believe half a dozen staffers may have been involved in accessing wrongful voter access from the hillary clinton campaign and going into the final debate of the year. >> bernie sanders and hillary clinton came face-to-face for the first time since that dispute over a breach of voter files exploded. the topic came off the top of the debate. the vermont senator wasted no time apologizing on behalf of his campaign. cnn's athena jones has more. >> reporter: good morning. the debate kicked off with a question about the very issue we spent the last couple of days talking about, this dustup over the democratic national committee. sanders explained what happened and then was asked if he owed clinton and apology. take a listen to what sanders

had to say to that and clinton's response. >> yes, i apologize. >> secretary clinton, do you accept? >> no. not only -- not only do i apologize to secretary clinton, and i hope we can work together on an independent investigation from day one, i want to apologize to my supporters. . this is not the type of campaign that we run and if i find anybody else involved in this, they will also be fired. >> now that i think, you know, we have resolved your data, we have agreed on an independent inquiry, we should move on, because i don't think the american people are all that interested in this. i think they are more interested in what we have to say about all of the big issues facing us. >> reporter: clinton accepting sanders' apology and saying they should move on to there issues, echoes sanders in that first debate saying americans are tired of hearing about clinton's e-mails. so that was an interesting moment that seemed to diffuse that issue, at least on the

candidate level. another important theme that emerged during the debate was this divide between sanders and clinton over america's intervention in overseas conflicts. sanders said that clinton was more of a proponent of regime change than he is and argued that the u.s. doesn't have to be the policemen of the world and that divide echoes what we have seen also on the republican side among candidates like ted cruz and marco rubio and donald trump. trump, in fact, was used almost that exact same terminology saying the u.s. doesn't have to be the policemen of the world. and speaking of donald trump, he was mentioned over and over again in the debate and he is the only gop candidate to be mentioned by name. back to you guys. >> thank you so much. joining us is cnn politic senior reporter stephen collinson. talk with the apology from sanders and the acceptance of that apology by hillary clinton. is this over or at least fading as a primary issue? >> i think, victor, it's

suddenly fading. the political impact of it is fading and we don't know what is going to happen with this investigation. as you said, another couple of sanders' employees have been suspended pending that investigation. i think what it shows us is hillary clinton has no political incentive to wage this with bernie sanders in public and doesn't want to do anything to enrange bernie sanders supporters and give him more momentum into this race as we head into the first vote, seven weeks or so away so i think smart politics for hillary clinton to get on with the issues and animating the democratic base. >> speaking of that, one man is doing that. we heard his name over and over. watch. >> i worry greatly that the rhetoric coming from the republicans, particularly donald trump -- >> fascist pleas of billionaires with big mouths. >> somebody like trump comes along and says, i know the

answers! the answer is that all of the mexicans, they are criminals and rapists. >> he is becoming isis's best recruiter. >> fascist and big-mouth billionaire and isis's biggest recruiter and democrats have identified their target and his name is donald trump. >> exactly. no other name of any other republican presidential candidate was mentioned in the debate. what i think hillary clinton was trying to do is portray donald trump as a spokesman for all republicans and even if he is not the nominee and she has to go up against somebody else, assuming she wins the democratic nomination, she will try to paint the republican pear as the party of donald trump trying to went over centrist moderate voters might find his stage troubling. at one point, hillary clinton said that isis had used videos of donald trump to recruit supporters. the cnn reality check team looked into that. they couldn't find any specific evidence of that, but it's clear and experts would support the

view that the kind of anti-muslim rhetoric that donald trump has been indulging within this campaign plays into radical groups in the middle east are at war with the civil war with the united states. >> we have have debbie wassermann schultz on the show later and talk to her about this. for this moment, what is the residual effect, if there is any, on the gop primary now that we see that the only candidate named in the democratic primary debate is donald trump? >> i'm sure you'll see donald truver as he comes out on the political shows today showing this just proves that the democrats fear him than any other candidate and that is he the legitimate front-runner and it will play into the feelings of some in the gop and hierarchy that donald trump is damaging the brand of the republicans. i think democrats believe that

