that will be much better. >> reporter: president trump selling it as a christmas present for the middle class with some companies delivering on the promise. comcast and at&t promising $1,000 bonuses to their employees. pfizer and coca-cola validating democrats's concerns saying they will turn over most gains to their shareholders. >> is that what you intended? give more money, increasing the wealth of corporate ceos? >> reporter: as the tax bill makes the way to the president's desk, republicans have two days to pass a spending bill to avoid shutting down the government. a closed door meeting of house republicans late wednesday night ending with more questions than answers. the president still has not signed the tax bill. that could be a day or two before it gets to him. now, there is nothing on the president's schedule today.

however, we are waiting to see whether there could be a year-end news conference. no word so far on the white house on that. bill and alisyn back to you. >> joe, thank you forsetting all that up. people are waking up with uncertainty this morning. they're not sure what this means for their paychecks or insurance coverage, especially if they have he obamacare. they said obamacare is repealed. let's just put up for everybody what we know is in and out right now, what's been taken away and what remains. here's what's been taken away. individual mandate, effective in 2019. the cost sharing subsidies for insurance companies they were haggling over in congress. here's what remains in obamacare. medicaid expansion, pre-existing conditions that are the most popular provision. no lifetime cap on benefits. subsidies to low and moderate

income customers. and so, karoun, we always heard, hadn't we, that if the individual mandate goes away, obamacare does collapse. is the president right? >> unck it is a hit to the obamacare structure that democrats did not want to have to contend with. it is basically inching the system more towards this sort of -- it's not really the public option but more towards this thing that will, the medicaid people, all the kalt goers that you just listed that still exists. it becomes a different math problem. republicans were looking for something to offset various positions of the tax bill and looping in the mandate and repeal both sounded politically go and helped them a little bit with the numbers. you are seeing the combination of that right now. this is not a direct getting rid of obamacare. that is a sales pitch that the

president is making because so many parts of it are intact. and they are promising they will revisit health care into the new area. they are going to work on the alexander-murray provisions. that will be something they revisit when they get back in january. >> how many of us would buy car insurance if it wasn't a law? the mandate was a republican idea. it came from mitt romney in massachusetts. it is is personal responsibility. yet more people into the poll. can we play sound from the president talking about this at the cabinet meeting. let's listen to president trump. >> the individual mandate is being repealed. that means obamacare is being repealed. because they get their money from the individual mandate. so the individual mandate is being repealed. so in this bill, not only do we have massive tax cuts and tax

reform, we have essentially repealed obamacare. and we'll come up with something that will be much better. >> i was hoping that was the bite where he said we didn't tell. we told the people to keep it from the press. >> right. >> because we didn't want to scare anybody with the idea of the obamacare. david, didn't he hide the ball on this? were republicans able to keep that away? >> that wasn't a very well kept secret. we have been reporting on it for a week. >> it struck me the president was referring toward this idea they didn't want to complicate tax negotiations by getting too caught up in health care implications. look, the individual mandate was always one of the key problems that republicans had with obamacare. of course you know they had many. the party long evolved away from that philosophy.

so i think the it felt good for republicans. but what they haven't done is replace obamacare. owe on 'bama care is still in place. there are all sorts of guarantees that obamacare makes that cost money for the insurance company. and to fully fix the insurance system and milwaukee sure costs don't continue to skyrocket on consumers, which is a major problem, republicans will have to come up with proposals and get things passed. otherwise, i think you're going to have a lot of angry voters. but by putting this into the tax bill, they were able to help create more votes. it created more of an incentives. we haven't talked about opening the wildlife refuge into energy exploration. republicans have been trying to do this for decades. incident was another reason why they were able to create a deal around the tax bill even though there were a lot of tough votes to take because they put a lot of goodies republicans have been

interested in philosophically and fiscally for a long time. >> the government shutdown could happen tomorrow night at midnight. so, what are the sticking points? >> well, at this point -- there are many sticking points. a big one is about defense spending. a big one will be about what to do about reauthorization of a surveillance program that will be expiring at the end of the year. there are a variety -- as you just put up on the screen, the question about extending the children's health insurance program. and of course the disaster aid as well for people who got hit by the hurricanes earlier this year. it is creating factions along party lines. there are internal divisions. when the house gop last night, you saw them squabbling over this. they are whipping votes to figure out what they can do. they have to come to an agreement across the aisle. with talk about government shutdowns periodically. i'm sensing less urgency behind

that threat that in years past we really were heading straight into periods where the government had to shut down several weeks. so the question is how much of a motivation factor really is the fact that we are heading to the holidays right now. this could trickle into the weekend as they work out the fine-tuning. some of these issues have been slightly resolved. they have settled on at least what they will be doing about the survey by kicking the can down the road a few weeks. this is a short-term extension that will let them live to fight another day, several sticking points which could buy them their vacation. >> striking moments yesterday not just at the photo-op on the steps with everybody celebrating but also in this cabinet meeting. listen to vice president mike pence talking about the boss. >> i'm deeply humbled as your vice president to be able to be here. because of your leadership, mr. president, and because of the

