>> thanks very much for joining us. there's a lot happening tonight starting with breaking news, police in riot gear, some on horse joining us. there is a lot happening right now. police and protesters after trump rally and damaging report on hillary clinton's e-mail practice and report of a big trump's endorsement, that is if it happens? we begin though with donald trump with the violence outside trump rally last night of a albuquerque. first, gary tuckman is outside anaheim where some of the clashes took place, gary, what happened? >> reporter: anderson, what happened in anaheim california after the donald trump rally
9:01 pm
right across disney land of the happiest place on earth, a potential of hot political summer. particularly large metropolitan area like anaheim in california. five people were detained today and demonstrations that got really tense. police apprehended by police were considered to be the ring leader. rocks and bottles were thrown. police here had a response they planned for today. hundreds of police officers from anaheim and sheriff's department and other municipality in the county showed up. they're trying to push the demonstrators at least to three different part of the city. it started at the ferris wheel. they kept on pushing demonstr e demonstrators back. no body was seriously hurt. there were some rocks thrown and
9:02 pm
bottles thrown and some minor vandalism. now, sarah marie has that story. >> donald trump is campaigning across the golden state. >> hillary as i say crooked hillary. >> and he's on a new report of the state department's general saying hillary clinton failed to follow the rules with her primary server. >> she had a bad news today of some reports came down were not so good. but, not so good, inspect general report, not good. >> trump unleashed an attack against both clinton and elizabeth warren. >> elizabeth warren, i call her goofy. she gets less done than anybody in the united states. she gets nothing done. >> as clinton slams trump for
9:03 pm
the housing market. >> i want you to know that donald trump actually rooted for the housing crash that caused 5 million families their homes. i am not making this up. >> trump is playing defense, arguing he was speaking at a saavy businessman. >> they got clips of me years ago, yeah, if it goes down. i am a businessman, that's what i am supposed to do. >> trump hitting another rough patch on tuesday as he took a fight at suzanne a fellow republican. >> she's not doing her job. hey, maybe i will run for mexico. >> a statement saying the governor will not be bullied and support the candidate until she's convinced that candidate
9:04 pm
will fight for mexicans. adding, she was disappointed as she did not hear about anything. >> last night, he insulted the republican governor, martinez of mexico. i don't know, he seems to have something about women -- i don't know. >> now, donald trump fighting against women in both parties, there is a lot to talk about. joining us, don brazil and trump's supporter jason osborne and our campaign strategist. >> it is an obvious thing and senator warren but the governor of new mexico? >> she made him mad. that's the bottom line. >> seems like it. >> it appears that way but all
9:05 pm
indications are that the fact that he showed up at her state and she very decided not to go to his rally and never mind of endorsements and anything like that. she had tough things to say about him but she's too busy to go. he did not act like a normal politician in any way and that has not change since he has become the presumptive nominee. the republicans who have been trying very hard to get the suzanne martinez of the world to vote their way, never mind be a city governor of a large state or the head of the republican governor association -- they're going, huh? >> that's what trump is. >> the only female latina and a woman of the state. >> that's clearly, when donald trump feels when he's attacked, his erasmojo is to go back and
9:06 pm
them harder and harder. she's a latina and that's really important for the republicans. more importantly, is about respect and common sense. he wants donald trump to lower his volume and that's all she says. and today, he says well, you know what, i can attack her, too. >> adding to the growing list of things that professional politicals saying, that's it, john mccain is not a hero. at a time is obvious. he needs to unify the republican party. she's a woman and hispanic and he has issues with all these things. i don't think that'll be a battleground state. i think new mexico is moving away from the republicans. if you want to make one, this does not help. for every box you check, this is a negative for donald trump. if his view, if it is not broke, don't fix it.
9:07 pm
>> does it make sense to you, jason? >> is it that he got annoyed? >> i think that's exactly right. >> is that good for a president to get annoyed? >> i know donald trump is making everybody brains hurt on the democratic side. he continues to do that. and it is entertaining. >> as a supporter, you think that's okay? >> yeah, the thing about donald trump is he says what he is thinking. that's what a lot of americans like to see in him. now, he's not a politician but somebody is running for their president. they're tired of the republican party of politicians that are repeating the same lines over and over again and are robotic. he makes you laugh. whether you agree with him or not, you want to sit there and go wow. so what he did to suzanne martinez, it was not a fight on her being latina, a woman or republican. it was the fact that she was in
9:08 pm
her state and the republican party is trying to come together and she made no effort to try to come out and say i am going to meet you half way. what is he going to do? he's going to sit there and gloss over her record. he pointed out the problems of her record and spoke the truth. he did not embellish it. >> that's why people respond to him but it is also why people think it is not a great quality in a president at least when you are dealing your domestic advisary. >> if you want to distance yourself, fine. she say as critical thing and this is what he does. that's the pattern throughout the campaign and that's why people who are calculating, can i endorse him or not. can i distance myself. it is ad delegate game. donald trump does what he want to do in a given moment.
9:09 pm
>> we are not sure they can trust the word in his team and that can hurt you in the campaign. >> if you need to distance yourself and donald trump does it and he cuts you out, that can cause a lot of problem. listen, i need to do this and you got a pass and he changes it on you. that's a problem. >> donald trump speaks for donald trump. you will never hear me or any of his advisors coming out. >> when he's the president of the united states, does he still speak for donald trump? >> that's a different though. right now he can speak for himself. >> so you are comfortable? >> like his business, he's going to run his businesses and delegate people to do certain things. but, when he's president, you don't think he will be for himself and or for the country. >> i don't want to say what he's
9:10 pm
going to do or not do. it is him >> a presidential campaign is complica complicated. >> you are trying to run the states. the person on the other phone has to know, okay, governor romney is cool with it. if that's not true, it is the most trouble. >> what donald trump did was not in donald trump's best interest. the two groups that he needs most are hispanics and females and throw in elected officials who need to back i him. we can say he speaks his mind but when kids do that in class, they learn manners and the ability to speak whatever in our head that's not generally considered an aspect or any kind of leadership world. if you look at the pattern here, it seems like two ways that donald trump can deal with people. either submission or he