need to be in the fight against the terror group. take a listen. >> when we look at these complex problems, i wish it could be either/or. i wish we could say, let's go destroy isis and let assad continue to destroy syria, which creates more terrorists, more extremists by the minute. no. we now finally are where we need to be. we have a strategy and a commitment to go after isis, which is a danger to us, as well as the region. >> let's bring in cnn military analyst lieutenant general mark hertling. great to see you, general, this morning. do you agree with hillary clinton when she says we are exactly where we need to be when it comes to this fight against isis? >> good morning. i have many things to both agree and disagree with secretary clinton on. she basically said we are where we need to be and i think that is close to being correct. we have had some stumbles in the current administration and what

they have attempted to do, but i think we are starting to get our act together. she said a couple of things i think were important. first of all, i agree with her it would be a strategic mistake to put ground troops in syria. she named particularly mr. trump but i think anyone who is putting the narrative that muslims are the problem is counter to what our american values are and also contributing to the strategic narrative of this group. third, she mentioned the no-fly zone and i can't agree with her on that and i think she was providing hopeful methods, saying that she knew it would work when, in fact, that is a very dangerous situation, requiring a lot of forces. >> yeah, especially when she talks about deconflicting with russia and russia is specifically flying in that air space. you mentioned boots on the ground. i want you to hear the sound bite from hillary clinton last night where she was saying why she is opposed to u.s. boots on the ground. first, take a listen to that. >> they want american troops

back in the middle east. they want american soldiers on the ground fighting them, giving them many more targets and giving them a great recruiting opportunity. >> now, bernie sanders also reiterated that viewpoint, u.s. ground troops should not be fighting the fight on the ground. you were just mentioning your take on thacht. >> i disagree with mrs. clinton where it gives them many more targets. that's what the military does. they are sent someplace and they fight and win where they are sent, but it's not the target issue, it's the problem of being put right in the middle of a battle for islam and it will cause -- isis has said this -- it will cause them to grow more recruits. it is exactly what they want from the standpoint of generating more recruits and

claiming that what they are fighting for is exactly true, and it will sway many people in the islamism dialogue to come closer to their side. >> yeah. bernie sanders also brought up this point last night, you know, that muslim nations also need to get more involved. you had the saudi coalition being announced a few weeks ago about common nations. you know the battlefield, especially in iraq, how much of a difference this saudi-led coalition is going to make on the battlefield when you have pakistan saying they had no idea they were a part of this coalition. >> yeah, that's an interesting point. i thought that was somewhat interesting, especially when he cited king abdullah of jordan and how we needed to have him join the fight. he's been in the fight. the interesting issue is it's extremely difficult to get the nations around there to counter what they believe are their national objectives to do what we want them to do.

nations don't work that way and that is where i have problems on both the republican and democratic side. there has been repeated comments about here is what we need, the kingdom of saudi arabia to do and what we need jordan and turkey to do. guess what. they have their own ideas what they need to do and that is what diplomacy is all about. we have been working on that from the state department standpoint and getting closer but very challenging to get the nations to go against their national objectives. >> a debate unfolded ens isis and assad and if the strategy should include both or as bernie sanders and o'malley was saying the main focus should only be isis but the overarching question let's say assad were to go, who would fill that vacuum? of course, this is a divided country, what will be left after the syrian war and, of course, isis would definitely try to take advantage of such a vacuum. >> you and i have talked about this many times before. it is not an either/or as mrs.

