in. >> the whole world has heard how donald trump treats women. we're not going to let donald trump get away with it, are we? >> this took place years ago. we're first hearing about it 27 days before the election. >> wikileaks, right? big stuff. she has to go to jail. >> they're going to use a quote scorched earth strategy. that just shows how desperate they are. >> this is "new day" with chris cuomo and alisyn camerota. >> good morning. welcome to your "new day" up first the election has taken another sordid turn. donald trump said his lewd comments about women was just locker room talk. that he never did what he said. this morning, several women have come forward saying trump is a liar, a legend, he made unwanted advances toward them >> trump denies these new allegations, and he's threatening lawsuits. it's already ugly presidential race becoming a fight over who has treated women worse. we are just 26 days until
5:01 am
election day. only six days until the final debate. let's begin with cnn's jason carol live in ocala, florida, good morning, jason. >> good morning to you, alisyn. very bad timing for all of this. the trump campaign saying all of these allegations are basically politically motivated. going on to call the "times" article reckless and defamatory. some of the language you are about to hear in this story is graphic. several women speaking out accusing donald trump of touching them inappropriately. >> it was a real shock when all of a sudden his hands were all over me. >> two of these women, jessica leeds and rachel crooks telling "the new york times" they were both groped or kissed by trump without consent. the incident with leeds allegedly took place 35 years ago when she sat next to the billionaire in the first class
5:02 am
cabin on a flight. >> if he had stuck with the upper part of the body i might not have gotten -- i might not have gotten that up upset. but it's when i started putting his hand up my skirt. and that was it. >> reporter: crooks telling the "times" after introducing herself to trump outside an elevator at trump tour crooks alleges he would not let go of her hand. then kissed her. directly on the mouth. something she says felt like a violation. crooks says this happened in 2005. >> i'm automatically attracted to beautiful women. i just start kissing them. >> reporter: that same year trump boasted to billy bush about how he forces himself on women. >> grab them. do anything. >> the two women telling "the new york times" they came forward after watching trump deny ever assaulting women at sunday's debate. >> have you ever -- >> women have respect for me and i will tell you no i have not. >> the trump campaign says the
5:03 am
entire article is fiction calling "the new york times" story a coordinated character assassination. also in 2005, natasha stoynoff a writer for "people" magazine claims that she was physically attacked by trump at his mar-a-lago estate while writing a piece on trump and his wife melania's one-year anniversary. stoynoff says she was briefly alone with trump in a room when, within seconds, he was pushing me against the wall. and forcing his tongue down my throat. the trumg campaign did not respond to a request for comment but a trump spokesperson told the magazine this never happened. there is no merit or veracity to this fabricated story. this as another recording that year reveals trump bragging to howard stern about going backstage at the beauty pageants he owns. >> i'm allowed to go in because i'm the owner of the pageant and therefore i'm inspecting it. they're standing there with no clothes. is everybody okay. you see these incredible looking women. i sort of get away with things like that. >> reporter: former miss arizona
5:04 am
tasha dixon tells cnn that's exactly what happened in 2001. >> it was announced donald trump was going to come in and before you could put a robe or dress yourself, he walked in. some women were half naked and others were in the process of changing. it puts us not only in a physical, vulnerable position, but also an emotional state. >> reporter: trump's campaign manager refusing to comment. >> there's no way for me to know what happened there. >> reporter: clinton campaign -- and the clinton campaign quick to comment on this whole issue saying quote, these reports suggest that he lied on the debate stage, and that the disgusting behavior he bragged about in the tape is more than just words. trump's lawyer also coming out and asking the "times" to immediately remove that article from its website. chris? >> "times" says that will not happen. jason carroll, thank you very much. let's bring in cnn political commentator and former trump campaign manager cory lewandowski. and cnn political commentator
5:05 am
