we are covering it the way only cnn can. we are live in illinois where the three cop killers remain on the loose. >> good morning, michaela. you are right. cop killers on the loose and a community on edge. the latest on this investigation is that it has all been turned over to the lake county major crimes task force. here is the back story. it starts at 8:00 a.m. yesterday morning when the lieutenant was out in the community investigating suspicious activity when he radios into dispatch he was in the pursuit of three individuals. here is that radio exchange. >> officer down, 128. they were responding to a report of a suspicious male black and male white. it appears the officer's gun is missing. >> responding to officer down.

subjects are considered dangerous. >> reporter: now this unleashed a massive manhunt including, state, local and national authorities. air support was launched. here we are nearly 24 hours later and the suspects are still on the loose. the community on edge, schools are closed. they are mourning today and this morning for the lieutenant, which we are told he was one with the community, served 30 years in the police force, a father of four, a husband and from what we hear, a very, very generous with his time, giving back to this community day in and day out. >> seems like everyone knows him. you can hear the pain in the voices, coupled with fear as the manhunt continues. thank you. a police shooting a man who

has his hands raised. there's a second video that shows a clearer view of the incident. will the public get to see it? sarah sidner is following us live in san antonio. good morning, sarah. >> reporter: good morning, john. the fbi, we now know is assisting in the investigation along with the attorney's office and sheriff's office. the district attorney told me he is looking at two videos, one of which a witness released to the public. the other has not been released. it is clear and helped them determine whether or not to charge the officers in this case. we want to warn you. the video that has been released is very disturbing. officials in texas are examining two videos. capturing this officer involved shooting in san antonio.

also -- >> when police arrived, he was armed with a knife and resisting arrest. >> they tried to use nonlethal weapons to try to detain him. after a lengthy confrontation, both deputies fired shots, causing the man's death. >> reporter: thomas provided the video to ksap. monday, the sheriff's office labeling it as unethical and sad to purchase and air it broadcasting a man's death for $100 spark threats to deputies lives. to which is station says, it is their obligation to inform the public. it is not uncommon for them to pay for video for freelancers or citizen journalists. we can tell you, the district attorney says they will move swiftly in this case. as soon as they get the entire investigation handed over to them by the sheriff's

department. we know the family retained an attorney who plans to sue the city saying the family is extremely disturbed and mourning. michaela? >> the second video is going to prove vital. thank you so much for that. meanwhile, baltimore is bracing for potential unrest as six officers charged in connection with freddie gray head to court. jean casarez is in new york with the latest on that. >> reporter: good morning, michaela. today is an extremely important hearing in the case of the six police officers charged in the death of freddie gray. the baltimore police department is telling the force they cannot take leave today. if they have a day off, they have to come in. this is to prepare for anything that could happen. there will be increased police presence around the courthouse and community activists are encouraging peaceful demonstrations, protests and the word around town is they are

encouraging people to go to the higher socioeconomic areas of baltimore because of the hearing today. the defense is the reason for the hearing. they are asking the judge to dismiss some or all of the charges. they are asking the state attorney be recuse from the case because of so many conflicts of interest, she cannot prosecute it and a special prosecutor should be brought in and whether they should be tried together, separately or in groups. another thing on the mind of people is they are due to have a fund-raiser here in baltimore in about two weeks. alisyn? >> it's complicated thanks for that. for more on these police incidents, let's bring in the senior vice president for fjb and a former atf executive. thank you for being here. we have three troubling law enforcement troubles to get through. one where there's an active

manhunt in fox lake, illinois. police are looking for three suspects, three white guys, one black guy, they believe who shot their police officer. they don't have much to go on. here, let me play for you the information that the dispatcher has. here is the sound. >> fox lake for an officer down. 128 honing. a suspicious male black and male white. appears the officer's gun is missing. >> responding to officer down, fox lake. considered armed and dangerous. >> the police officer who was killed was able to say he was per suing three suspects on foot. where do they begin? >> they are going to determine if anyone was at the scene or close to the scene to give us vital clues about the identities about the suspects. >> schools are closed today. >> yes. >> in three districts. the community is very scared.

