the man that is leading communications for judge gorsuch confirms he did say what blumenthal said he says. your thoughts. >> i was in a meeting where they had this conversation. that's what his spokesperson said. it's highly unusual for a senator to disclose the entirety of a meeting after a private meeting like that and not believe that senator blumenthal and i would agree with judge gorsuch. we go back to january six years ago or 7 years ago in front of the joint session of congress and by attacking a decision they had made. he started it out with all due

judiciary. moments ago he weighed in saying senator blumenthal said for years it now misrepresents what he told him. joining us now is the senator from delaware. he is part of the delegation meeting from president trump today. senator thanks for being here. and his own spokesperson. last night confirmed that judge gorsuch did call it demoralizing. was confirmed by the spokesperson. >> this back and forth makes me feel like i'm back at high school. frankly what matters here is whether or not judge gorsuch that will be up for confirmation for the supreme court in

meetings with senators and then publicly demonstrates judicial understanding. it's one of the cornerstones of our constitutional order. and personally attacking or challenging judges who are delaying or may ultimately overturn his travel ban deserve respect. >> are you then calling for judge gorsuch to also speak out publicly about this? >> in my meeting i will also ask about judicial independence and we will ask him about that during the confirmation hearing but i don't think it's constructive for president trump to weigh in on this and level accusations against sitting senators and i think the more he stays out of this the better for his judicial nominee but this highlights why judicial independence is going to be so important for me and other senators as we go through the process of meeting judge gorsuch

and considering whether or not he should serve on the supreme court. >> president trump wants judge gorsuch. he can't criticize i think his own supreme court nominees so he goes after the messenger, senator blumenthal. so do you feel that he should and can publicly speak out and say yes i do find this demoralizing. >> i think we need to focus on the larger issue here rather than the he said, she said about what they did or didn't say. the larger issue is that judicial independence is at risk. president trump is not responding well to a challenge in his travel ban. district court judges in several districts across the country stayed that ban and challenged that ban and it's now being considered for an emergency stay of that order and i think

same thing back to republicans would be hypocrisy so i said he deserves a hearing. the hearing that judge garland never got. that allows my constituents to hear his background, experience and constitutional philosophy and i think we should have that hearing on the judiciary committee. after that i think we should see but i don't agree that we should simply refuse to even consider his nomination. >> very quickly, i heard you just called the travel ban from mr. trump illegal. it doesn't sound based on the oral argument that the 9th circuit court thought this was an open and shut case. >> i think it is an arguable case as are so many but as i looked at the details of how it was prepared and how it was implemented and what the impacts will be i think it goes against the immigration and naturalization act because it does discriminate based on nationality and religion and the way it was implemented shows it violates at least the spirit if

joining us. what has made this a point of intrigue is that the judge probably did himself a favor and may have done the president a favor saying what so many feel about his comments about the judiciary but then the president tweets that senator blumenthal is misrepresenting the conversation but his own guy said he said it so what's going on here? >> he absolutely did the president a favor and the president has just refused that gift and the favor was that he refused this issue. of course it's going to come up in the course of his confirmation process how he feels about the president's open comments about the federal judiciary so he said what he said and it was heard by the person guiding him through the quarters and smoothed the path for his own confirmation but he

time for cnn money now. a big tech company unveiling a huge investment in one of its u.s. factories while meeting with the president. is it all due to trump's policies or something else? the answer from chief business correspondent christine romans in the money center. it's like the bat cave. >> an interesting past few days for tech giant intel. on sunday it believed president trump's immigration order was unconstitutional. then announcing a $7 billion investment in a u.s. factory, he said that was due in part to trump's policies. the real story more complicated. intel announced plans to build a