and hillary clinton supporter hillary rosen. cory, donald trump says the campaign says women deserve to be believed. how dare hillary clinton not let these women say what was done to them by bill clinton. how dare she dismiss them. now this. and you're completely 180 on it. shut them down. this is reckless. this is wrong. these women shouldn't be heard. how is that not hypocrisy? >> look, i think, you know, the media should cover this story with the same amount of coverage that they've given the accusers of bill clinton and the rape victim that hillary clinton was -- >> so for the next five years we should cover this? >> look -- >> because that's what i spent my nineties doing. should we do that now? >> i don't think kathy shelton has had the type of media coverage who was a 12-year-old rape victim that hillary clinton defended the rapist. she has not had the type of media attention. >> fact, hillary clinton worked for an organization that assigned her to do it. >> yes. >> fact, she asked not to do it because she didn't want to
5:06 am
emotionally involve herself in that case. the boss said this is what you do. everybody deserves a defense. fact, she never -- >> -- express regret. >> thank you. >> she never laughed about what that man did. she laughed about an aspect -- used a lie detector thinking that would win the case for them and it made her lose confidence in that. that's what she laughed about. why bring her up as showing that she doesn't like rape victims? >> cnn's own reporting of the affidavit that hillary clinton signed in that particular case said that she stated in this affidavit that this 12-year-old victim of rape had wanted un -- had solicited additional men and had mental problems, which is absolutely untrue -- >> how do you know? >> cnn reported this. >> no, they reported that that's all untrue? >> that the 12-year-old rape victim has solicited additional men and wanted this type of attention? hillary clinton signed that affidavit that that took place. it's absolutely and patently false. >> why is this even connected to what you're talking about? >> because if we're going to talk -- if we're going to talk --
5:07 am
>> no, corey -- >> i didn't know you were the moderator of this. when you become the moderator you get to ask questions. >> in fairness, corey we all talk about this all the time. i don't want to have to police everything you say. i just want you two to go at it. problem is when facts are distorted i got to get in there otherwise you create a false record. hold on this is about you two. make your point. what is your point and then sproend to her? >> so my point is that first of all, hillary clinton expressed an -- in her book that she regretted taking that case. i mean, the issue here is where we are now is that donald trump is bringing on he's dared people through that debate to come forward and say that what he did he -- were lies, and so we wouldn't be having this conversation if donald trump had said the truth to anderson cooper in that question. if he'd said you know, i've done things to women that i'm not proud of. that's not who i want to be and women deserve much better treatment. instead he threw all the shade back at bill clinton.
5:08 am
he denied he ever did anything and all of a sudden now you have all of these women saying, wait a second, that's actually not true, donald trump lied at that debate. he did this to me. so, it's really donald trump who keeps bringing this up. hillary clinton wants to talk about the issues. but you know, i feel for you, corey and other trump surrogates, because you know, your guy won't let people stop talking about this because he's out there on the hustings talking about it all day long. how he's a victim here from paul ryan, from bill clinton, from the media. stop it. he's not a victim. >> i don't think -- i don't think that hillary clinton was talking about open borders and immigration when she has obviously said she was in favor of, tpp which she said was the gold standard, now it's not the gold standard. which all the jobs are leaving our country -- you know what hillary clinton said. i wish all of my e-mails would get out. and now what we see is this drip, drip, drip every day of wikileaks, tense of thousands of e-mails from her chief campaign correspondent, podesta is the
5:09 am
top guy over there, put all the e-mails out. they have never once -- the hillary clinton campaign has never once said that these e-mails are not authentic. >> where are your e-mails? i want your e-mails? >> have donald trump put all the e-mails out he's ever sent -- >> he hasn't sent any e-mails. he doesn't do it. what about you? what about bannon, where are your guys e-mails? i'd love to see how i'm talked about in those. >> here's the point. wikileaks obviously is doing this with 20 days left in the campaign. 25 days left in the campaign. just like these women who had alleged an incident took place 35 years ago in some cases, have decided to wait until the last three weeks of the campaign -- >> women are humiliated. they're ashamed. and are you saying that the timing of wikileaks which you know roger stone says he's behind, one of your boys. one of your boys. >> let me be clear. >> one of your boys. >> roger stone and i don't agree on anything. i don't think -- he does not represent this campaign. he does not -- >> not what he says. >> what roger says and what the truth are are two factually very different things. >> for the last couple of years, the republican party has joined with the democratic party with
