speaks up and says i deny the claims that are being lodged against me. we will see whether this claim that the police refused to prosecute will also become frivolous to the court in a civil case. all of those are things that we will find out in time. i know that that is the way the system should work. i pray it will work that way in this case. >> we will be watching along with you. thanks so much for being on "new day." >> thanks so much for having me.
