segments would happen and you can only hope he laughs as hard as we do. don't forget you can watch out front any time on cnn go. ac 360 begins right now. good evening. we begin with roy moore and thing said. the lawyer for mr. moore taking aim late this afternoon at one of the accusers, questioning her credibility and in fact denying all alleges against the candidate. more shortly. first of all the silence about it coming from the white house. president trump stepped up pressured to saying this by roy moore. he talked for 20 minutes stopping for water as he recap his twelve days in asia. he talked about roy moore during the trip telling reporters aboard air force one. saying i've been with you folks so i haven't been able to see

much. now he's back, he's seeing how the story's playing out, now he's heard the call from republicans for roy moore to get out of the race. now that he's got a television audience to speak to here's what the president said. >> should roy moore resign as a president? >> said nothing about a speech and didn't answer any questions shouted at him. the question is, why isn't the president weighing in? a number of republicans, including mitch mcconnell are proposing a way out for him, one that will also let him replace attorney general jeff sessions, namely persuading sessions to run as a candidate. that seems like it will be simple and have the added benefit from mr. trump in remove lg mr. sessions from his attorney general post, which according to back in july president trump wanting anyway from the recusal of the

investigation of jeff sessions. his daughter, ivanka has spoken out telling the associate press wen asked about moore, quote, there's a special place in hell for people who prey on children. yet from her father, nothing. the question is why. according to cnn reporting it has to do with stories like this. >> the dirt is squared away the dishes and everything like that, and it was like suddenly he's like encroaching on my side of the seat. and his hands were every where. >> did he say anything? >> no. and i didn't either. >> you didn't say anything? >> i didn't say anything. >> you say his hand were every where, can you be specific? >> well, he was grabbing my breast and trying to turn me towards him and kissing me. and after a bit that's wen his

expected. >> no, because it was happening at the same time as an emergency meeting of the state gop, the belief was that this might be something sub substantiative about the future of the campaign. instead it ended up being much about handwriting. so, what the attorney for roy more says he want it is public to decide, so here it is. take a look at these three handwriting sample. what the attorney said is, look at the way his handwriting looks. this is his current handwriting in 2017 in your top left. to your right is what it looked like in 1999 when he was signing as a judge. below that is the yearbook, the yearbook that befrly nelson showed at that heart breaking news conference. the government says don't look at the signature rkt look at the da. now it looks like it's going further. legal rangling over the

yearbook, a very messy next step. anderson. >> what else did moore's attorney say? >> the next part he said was quite interesting. you may recall that after nelson had her news conference, she said she didn't have any further contact with moore since that incident when she was 16 years old. the attorney came out very hard and he said, they did have contact because moore was the judge when nelson got divorced. here are the big questions, did she ever have to appear before moore? and we should point out that when nelson had that news conference shortly after that, moore came out and said and i quote, i don't even know the woman, i don't know anything about her. yet today he's saying he was now the judge presiding over her divorce case. >> kim appreciate that. later today the accused lawyer asked if she'll turn over

the yearbook and she said yes, only if moore does this. >> is he or is he not going to stand up and take the oath to tell the truth, whole truth, nothing but the truth so help him god before the united states senate and before the public. not only in alabama but before the nation. one he is ready to do it, if it's ready to do it, if the senate will conduct that hearing prior to the election then we have made our offer to allow an independent commander to examine this. we think that's recently. until then, if he want to evade, illinois -- avoid, deny, threat, try to discredit we're not going to allow ourselves to be distracted by all that noise. let him step up and testify and even can throw out their conclusion about whose telling the truth.

another. and there's a lot that senator -- well, i should say former judge roy moore has not discussed. a lot that he hasn't disclosed so let's do it in a hearing and not be distracted by anything else. >> dplgloria allred. i want to bring in the panel. mark, does it make sense to you that gloria allred would not a, hand over this yearbook for a mutual party or announce what miss nelson knew or did not know? >> well, the yearbook i think even if you have an independent expert look at it, the independent expert is going to want what is called an exemplar from the time. most handwriting experts are never going to be able to

testify conclusively based on somebody whose 70 now and 30 something at the time. so turning over the yearbook is only one step, they'd need something to compare it with at the time when he was 32 -- >> but the district attorney there must have been plenty exampling of his handwriting back then. >> right. so, that's what they'd need. yes, i think turning over the yearbook would clear this up. taking a look at it, layperson can testify in most jurisdictions as to handwriting. one thing that's troubling for the accuser is the part about the divorce proceeding and that's where somebody needs to do some investigation. somebody needs to go down there, look at the court docket sheet, see if it was just assigned to judge moore, which happens on many occasions or whether he actually prdsed over it.

