this guy was granted top security, secret security clearance. he had access to highly sensitive information. he is a chicago security's trainer. what qualifies him? >> my understanding is that this is a board that seeks to have a balanced point of view from people with diverse backgrounds. my understanding is that he had a background in international business, international finance and implementing sophisticated risk management tools and that he was interested and very focused on all of these issues. look, the vetting for these kinds of board positions is vast. it is tough. so he had to go through that security vetting. if he got top security clearance, it's because he had the qualifications to obtain it. i don't really know anything other than that. but i will tell you this. if this is what the focus of the opposition of donald trump and

the republican campaign is going to be in terms of their criticism of hillary clinton versus their complete implosion in terms of what donald trump represents as the standardbearer for the republican party, they are in a worst position than we thought. >> it is not just them. we have state department staff that characterized it back in 2011 as an awkward selection for the group and it came up when network reporter started asking questions about that during her tenure as secretary of state. it makes a lot of people wonder, does this amplify the argument that secretary clinton is exchanging donations for access or influence? >> that is certainly something that the republicans will glam on to. they have no other argument to make. >> back in 2011, people were asking about this, again, during her tenure?

>> this will all be talked about in the next couple of days. that will be part of the discussion. we will hear what the reasons were for this person being put on the list. as i understand it, he had an extensive background in international business and international finance. those kinds of different points of view are welcome in these kinds of boards. i will underscore if this is one of the things that the republicans are going to go after hillary clinton on. it doesn't surprise me one bit. they don't have any other argument to make to the american people. they will try to use anything and everything including the kitchen sink to try to go after hillary clinton when their standardbearer is so embarrassing. whether their standardbearer has nothing to add and to offer other than divisive rhetoric. when we look at history, he will do nothing but divide, degrade

and defraud the american people. >> i do want to at least get the clinton per speck siespective i. the campaign did release a response. they said fernando had experience with other if organization that is deal with foreign affairs and as to the state department, this was an ub paid voluntary p advisory board and one of several foreign policy-focused organizations he was involved with and the state department itself said the isab charter calls for a diverse set of experiences. when you look at the other members, required generals and high-ranking security experts and this man, a chicago security trainer, is this statement enough to quell the questions? >> we will see in the next couple of days. as you pointed out, everybody else on this board has vast

experience in the kind of background this board is supposed to deal with in terms of the issues. the best boards and organizations in this country come about when they have representation from a vast array of different backgrounds. an international business background, i think t would be something that would be an additional background, an additional point of view that would be looked at as a plus on this kind of board. so there is nothing untoward here. if this is going to be one of the things that they throw at hillary clinton, because they have absolutely nothing else to compete against her on, in the battlefield of ideas, then i think hillary clinton is going to continue to be the choice for the american people in terms of who is going to be the person that's fighting for you and looking for solutionins in

outrage over the light sentence handed down to a former stanford university student convicted of sexually assaulting a woman behind a dumpster is now being fueled by newly obtained court documents. new court documents shed light on his apparent history of alcohol, drug abuse and sexually aggressive behavior. he was convicted on three felony counts of sexually assaulting a young woman behind a trash bin. he was sentenced to six months and could be out in three. >> a sentencing memo shows i initially became aggressive with his victim's sister after she rejected him twice. turner went after the victim when she was, quote, alone and inebriated. those are exact verbiage there. prosecutors say he lied to his probation officer about smoking marijuana and using other drugs.

he claimed he was an "inexperienced drinker and partygoer." he was arrested in 2014 for having a fake i.d. and walking on campus and possession of alcohol. he has pictures of this picture of him holding what appears to be a bong. text messages indicate he used drugs in high school and included references to acid. defense attorney, keisha heaven helping us understand these documents. thank you so much, keisha, for being here. in light of all this new information, a lot of people say turner lied, about what happened that night, about past drug and alcohol abuse. is there a chance prosecutors did not know this information during the trial and could it change the outcome in any way? >> normally, when an attorney is arguing that a judge abused his or her discretion, it is the

defense attorney arguing that the judge imposed a sentence that is too harsh. here we have a judge that imposed a ridiculously lenient sentence and that information just discussed with those documents, that's all in the pre-sentencing investigation report. the purpose for that investigation report is to let the judge know a little bit about the defense. that information is supposed to be used in imposing a sentence. knowing that this defendant lied, that he did have experience with narcotics and that he did have aggressive behavior to someone else prior to committing a sexual assault, the judge should have seen those things as aggravating factors instead of mitigating factors. >> do you say the onus still lands on the judge at the end of the day? >> absolutely. i really think the prosecutor is going to appeal it. normally, it is the defense attorney that is appealing a conviction or sentence. here, the judge clearly abused his discretion. if that information was in the