they believe he took the officer's gun or they were armed since he was killed. that's not a lot. two white guys, one black guy. it's not a lot to go on. >> we have seen crimes like this with a lot less information. i'm sure everything we are hearing is not everything they have. that's the first thing. the second, boots on the ground. you have seen the organizations galvanized. they are following leads, allowing the information to drive the investigation. it may seem like we don't have a lot, i'm sure they have more than we are aware of. >> the fact that three school districts are closed, do they believe they are still in the area? >> if they are there and boots are on the ground, there's intelligence that tells us they are there. >> two sheriff's deputies shoot a man who they have been called on a domestic disturbance. he appears in the video, this is

cell phone video, to have his hands up. this is disturbing video because you watch someone be killed. we want to show it. his hands are up. now, he's shot to death. matthew, explain what we are seeing. >> i don't think there's too much explanation necessary. the standard of objective reasonableness for use of force is clear. that's what law enforcement is guided by. in this case, there is no objectiveness or reasonableness about what we saw. >> when you look at that, as a law enforcement officer, you don't see any reason they opened fire on him? >> i don't see any reason. there may be things that come into play about state of mind of officers, but the individual's hands were up. he should have been arrested and brought in. >> they say an arm is obscured by the pole. we can't see what.

>> drop the knife. we didn't see it. they may have done it. when he was shot, his hands were up in the air. >> there's no justification for shooting someone with their hands up in the air, even if they have a weapon? >> in 27 years in law enforcement, i have never seen one. every case is uniquely different. >> that's a strong assessment. let's go to baltimore. pretrial hearings for the officers involved in freddie gray's death. obviously, it's a heated issue. it will be a heated trial. how is baltimore preparing? >> crisis management 101. expect the best, prepare for the worst. i'm sure the state of maryland, the city of baltimore, the mayor, the police department, they are going with their intelligence, they are examining social media and coming up with a plan to ensure any peaceful protests don't get out of hand and go into riot status. >> we are connecting the dots on

these issues happening around the country. do you sense, from your contacts, are police feeling more embattled? are they feeling under fire? are we putting a title to this and it doesn't exist, this is police business as usual? >> i think three things are going on. the optics of our lives are very dir different. police may be feeling the stress or measure. listen, probable cause hasn't changed for quite some time. reasonable suspicion and probable cause. two, the public is seeing more now than they have seen in the past. that's creating tension and stress. you can't draw inference for all those things. lastly, this year, up to this quarter, 83 police officers killed in the united states. one is way too many. 1% down from last year. even if the trend continues, we won't match last year's numbers.

years ago. trump was going to do what he did do and release it. all the attacks trump has done against jeb, this is a problem for jeb. they have been utterly predictable. he used quotes from his mom saying he shouldn't run. jeb's people have been caught off guard by it. there are different rules trump is playing by. >> let's talk about the rules. he had an unpredictable meeting at the chamber of commerce. trump has had issues with latino voters not happy with his stance on immigration or loud stance on immigration. he has the meeting and the guy says it was a positive meeting. >> i don't imagine they were throwing things at each other. for trump, it does what he needed it to do. trump is turning into a politician. he's not under an illusion, the ship sailed. he's not going to get latino

killers on the loose in illinois. the fbi and u.s. marshalls are joining the manhunt 60 miles north of chicago. they gunned down a 30 year fox lake police veteran tuesday morning as he pursued them on foot. several school districts are shut down this morning as the manhunt widens. pretrial hearings get under way for the six police officers charged in the death of freddie gray. among the motions to be considered on whether to try them together or separately and whether they should be removed due to convict of interest. gray died due to a spinal injury. a woman killed -- wrongful death claim by the sheriff. she was randomly shot in july as she walked with her father along the waterfront.

