"ac 360" starts right now. good evening. thank you for joining us. we have got breaking news tonight that could decide which ten republican presidential hopefuls make it on stage for the first debate of campaign 2016 and may also say a lot about donald trump's staying power. there is new polling just out from fox news which is of course running the didn't. you can see it there. it shows mr. trump leading by a lot, 26 to 15 over jeb bush with wisconsin governor scott walker third and john casic, who happens to be governor of the state where the debate takes

place. he barely squeaks in. the latest monmouth university survey released today also showing donald trump with 26%. casic makes it into the top ten. we could get several more national polls between now and when fox news is going to make their debate decision. tom foreman has more. and joins us now. >> reporter: i can guarantee you everybody in washington is looking at this tonight. yes, only ten of the 17 candidates get to be in the race. fox hasn't told us specifically which polls they will rely on. we have taken the new poll from fox that you just mentioned. folded it into our national average of polls, what we call the cnn poll of polls and we we can say with pretty good probability who will be on the stage. up top, donald trump, jeb bush, and scott walker with double digit. they are all in. the next level down ted cruz at 7%. ben carson 6%. mike huckabee at 6%.

and then the last group, rand paul at 5%. mark o'o rubio, 5%. john casic, 4%. and chris christie sweeks in at 3%. based on this average of national polls. this is like at the line up. for a while it looked like rick perry might be able to squeeze in there. but the latest numbers tonight bump him down to the bottom group here the people who in all likelihood anderson will not be on stage unless we have some big surprise in the next few hours. >> fox has said there is going to be a second debate on the same night for all the candidates who don't make it into the main debate which will give them a chance to claw their way onto the stage in the future debates. >> yes. they are goc to look at everybody on the main stage and hope that somebody stumbles somehow and opens up a slot for them. there is a big caveat here. two thirds of the people on this stage statistically are already long shots. you can argue about who they are. but if you look at history, by

this time in the race, the person who will be the party's event nominee is traditionally already polling in the double digits. that doesn't necessarily say that's what will happen this time but it has happened in the past. that's why ads i said at the top, anderson everybody in washington is going over these numbers tonight. >> no doubt. given that kinds of pressure to make the cut candidates have been doing almost anything for an edge. governor casic chose to enter the race a couple of weeks before the debate to try to take advantage of a polling bump that new candidates enjoy. here's candidate ted cruz frying bacon on a gun barrel. ♪

>> let's see if we've got some bacon. ♪ >> rand paul, as you know has made a video taking a dhain chain saw to the federal toxicode. lindsey graham torched his cell phone and did other things to it as well. donald trump has his own planes and chopper. for more mo on leads and how long it might last joining us jeffy lord currently with the american spectator. and cnn commentator anna navarro, and cnn political commentator and democratic tragic donna brazil. mr. jeffrey, two polls putting donald trump at 26%, way ahead of the others. as you know, there are a lot of people who will say just ignore donald trump at the debate. but how can the other candidates ignore the guy with 26% support? >> at this point we keep seeing poll after poll after poll after poll that shows some variation of the same thing, that's ahead,

and ahead by a lot, or at least a reasonable sized margin. which says these things are not outliars. these are measuring a real sentiment out there. i think now these candidates are beginning to take him seriously. i think governor bush has sort of come around on that. i saw something today that rubert murdoch sent something out the other week that he should stop embarrassing his friends and the country suddenly said today well we need to be paying attention to what is happening here i think there is something in these numbers. >> anna what about that? there are those who said this is in large part because donald trump is a celebrity, there is huge name recognition. to be fair jeb bush who you are supporting certain has high name recognition. >> yeah. i don't think he is a celebrity to the same level and i don't think the name id is to the same level. jeb bush has the recognition

when it comes to his last name but most people are just now getting to know jeb bush and his record. i think at this point it's time to take donald trump seriously, if not donald trump, certainly his message and the message that the republican voters and the people responding on these polls are sending. >> what is that message. >> they are fed up with washington, fed up with the dysfunction, fed up with things not getting solved not getting addressed. they are angry. they are frustrated. and they have had enough of it. he is channelling that. i think anybody on that stage, anybody running on either side should frankly heed that message. >> donna, i mean, i know you have talked about enjoying every news story about donald trump getting popcorn, watching it every single night waiting to see what he's going to say -- >> absolutely. >> might it be a case of be careful what you wish for? if trump has great night at the debate thursday he is measured substantive, or however a great -- whatever a great night