pre-sentence investigation report, the prosecutor and defense attorney knew it. obviously, the judge knew it but didn't care about it. >> what about double jeopardy? if the prosecutor appeals, what does it mean at the end of the day for this defendant? >> with an appeal, the appellate division looks at the ruling or the decision of the trial court below. in this case, the prosecutor is going to argue that the trial court abused his discretion. therefore, the sentence should be -- the defendant should go back for resentencing looking at the mitigating and aggravating factors and that the sentence should be more sdpch. >> how often does that happen? >> it happens a lot. normally, it is the defense. once there is an injustice and you have an outrage with the community like we have in this case, the prosecutor has no other choice but to file an appeal. >> in your legal opinion, do you

racism, bigotry and misogyny and calling for trump to release his tax returns. what we are hear fing from dona trump we have heard before. is this the extent, the full breadth we are going to hear from donald trump? is this the full strategy? >> meet the new donald trump, same as the old. he can't talk about the issues. he can't talk about anything. all he can do is go out and hurl insults. he is bringing up racial tones, which will not help us grow as a party and show we are a big ten party. we can't grow with hispanics. we can't grow with asians. we can't grow with women. we can't grow with african-americans. we can't grow with millennials if we are being so divisive. every other republican candidate is tagged with the label of trump if they are going out and saying, this is what i can offer

economically and safer. they have to talk about whether or not donald trump is a racist. that's a terrible thing for any candidate to face. >> i saw off camera, chris, an eye roll. you said it is time to move on to the issues. many of those would say that those are policy focused. donald trump has said he can be presidential and talk policy. when is that going to happen? the next big speech he is giving is on attack the clintons. when is he going to make the turn you are calling for? >> i think you will see the turn being made very, very shortly. >> people are calling for that since he got into the race and it hasn't happened. so they have been calling for it and it hasn't happened. i definitely think that it is going to happen very, very quickly. to suggest that from my perspective what has happened is we are being -- we are in this rabbit hole about racism and we

want to still keep just going over and over and over this issue. look, what he said was inappropriate. he is going to pivot to the issues relative to this campaign. that's what's going to happen. i don't know how we can brand him as a racist. we don't know that. to call someone a racist is absolutely one of the worst things that you can do. some of the things he said absolutely were inappropriate. it is time to move on. >> well, you say that you can't brand someone as a racist. i don't know that anyone who has spoken out has said that donald trump is a racist. i think they have couched it that they don't know his heart but his words were racist. the speaker of the house, paul ryan, said that the words were text book racist. do you believe that if donald trump says, as he has, that this judge cannot do his job, he cannot be impartial, because he is of mexican heritage, do you

believe that's racist? >> i do not believe that, in fact, that's what he said. . >> it is exactly what he said. >> chris, finish up and then i'll come to you, evan. from my perspective, here is the issue here. the issue with the judge again, appropriate to have said that. the proper venue for that, if he felt that, in fact, the judge is being very unfair to him, his lawyer should have filed a motion for recusal. >> absolutely. that has not happened. we don't have any indication it will happen. evan, last 15 seconds to you. >> in fact, donald trump began this attack on judge curiel in february. we just didn't pick up on it. since then, his lawyers, right through last month said the judge is fair, impartial, has been wonderful. they have filed no motion for

cnn has obtained court documents revealing the former stanford student may have initially targeted another one. >> he was convicted of three counts of sexually assaulting a young woman behind a trash ban. a sentencing memo shows he initially became aggressive with his victim's sister. after she rejected him twice, turner went off the victim when she was alone and inebriated. he was sentenced to only six months in jail but he could be out in three. >> the judge's leniency fueling outrage from across the country. cnn's sara sidner, has more for us. >> victor and christie, the furry over the details of this case continues to grow. so does the support for the victim of sexual assault whose searing words have touched a nation. >> you don't know me but you have been inside me. that's why we are here today. >> i was butt naked all the way

down to my boots, legs spread apart and had been penetrated by a foreign object by someone i did not recognize. >> i stood there examining my body beneath the stream of water and i decided i don't want my body anymore. >> the searing words of a sexual assault victim brought to life by people who have never met her but want her voice heard. the 12-page letter read aloud by the 23-year-old sexual assault victim by her 23-year-old attacker. the two go to the same party and both drink too much. brock turner attacks her. two graduate students find her unconscious behind a dumpster. a jury convicts turner of three felony counts. the judge sentences him to just six months and three years probation. in line with the probation officer's recommendation, his ruling sparks outrage. >> it says if you are raped on a

college campus in california, you are on your own. to potential perpetrators, it says, don't worry, we have your back. >> now, more nthan 1 million people have signed online petitions calling for the judge to be recalled. those petitions delivered to the california judicial performance commission. the furry is still growing as letters to the court from brock turner, his father and supporters become public. in brock's letter to the court, he apologizes, saying, in part, it debill taits me to think that my actions have caused her emotional and physical stress that is completely unwarranted and unfair. he blames campus culture. coming from a small town in ohio, i had never really experienced celebrating and partying that involved alcohol. the prosecution submitted evidence to the judge that turner was doing a lot more than drinking, some of it before arriving at stanford.