clinton said and it's not sequential as senator sanders said. you can't do it that way. it has to be -- it has to be collateral and come together and complimentary in the effects that you're attempting to do a military action and that is continuing the efforts against isis while, at the same time, attempting to find a diplomatic solution. i, again, quote on this by saying that war is an extension of politics by other means. we have, in fact, attempted to do both things at the same time and that is very, very challenging. >> it sure has shown to be very challenging. lieutenant general mark hertling, great to get your expertise, thank you. >> thank you. >> thousands of iraqis protest in turkey demanding them to pull their troops out of iraq and the government responds. russia's president gives his biggest signal yet he'll stay the course to fight terrorists

consensus that exists in the country. >> good. >> it's no longer enough just to say that the vast majority of americans want common sense gun safety measures, including gun owners. we need -- and only the three of us will do this, nobody on the republican side will even admit there is problem -- >> we heard that from secretary clinton and then we heard from governor o'malley going after both sanders and clinton. watch. >> isil training videos are telling lone wolves the easiest way to buy a combat assault weapon is in a gun show and because of the flip-flopping political approach of washington that both of my two colleagues on this stage have represented there for the last 40 years. >> whoa, whoa! >> you heard the whoa, whoa, whoa there. that started something there between the candidates. this is getting a lot of attention, but let's talk about the issue of gun control in the latest cnn/wmur poll, it ranks fifth among democratic voters in the primary, amongst most important issues. so is there traction here? is this going to be a single

issue for any of the voters potentially, maria? >> i don't think that it will be the deciding issue, victor, but this has always been an issue that has been top of mind for democratic voters and progressives in this country and, frankly, most americans do believe that common sense regulations do need to be approved and that there should be legislation on expanded background checks which is exactly what hillary clinton was talking about. so i think, as a whole, this is a winner for the democratic party, even though we saw governor o'malley trying to challenge both of his opponents that were on the stage on this and he needs to do that, baugh he is so behind in the polls. i think this is something that unites the democratic party and, as hillary clinton mentioned and underscored, it is something that is a huge differentiator with republicans because we know all of the republican contenders are absolutely against any kind of additional common sense gun measures and when you can point to specific instances where

additional common sense legislation or reform would have helped, for example, hillary clinton uses the south carolina example where that massacre could have been avoided then i think it rings true to american voters and that helps the democrats. >> let's talk about foreign policy, specifically libya. clinton and sander went back and forth over the issue, specifically regime change. erol, listen to this. >> i worry too much that secretary clinton is too much into regime change and a little bit too aggressive without knowing what the unintended consequences might be. >> you voted for regime change with respect to libya. you joined the senate in voting to get rid of gadhafi and you asked that there be a security council valuation of that with a resolution. >> so the secretary there saying, listen, if you're criticizing me, we are in the

same boat. you supported this policy. obviously, libya going to come up in the general, so will russia and so will iraq and syria, of course, erol. again, is this going to be enough to start to shift votes and change a narrative in the primary? >> well, i think that this, unlike some of the other issues, actually does resonate with primary voters. i mean, if you remember, the reason ultimately that clinton started to fall behind and ultimately lost to barack obama back in 2008 was over that vost she cast for intervention in iraq. to the extent this issue comes up again and bernie sanders has a really good issue to push on her because cher clearly different on it and it is something i think we have seen demonstrated that primary voters don't want endless intervention. primary voters are split what is the best way to go after isis. do you put boots on the ground and plan to stay 20, 30, 40

years or do you do something else? hillary clinton has a lot to answer for. she and samantha power and susan rice are believed and often described as the architects of the decision to take the actions that this administration took in libya. she's got to answer for that and she's got to own it. bernie sanders represents a very powerful, rather large wing of the party that thinks that it has been mishandled and that intervention is a huge mistake. >> maria, let's talk about one of the lighter moments and really a role that some people, i'm sure, have considered or questioned what would former president bill clinton's role be if secretary clinton becomes the next president. here is her characterization of what his job would be. >> with respect to my own husband, i probably will still pick the flowers and china for state dinners and stuff like that, but i will certainly turn to him as prior presidents have for special missions, for

advice, and, in particular, how we are going to get the economy working again for everybody, which he knows a little bit about. >> how much of that rings true? do we really expect that the would-be president would still be picking out flowers for the state dinner? >> this is so interesting, victo victor, because last night that got a lot of reaction good and bad on twitter and a lot of my own progressive girlfriends were sort of upset about that answer. my reaction was, so what? ! this is a woman if she becomes president will be so competent in her competence she will be able to take care of china and pick out the china. >> well done there, well done. >> thank you. i think it was one of those lighter moments that underscores that you know what? she is just like everybody else in a sense, right? this is something that she joys.