means for him and for his supporters. won't you -- will you have to take him more seriously? isn't it possible you could be facing a very strong candidate? >> look i'm not laughing at donald trump. i'm laughing at the process that we're undergoing to determine who should sit at the table, so to speak. that's the gift that donald trump has taken a hold of this process. and he has really done himself well. if you look at the polls, his favorability continues to go up. and i don't think it's just washington. the fact is is that he is campaigning as the nonpolitician, the person who will get up and say what he believes to be true even if we don't have the substance behind the sound bytes, i think people are responding to someone who is just basically calling it as he sees it. >> donna then you look at the democrats, i mean can anybody say that about hillary clinton? >> you know she is not campaigning like donald trump. she is not going out there and calling people idiots or going

down to the border and saying mexico should pay for this and not have a plan. look she is campaigning with a lot of substance. her criminal justice reform plan her immigration plan her climate change plan. i mean look when you are a democrat, you often campaign with plans and programs. when you are a republican i think sound bytes work. tomorrow night will be -- i'm sorry, later this week will be interesting to see if mr. trump, is there any substance behind some of the things he has been saying. >> jeffrey, what about that? do you think the democrats have a problem here if donald trump is doing well because people say he is antiwashington he is telling it like it is -- do you see anybody on the democrat side who can compete with that? >> to be candid i think hillary clinton has the same problem that some of the republicans have. i think she is seen as a politician first. and that's part of her problem. and that's part of the problem some of the republicans have. >> anna there was a story in the new york sometimes suggesting jeb bush and some of his team like the trump surge

because if and when he implodes bush will be the best option. everyone else will be drowned out by trump. trump says that's false, that bush is quote, miserable. what do you say? >> i don't know. but i don't think jeb is miserable. i see him out there on the campaign trail being frankly joyful which is something he wanted to do he wanted to be a positive campaigner a happy warrior for the cause. what i do think is that it's hard to argue that trump is not hurting a lot of the candidates on the right lane of the republican party. if you see bobby gin dell's numbers, marco rubio's numbers, rand paul's numbers -- frankly, donald trump is taking the air out of those tires. you know let me tell you something -- i want to say something to my friend, donna. yeah the trump phenomena has been entertaining on the republican side. let's see what comes of it. girl i'm going to be popping popcorn when joe biden comes

surprise number one in the campaign so far of course donald trump beating all republican contenders in the polls by a lot. we mentioned surprise number two before the break, the possibility of vice president joe biden. new york times columnist maureen dowd got the ball rolling this weekend writing that mr. biden is weighing a run. today the forth forward movement got a boost by draft biden. >> i'm looking for a job. >> looking for a job, but the question is for joe biden is which one? he has long eyed the presidency and he is still considering joining the 2016 race. the summertime speculation has suddenly hit full boil over whether he will challenge hillary clinton for the democrat nomination. one factor weighing heavy, his son beau biden urged his father to run before dying of brain

cancer in may. and now, one of beau biden's close advisors are joining a grassroots movement called draft biden. and the vice president is holding political meetings of his own with his old network of supporters to see if there is interest in backing a new campaign. questions about clinton's candidacy hangover the biden boomlet. a recent quinnipiac poll showed only 37% viewed clinton as honest and trustworthy while 57% did not. forred bien it was the reverse. 58% found him honest and trustworthy. 34% did not. new hampshire democratic mary carey foley is all but begging biden to run. >> hillary does have a problem with trust in this country right now. and i do believe that when and if he decides to run, joe will add a new dimension to this -- to this race. >> reporter: biden has run for president twice before. he has never ruled out a third time. if he did, the gaffs from more than four decades in politics