police officer outside chicago. nationwide, officers are reporting feeling concern for their safety. we want to discuss it with two guests. a cnn law enforcement analyst, harry and cnn political commentator, mark. i know you debate issues hero bustly. i think there's not a lot of debate when you see officers gunned down in the line of duty. we approach it with a heavy heart. mark, i want to ask you, we have been seeing a push for crimes against police officers, attacks on police officers to be included in the hate crime laws nationwide. the federation of police have been pushing for that over ten years. do you think we are any closer to getting traction on that issue? >> i mean, when ever you have a national crisis or controversy, when ever hearts are heavy, to use your language, you are likely to see legislation pushed through. we saw post 9/11 and other

moments. whether or not that's the best approach is a different conversation. surely, it's more likely to happen. the key is how to address the issues. not in ways to kill cops. >> that's a point. you are right. there has to be responsibility -- people need to be held responsible. we have to stop the bleeding. harry, i want you to see this. i'm sure you can relate to this. this is from the l.a. times, they spoke to a 17-year veteran of the force in arizona. he said day-to-day, you are more aware of your surroundings and skeptical of people. these days, if i don't know you, i'm going to be extra guarded around you. that is sobering to think officers are skeptical of people especially when they are charged with being officers of peace. how do they do that? they are watching their six, feeling paranoid and under

attack? >> well, this is our job. this is what we deal with every day. as a police officer, you know, with all the police officer that is have been shot at, especially the last one that was assassinated pumping gas. police officers are going to feel hesitant when people approach them. i know when i used to sit in my radio car, i had my holster in my lap. if somebody walked to my car, my hand was on my gun in the event somebody pilled a gun. that was when we had 10-12 new york city police officers killed every year. now we have this problem out there. if someone approaches them, if a police officer can't see somebody's hands, they are going to be hesitant to tell them to back off and show us your hands. we don't know, as far as officer goforth was concerned, did he walk up and ask a question first and he turned around? we don't know that.

that makes officers very, very wary now. >> let's look at statistics. we have this from the national law enforcement officers association. we know it's a dangerous job, obviously. firearm related deaths, so far, remember, it's only september. 26 officers have died this year as compared to 2014. the entire year, there were 30. the numbers are down a bit. if we keep on pace, we are going to surpass that number. >> we might. one thing to remember, if one officer gets killed as the officer in texas did, we say it's one too many. we are not suggesting any is a good number. last year was the lowest number we had seen. 32 last year. the year before, in the 50s. we are down in officer killings over the last ten years, five years, three years. last year was unusually low.

if this year goes up a little bit, i don't want to assume there's a nationwide, sort of spike in officer killings. this may be statistically fair. again, one is too many. >> that's the key, right? we see there is a sentiment that is getting rhetoric in the country. i want to show you this graffiti that was spotted in houston. remember, houston is mourning the loss of one of their own officers just this week. this was spotted on the street. this, you know, heartless and thoughtless and foolish graffiti. this kind of thing, har wryharr senseless. this is not helpful in conversation we need to have nationally. >> you have a certain percentage of lunatics out there that hate the police, that will -- say it was graffiti officers who did

this. do i think they would kill a police officer? no, i don't think so. but, you never know. is he trying to intimidate someone or put a message forth that somebody should be out there killing police officers? i think that's what's going on. it's going on with a lot of rhetoric out there. a lot of people telling we have the demonstration in new york. what do we want? dead cop. when do we want them? now. we have the message about pigs in a blanket. things like this and other rhetoric out there. i'm sorry -- some lunatic might get this. >> might get in his head and we don't want to see it happen. marc, i want to give you a final thought. i know you want to respond to harry's last comment. >> i think we have to be careful not to overstate this idea of rhetoric. we are paying attention to police in the community. we notice the protests more. we notice police misbehavior and

death of freddie gray. we have the latest in baltimore now. jean? >> reporter: this is a very important hearing today, pretrial hearing for the six officers. we expect increased law enforcement around the courthouse. they are telling the entire force they can't take leave today. if they have the day off, they have to come in because they want to be ready for anything. community activists are encouraging peaceful demonstrations and protests surrounding the hearing. they are also asking them to go to the higher socioeconomic areas for the protests. it is because of the hearing. this is a critical hearing because the defense is asking for some or all charges to be dismissed outright. they are also saying the state attorney, marilyn mosby has so many conflicts of interest she could recuse herself or berecused by the judge on this case?