5:10 am
responsible elected leaders and denounced wikileaks, denounced the russians, and the chinese, for investigating for, for, for hacking, for infiltrating cybersecurity systems in the united states. that is a threat to national security. instead of the traum campaign, instead of donald trump saying it is inappropriate for the russians to be doing this, he's out there promoting it. whether or not any of these e-mails are accurate or not, and we've seen over the course of the years that, in fact, the russians have, you know, distorted e-mails, have distorted -- have created misinformation. so it would be much more sensible if you want to be the leader of the united states to actually be offended at this kind of espionage. instead what they're doing is they're promoting it. i don't really understand that -- >> hilary no one from the
5:11 am
clinton campaign has said that these e-mails are not authentic at all. they've never said that they've been drd. that's the truth. what we see is the internal workings of the campaign. what we see is that chelsea clinton, chelsea clinton raised significant issues about doug band's relationship and his profiteering because of his relationship with the clinton campaign and the state department. there was a fine line there. we know that fallon, we know that fallon -- >> wasn't the state department. >> the relationship between the clinton foundation and the state department we know the justice department -- >> potentially doctored e-mails -- >> it wasn't doctored -- the clinton campaign would be out right now saying -- >> a daughter raised in a potentially doctored e-mail a daughter raised a concern that someone was trying to use her father to advance her his own commercial interests. that had nothing to do with the state department, it had nothing to do with anything else. and so the idea that you would connect that kind of concern by a daughter to a state department which wasn't even referenced -- >> how about fallon and the justice department >> -- makes no sense.
5:12 am
>> having information before everybody else has it. are you telling me that chelsea clinton -- >> public information -- >> e-mails apart. >> if you're saying that her e-mails were doctored then just release the original e-mails. >> no. i'm saying it has nothing -- even if it's factual it's not bad. >> of course it is. >> of course it isn't. >> -- everybody knows takes place -- >> you know what corey you're not being accurate. >> i'm absolutely being accurate. >> all right, let me just clean this up and i want to get back to what's going to happen today. one, chelsea clinton did write an e-mail, the authentic -- the authenticity of it has not been questioned. in it she says i don't like that doug band has his outside business and he's trying to get my father to help front run it. never about the foundation -- >> it had nothing to do with the state department or the campaign. fallon is talking about the e-mail investigation, a foia request to get e-mails. it was public envelopes at the time. those are the facts. r today donald trump is going to go out on the hustings.
5:13 am
what's he going to do with it? >> he has said that these allegations or alleged allegations are false. he's been very clear about that. he's note fried the new york tms of that and there's nothing more to say. >> he is going to go after the victims? is he going to double or triple down and say bill clinton, the you know the clinton accusers let's talk about them? or is he going to move off it? >> we'll wait and see what donald trump does when he's in florida and he's in ohio for a few stops today and we'll listen to what he says. i'm sure the media will be very interested in what he has to say and let him speak for himself on that. >> what's the chance that he sues the press to get out of this? >> that i don't know the answer. i'm not an attorney and i didn't stay at a holiday inn express last night so i'm not sure. you know, that's a question for the legal team of which i'm not part of. >> do you think -- >> you know the more that trump does this, chris, the more that he talks about it, the more he attacks the women, attacks the media, attacks paul ryan, the less he is going to do to advance his own campaign. so it must be clear that the
5:14 am