on friday and the highest single day ticket sales ever and in its opening weekend it could claim the title from "the jurassic world." some forpredict "the force awak" could be the highest producing movie of all time? >> absolutely. there are weeks and weeks to come where more and more people will be seeing the movie. i think the hard-core fans have already seen it by now and they sold out the early showings. this is so popular that disney had to reassure people there are tickets left this weekend and trying to get that message out. you mentioned that record 208 million is what "jurassic world" made earlier in the year at its opening weekend and it looks

like "star wars" will pass that this weekend. we will pass the numbers along when we get them but it looks like "star wars" will beat that record and beat the "harry potter" record set in 2011 opening day record of $43 million and "star wars" $57 million. we are seeing a continuing record pace by this movie. it goes to show that disney was right, the right time to reboot this movie and right to have j.j. abrams as the director. >> brian, this is one of the things that really has me excited. i don't really go to movies. >> you don't? >> i don't. i don't. >> okay. >> but this, i'll go and see. because, apparently, there are things hidden in the movie. i like this element of it! that fans should be looking for. >> yes. easter eggs, they are called. the director, i mentioned j.j. abrams has put these all throughout the movie approximately really making you have to see it is and he could time for some of these fans.

staying true to his word about this investigation within his campaign over the data breach. the bernie sanders campaign suspended two more staff members. >> sanders' campaign manager saying they are looking into a half dozen of accounts that may have been wrongly accessing voter data from hillary clinton's campaign but that doesn't necessarily mean half a dozen staffers, since one person can sometimes have more than one account. we have will continue to follow this throughout the morning. in the meantime, cnn's athena jones joins us more on the highlights from the democratic debate. one of them was this apology that the debate kicked off with. >> reporter: absolutely. interesting to see the debate kick off and diffuse that at least on the candidate level. i got to tell you compared to the gop showdown from earlier in the week, last night's matchup was pilolite and even warm at

somebody like trump comes along and says i know the answers. the mexicans are criminals and rapists. >> so a lot of mentions of donald trump. the only gop candidate to be mentioned by name last night. one more point i want to bring up. an interesting divide on stage when it comes to america's overseas conflicts. we saw sanders saying that clinton was more of a proponent of regime change than he is and he argued that the u.s. doesn't have to be policemen of the world. this is very similar to the divide we saw on the gop stage earlier in the week between candidates like ted cruz, marco rubio and also donald trump. trump has even used that same language in interviews, saying that the u.s. doesn't have to be the policemen of the world. back to you guides. >> guys. >> great reporting.

thank you so much. stephen collinson joins us with errol louis and maria cardona. errol, the database breach has that been neutralized after the apology and acceptance and will they move on? >> i think the only reason we are not entirely sure we can put this behind us is the new names came out. apparently the database, from what i can figure out from digging into this is one in which everybody who accesses it can be tracked and traced. and so when you can find out exactly who saw what and exactly what they did, once that investigation is completed, it might be more than a few people who actually sort of snuck a peek at some data they were not supposed to see. they weren't able to export it and reserved for the highest level of the people in the campaign but getting a peek at what your opponent has compiled

something that hasn't happened. >> i think there was a report that the videos hadn't been found but a report by abc news that said this is something the jihadists were saying and using to recruit people. i think her overall message is right on, because this is exactly what isis wants. they want the united states to be at war with muslims. they want to be able to say the united states doesn't like muslims and, therefore, use it as something to continue to recruit people from all over the world. so her point is that what the republican rhetoric is doing is feeding right into what isis and the terrorists want and that democrats need to be very careful to make sure that we don't alienate the exact communities that we need in order to fight terrorism, not just globally, but here at home. so i think that is a very strong message that resonates both with the people here, who understand that this is a problem in their communities, as well as around the world. >> stephen, let me come to you