i think one that stands out, they say when the police department finished its investigation on may 1st and went before the district court commissioner, 13 minutes later, the first arrest warrant went out and actually, those conclusions are supposed to be given to the prosecutor. they look at it and there is time involved in all of this. they say, that's what began all of this. but, they are also asking for the defendants to either be severed and have separate trials or be tried in groups. i was in that courtroom yesterday for the hearing. it's pretty large. i couldn't help but notice on the defense side, there are 11 chairs for the defense attorneys today in court. we do not expect the six police officers, the defendants themselves to be present. they have waived their appearance in this extremely important hearing. john? >> i want to bring in baltimore city councilman nick mosby. his wife is the state attorney,

marily mosby who will be prosecuting this case. thank you for being with us. we just -- >> thanks for having me on, john. >> we heard jean casarez say how the police canceled leave. they are concerned about the possibility of tensions. what are your expectations heading into today? >> it's important to be prepared. i think we saw back in april how the city of baltimore was not prepared. i think, you know, the police department has taken all precautions to ensure that no matter what takes place, they are prepared for it. i'll be honest with you, john, i did not expect to see what the hype is around, if there's going to be any major tension. i think there will be some protest. i expect it to be peaceful and productive. >> the police are prepared. do you think the city is prepared? all over the country, we have seen protests that black lives matter move.

a lot of times calling for due process. they want the cases to go to trial. they want them to get before a judge. here, it has gone before a judge. is the city prepared for the possibility that the judge doesn't rule the way they want them to? >> i think the main line of defense associated with any unrest is the police. yeah, i have full confidence in the interim police commissioner. i think he's had the advantage of kind of seeing what took place back in april, which we clearly were not prepared for. you know, it's my expectation that the police will be prepared. again, i don't expect to see any unproductive or any issues that we saw back in april, today. >> now, the defense filed a claim. they want the judge to dismiss the case based on what they claim to be misconduct by your wife, the state's attorney. are you confident the charges

will stand? >> i can't speak to that. i'm not a lawyer, have not looked at the case in-depth. i don't have the ability to speak to that. >> you do serve a role here. you are married to the state's attorney. i understand there is a wall and you have to keep things separate. how is she doing heading into this day? this is a day a lot of people have their eyes on. >> i think she's doing fine. i had a long night last night, you got me up early today. didn't have much time to speak with her. i think she's doing okay. >> again, some of the issues discussed by the defense, they are saying misconduct and conflict of interest. she recused herself from other cases. there's a case right now where a police commander's son is charged of murder. she recused herself from the case because she knows the police commander. some people are saying she

should recuse herself from this. any thoughts on that? >> again, that's something you should take up with her. i think in the near future, we will hear the ruling from the judge. no, i don't have any specific opinions associated with that. >> let me ask you what is going on in baltimore right now. 33 homicides in the last 30 days. do you have any explanations why this is happening? >> i mean, unfortunately, in urban areas, crime is cyclical. we like to pat ourselves on the back when the numbers go down and chase new plans when crime goes up. if you don't change the structural issues in the poor, urban environments that are filled with illegal guns, that are filled with elicit drugs, the byproduct of that is crime. we can continue to act as if

this is a new phenomenon in america. unfortunately, most of the cameras don't come until you have these spikes in crime. they don't come to really try to expose the structural issue that is have been in place in these communities for decades. that's the discussion we need to start having. >> hopefully we will continue to have that discussion. let me ask you this. you are an elected official. your wife as well. everything happening, there is criticism because she's heading to a fund-raiser in a couple weeks. do you think it's appropriate to raise money while the case is at the forefront and being tried? >> again, john, i don't know if i'm not making myself clear enough, but i'm not the appropriate person to answer that. maybe her campaign or office or herself. that has nothing to do with me. i think what we need to focus on is, you know, the issue that is are putting us in this position.

alaska delivering an urgent message on climate change. he will be the first sitting u.s. president to visit the alaskan arctic. what they hope will be one of the lasting images of the obama presidency. i got a chance to follow him on a boat tour off the southern alaska coast, taking a look at the glaciers melting rapidly as a result of climate change. we saw stunning wildlife that you see inhabiting this corner of the world, including endangered sea lions. as we pause, i asked the president for his impressions of the tour. he remarked on the giant chunks of ice that are broken loose from the glacier. here is what the president had to say. >> itting in a lake right there. periodically, the icebergs will break up with ice.