only strategy that trump campaign has left is to try and depress the vote. and try and make everybody feel that this election requires you to go home and take a shower. and if that's what donald trump wants to turn this country into, you know, we have to fight back on that. because i think as a -- as a -- as a citizenry we have to -- we have to know that this -- this is not going to be the last election. that civic engagement is important. that what government does in taking care of the people is important. and donald trump is taking this campaign to the sewers. >> what we know about this campaign is that 11% of the people think hillary clinton is honest and trustworthy. she's lied about her e-mails. do you want to keep the same washington, d.c., which is fundamentally failed the american people for the last 30 years or do you want fundamental change? that's what this election comes down to. when it comes to paul ryan, donald trump is the head of the republican party. he has raised hundreds of millions of dollars for the republican party this year. it is because of his fund as iing effort that you have all of these offices open around the country and making sure that those down ballot races have the resources necessary to be
5:15 am
successful. >> corey lewandowski, hilary rosen thank you very much for the discussion today. >> okay, chris, hillary clinton is facing another stolen batch of e-mails from inside her campaign. they have been released. will this hurt her with voters? we look at that next. across new york state, from long island to buffalo, from rochester to the hudson valley, from albany to utica, creative business incentives, infrastructure investment, university partnerships, and the lowest taxes in decades are creating a stronger economy and the right environment in new york state for business to thrive. let us help grow your company's tomorrow- today at business.ny.gov

5:19 am
members of her staff over this and apologize about this e-mail regarding catholic and evangelical voters. let's discuss the democratic national committee secretary and the mayor of baltimore stephanie rawlings. thanks so much for being here. i want to talk to you about the top story of the day and that is these new allegations coming out against donald trump of sexual assault there are two women who have come forward to "the new york times," one to "people" magazine. cnn has not been able to independently confirm these. but they do report accounts of sexual assault at the hands of donald trump. is this something that the clinton campaign will and should bring up on the campaign? >> beyond whether or not the clinton campaign should bring it up, as a mom, i have a daughter that just turned 13, when people say what are the things that keep you up at night, it keeps me up at night that there's a possibility that this man could be the leader of the free world. commander in chief. setting the tone and the example
5:20 am
of this next generation of young men. what he said was not acceptable at all. to dismiss it as locker room banter is dangerous. i don't want that to be the example for young men. i don't want young girls to think that that's okay. and regardless of whether the clinton campaign brings it up for not we cannot dismiss this as anything other than what it is, and that's bragging about sexual assault. >> look you know that the trump campaign says that the very same allegations exist against donald trump you saw them -- i mean against bill clinton you saw them front and center at the presidential debate. are these the same? >> president clinton is not on the ballot. secretary clinton is on the ballot. and she's very, very clear that this is unacceptable. that instead of this flailing around that trump is doing as he is, you know, drowning in his own net, instead of these
5:21 am
accusations he should be apologizing. that, that nonapology was embarrassing. as a -- if -- if i were a woman republican i don't know how i could look myself in the mirror and know that this is my candidate. if i was a woman, that was a republican, with a mother, how can you tolerate that? >> i want to ask you about this new wikileaks e-mail dump. they revealed john podesta, top adviser to hillary clinton, his e-mails. donald trump says that it basically captures the communications director jennifer palmieri maligning catholic and evangelicals. let me read it for you and our viewers. this is an e-mail exchange that she has with somebody from the center for american progress. he, john halpin says many of the most powerful elements of the conservative movement are all catholic. many converts. it's an amazing bastardization of the faith. they must be attracted to the systematic thoughts and severely backwards gender relations. she jennifer palmieri then
5:22 am