dominates. he respects you if you are defiant or if you submit to him. you know, this submission or defiance is not a good pattern and when people need to invest in you. it is a dangerous quality. >> the other quality that he has or character that i had that he has is fearlessly loyal. >> there are no peers. who is donald trump who would speak to him as a fear? he treats staffers with loyalty, maybe more loyalty than they deserve. that's dealing with the health. martinez is head of the

hillary clinton campaigning hard in california today. got some bad news today of her use of a private e-mail server. >> my personal e-mail use was fully about the board and allowed by the state department as they have confirmed. >> everything i did was permitted and i went above and beyond what anybody could expected in making sure the state department did not capture something, i made a real effort to get it to them. >> well, the report suggests

otherwise, joining us now is evan perez. give us the big take away. >> the report contradicts the major part of clinton's defense which you heard right there. her method of preserving these records violated the rules when she took office. they found no evidence or her staff requested or receive approval from the states department's lawyers to conduct all of her business on a private serv server. >> they never got permission to do this? >> right. they never thought or received permission from the lawyers or the security staff. >> and this report says she explicitly want her personal e-mails on the states department easter ve 's server. is that why he did all this. at one point, one of clinton's

an fbi ongoing investigation is going on. joining our legal analyst and angela rocsh. >> all right, jeff, you are a lawyer, anything? >> that's legal news, there is no question about it. the report is he really a keystone cop operation, they did not know what they're doing it or why they're doing it. the fact that they did not get formal approval for this set up is really embarrassing and contradictory to what she says. >> this is different than the justice department. >> right. if you can say anything is good news. that's the good news in this report. it is not a crime to fail to follow state department policies. a crime is to violate the rules on classified information. this report does not deal with classified information or that whole subject. i don't think it affects one way or another how the fbi

thinking she's not trust worthy. she's very guarded. if we try to humanize for a second, we can understand someone who's been targeted as the first lady in the clinton's white house and as the senator, you would understand why you would want to be guarded. you have a certain level of openness that's expected about you. this is frustrating. the one thing i would ask as a lawyer is what are the consequences if she did not comply with this federal record. she did not provide all of the e-mail in a time ly manner. the question i would want to ask now is what are the consequences and how much longer is this going to be? but, it is frustrating and it is a true, true distraction. >> donna. >> she made a huge -- colin

is holding the administration at large accountable for this? >> because she did not comply. >> why didn't they know that? >> i mean they're receiving e-mails from her that are not official. >> i have the same question, why did anyone ever noticed? >> yeah, right. >> the purpose of the e-mail of the communication, she's communicating mainly with the people of the administration. it would seem that someone raise a flag here. why is it that the secretary of state checking the e-mail. the officials doing this at the time is the ambassador to nyobi stepped down. >> it was not obama's policy, it was her own policy to her own staff. >> she didn't follow that. for me personally, i don't care about the e-mail she got