generally the docket sheet will show whether she appeared before the court in front over the judge or whether every it was done without her presence and done by lawyers. that to me would tell you quite a bit. if in fact she had appeared in front of him that's something i can tell you most people that i know that go through divorces remember the name and everything that happened about their divorce case. that would be something that would be very concerning to me if i'm representing the accuser. i'd want to know that and see the docket sheet. >> i'm wondering what you made over the press conference from moore's attorney. >> at this point with gloria allred, when i listened to her show i was shaking my head that she would ask for a senate hearing issue. roy moore is not a u.s. senator. only until he's the u.s. senator

would that ever happen. she i think is clearly asking for something that will not happen so she can perhaps throw a fit about it, i don't know, because the request is so unreasonable and makes her client looks bad. >> david, the take iowa from the roy -- away from the roy moore campaign says hee not backing down and dropping out. >> this is a nightmare from the republican party. i for the life of me cannot understand why steve bannon hadn't seen that he ought to protect his old boss and his friend and get roy moore out. i would think to protect his friend he'd ask to get out of the race and get this settled once and for all. this looks bad for the republican party, the president, gloria allred. i think most people are shaking

their heads and saying what a mess. if it goes on many more days, the democrats are going to win that seat and that's going to be a blow to the president. steve bannon ought to get him to step away and take that bullet. >> ed, how do you see it? >> david summarized it pretty well. i think a lot of people look bad. i thought it was a little confusing. at the end of the day policewoman yans get to vote on this -- alabamians get to vote on this. it feels like an ork straited effort. gloria allred comes in try to go a little too far on the hearing. with four weeks left the alabamian people are going to decide between a "washington post" fight. that's where roy moore i think wins. i talked to sources with the roy

moore campaign and they have drafts of the lawsuit against "the washington post". if roy moore's going to sue, if he really believes like he said, he's going to sue, and then he said to the public, i will be in court and these women can get they're day in court. rhyt mitch mcconnell should apologize and say -- this is a political hit on roy moore in my opinion. and roy moore's got to fix it though. >> i think there's an elegant solution that involve steve bannon not taking a hit. luther strange can re-sign from the seat, zboerch kiv would aappoint a new senator in his place and a new special election where the people of alabama can

vote about this in mind. is that necessarily fair to the flats raining for -- running for that seat, no. >> just from a legal standpoint, does it make sense to you, mark, that -- i mean roy moore is threatening to sue. there's a lot of people threatening to sue and never follow through. if roy moore was to sue he would have to go through the "discovery" procediscovery process and answer questions. >> yeah, except the timing of this is spectacular for him because he can sue tomorrow, he can file on friday. he does not have to serve it immediately. he can literally sue, he could have his complaint out there and it would not responded to, he wouldn't have to do a deposition, there'd be no discovery. >> hey mark. >> let him finish.

>> alabama procedure, i looked it up, it looks like in this case they can expedite depositions and do it quickly. but you're absolutely right. if i'm roy moore i file that lawsuit tomorrow and i go and i say i'm willing to put myself -- i'm roy moore, i'm willing to put myself under oath in this lawsuit, and the women will get their day in court they'll be there too. if he didn't want to go with the lawsuit in six months he can drop it. >> he can file the lawsuit and literally dismiss it & day of the election -- the day of the election and that's the end of that. >> david, what do you think of the whole idea of the lawsuit? >> oh, i'm sorry. what about the other two women, there are now six women who have come out here.