responds i imagine they think it's the most socially separable political conservative religion. their rich friends wouldn't understand if they became evangelicals. mike pence has said that this deserves an apology from hillary clinton. let me play for you what mike pence said on the campaign trail. >> if only on behalf of her catholic running mate, hillary clinton should denounce those bigoted, anti-bath lick, anti-evangelical remarks and her campaign staff should apologize to people of faith and do it now. i believe that the men and women of faith cannot choose to stand idly by. in this great national debate. >> okay we've got no indication from the clinton campaign that she has any inclination towards apologizing for these stolen e-mails. however, should there be concern that somehow this will alienate this all-important voting bloc of catholic and/or evangelicals. >> just listening to pence say
5:23 am
those words it reminds me of growing up when you know that someone is telling something that is so untrue that you want to stand away from them because you know they're going to be struck by lightning. to think that this is the person asking for an apology -- >> what's untrue about what he is saying? >> what he is saying that -- not necessarily untrue but the fact that he's calling out hillary clinton for not having -- for not making an apology when there has been no time in my lifetime where you've had someone with the -- with -- as close to power as donald trump is, as close to president as donald trump is, who doesn't even understand the word apology. so the fact that pence is saying that hillary clinton should apologize is laughable. but whatever those e-mails say, we shouldn't forget the fact that this is espionage. this is a foreign government trying to interfere with our election. republicans and democrats should be speaking with one voice. that this is unacceptable. but instead, i think it, it, it is an unfortunate distraction. >> this next one is not
5:24 am
espionage. this next batch of e-mails is from a freedom of information act that obviously the media asks for when they want to get to the bottom of something and this one this next one seems to again illustrate the cozy relationship between the state department and the clinton foundation. this comes from a state department official to the clinton foundation it says need you to flag when people are friends as william jefferson clinton. most i can probably i.d. but not all. this is basically just sort of suggesting that friends of bill clinton's would be able to jump the line, would be able to get some sort of special favor from the state department. voters hate to hear this. because this is where they think that this is a rigged system. that, you know, in politics people do special favors for each other, and that there was some sort of collusion between the state department and the clinton foundation. what's your response to that? >> my response is that when you have something like that that can be read many different ways, it does open itself up to that interpretation, that incenses american voters. but that's unclear based on what
5:25 am
you're saying that anyone is getting you know jumping ahead. that being said, i think the fact that we're shining a light on the foundation, the state department, you know, i'm in city government. i know that there are times when we need to tighten up our ship and we need to take a hard look at not just what we're doing, but the appearance of what we're doing. and i've had to strengthen ethics laws in my own city. i know that the concerns that have been raised throughout this campaign will make all of us in elected office, all of us that are doing this work in the not for profit world much more careful about not just what we do, but how we do it, and the appearance. >> and even hillary clinton? i mean obviously the complaint is that she is somebody who will not strengthen that because when she was secretary of state she allowed these this sort of cozy relationship. >> well, i think when you take a look at her there's -- let me just start by saying there's no one that -- there's no one that's perfect. there's no one that hasn't made a mistake. the great thing about secretary
5:26 am
clinton is, when she's made a mistake, she owns it. and commits to making sure that it doesn't happen again. and that's what gives me faith. when you have someone that refuses to acknowledge that they have ever been wrong. when you have someone that when -- when someone shines a light and they believe is negative, that they just start going on the rampage, and start attacking everyone else, that does not give me faith that that person can be a leader that we can trust. >> mayor stephanie rawlings-blake thanks so much for coming in on "new day." let's get over to chris. >> all right. so overnight this avalanche of allegations against donald trump. what are they going to mean to the campaign? and the race? we're going to get the bottom line from david axelrod. the ax. next. life and death. 600 dollars. of abuse. important step forward. the time is long overdue... pharmaceutical industry. passes - the ballot.