press, huge attention and maybe a donation for his organization. so, i think, you know, i think it's a smart thing for him to do in terms of marketing for his organization. i can tell you, in south florida, the largest builder's association just pulled their event from trump even though it meant a deposit and means it may risk a lawsuit because they felt so strongly they didn't want to be at his resort. >> let's talk about jeb bush. we have seen a more aggressive bush going after trump. there are ads about how trump used to be liberal and used to be a democrat. you are laughing. shouldn't jeb bush put up his dukes? >> well, i think, at this point, this is all he's got left. this is desperation time here. he's riding along in the polls at 5% of 6% in the last two polls we saw. what else is he to do?

i'm sure he's going to fight back and continue to fight back. i think donald trump understands that perfectly, so i expect we will see more of this as we go along. >> we have been talking to people here. maggie was errol were here. they are not convinced the attack from jeb bush is going to land. let me ask you, is this the best he can do? >> i think it's going to be a consistent strategy. i do think somebody has to go through the trouble and through the effort of unmasking and revealing donald trump for what he is. a guy who has been a liberal. a lot of his life, recently became the conservative before the liberal in new york. >> is this what an angry jeb bush looks like in. >> you know, i don't think you are going to see jeb bush breathe fire. that's not his type of thing. i think you are going to see him

of the moderate republicans, the so-called rhinos. he was supposed to be the guy scooping up all the endorsements, got all the money from lobbyists in washington, d.c. he's a bush. everything was supposed to be in his favor. it hasn't turned out that way. i never bought into the hype. i didn't get it here. i thought there were a lot of negatives he was going to have. his dad's tax cut. a lot of things from his dad to his brother and from himself, common core. his position of 2012 saying he'd consider a tax deal and all this like his dad did. you know, these kind of things add up. i never thought this was a sell in today's republican party. sort of reaganized republican party. >> donald trump seems to have an answer for everything. over the last day, the one thing i have not heard an answer for is ben carson. what does he do about dr. ben

carson, now tied in iowa? it's not like ben carson is lighting anyone on fire. he's not out there on the stump going crazy. is trump going to start talking about ben carson the way he's talking about jeb bush? >> we'll see. i'm not sure he knows himself, at this point. one thing about politics is when you get down to a two-person race and we are a ways from that. if it came down to a trump versus carson race or trump versus anyone race, i think that, you know, you would start to see sparks. you look through american history. it is just chock full of these examples. john f. kennedy and lyndon johnson and nelson rockefeller and barry goldwater and on and on it goes. bill clinton and others. in the end, most of the time, they make up and move on. a lot of times they win. i expect there may well be some of this. this is a good thing, not a bad

suicide. >> reporter: when police arrived, they say he is armed with a knife and resisting arrest. >> they also tried to use nonlethal weapons to try and detain him. and after a lengthy confrontation, both deputies fired shots, causing the man's death. >> reporter: thomas first provided this video to ksat. the sheriff's office labeling it as unethical and sad for the news station to purchase and show the video. the station says it's their obligation to inform the public, saying in part, it is not uncommon for news organizations to pay for video from freelancers or citizen journalists. now, the district attorney has told us that he is grateful for the video, saying that both of the videos and the other evidence will really help them determine whether or not these officers will be charged.

we also know that the family has hired an attorney and that attorney says he plans to sue. baltimore police preparing for potential unrest as a hearing gets underway for the six officers charged in the death of freddie gray. what's the scene there, jean? >> reporter: the scene is that the courthouse is just opening right now. so the court day is beginning. the hearing is in about an hour and a half. we did hear there's going to be increased police presence around the courthouse. and also the possibility of protesters. our producer just saw several people with great big signs that are trying to find a place to protest in front of the courthouse. the police department says if anything happens -- because this is a critical hearing today. there are some major issues at stake. police department saying they will be ready. and any of the officers twhan d that wanted to take leave today and not come in, they're saying