lindsay gram has been accused of all kinds of things in his private life, should he quit. if the president comes out to say to alabamians i'm going to take away your right to chose, if he does that evangelicals and conservative catholics will look up and say, boy, why is he weighing in on the wrong side of this. what he should have said is this, roy moore will stand up and say i'll go to court, sue "the washington post" and the women and i will get our day, until then don't judge this guy and smear him. where do you go and get back your reputation if david gurgan says you're classless on t.v. if you didn't do it? david doesn't know if he did it and he doesn't foe the women. >> david. >> well, you're so wrong on so

remember a specification litigant from 1999 is slim to none unless there's something significant about it. the lawyer in radio mooof roy me had a bad day today when he was doing an interview, so today was not a great day for lawyers involved in this case. seems like everybody was having problems. i think to bring it to full circle of the discussion we were having before, david guerrear b made -- gurgan made a more telling point. if steve pulls the support in this case, then i don't think that he's got a way to go. i don't think that there's a path to victory. but, if bannon sticks with him, i'm not so sure that alabama doesn't get -- alabamians don't get their iron up and say we're

not going to be dictated to by washington republicans. i think this idea of a writing campaign, this isn't lisa in alaska, i just don't know that that's a real thing. i think amanda's solutions make real sense. bannon pull the support if he resigns and he pull something and cancel the election that is one pathway for republicans. >> and to republicans say look, obviously want the president's agenda to move forward, do you fear if a democrat is selected suddenly the president's agenda is more vulnerable? >> yeah you bet -- >> and if roy moore is the cost of prevent that is that worth it? >> no. look if a democrat wins the election the blame will lay at the feet of mitch mcconnell --

>> you also said the blame will go to roy moore for what people believe are his actions many years ago. >> again, anderson if you believe he did it all that, that's okay. if he doesn't they he did, he has the right to stand up and say i didn't do it. the president should say, the people of alabama should decide who they want to represent them. after they decide we'll have a discussion on these other things. i think the best thing should be some mechanism, a lawsuit by "the washington post" would give the women their day in court too. look, melendez is in court and nobody's saying we're beginning to expel him. in this case, no no we won't wait and see anything. i think it's unfair and alabamians may reject it. america may not, you may in washington and new york say oh boy, moore's bad. alabama may stick with roy

moore. i think that's a factor. >> david, that is one of the concerns for the president weighing in, you know that for the people in alabama who support him and there are a lot who support him as we've seen at the rallies, they already in his opinion i guess made a mistake on backing luther strange. and then for him to weigh in against on a t state's right issue, does that look bad for him? >> well, look i don't think any gray options for the president, which he did you know come out with some wounds. but it does seem to me the best option from his point of view is that jeff sessions be on the ticket or be a write-in candidate that people can yunit behind and put these other arguments aside. i thought from the beginning

more breaking news out of ma'am, two new -- alabama tonight. two new accusers coming forward. two more women described unwanted contact with roy moore

at a mall. beth ryan heart. if you could just explain what you've been reporting. >> so we were about last week four teenager girls, roy moore was in his early 30s. he was local prosecutor per sued with one over the women. he touched her sexually. as a result of that story some women have been encouraged to come forward. one of them wrote about in a story posting tonight, a women named gina richardson who was a high school senior working at the mall at sears, when roy moore approached her, asked her for her number. she declined. she then was in school later when she heard she got a call. she thought, oh my goodness, is it my dad. she went to the office it turned

out to be roy moore asking her out on a date. >> what age was she at -- she was a senior in high school you're saying? >> yeah she was 17 or 18. >> and do you know what happened? i mean roy moore called her through the school she's saying? d >> he called her at school, she said i can't talk now i'm in class. he came back to see her where she worked and asked her out again. she relented and met him that night at the movies. they went to a movie and he offered to driver her to her car which was on the other side of the mall parking lot. and, sort of, you know grabbed and kissed her at which point she got, you know kind of nervous and said i really feed to go and left. and then when he'd come back into the mall she'd sort of hide from him. and this has been a time in the late '70s, early '80s he was

gaining a reputation around the mall. we talked to a number of women in the mall who was asked out by him. b but, they saw he was a constant presence at the mall. you know, his -- his -- he was constantly going after girls who were teenagers or girls in their early 20s. >> and you said this is the one person, is there a second person whose also come forward? >> yes, yes. there's another woman who we have conducted an interview in our story. she worked at another store. >> in the same mall? >> in the same mall, yes. she described how roy moore would come in frequently, ask her out. she would say no, he persisted. she finally complained to her manager at the time.