about martin o'malley. the exchange at the very start and senator sanders apologized and called for an investigation. the secretary accepted and said let's move on. then we heard martin o'malley saying this is the bickering that voters don't want to hear. i thought they weren't really bickering. maybe a line that didn't work. later in the debate, he was swatted off like, calm down, martin. >> right. i think that early exchange kind of spiked martin o'malley's guns a little bit, if you like. he would like to see bernie sanders and hillary clinton go on it on a prolonged basis on this issue and that line might have had more resonance. i think it's seen he was a top prospect in the democratic party many years and has not had much luck in inserting himself in this race. i think he possibly could have emerged, had bernie sanders not been in the race as sort of a liberal challenger to hillary clinton but the fact that bernie sanders is in there and has

proven so popular with the grassroots, the party has made it very difficult for martin o'malley to get in and i think there is a lot of frustration and you can see that in these debates. at one stage, he mentioned the debate as something that he was -- the democrats were allowed to have take place. there is some frustration in the o'malley campaign that there are only five democratic debates and not given him much chance to get into this campaign. >> maria, let me ask you something that kind of stood out, gwynne. there have been three primary debates and for the second time, secretary clinton is not at the podium when they come back from break. what is happening? i mean, not literally what is happening, but what is happening -- >> it takes a little bit longer for the ladies to use the ladies room! but it's interesting. because that moment last night was also a moment that got a lot of chatter on social media. a lot of people saying that it was kind of bad forum by abc to

show an empty podium and not to go to some sort of analysis and wait for her. but you know what? i think it was a small moment. it did not endanger in any way the kind of debate that the democrats had which i think was fabulous. i think they all did really well. i think secretary clinton actually won the debate, but, overall, democrats won and the american people won because the contrast with republicans so so stark and going into a general election is what we want the american people to see. >> thank you all. >> thank you. >> sure. they are back. overnight, tina fey and amy poehler revived their classic hillary clinton and sarah palin characters on "saturday night live." take a look. >> oh, geez! looks like i went through time in space again!

sanders fired two more staffers. is this all over or is it going to haunt the campaign? >> i think the campaign is doing quite well with dealing with and that the investigation will go forward. more interesting was the clip that talked about the question of foreign policy and the big differences between hillary clinton and bernie sanders on foreign policy and dealing with isis. remember, as this campaign goes forward, i think we out in the grassroots are going to remind every democratic voter that hillary clinton voted for the iraq war, cited with george jush a bush and dick cheney and bernie sanders showed a lot of wisdom. you could see this on youtube and look at his opposition to the war. he was then in the house, opposing the iraq war. and every single thing he said, every single thing he said about his opposition to the iraq war came to pass, including forces foreseeing the creation of something like isis, if you fractured iraq, what would going to happen, what was going to come in that vacuum?

i think that showed, that moment showed how bernie sanders is far more likely to be a much better commander in chief and protect the american people than hillary clinton. >> how is he going to set himself apart from the former secretary of state hillary clinton who has a lot of experience in foreign policy? because as you know, bernie sanders rose to popularity, you know, with this message that resonated with a lot of people on income and equality and corrupt campaign finance. >> again, let me make the point that bernie sanders, in the most important vote, the most consequential vote in foreign policy the last 15 years, bernie sanders had the wisdom to vote against the iraq war and not believe george bush and dick cheney and donald rumsfeld. i will ask every single democratic voter out there would you have believed dick cheney and george bush and donald rumsfeld? the answer probably would be no. hillary clinton sided with george bush.

that war devastated iraq and cost the taxpayers money. that alone says that bernie sanders is far more prepared to be commander in chief than hillary clinton. frankly i think this idea that hillary clinton has foreign policy is a myth. she knew around a lot as secretary of state. it's not clear to me exactly what she accomplished. if you compare her to john kerry who completed this amazing deal with iran and kudos to him and the president and compare that to what hillary clinton accomplished and it's hard to see any record other than flying around as secretary of state. i grant that she has enormous amount of celebrity but in terms of actual accomplishments it's a big question. this is an important question on isis. bernie sander has been very, very clear. he believes that the muslim world and he praised a number of times the king of jordan. praised him numerous times in citing the fact this is really a problem for the muslim world.