9:29 pm
are we really going to say is it because she was above the law? >> the opportunity is instead of trying to fix the problem that the taxpayers pay for is to set up your own. that's the problem. >> we'll have more when we come back. donald trump has been attacking hillary clinton over her husband's alleged behavior and how she handled it. she brought up a case of working as a lawyer. we'll take a look at the facts we'll take a look at the facts in that case, next. man 1: i came as fast as i could. what's up?

case. we are going to try to take as many opportunities as we can to take a step back examine the facts against the claims when ever we can starting this one. >> it happened on this stretch of highway in fayetteville, arkans arkansas, back in 1975. a 12 years girl brutally attacked by a 41 years old man. she says he beat and raped her. the six grader ended up in the emergency room. >> the young lawyer called to defend the suspect in this case was none other hillary roden. she moved to arkansas and being with her boyfriend, bill clinton. t the defendant denied the charge requested a woman lawyer so the judge appointed the future mrs.

clinton. >> she called me and wanted to know if i can get her unappoi unappointed. she did not want to represent the rapist. clinton emersed herself in taylor's defense as she was legally and obligated to do. in this affidavit signed hillary roden, suggesting she brought false accusations like this before and she fan tasize about older men. cnn's contributor josh rogan interviewed the victim now in her 50s back in 2014.
9:36 pm
she never romanticize special experiences or making any false accusations before. >> there is not been any evidence that hillary clinton made in that affidavit, she was a victim. this was an attempt by hillary to mirror her. the victim believes that it was as lie in order to win. >> clinton insisted on getting her own expert opinion on the accused rapist under wear. after the crime lab cut out the key part to test but then lost it. >> reporter: what was left from the accused rapist's under wear all the way here from brooklyn, new york. forensic experts could hunt it down and look it over. aggressive and even by the prosecutoror standards. maybe so, but it worked. >> it hardly show the

defendant's blood or seimen. the prosecution case quickly started to unravel. >> we began to consider possibilities of lesser offenses. >> the story was mostly forgotten until 2014, audio emerged of clinton talking about the case with an arkansas journalist back in the 1980s. listen to her laugh describing the moment she defended her forensic findings. those recording were played for the victim by josh rogan. her reaction was anger. >> he lied on me and you are supposed to be this for women? what she's done to me and i hear her on tape laughing. >> there is another piece of audio that clinton's critics pointed to some time. clinton on the same test
9:38 pm
laughing about her client passing the polygraph. >> whatever evidence the prosecutors had was trumped by clinton's defense. clinton was doing any good defenders going to do. >> she was doing her job and she's requiring us to prove this guilt. she got her client charges reduced, from rape to unfondling the child. she was sentenced to one year in the county jail and that was reduced two months for times served. clinton was asked about the case weeks after her audio tapes.
9:39 pm
>> when you are a lawyer, you don't have the choice as to who you will represent and by the nature of criminal law there will be those who you represent you don't approve of. at least in our system, you have an obligation and once i was appointed, i fulfilled that obligation. >> the victim sees it differently. >> she said that the sentence was a miscarriage of justice. in the victim's view, you cannot mirror a rape victim and turn around to be a defender or a role model for women. >> did the clinton campaign had anything to say about this? >> i reached out to get their reaction earlier today. this covers a couple of the main point in our story, first on the affidavit, the spokesperson told me clinton was fighting investigation of experts and investigators in the case. so in other words, the affidavit
9:40 pm
did not express her opinion about the campaign. on the issue of her laughing on tape, the same spokesperson told me this, the reaction is disbelief and breaks down the handling of the case. and adding this in the interview and she called this a terrible case and it is clear she's pained to recall it. i should point out that clinton has written in her book that this case inspired her to start this first rape hotline in arkansas. anderson. >> all right, brenda kay, thanks very much. >> that stowe'll talk to the pa about that. we'll be right back. bo advil liqui-gels make pain a distant memory nothing works faster stronger