2014 texts on his phone show him asking for pot and talking about doing acid. then, in his stanford swimming shirt, he is holding a bong. when his father tried to defend him, his words angered the public even more saying in part his life will never be the one he dreamed about and worked so hard to achieve. that is a steep price to pay for 20 minutes of action out of his 20 plus years of life. in this case, it was the deeply personal words of the victim that stirred the nation and put the spotlight on an issue so often kept in the dark. her words now inspiring others to tell their stories. >> i am really upset about this lenient sentence, because i am basically sentenced to life as a survivor of this. what has further angered people is that brock turner will not actually spend the full six

was an appoint tee to the u.s. state department's international security advisory board. what qualifications did he have for that? apparently, none. what he does have is big money ties to bill and hillary clinton clinton. he has donated between $1 million and $5 million to the clinton foundation. he has donated to mrs. clinton's 2008 primary campaign and even served as a so-called bundler of large campaign donations for democrats. on the campaign trail today, donald trump called his appointment just another example of his crooked hillary campaign theme. >> she even appointed to the national security board someone with no national security experience, instead, he was a donor, a recent donor to hillary clinton's campaign fwhch. >> reporter: it is clear raj fernando had no diplomatic experience and background in international security affairs. which could explain why just one

month after taking this photo with his first meeting with the board, where raj fernando was writing a letter to secretary clinton re-signing. e-mails show behind the scenes political panic was setting in as a state department official struggled to explain what this big donor to the clinton foundation was doing with top security clearance inside the state department. on august 15th, 2011, an e-mail from an abc news producer asks for fernando's qualifications. they show state department scrambling to come up with an explanation and discussed how the appointment came from hillary clinton's long-time aid and state department chief of staff, cheryl mills. the true answer simply is that cheryl mills added him, the state department writes. he was added at their insistence. someone else writes, can we dig up a short paragraph about his distinguished career and a

sentence about our selection and approval process? the next day, a senior adviser e-mails, we must protect the secretary's name as well as the integrity of the board. through a colleague, cheryl mills chimes in to the e-mail chain asking the state department to stall in its response to abc news for 24 hours. no real qualifications for fernando were ever sent. instead, the next day, august 17th, raj fernando suddenly re-signs. at the state department today, answers on why were hard to come by. >> if he was at all qualified, why did he re-sign so suddenly after abc news started asking questions? >> you would have to ask him. >> drew griffin, cnn, atlanta. donald trump is already seizing on this issue and using it at his rallies. here is what he said about it yesterday. >> they all looked and said, where did this guy come from? he made a contribution of $250,000 and all of the sudden, he is on this very important and

appoint so many people to so many different boards. i'm not going to speak to the qualifications of one specific person, but i can speak to one thing. the clinton foundation has helped so many people all over the world. what president clinton has done in his post presidency -- >> let me stop you, mr. mayor. i don't know that anyone is questioning the work of the clinton foundation. the questions are about why was fernando qualified to be appointed to the isab. this is something that cheryl mills according to the e-mail, being the chief of staff for then secretary clinton insisted upon when pressed by abc news to find out why he was qualified, how he was qualified they were told to stall and then he resigned the next day. so maybe you don't know specifically those answers, but are you concerned about the questions about the qualifications and the lack of an answer five years on? >> no, like you just said, five years ago one political appointee for one voluntary

board, when you take a civilian without government experience, who's not a politician, you throw them on the fire, put them in the public eye a lot of people don't want that and they resign from these boards. it happens all the time. but i think more importantly and i want to get back to talking to jeffrey about it, you have a nominee who come out with such racist comments and all of a sudden he may sound a little bit more presidential, what i'm going to recommend is they use that google glass and they make him wear it all the time and he reads from the google glass so he looks more presidential. if it swims like a fish, usually it's a fish and i think that mitt romney really hit the nail on the head. >> jeffrey, let me come to you with this question about fernando and the concerns about the statements being made by donald trump. we have a rally that's scheduled to start in fewer than three hours. donald trump has attacked the

hillary clinton now and president nixon back then. with me now ian pryor, american cross roads. it's good to have you. because i want to ask you first, i went all over the website, did some reading and i know american cross roads is backed by karl rhodes. he's been very critical of donald trump. is this group pro trump or just anti clinton? >> well, for the past year we have been conducting research through polling, through focus groups on how best to define hillary clinton. so i would say that, you know, over the course of the year we have become the anti hillary clinton super pac. we are also highly focused on maintaining the senate in republican hands so we are a dual operation. >> so one more time and maybe i can narrow it down. does american cross roads want donald trump to be the next