you have to be here. we have to have a full force. they would rather have an abundance of people readily available as needed. the reason being, the defense is asking for the charges to be dismissed, all in part saying there is no reasonable basis in fact for these charges to be brought against these six officers in relation to the death of freddie gray. obviously the probabilisecutor disagreeing very strongly in that. speaking of the prosecutor, the defense says there are so many conflicts of interest with ma marilyn mosby that she should be reaccused. a special prosecutor should be brought in. on the night before the charges were announced, the prosecutor's office had a special meeting with the assistant medical examiner. this is before the defense says in documents that a cause and manner of death was even established. and then the next day there are

arrest warrants that are issued. prosecutors saying we believe beyond a reasonable doubt these charges are justified and we can prove them with a jury of the peers of the police officers right here in baltimore. we don't know if the judge will rule from the bench or take this under advisement. but the community is aware this is happening today. well, the gloves are off between donald trump and jeb bush. trump taking to cnn to fire back at bush's latest attacks. all of this as a new poll shows trump's unfavorable numbers are inching the wrong way, especially among hispanics. >> reporter: these are not good numbers from this new "washington post" abc poll. it shows among all voters, donald trump has just a 37% favorability rating versus 59%

of your time because this year there is such a deep desire for outsiders. how do you explain what the electorate seems to be saying about people like bernie sanders and donald trump? >> i think there is a legitimate anger in america out there. we've been through the financial crisis. people my age, they've seen their savings get no interest rates whatsoever. we know that money is su subsidizing big banks. the housing market has not really come back. and much of america, despite the fact there's some -- we're still involved in fighting. people have a sense there's something wrong. they don't know exactly what it is. but they want clean, clear answers. and that's what we've seen over the summer from both parties, because they're looking for easy answers. and the things, here's the trouble, alisyn, there are no easy answers for this, because it's taken over 30 years to get

where we are from the reagan administration in 1980 through right now. we're not going to find an easy, quick fix. but the american public is expressing its frustration, its anger. and that's what sanders and trump are both tapping. >> you said people are looking for clean, clear answers. that leads to the next question about hillary clinton. how big of a deal do you think it is, this investigation into her e-mails? >> well, i think it's a great political boon to the republicans. but if you ask, is there any real substance to this issue, the answer is, don't think so. all of us who have been in government and especially those who have worked at high levels and seen the interplay between the various intelligence agencies, the pentagon and the state department, know there's a lot of -- let's call it slack in the system. there are people who say things, refer to things, send e-mails,

have telephone conversations that, if you went strictly by the guidelines and tracked it back afterwards, you'd say, well, he shouldn't say that because that could be classified. but people say things in a way -- and some of this stuff got into hillary's e-mail system. >> yeah. >> and it wasn't classified at the time. it wasn't marked classified. and she would never have tried to use that system to handle classified data. but when you go back and look at it, there's some junior person who says, your responsibility is you tell us if this could have been classified. of course they're going to say, oh, that could be classified. there's a lot of fluff in this. >> you're an interesting person to talk to about this. so many people say general petraeus lost his job over this same thing.

how can you say there's nothing there when the investigation isn't done yet? >> well, because the two circumstances are entirely different. now, the general had a great military career. he was an outstanding director of the central intelligence agency by all reports. however, what he did was put together a collection of classified documents, highly sensitive documents that were marked with classification and delivered them to a writer, someone he was involved with personally. and he did that intentionally. he then attempted to conceal that. this is totally different. from people in the normal course of the day e-mailing the secretary of state and saying, are you going to be able to make the dinner tonight, and, what about the issue with the givelte fish and things like this?