the muslim world needs to take hold of that with support from the united states in a broad coalition, including russia and that goes to the point that bernie sanders is very hesitant to put boots on the ground to risk american lives. hillary clinton, i think her impulse is favor regime change and i think it goes back again to her support for the iraq war and i think that is a very risky thing for the american people and i think that difference is going to continue to play out in new hampshire and iowa. >> but on isis, you're saying the muslim countries have to take more, you know, take a forward step on this but isn't that what we are seeing especially with the islamic coalition being formed in the saudi ko circumstances saying we have 34 nations coming together to fight isis? is that not enough according to bernie sanders? >> i think bernie wants to expand that and some countries we don't agree with on every issue his point is must be a global coalition and that it

can't be, that it's the u.s. that is the policemen of the world. that has got to stop because it puts at risk not only the lives of our troops, our men and women who go to fight and die in those words, but an enormous cost to the american taxpayer and money we should be using for medicare and all lower prescription drugs and past family and medical leave act which hillary clinton does not support because she is against the dollar and change increase in taxes that will give family medical leave. all of those things, we should spending money there and not fighting wars in middle east and creating more opposition and hate toward the united states which emboldens that kind of radical islamists like isis. >> you and bernie sanders sound optimistic and quite confident. we heard from bernie sanders the campaign is on the verge of a historical upset but when you look at the poll numbers, i mean, he is more than 30 points behind. how is he going to make a dent in clinton's lead?

>> well, the fact is if you look historically just six months ago, bernie sanders was an afterthought. he would have been 3% in the polls. i don't put much stocks in the polls. i've been traveling in iowa and nevada and south carolina and now new hampshire. i can tell you the excitement and the energy and the thousands of volunteers, the incredible staff that bernie has is going to bring victories in iowa new hampshire and forward. take one instance. when the democratic party, under the leadership i believe is a debbie wassermann schultz tried to tip the scales. in under 24 hours, over 500,000 signed petitions. that would not happen if you did not have the strong support on the part of grassroots and on the part of voters who support the sanders campaign. i think you will see that in iowa, coming into january and i

between the campaigns, moving forward of the data breach? >> well, i was very pleased to see that bernie sanders apologized. that was the right thing to do. he took responsibility as a candidate and said his campaign engaged in wrongdoing and said he was disappointed. what it allows us to do is make sure we can move forward with the independent investigation, that the sanders campaign has agreed to participate in and cooperate with us in on. and i was very glad that -- and very proud of our candidates last night, because the -- other than that first question, the rest of the debate was very substantive and robust and it allowed us to make sure that our candidates drew a very stark contrast with their vision with the country compared to the extremism we saw last tuesday on the debate stage for the republicans. >> let's get to the rest of the debate then. one name we heard many times was donald trump. we heard one comment from secretary clinton that is getting a lot of attention, some people saying she went too far. let's watch it and then we will

talk. >> we also need to make sure that the really discriminatory messages that trump is sending around the world don't fall on receptive ears. he is becoming isis's best recru recruiter. they are going to videos and showing donald trump insulting slau islams and muslims to recruit more jihadists. i want to respond to this sort of bigotry. >> the cnn reality check found that there is no evidence of trump being used in these isis videos going around to recruit jihadists. i know you may agree with the sentiment, but because of what she said, there is no evidence to support it, should she apologize or clarify or did she go too far? >> i'm not sure about the organization you referred to as