5:30 am
5:31 am
did, he only talked about. so how does this factor into the bottom line? we have former senior obama adviser and cnn senipolitical commentator david axelrod. how are you looking at the wave of hostility toward trump? do you think this is just a wave or the bottom? >> well i think that's the big question. has he bottomed out? because i do think remember in the primaries when he said i could walk out on fifth avenue and shoot someone and wouldn't lose a vote, you know, there's something to that. his supporters are very, very committed. and the question is, what is the irreducible core. we may be approaching the irreducible core. the question has always been, can he grow that base? and i think it's becoming very, very difficult to see that. i think he recognizes that, which is why he's gone to the scorched earth strategy to try and drag hillary clinton down because he knows there's a limit to how much he can grow his own
5:32 am
vote. >> and what do you think about that strategy, david? that he seems to be trying to drag her down, suppress the vote, make people wildly unenthusiastic about turning out to pull the lever for either. can that work? >> well, i think it's very, very doubtful. i don't think that he can pull her down to the agree or depress turnout to a agree to offset some of the negatives that he's amassing here. just as a editorial note on my own part you know i wrote a book called "believer" because i actually believe in this process and i believe that through politics and through government working to the we can get things done. this is a dispiriting time in our politics. this is not, you know, i joke about the great pageant of democracy. but this is a particularly dispiriting tactic. and a dispiriting campaign. i think it's going to be a rough 27 days for the country. >> well, why doesn't your from
5:33 am
your book "believer" which i read, why doesn't the situation of what trump's trying to do to clinton fall into the category of what happens to higher monkey climbs up a ladder? which is that you get to see more of its bottom? why couldn't this depress voter turnout for clinton supporters who say oh, man all this stuff in totality i just don't want to leave the house on election day? >> because i think that there -- that people -- there are a large number of people who actually vote regardless. and understand that there's a binary choice and one of these people is going to be president of the united states. so it goes back to the bear outrunning the bear. >> oh, here we go again. >> but i mean i think that people -- i think that people will look at these two candidates and make a judgment as to who they think is best equipped to be president of the united states. and that's trump's problem, because when it comes down to that binary choice, everything that's happened recently, and
5:34 am
over the -- you know, the aggregation of this campaign, is working against him in that regard. >> let's listen to joe biden, vice president. he was on seth meyers comedy show last night. listen to what he had to say. >> my dad used to say the greatest sin of all is abuse of power. and the cardinal sin of all is a man raising his hand or taking advantage of a woman. and it is -- and here's a guy who says, i'm a star. talk about power. i'm a billionaire. i'm a star. i'm a celebrity. so i can go in, intimidate women into allowing me to assault them, and assume they're not going to say anything. that is the ultimate abuse of power. and i don't think -- and i don't understand how anyone can remotely justify that. >> david, when joe biden watches all of this going on on the campaign trail how much do you think he wishes that he had run?
5:35 am
>> well, i'm sure there's a part of him that will always wish that he had run. but on this particular issue, he's always been very, very passionate. he was the author of a violence against women act when he was in the united states senate and i think he speaks from a very deep place on these issues. he's clearly owe fended. as a political matter we should ask what all of these means. donald trump was already running a huge gender gap among college educated women. but he was doing relatively well among non-college educated women. in some of the recent polling that gap has closed. and so, he is not running the same advantage among those women. so that's where you might see some diminution of his support but as for biden, as i said, this is -- this is not -- this is not a passing issue for him. this has been a lifetime issue for him so i'm not surprised to hear him use language as sharp
5:36 am
as he did last night. >> so camerota looks at me the other day ax and i say it's 30 days until whatever the election. she looked at me, she goes you're a liar. which is true in an objective sense. and i said why this time? and she said because it's not going to be over in 30 days. and i think there's some truth to that. we'll know hopefully who the president of the united states is. but, this animosity. this rancor, what can happen no matter who gets in? >> well, this is a real concern of mine, especially because what seems clear is that donald trump is either going to win this election, or he's going to tell his supporters that the election was stolen from him. that the election was rigged. delegitimizing the whole process, and as we've seen with other things, there will be an audience for that. and it -- you know, generally what happens and we've seen it even in the most difficult of elections, we all remember al gore's concession speech in 2000. the -- the -- the candidate who
5:37 am
loses the election acknowledges that the will of the people prevails. and -- and acknowledges the legitimacy of the process. this isn't going to happen here. i don't think donald trump is going to go quietly into the night. and it's going to make it very, very difficult for a president hillary clinton if she should win and i think she probably will at this point, to move forward. it's also going to make it hard for a speaker paul ryan, and it my force him to make a choice as to whether he wants to continue as speaker because if he has a caucus that is incited in this way, and it's going to be a smaller caucus with less moderate -- less -- smaller number of moderate members, how is he going to fulfill what he this is the right path for the country? so i think there are a lot of difficult moments ahead after this election. which is in certain ways a greater concern of mine than the tenor of the next 28 days. >> on that note -- >> guess i was like. >> i guess you were. >> sorry you guys.