officials in san antonio have obtained a second video now showing the fatal police shooting of 41-year-old gilbert flores who was shot by sheriff's deputies in texas despite appearing to have his hands up. the first video was first released by local news stations. i really want to warn you that what you're about to see is disturbing. joining us now is michael thomas. he's the young man who took this cell phone video. mark wilson, a reporter covering the story is joining him there. gentlemen, i'm preesh appreciat both of you. i understand you were working near the house where the shooting occurred. what did you see and what led

you to think to record this incident? >> i was actually just in the neighborhood. i stopped by the corner store right by there to get some food on the way back to my job. i saw cops and ambulances down there. i kind of went down the road and checked out what was going on. there was two cops in a row. one had a riot shield pointed at a guy in the yard. so i turned around and sat there for a while, just watching them. i was like there's been a lot of things going on in the world, so as i'm sitting here i'll pull my camera out and see what's going on. i started recording then. >> from your vantage point, sometimes cell phones don't see it as well as our own eyes see it. did it seem like the suspect was posing any threat to the officers? >> at the time he was shot, it didn't look like he was posing a threat to the cops, no ma'am. >> from one advantage poi-- poi

right? what more do we know about flores? >> right. it began was a domestic call. deputies were dispatched to the seen around 11:30 a.m. on friday. they arrived and found a woman with a gash in her head holding a baby who may have also been injured. flores was outside and armed with a knife at the time. apparently there was a lengthy confrontation prior to the actual shooting that is not seen in the video that was played by our local tv. but exactly what happened in the time leading up to shots being fired is still unclear at this point. >> right. and that's what michael's video does not show. i tluunderstand there's a secon video that's been obtained by authorities. does it give a different vantage point. >> that video has still not been

. welcome back to "new day." president obama just one vote away from ensuring the nuclear deal with iran survives congress. two more senators now affirming their support despite serious reservations. one of those senators is a democrat from delaware who's on the foreign relations committee. senator, thank you so much for being with us this morning. you said, frankly this is not the deal you hoped for and you have concerns about whether the u.s. can hold iran to the terms. so an unsatisfactory deal that you don't think the u.s. can enforce, that hardly sounds like a ringing endorsement.

>> that's right. i think this was a very close call. coming out in support of this deal doesn't change my unwa unwaveering support for israel. the u.k., france, germany, the e.u., that they will stand with us during the whole lifetime of this deal even as their own countries begin to develop closer economic sties. if we can count on them -- and i was ultimately convinced we can -- and if we can aggressively enforce this deal, i think it can end up being a positive deal. the deal does accomplish some big things. iran has to give up their 12ura they have built up over the last decade. they have to let in inspectors

who will be physically present and monitoring all of their nuclear sites, their whole nuclear fuel cycle for more than 15 years. but i am very concerned about what iran will do with the tens of billions of dollars they'll get that they'll likely use to support terrorism. and what happens in 15 years when they have an industrial scale civilian nuclear enrichment program. >> 56% of those polled said they believe the world will be less safe because of this deal. let's project 15 years forward. how confident are you as you sit here right now that the united states, that israel will be more safe than we are right now from iran and a nuclear arsenal? >> well, there's no guarantee that iran will dash toward developing a nuclear weapons arsenal 15 years from now. what this deal lays out is a pathway for them to have a large civilian monitored nuclear enrichment program.

we will be more capable of effectively striking iran if they decide to take a nuclear energy program and turn it into a nuclear weapons program. but i frankly think whether that happens will in some significant part be influenced by how strongly we enforce the deal and whether we convey that there is a credible, conventional deterrent capability, both for israel and for the united states to take out iranian facilities. >> senator, the president is one vote away from making sure the senate can't block this deal right now. some are saying could be six votes away from perhaps being able to support a filibuster in the senate, meaning there will never be an up or down vote in the senate on the nuclear deal. do you think there needs to be an up or down vote in the senate on this? >> i think there should be. and i had a conversation with one of the senators in our caucus leadership yesterday. technically we will be on the bill right when we get back next week. >> right. >> so we will debate this.

but this all comes down to whether or not majority leader mcconnell will reach an agreement with minority leader reid to let us go straight to the vote and have an up or down vote which should be a 60-vote margin. and ultimately it's filibustered as were by a 60-vote margin. i would think it would be really regrettable if we didn't ultimately go to the floor and cast our votes for or against this deal. >> let me ask you a presidential politics question right now. you supported the vice president. you worked for him in his 2008 campaign. have you spoken to him about the responsibility of joe biden running for president? >> yes. we have spoken a number of times about it and i have reached out and said, it was my honor to go to iowa and campaign for him in 2008 and i'd be honored and thrilled to get to do it again.