being a validated or the last word on whether there are or not videos. but the bottom line is that -- >> cnn. >> there are terrorism -- i'm sorry. i didn't hear you through my ear. but the bottom line -- >> cnn. >> throughout -- yes, i heard you. >> okay. >> thank you. the bottom line is that there are terrorism experts throughout this discussion, particularly since last week, when the republicans were on the debate stage essentially only chest feeding and none of them repudiating they would support donald trump when he was the nominee when this is someone who said he would ban all muslims and there is no question that terrorism experts have said that what he is doing, and this ugly nasty rhetoric is absolutely a potential tool to be used by isis to recruit others to their cause. >> a potential tool but they are going around this to recruit

jihadists. i will say cnn is not the only news agency that determined that -- there is no evidence to support that. should she at least clarify? >> as i said, what i am aware of is that over the course of this debate, it is clear that the actions and rhetoric of donald trump have absolutely been articulated by terrorism experts to be potentially used as recruitment tools, rather than making sure that we can bring muslims, who are overwhelmingly peaceful and who wish to make sure that they can just live their lives every day, against the actions of isis. and it's not helpful. it's harmful. and donald trump's rhetoric and actions really would drag us back to the mccarthy era and it's a stark contrast that was an important stage to be made between the two debate stages. >> let's talk about the scheduling of the debates. this was, obviously, on a saturday night. the previous debate was on a

saturday night. the next debate will be on a sunday night. i want to put up on the screen for us what we read from "the washington post." chris elisa in his determination of the winners and losers of the wrap-up of the debate, he writes this. there's simply no jutification for hosting a debate on a saturday night six days before christmas, unless the goal is to ensure that said debate is lightly watched and therefore any mistakes made by the pres e presumptive front-runner is lessened. many outside of the campaigns believe you and the dnc are working to coronate secretary clinton and want the debates to be pushed away. what is your thought this is to help the front-runner? >> does it make any sense that a national party chair would want fewer people to watch our candidates on debate for the presidency of the united states? that is nonsensical. i hope that chris and others

hold republicans feet to the fire in a similar way because, geez not coincidentally their broadcast network debates are also on a saturday and that is simply because broadcast networks have less flexible programming. i did not say to abc, hey, let's schedule this on a saturday night. i didn't say to any of those networks that they should do that. that is how the programming worked out. we have six debates. three are during the week. three are on the weekends. there are other candidate forums and multiple opportunities for voters to see our candidates in a variety of ways. any accusation like that is nonsensical. we are neutral and i am neutral and we want to make sure our candidates have the maximum ways to see the candidates and especially early in the campaign process. >> i know you are passionate about and the candidates are passionate about, but you would

not have been able to determine that based on the questions last night. of course, the discussion of national security and economic security, isis, gun control, but not a single question, no discussion of climate change coming so short -- so soon after, you know, the paris agreement, the top 21. are you satisfied with that? maybe should there possibly be a debate dedicated to climate change, science technology? your thoughts. >> it did not come up last night and the candidates have talked about that over the course of the first two debates and on the campaign trail. they have been able to make very clear that while the republicans are back in another era and simply are sticking their heads in the sand, you know, pun intended, that climate change and global warming is nonexistent or certainly not man-made, compared to our candidates who all believe it is

man-made and there is no question that the climate is warming. we have 97% of climate scientists that agree with that. we need to take steps to be able to reduce our carbon footprint and do somebody about that. the moderators are the ones that determine the questions. we certainly don't dictate to them what questions are asked. owner over the course of the next two debates i expect those questions to come up and our candidates are bringing that issue up very prominently on the campaign trail. >> debbie wasserman schultz, good to have you back. >> thank you so much, as always. while the democrats were debating, republican candidate ted cruz ran this ad. >> imagine the greatest christmas stories, told by the senator who once read "green eggs and ham" from the senate floor. >> 'twas the night before the shutdown and all through the house, not a bill was stirring, not even the fundamentalist.