politics, they are not completely unrelated. it might not be happening if some democrats didn't perceive an opening and vulnerabilities for clinton these ads, $2 million in iowa and new hampshire, are designed to soften her image and reminds voters of why she is running for president. >> i want to bring in the panel, dan pfeiffer patty so list doyle, and former south carolina democratic party chairman kick hare puttlyian. di patty, do you want to see him get into the race? >> i think he would be a formidable candidate. he is the signature vice president. he has been in the room with barack obama when the tough decisions get made. he has incredible relationships with congress on both sides of the aisle. and he is incredibly relatable and likable. in this particular climate in 2016 where tell it like it is candidates are prevailing i

think what was once a negative for him, his tendency for gaffs, can be a real positive this time around. >> do you think he will get in the race? >> you know, that's a really personal decision. and i can't even imagine nor will i presume to speculate about how the death of his son is impact that decision. but i think with steve row shetty, his chief of staff, has to do right now is answer some questions. can he raise the money? can he recruit the staff needed the political talent? can he set up an organization in the early states? and if the answer to those questions are yes, then, you know, why not? >> dan, you obviously read the maureen dowd column over the weekend that gave new focus i guess to this conversation, the idea that beau biden wanted his father to run for president. do you think that will factor into the vice president's decision? >> like patty said i think that's a personal decision. i'm hesitant to try to imagine what the vice president has been going through or how that can

affect his decision. look i don't know if he is going to run. i think i would be surprised if he did. but he has more than earned the right to run. if he did he would be a formidable candidate. >> why surprised? >> i think it's awfully late in the game. i think that hillary clinton would have an advantage in large part because she has had months to be organized in the early states raising money, and recruiting support he is. but if theres in candidate left who can get in the race and still have a shot at this point the vice president would be the only one. >> dick i know you are a staunch biden supporter, you think he should run against clinton. you are not concerned about the number of supporters she has locked up, the amount of money to dan's point? >> no. and let me tell you there are a couple of things going on. joe biden's chief of staff announced yesterday he is going with the draft biden movement he is calling around soliciting supporters and money. i made a commitment today to a substantial to the draft biden effort there is an evident going on.

i do think joe biden ought to run. if he can put -- look the loss -- he has lost two children. but the loss of this child this recently is something he has got decide whether he can put that aside and run for president. i mean he has been through a very, very traumatic process and period. so that's a decision he -- a personal decision he has to make. but if he makes in a decision i believe he will be the next president of the united states. >> do you -- is it that you support biden so much? or you don't believe hillary clinton can win or would be a good president? >> well, i think it is a combination of both. i think hillary clinton -- you know i supported barack obama over here in '57 and '58. i don't think she is a good candidate and i don't think she has the relatability factor that patty talked about. i think we see in her delivery she checks off the points. but i'm getting calls from all

over if state from people who are committed who would switch tomorrow if joe got into the race simply because joe inspires them. joe magnetizes them. he has the charisma, the connectivity that she does not have. so i don't think she can win in november of '16. i think joe biden can. >> patty, what do you make about that? are you concerned, the controversy over hillary clinton's e-mails? the criticisms of her on the campaign trial her unfavorability ratings have gotten worse? are those warning signs to you? >> i disagree. i think hillary clinton would make a fantastic president. and i think she is very charismatic. you know when she is on the job -- when she was secretary of state, when she was u.s. senator, when she was first lady her numbers were incredible were very high. so obviously, when you put yourself in the political arena. >> what's going wrong now?

>> she is running for president. she has inserted herself in the political arena. she is being attacked. and your numbers logically fall. if joe biden got in the race his numbers would fall, too. that's just life in politics. >> dan, as a campaigner she has obviously come under criticism. there are people who say she gets better as campaigns go along, and perhaps even the entrance of a joe biden would actually be good for her if she does in fact become the nominee. >> i thought for a long time that a competitive democratic primary would be the best thing for hillary clinton. >> you think what would help her? >> whether -- i think if we have a competitive primary, bernie sand ears or martin tin o'malley or others i think that's good. the hillary clinton that was facing obama in 2008 when we locked it up was a formidable candidate. she had have won in 2008. >> i want to clarify something.