5:38 am
>> the cubs are winning. that's good news. >> there you go. thank you. david. for that silver lining. >> okay. >> so the aftermath hurricane matthew continuing to cause severe problems in north carolina after days of flooding and a rising death toll. the governor is warning that believe it or not the worst may be yet to come. we have a live report coming up.

the worst of it yet. cnn's paolo sandoval is live in lumberton, north carolina with more. what are you saying polo. >> hey, allison. states of emergency and also evacuation orders are still in place here in north carolina. and behind me you can see why. not even the town's fire house here in lumberton north carolina was spared the flood damage. this is already almost a week since the storm blew through. actually yesterday we came upon some neighbors here who were helping some of the friends and family remove some of their belongings from their still flooded out homes. and they asked us to join them on their boat to give you an even closer look at the widespread damage again it's going to be a very long time before these folks get their lives back in line here before they can even think about starting to rebuild. much of the attention now whether, of course, be shifting to some of the nearby towns. for example in kinston, north carolina, we are told that the river there is expected to reach record levels tomorrow. that obviously a sign that the

worst is not over yesterday for some of the folks here particularly in eastern north carolina. and nearby greenville we're told at least 9,000 residents have already been evacuated. that's one in ten residents already out of their homes. chris matthew may be long gone but the effects of this storm still being felt and will be felt for a very long time. >> polo thank you for being there. the situation complicated by the fact that a lot of people didn't listen to the evacuation order. >> what are you going to do? >> now you have first responders going in there having to save them. this is going to last for months. months. all right donald trump picking a new fight with one of his favorite targets. us. what should we read into this threat to take on "the new york times"? that is next.
5:49 am
donald trump continues to talk about the, quote, dishonest media, and he is now threatening to sue "the new york times" over its report of these two women who have come forward to accuse him of touching them inappropriately. trump denies those accusations. he demands a retraction from "the new york times." let's discuss this and so much more with cnn's senior media correspondent and host of reliable sources brian stelter and cnn media analyst bill carter bill i'll start with you about "the new york times" your longtime home. >> yes. >> he wants to sue "the new york times." because these two women have come forward to tell their stories one of whom says she was groped on a plane one of whom said she received an unwanted
5:50 am
kiss from donald trump how is that lawsuit going to go? >> it's a ridiculous suit. first of all they're on the record. it's not anonymous sources. you can interview people making claims about people. you're not necessarily supporting it. you're certainly saying they have credibility -- >> but if you publish a false accusation then are you in trouble? >> you have to know. the legal standard is, reckless -- >> right. >> -- disregard of truth. which means you know that they are lying and you put it out there -- >> and you know that he is a prominent public figure who many cases are brought and they can't win because they're prominent public figures. how many suits has he threatened? really. he threatens the alarm clock because it woke him up. so i don't take it seriously at all. plus go through discovery if he was to sue and who knows what that would turn up. >> that's with the tim o'brien suit a big shot investigative reporter one time for "the new york times." >> right. >> he gets sued by trump for a story he does about his business, and they then get
5:51 am
discovered. and that's where that big deposition came out with all the stuff in it about trump least of which was him saying i don't recall dozens and dozens of times right after he criticized clinton. so you've got to give to get and that's part of the calculation. >> just for what it's worth a trump aide telling me lawyers are doing the due diligence that is necessary needed to file such a massive suit. that's at least the trump camp's claim. i would be astonished if there were lawsuits filed. >> -- file -- >> are they going to sue the "people" magazine, too? >> you could. you can file suit. the only risk is, just because you file doesn't mean you win obviously. but also you could be sanctioned for a frivolous lawsuit. >> yes. >> but that's a very high standard, as well. >> all right let's talk about the repercussions from the billy bush access hollywood tape they continue to reverberate. the woman who was featured, not talked about, but featured on there, the actress who was in the purple dress, ariane zucker she has spoken out for the first time this morning. let's listen to what she has to
5:52 am