9:44 pm
welcome back we are talking about hillary clinton's past. there is been throwing allegations from donald trump and his supporters of this program that she will not be good for women and just as many people saying trump's record with women or the way he talks about women is problematic. back to the panel. kelly bringing up our 1975 case here to the program. you saw randy's report there. the prosecutor is sticking up for clinton. what do you make of it? does it change your opinion in any way? >> it does not. you know i will say this, hillary clinton took this case when she was 27 years old and it happened 40 years ago. do i think it is a case that frames the way she views women, i don't. we have to apply the same standards, secretary clinton which means looking into this case. i understand her defense of
9:45 pm
herself, i have taken professional responsibility, too. i understand that everyone deserves an attorney and someone has the constitution rights to attorney. she's absolutely correct about that. as an attorney are this, one, i think it exceeds the -- when you pay a six grader engaging with older men. i would not go down that road if i were defending this man, moreover, i would also think that i would not laugh about the case. if you are defending someone that you think is guilty, i would take that case with a heavy heart and not one of that marginal life is. again, this was in the past and i would like to leave it in the past and i would like to turn to issues. i don't think it suspects the voters today. we would like to leave donald trump's past in the past.
9:46 pm
>> jeff, is there anything in this? >> as far as i can tell this is all good legal work. first of all, consulting the experts in brooklyn. i cannot imagine anyone criticizing her on that. that's just looking at the evidence. on the point of affidavit and her history. it is worth to remember the day. 1975. rape shield laws which protect victims past not gone to effect yet. that's how rape cases were defended in the '70s and earlier. she was doing what people did to defend their clients in those days. it sounded like she did an effective job, i don't think there is anything to claim about it here. >> kelly makes the point really well. it is an actual thing that hillary clinton did. there is audio of it and there is an issue of tone here and sensitivity. if she's going to make the overt
9:47 pm
argument that she does believing the victim is paramount then this is part of her story, she has to answer this incensensiti recording she had in the past. the whole notion of believing the victim, is that add odds of the responsibility to represent a client. >> it is a perfectly fine argument, this is my duty and i am doing it and many people are buying that. the last thing is the tone. that's something that hits people on the level if they listen to it or does not. >> i had a professional in law school where some people think some crime is so terrible. this was a rape case, she was assigned to defend it and she had to defend her client whether he was guilty or not. what she did was in the bounds of ethics within the rules o f
9:48 pm
the game. as for the laughing -- i didn't make out what she was laughing abo about, it didn't sound like lawyers talking about warrior stories. she was insensitive to women. >> oi remember sitting in my class, there is got to be a way out. i empathize with this moment where she said she tried to get out of the case and she had this prosecutor saying she remembers him getting out of the case and she tried to talk to the judge and contact is so important. they say in washington county at that time, this defendant requested a female attorney and the judge only has three or four and she was one of those three or four. i think the other part i want to say is there are things that's said on anderson's show and other things all the time.
9:49 pm
i don't want to put myself in hillary clinton's shoes. i didn't hear her going, oh, can you believe this? >> that's not what she's doing to me. in fact, one other piece we should remember is in this case, she took this and she felt she really needed to do a good job because she was standing up a legal clinic for indigent defendant, for poor people that could not afford counsel. that to me is the admirable piece of of this story. >> trump will bring up stuff like this and other nominee might have not been able to bring up and we'll end up talking about it. this is a real part of her past and some people will react negatively and others may not. >> that's a good point. explanation rarely catch up with
9:50 pm
accusati accusation. even people believe she did not did anything inappropriate here but hearing her mocking a victim -- >> lying ted and low energy jeb. he has a history for everyone and now he wants to make it for crooked hillary. will it work in the general election? >> i don't know. >> the clintons have always come out on top. tl conservative base, they like ilt when they go after the clinton aggressively. on the question of is he hurting her standing among women in the nbc's wall street journal. >> she's on the high ground. >> we got to take a break,