so, it's a scene that he was, you know constantly at the mall asking girls out. some of whom thought flattering and did go out with him, some who got uncomfortable about it. cts were you able to con if you remember with the person who was the manager at the time? >> unfortunately that manager has passed away. >> there have been also been reports on alabama.com talked to somebody who worked in a record store last night who rehabs there about kind of questions raised about roy moore and being told to alert store or mall security if mr. moore was seen in the mall. have you heard anything more about that? >> we have heard that but we -- the story the posted tonight was what we sub substantiateuated on

the record. we quote women who talk about being pursued by roy moore when they were teenagers. >> and beth, obviously the question some people ask is why, you know is it now that these women are coming forward. what did they say to that? >> well -- >> or what's your sense of that? >> i would say the women that we talked to, for example this high school senior, you know, contacted the post after she saw the story we wrote last week, which included a account of a woman when she was 14, roy picked up around the corner from her home and took her to his house where he touched her. she contacted the post and said i want to tell you about what happened to me. she told us about the story of calling her in class and asking her to the movies.

>> thank you very much, beth. i want to bring back in the panel. amanda, i think somebody said on the show last week, these are early days, the reports are coming out who knows what's going to happen over the couple of weeks. now we're hearing more women coming forward. >> yeah, i think the people of alabama has to take a look. these are their sisters, daughters, wife's, aunts coming out saying this happened to me. this isn't going to be an issue settled by "the washington post", mitch mcconnell or somewhere else. the people of alabama has to decide this issue, the republicans of alabama particularly. the governor of alabama is a woman, her name is k. ivy. she's running for re-election. she's going to have the spotlight on her because she discuss have the tools to do something about this. she has not wanted to make any adjustments.

she has said very recently that i will vote for roy moore, i have no reason not to. i think she needs to come under a lot more scrutiny because she had the power to they an election, appoint someone else. the people has to stand up because they'll either lose this election -- the republican in alabama will hand a seat to a flat or they can say this is not a man that will represent our party and we're going to take action and change things. i would be deeply disappointed if a female governor does not doing in soon. >> does it creep you out at all the number of people in this mall who have now come forward and saying, oh yeah, he used to troll around here? >> ae oh yeah. anderson, when you described behavior to me or that reporter

described what was done. i have two daughters, it creeps me out. here's the question -- i'd add beth ryan hard to the suit and dispose her. if every situation when you do an opposition play you go piece by piece. roy moore is being cut a thousand times. i'm not saying these women aren't being truthful, i don't know, but the people of alabama deserve to make the decision. and i want to know whether "the washington post" has this story tleemsz and waited physical after the primaries. this is all factors and we're not gung to know until after the election. i think the people of alabama get to decide who they want to represent them. the thing about sessions coming in -- that sessions thing is a red hairing, the question will be these two guys. and the people are going to decide, and i hope like they did

with trump, when the country told them -- arneson i sat in the stop executive networks and i was told donald trump can't went and he won. people don't want "the washington post" telling them whose a good and bad guy. >> i have to weigh in really quick. throwing in the responsibility that beth and these other reporters are defaming people by doing this their -- their job. but for you to go through and say that beth ryan hard are intentionally deceiving people i think you should be responsible for that too until you're willing to file a lawsuit perhaps you should quit spitting those allegations. >> what i'm saying is if there's a lawsuit -- >> until someone puts their name on a complaint i think they should stop putting their name

on -- >> and donald trump has talked about suing people all the time and never sued anyone. >> anderson, you can't have amanda say that roy moore did you know get to defend himself by filing a suit. >> i say he should. >> these women didn't file a suit. >> they don't have to the statute of limitations are s out the window because it happened 30 years ago. >> go ahead mark. >> i was just going to say, the filing suit, there are practical consequences. that was kind of the approach that bill cosby took which is filing against his accusers. it's been kind over the approach some of these other hollywood types have taken where they're filing a suit against the accusers. that's generally not a great path to go down. i think ultimately it's one of reasons the president is probably not weighing in,