say. >> they are offensive comments for women. period, yes. yes. they are. >> you weren't shocked? >> not with that type of personality. it wasn't shock. >> which is probably why it doesn't mean a lot to me. >> what about the role of billy bush? some people believe that he egged it on. what's your reaction? >> who knows how he was feeling when he walked off the bus or what he needed to do and the relationship. because when he came off the bus, along with mr. trump, i had no feeling but professional. that's it. >> interesting. to hear her say that she wasn't shocked. and that it didn't mean that much to her. because she's in this sort of world, and she's heard some things like this. >> i'm glad we're hearing from her though. because oftentimes in these situations we forget about the accounts of the women. whether it's a woman who might have felt offended by comments that were being made or whether it's these women who are now alleging assault or some sort of inappropriate touching. sometimes we forget about the women's experience and the women's stories --
5:53 am
>> she was objectified by -- >> billy bush is the one who said look at her, what legs. look at those great legs. she was being objectified and then he called for the hug which i think was really over the line. we're into this whole thing about touching and what was fair and not fair. >> he called -- >> -- through the context of eleven years later. to be fair there's a prism we're now viewing all of those comments through. >> she also handled herself well. because they said a lot of suggestive things to her some stuff we don't even play. when they were walking down the hallway they said a lot of sexually suggestive things and she sort of deflekted, deflected, deflected. so it was interesting to hear from her for the first time. >> not everything is an assault. >> you know what i mean? >> and guys are often saying that's a great-looking woman. and that -- >> a lot of women say that's a great-look gieg. >> exactly. >> that is a great point. i mean sexual harassment is in the eye of sometimes of the recipient. >> yeah. >> and it was interesting to hear from her. billy bush, what do you hear? what's happening with his career
5:54 am
and his position -- >> that he could be leaving any time? these negotiations are happening. it takes a little while to work out the terms but that he will be leaving nbc. the question becomes, will he end up somewhere else? and i think he will. mtv there are second, there are third, there are fourth acts but not at nbc for billry bush. >> yeah, that's over. >> let me ask you something the -- this question of when these media companies become morality police, hmm it bothers me every time one of these decisions is made. this one bothers me. i'm not i i i'm not trouble by the speech what trump said i get why it's offensive. i get why these women coming forward now need to be listened to to change the dynamic of our coverage but so be it that actually matters more than things that come up in an election. but you know they decide that this is too much for billy. this offends their sensibility of who they are. but other allegations that have come up about anchors in the past have been ignored by them. how much time they took with brian williams. what they did you know, with, with other people that they got rid of because of what they
5:55 am
said. their stand seems to slide -- >> partly it's the spotlight of this one, don't you think? this is enormously covered. everyone has seen that tape. other things are rumors. you hear rumors about their anchors or whatever. and not everybody heard that. not everybody can see that. this billy bush unfortunately for him was caught saying these things in a very visible format. >> and that was a domino effect. and there's been all these dominoes ever since. including the debate on sunday where trump denied touching women and then these stories overnight. >> which machd what he said. matched -- >> that's trump. that's not bush. we have no reason to believe that billy knew what trump was -- >> -- tarnished by the association with trump. >> one last thing that i want to get to we've been talking about also the document dumb from wikileaks and talking about what's in there. i, incorrectly, said that there was this exchange between jennifer palmieri who is the communications director for the clinton campaign, and a colleague at the center for american progress, and there is.
5:56 am
an exchange and it's about catholics and evangelicals and donald trump has said that she was maligning them. but it wasn't during the campaign. this was from 2011. when jennifer palmieri was at the center for american progress, that is a liberal think tank so that also changes the equation that donald trump is calling for an apology, my campaign is calling for an apology. this is not when they were part of the campaign. gentlemen thank you very much. >> all right "newsroom" with carol costello is going to pick up and there sure is a lot of news to get to. quick break. more news. i'm jamie foxx for ve, introducing lte advanced powering america's largest and fastest 4g lte network ever. and i'm also jamie foxx for sprint. and i'm also jamie foxx for t-mobile.