new information. >> what's that bolling on the floor there. >> oh, that's a bolling of air freshener. >> a bottle of what. >> it's air freshen. it's not liquor or anything. >> okay. do you have a license on you? >> the bottle said gin but the driver said it was a bottle of air freshener. turns out mr. dubose was right, there was no licker in the bottle. moments after the questioning, the officer shot mr. dubose in the head at point blank range. >> go ahead and take your seat belt off. stop stop! >> the car rolls off, and crashes to a stop. officer tensing, as you know has been charged with murder. cnn's jean casarez joins me now along with sunny haase tin. if it wasn't gin in the bottle what was it? >> the coroner's office confirmed with cnn that it is compounds associated with fragrance or pur perfumes.

that's what he said. he said it was air freshener. here's what's interesting. they are doing a lot of toxicology testing here. other items in the car being tested and they say they will not come out with any other results until they have conclusionary results on all of them. why did they come out with this? this is a preliminary result but obviously it's more likely true. >> does this change anything? because at issue isn't so much what came before. it was the moment whether -- i mean i don't know at what point you believe things started to lead to the shooting but the car was start, the officer reached in. and the gun went off. >> i think it certainly changes the complexion of the stop. when you are stopping someone and perhaps you think there is alcohol or drugs in the car -- it's clear to me and i think everyone when you look at the bottle it was filled with a yellow liquid. gin is clear. certainly i think the officer knew right away it wasn't gin. but it may have changed the

comet pleks of the stop may have rampeed things up that he had a bottle in there. >> the officer looked at it held it up to the fwottle and moved on. mr. dubose didn't tell the truth about having a suspended license, again not that that -- >> but he did tell the truth certainly about having this air freshener. let's face it let's not illegal to have a closed bolling of alcohol in your car. certainly many of us have gone to the wine shop and bought wine and are driving back. that in and of itself isn't illegal. i think it may have changed sort the continuum of that traffic stop because he was fishing this officer, he was asking questions, he was looking for thing that are in plain view in a car. and that is perfectly legal. but, again, i think to jean's point. it is interesting he was being very transparent about that particular issue, what was in the car. >> jean there is a lot we don't know about the grand jury and their decision to go for murder

on the police officer. a lot of people see this don't see that the officer was being dragged by this vehicle. we don't know whether how closely the grand jury watched this video, do we? >> we don't. but we do know the other two officers the assistanting officers that the grand jury met conceivably last week on them and decided not to return an indictment. those officers testified to the grand jury. in their statements, we learned this late on friday. they said they did not observe a dragging. that is something that really hurts the defense right here. >> right. >> because they initially had said or alluded to the report was written in way -- >> that they were not telling the truth? >> correct. >> that could be a big development because all along the officers theoretically had backed up what this officer said. >> absolutely.

that's quite a departure. because we thought there was a blue code of silence going on blue wall of silence where they were backing up what seemingly is false report filed by officer tensing. bottom line i think this is going to come down to the video and whether or not a jury believes he was dragged. when i see it there is no way this officer was acting in self-defense. that doesn't make sense. i think jurors will ask themselves are my eyes lying to me? that's why it's important that he was wearing body camera. >> and why don't the body camera show he was being dragged. >> and we will see after closer analysis whether or not that shows. more breaking news tonight. officials in tennessee say tremaine wilbourn the suspect in the fatal shooting of a police officer in memphis turned himself in. he was put on the top ten most

wanted list earlier today. the officer he killed was shot during a routine traffic stop as he approached an illegally parked call. >> i think he felt the walls closing in. >> reporter: memphis police tonight announcing the man wanted for killing a police officer is now in custody. 29-year-old tremaine wilbourn turned himself in this evening following a two day manhunt. it began saturday night when officer sean bolton spotted an illegally parked car. as he approaches police say he is confronted by wilbourn who opens fire. a citizen uses the officer's radio to call for help but it's too late. >> he's shot. >> officer is shot. officer down in front of the location. >> this is just a reminder of how dangerous this job is. >> reporter: bolton a former marine who served in iraq had been on the force nearly five years. investigators believe he