because he's probably got his lawyer yelling at him just stay away from this, this is the last thing you want to do. you yourself has gotten exposure. >> we're gung to leave it there. david quickly. >> we know six or 8 women have come forward, how many people have roy moore come forward whose worked at the mall, was a gentleman and everything like that? he hasn't produced one single credible witness on his behalf and he has a responsibility to people to do that, he has a responsibility as a republican to his party. he is not a man on his own but he's representing a party. most people who do that have some sense of loyalty to the party. i want to look at closer at the ethical and moral part here. roy moore says this is a spiritual battle.

is it a spiritual battle in your opinion? >> well, i don't like wen people use spiritual warfare in their personal battles because i believe it is real. we need to use that language where it's appropriate and it's appropriate in the gospel of jesus christ. that's what really concerns me here. it's people who are turning away from what they see as a season call use of relerelegist all across the country. that's not what christianity is. it's about the good news that god has reconciled us to himself through jesus christ. >> we have heard people, supporters of moore in alabama talking about biblical precedent, the age of men and women who were involved with each other in the bible.

they've talked about -- that i have compared this to lawn mowers. when you hear some of the comparisons being made what do you think? >> well my blood pressure has been elevated in right days with people suggested that even when such horrible things take place that it's equivalent to mary and joseph, no it's not. or i believe some person said on television i believe it was yesterday, this would be a misdemeanor so it will be e kwif len to taling a lawn mower. that's the most horrifying realtivity i can imagine. i want when we're in a country where so many women and girls who are having their lives crushed by powerful men who are using sexual advances and assault against them. we need to have the moral clarity to come out and say sexual assault is always immoral

that same aide acknowledges it's a low bar. for people like senator susan collins who has concerns about the mandate. you have people like antibiotic corker or jeff flake who have concerns about the deficit implications of this and then you have a firm "no" vote, at least at this point. johnson coming out tonight not with concerns about the individual mandate but concerns about pass-through entities that pay taxes on the individual side of things saying what the bill does doesn't go far enough for him. all this underscores that that is policy that's going to be conflicted even though republicans are moving well and believe they're on a right track. a lot of potential road blocks ahead. i will note president trump called senator johnson shortly after his opposition became known and tried to make clear they will try to find out how to

make him a "yes." for the senate proposal, they've been moving so quickly. they just introduced their lets a proposal last night and they don't have the distribution tables that say what this will actually do. we have a sense of where it would help people and might not. there's an expansion of the child coverage. all the individual side tax cuts and provisions would expire altogether in 2025. that would be problematic when you look at what's happening on the cooperate side. slashing from 35% to 25%. you also have to factor in, chifrmd from susan collins, still on the fence, the idea that repealing the individual mandate, they project turnover course of ten years they would raise premiums on average by

control the political process. >> i want to play something your colleague said why they think so repeal is a good idea. >> you have pretty strong agreement among republicans that we don't like the individual mandate. and the reason is it's a tax cut on those who can afford it the leastment in oklahoma 81% that pay the individual mandate tax make less than $50,000 a year. this is a tax that was intended to push people to be able to buy the product, but it's actually larchtd on people that can afford it the least. doesn't take away the subsidies. individuals can still get subsidies, but we remove the tax penalty for those who can't actually afford it. >> it is not the best way to bring people into health care. the best way, of course, is a medicare for all single-payer system, and it's funded based on

ability to pay. but what mr. lank ford is saying these days people will no longer have health insurance. anderson, you tell me what happens when that person today earning $40,000 a year gets hit by a bus or finds out she has leukemia. who's going to pay for it? order americans who have health insurance. what mr. lank ford and the republicans are trying to do is significantly you understand mine the affordable care act by closing off, cutting back on hundreds of millions of dollars in revenue now coming in. that is a backdoor way to destroy the affordable care act. what's the solution in terms of health care? we worked do what every other major country on earth does, guarantee health care to all people as a right and end the absurdity of the united states paying twice as much for capital on health care as do the people of any other nation.