state attorney for the city of baltimore is under growing pressure. this is coming after a mistrial was declared in the case of the first officer charged in freddie gray's death. jean announced charges against baltimore police officers in the death of freddie gray. >> i've heard your calls for no justice no peace. however, your peace is sin sincerely needed as i work to deliver justice on behalf of freddie gray. >> the 35-year-old's decision to charge one and suddenly put the youngest elected state attorney in the national spotlight. >> i looked at a criminal justice system that historically affected so many communities of

color and i wanted to reform that system. >> grey was arrested april 12th and broke his neck while being transported in a police van. one week later the 25-year-old was dead. the community reacted with weeks of protests and looting as the city of baltimore was placed under a national guard curfew. moez by helped restore peace and a sense of justice when she decided to bring a case against the six officers. vogue magazine called her a national figure and a boston college law school magazine described her as a prosecutor who quieted a city. >> after a hung jury in the case of officer william porter the once confident state attorney is now under mounting pressure. >> there are people who are going to say she overcharged the

case. she can't get a conviction. i think it's a defining case. there's no question that she will be described by this case for the rest of her career. >> mose by isn't commenting. the case is under a gag order. >> i don't think she's going to take this setback lightly. >> there are so many moving pieces to the puzzle. the defense attorneys for william porter. they have no say in whether prosecutors try the case again. they could try to postpone it for awhile or try to argue that right here in baltimore city it's not the proper venue for the case it should be tried in another county in the state of maryland. but in the end, it is up to the judge barry williams to determine if the citizens of this community, freddie gray's community can have the trial once again right here. jean casarez cnn. >> joining me defense attorney

scott bolden. a court spokesperson said no new court date has been set in officer william porter's case. how likely will it be that porter will be retried. it's a huge setback for the prosecution. >> it's not a matter of if but when. he'll get retried except one or two different scenarios. the government hasn't filed to retry him yet. they met with the judge and defense last week. nothing came out of the meeting. that's the first thing. they have to file. secondly, is there a deal to be had? both sides may be working on a plea deal that would allow porter to testify before the prosecution, which we know they want to use him against the other five defendants. is there a deal to be had there where he takes a plea or given immunity. and thirdly, since we know the case is going to be retried. what can we glean from the jurors. the jurors are involuntary manslaughter -- anonymous.

it doesn't mean they can't talk to you. the judge recommended they not speak to the media and others. there are all kinds of ways to find out the count in the jury room, what they were thinking, and what the reaction was to the defense and prosecution's presentation. this is case is about credibility and that's what the jury struggled with. >> what are the chances of porter being offered immunity in exchange of testifying against his five former colleagues, the five police officers. there's no guarantee he'll speak. >> that's absolutely true, and if she's been the subject of a mistrial he doesn't he can invoke the fifth amendment. he's got his career to look at and think about as well. so i would give it a 50/50 ratio if there's a deal in place where he doesn't have to plea. that's very attractive. if it's a deal where he has to plea to a misdemeanor. they were a hung jury on all of these charges. the misdemeanor as well as the felonies and stuff. so we'll simply have to see.

so far and historically he held out. he's held back. he said i want to try the case. i want to be heard from the witness stand. so he's been pretty stubborn about this. i promise the prosecution is stubborn about trying to get a deal with him. >> i would imagine the prosecution is reluctant. do you share that to retry the case considering the fact that the defense has access to the entire case? >> well, that's true. but so has the prosecution. you know, in the majority of these cases when they get tried, the prosecution gets a conviction the majority of the time. that's the first thing. so the prosecution can retool. one of the gaps in the case that the prosecution never really responded or met the defense accusation that these rules about strapping in prisoners are never followed. that may mean you got a dysfunctional police department but that needs to be met because that's part of the whole credibility issue in regard to

porter and what he did right or wrong. this is a criminal negligence case. that means porter can be negligent. he could be grossly negligent. that doesn't meet the burden of criminal negligence when you have a direct and proximate cause in causing this death. the last thought i would share is porter is both a liar to the prosecutor but a key prosecution witness against the other five. that's a tight rope for the prosecution. we'll have to see. >> yeah. the prosecution definitely in a difficult spot. scott bolden, thank you for your time. >> thank you for having me. the folks at saturday night live the show was on fire. the political parities included snl version included the cnn republican debate.