president of the united states? i think we do not want hillary clinton to be the next president and i think that ad makes it clear. >> so we heard from bill fletcher. he said during the story it's not his job to sell hillary clinton, that's for other people. this is an anti clinton group as you've just defined. i wonder in tying the republicans to trump, can this group tie democrats to hillary clinton? is that effective downballot for republicans? >> oh, absolutely and that should be the strategy throughout the country. we've done research, we found several things with hillary clinton. she's not trusted. she's seen as somebody that views herself as above the rules, and people are looking for any reason not to vote for her. there are also people that may vote for her, but do not want to give her a blank check because she has been a walking talking scandal for over 40 years, there

may be swing voters that say look, i'll vote for hillary clinton but i do not want the senate falling into democratic hands because i do not want to give her the full power of government like obama had from 2008 to 2010. >> donald trump has said many times that he is going after and his campaign has said they're going after the bernie sanders supporte supporters. part of the bernie or bust movement. how do republicans get though voters to support donald trump? or in your case, not vote for hillary clinton? >> well, i think it's more of a showing of why they voted against hillary clinton throughout the primary season. i mean, look, nobody thought that bernie sanders was going to take hillary clinton to the wire a year ago. most people hadn't even heard of bernie sanders outside of vermont and washington, but he created a movement partly on his charisma, a 75-year-old socialist speaking on new issues to young voters but partly because hillary clinton is viewed as the establishment, washington, d.c. politician who again has 40 years of being in

the spotlight in not such a good way and those people are not necessarily going to come out and vote for hillary clinton simply because she has a d. next to her name. so it's important to continue to remind people of her long history of scandals and to continue to show that hey, these scandals are not just an isolated incident. this is something that's happened for decades and we now have this clinton foundation issue with a donor that homicide put on an intelligence position which is not going to end. >> but there is one element that unites democrats. whether they support hillary clinton or bernie sanders or neither and that is in large part, wanting to keep donald trump out of the white house. you've said this is not a pro trump group. how does donald trump, if he does, complicate that effort? >> well, you know, i think one of the things that trump needs to do is he needs to focus his attacks on hillary clinton and her surrogates on the substance.

and i thought it was a good way to do it. i describe it as the persian pink panther beats borat. i think comedy is a great way to get people to change their minds about a group that they have seen in another way. our tag line for the movie is heroes are not born, they're imported. so i was trying to take a swing in having a hero of middle eastern descent in an american movie. >> i've watched some of your standup online, after the proposal from donald trump of the temporary ban on non-american muslims coming into the country, his support went up, the majority of many voters, gop voters supported that. a plurality of voters outside the party supported it. i wonder how much of what you saw politically in the presidential race played into what you're going to see on the screen. >> what's interesting is we actually made this movie a

couple of years ago and is coming out now, but it was before trump and back then the character that you just saw was kind of based on dick cheney type, but now you've got trump and it's even crazier and worse and it's heart breaking because what happens is the people who commit acts of terrorism or what have you are criminals in many ways, and then the people that the gop was going after, whether it was the refugees or saying there should be a ban on muslims are just innocent people who love america. they want to come to america for an opportunity, and we're cloeing the door to them and so in this movie, again in a comedoic way, i have an iranian who wins the green card lottery to come to america and he comes to america expecting america to love him but they do not love him back, which is kind of where we're at right now. >> you performed for the first lady and something you said that

you don't expect what happened in a trump white house, trump has said that he has muslim friends, that those friends love him, he loves them. what do you make of donald trump? >> you know, i'm sure he has friends that are muslim friends that he loves and they love him and that's a lovefest. however, the words that he says are vi tral controlic. the problem is i think that a lot of americans have not experienced the muslim experience at all. they have not traveled to those countries. i as a comedian have had a chance to go to the arab countries, do shows there. all the muslims that i've met have been good people trying to live their lives, but a lot of the people that are trump followers that are falling for what he says, the anti muslim rhetoric don't know a muslim.

they've never stepped foot in a muslim country and they think if they step foot in a muslim country they'll be kidnapped and hi jacked. which is not the case at all. so he is stirring the fire and it's unfortunate. again, i've said it before. what scares me more is not just trump. it's his followers. when you see his followers at a rally take an elbow to the face of that african american being escorted out or you see another follower yelling anti muslim hate, it's just a shame. i don't get it. i wish they would really open their eyes and maybe try to meet a muslim. >> all right. the movie is jimmy vestwood, american hero. in theaters right now. thanks so much. >> thank you. bernie sanders set to meet with his top supporters in his home state of vermont tomorrow after signaling his campaign could be moving into a new phase. so what does bernie sanders really want moving forward?