interrupted a drug deal saturday night, and that's why wilbourn a convicted felon, shot the officer multiple times. memphis police director tony armstrong visly emotional shortly after the shooting. >> as a community, we say so often there is a theme that do black lives matter? and at the end of the day, we have to ask ourselves, do all lives matter regardless of race creed, color, economic status what professor that person holds -- all lives matter. >> reporter: in the last four years, three memphis police officers, including bolton have been shot and killed in the line of duty. >> when you look at this individual you are looking at a coward. he is a coward. >> and nick joins us. nick the suspect turned himself in. where is he now. >> reporter: shortly before 5:00 p.m. local time he turned himself over the u.s. marshal service and was immediately handed over to local

authorities. we believe he is still in custody. the homicide detectives where he is currently being interrogated. we are told by police during the initial interrogation he told them quote i'm not a cold blooded killer i'm not a coward. his arraignment is scheduled for tomorrow. >> nick thanks for the reporting. busy day and weekend for firefighters across california. this is what they are facing. fires burning up and down the golden state. they are getting a bit of a break from cooler weather but they could face new danger if thunderstorms erupt. more on the challenge from paul vercammen. california burning. at least 21 major fires are currently raging in the parched state. the bone dry landscape, gusty winds, and low mumdity are creating a tinder box of sorts fueled lie lightning. daunting conditions for the nearly 10,000 firefighters battling the fires. a u.s. forest service firefighter from south dakotaa was killed while working a fire

in body ok county. the married father of two because zouting ways to attack burning fire when he was attacked by flames. as the fire ravages anything in its path. >> it looked like a bomb went off over here. it's scary. >> reporter: the largest blaze, the rocky fire has burned 60,000 achers north of wine county. >> there are firefighter that have 20, 25, 30 years on the the job that have never seen fire behavior like on the rocky fire. >> reporter: the reason fire officials say four years of drought and 100-degree heat have created conditions perfect for explosive growth. so far two dozen homes have been destroyed. governor jerry browne declaring a state of emergency. and evacuations have been ordered for more than 13,000 californians leaving many worried that their homes may be in the fire's path. >> hopefully, the fire doesn't come this far and burn our stuff down. so we'll come back to at least

i knew something was wrong then. >> have you seen sharks out there before? >> i hadn't seen sharks out there that time. but, yeah not so much that close. you know they have been bait fish around and stuff like that but i hadn't seen any sharks up until then. >> when the fin of the shark comes out of the water that's when the viewers realized what was going on. was that the first glimpse you got of it? you. >> yarks pretty much. what is viewers saw is kpleekt how i first saw it too. i think if i saw it earlier i would have rose the alarms and came in. but, yeah unfortunately, it was too quick. happened too fast. and yeah we all got to see what happened. >> it seems like it kept coming back. i mean what was the sequence of events? you see the fin. then what? >> yeah so the first time when it came through it sort of you know that was when everything that you could see.

but then as it knocked me off the board it circled back again. and that's when i was like do i swim for my board or do i swim for shore? and it came like right next to me. and luckily, it didn't go for me and just went for my board. but i stopped and turned around just to make sure that i could see what was coming as best as i could anyway. not that i could do much. but -- >> i was curious about that. because is seeing it better than not seeing it at that point? i mean -- >> i guess so. you know? you never know how you are going to resnookt sure. of course. >> you know you speak to divers or you speak to other people that have been in that situation, and they always say if you can get a shot on its nose or something that might deter it. that's sort of how i was thinking. but, yeah i didn't -- i didn't know if i would have enough time to react or whatever. i just thought, well you know can't go down without a fight. >> there was a time when a wave

certainly a lot of tears and heartache in kansas and across the country tonight for a 9-year-old batboy. his name, kaiser carlyle, who was accidentally hit in the head by a practice swing at the national baseball congress world series in wichita over the weekend. he was wearing a helmet but his injury was too grave. he died on sunday. tournament organizers announced today they have suspended the use of bat boys and girls. however the tournament will go on. kaiser's family and his teammates say that's what he would have wanted. the little boy, who would have been a fourth grader later this month idolized his team, the beyeas of liberal, kansas. the feeling was mutual gary tuchman reports. >> reporter: there is no shortage of 9-year-olds who love baseball and dream of being a batboy. kaiser carlyle was one of them. and he got to live that dream out. with the liberal kansas bee jays, one of the teams in the amateur national baseball congress arc summer league for