this sort of adulation and praise. i think when the vice president and other members of his cabinet, we saw during the victory yesterday, you can't blame republicans for being excited and happy about what they achieved. it was monument al and historic. when they were laying the praise on the president thick, i think they understand what motivates them. this is the kind of thing they are hoping to use to get him to continue to play ball as they go forward next year with really tough issues they will have to deal with. one of the things so interesting about tax reform is unlike health care, for the most part he stopped beating up on members of his own party, stopped beating up on legislation they were negotiating. and i think that was one of the reasons this was able to come about. and i think republicans know that and they're trying to set the table for more of this and less of what we had over the summer, which was a lot of infighting. >> david and karoun, you are so

virginia democrat mark warner, ranking member of the senate intelligence committee, is drawing a red line over coordinated attacks against special counsel robert mueller. >> any attempt by this president to remove special counsel mueller from his position or to pardon key witnesses in any effort to shield them from accountability or shut down the investigation would be a gross abuse of power. these truly are red lines and simply cannot allow them to be crossed. >> he told cnn he is worried they may make a move over the christmas recess. qaa rupe, what about the timing of warner's statements there?

>> i think it is clearly meant to be a warning as congress will leave washington, d.c. for a period of time, about ten daus. the senate has been has been grappling over these bills that would prevent firing special counsel without it being put to a three-judge panel to make sure it sound legal. they have been dragging their feet about actually doing something. and democrats are getting angry about that. basically it leaves them with no immediate recourse to try to prehaven't the president from getting rid of special counsel while nobody is around to rush in and stop them from doing that. it is the president's ability to do that. at least to order it through the acting ag, rod rosenstein, who

said he doesn't want to fire him. congress gets nervous about what they will do when they are away. this is not a normal investigation in terms of what it is doing and how the president is reacting to it, which is consistently negatively. >> david, listen, this is what we need help understanding. the president has said he's not considering firing mueller. he can't. he has to order rod rosenstein. he said he sees no reason. he's not considering can it. >> if the media continues to ask for responses to every absurd and baseless rumor, attention-seeking partisans will continue to spread them. >> why do democrats keep beating this drum? >> the president has from time to time expressed publicly his unhappiness with the mueller investigation. the fact that it is a witch-hunt. and he has never taken the idea that he might fire mueller off

the table. many of his allies have been encouraging him to do so. there are small pockets of republicans on the hill. not many but small pockets that questioned the mueller investigation and suggested the president should do something about it. i also think, look, politically the democrats see value in keeping the rub that investigation at the forefront talking about what trump might do. and a lot of this i think stems from how trump has handled the investigation from the beginning. he has constantly questioned it, constantly tried to undermine it. even when i think it would be beneficial to him to just let the investigation work its well, focus on legislation, focus on our agenda, and voters will end up probably making a tkrpl nation. that way is more beneficial to him than if he constantly focuses the spotlight through his tweets and other public pronouncements.

what's important to understand is republicans on the hill don't want to be too up front in criticizing the president. most of them do not want him to fire mueller. they don't want him to deal with implications of what that might mean. they would much rather have it be mueller's responsibility. >> absolutely. this don't need that headache. let's talk about what's happening with israel and the president's move to make jerusalem the capital and move the embassy to jerusalem. so there will be a vote in the u.n. security council and nikki haley said if people vote against this, as countries are threatening to do, they will be taking names. she and the president are taking names. they are keeping a list of who would go against the u.s. here's what the president says about that. >> i like the message that nikki sent yesterday at the united nations for all of these nations that take our money and then vote against us at the security

council or potentially at the assembly. they take hundreds of millions of dollars and even billions of dollars and then vote against us. we're watching the votes. let them vote against us. we'll save a lot. we don't care. >> karoun, that is really interesting. it's really satisfying on sort of a vengeance level. i know from talking to so many of the die hard trump supporters, they will really love that move. can the president unilaterally do that? >> this whole stick it to the u.n. line has worked for a lot of people, especially a lot of people that support the president, who is not the biggest champion of multilateralism when he was on the campaign trail. nikki haley has to bring her pencil sharpener. there is a long list of names. issues where there is more of a debate about who is right or wrong to the united nations. this is not a move that the security council like the naming

of skwraoupl as the capital. it is one of those final stage negotiation topics when you talk about the israeli-palestinian deal. having done this by the united states, recognizing jerusalem, opens the flood gates for other people to do things that the palestinians wanted but the united states always said leave that to the end. that's one of the last thing we will resolve in this peace negotiation. the united nations has been the place they have gone to do these things. there will be a lot of resistance to what the united states decision has been. you hear the administration is sticking to it. they are saying this is the correct decision. they are going to be very upset and expect loyalty with anybody else we engage with. the united states has a lot of power to wield around the world. but this is a topic that is weakening. it hasn't been the case. it seems strange all of a sudden people would fall into line around this declaration, which

was so unpopular around the world. >> david, your thoughts on this? >> what is interesting about the jerusalem decision, most countries in the u.n. were never going to embrace this. it's -- they usually tend to be more sympathetic to the palestinians and the issue of peace talks between the israelis and the palestinians. is the president's move a part of a broader strategy and a change of direction in how to arrive at at a peace deal? it doesn't right now appear that was the case. but i don't think the president's decision was necessarily the big problem that people make it out to be simply because we have never been able to arrive at a peace deal for decades while leaving the question alone and keeping the u.s. embassy in tel aviv. the president still signed the waiver. much of this is symbolic. he left room for a final status issue to be decided by the party. is strong arming and jawboning at u.n. member nations can gain

>> reporter: well, alisyn, what we know at this point is this was a young defector. he was late teens, early 20s. we understand he was a low-ranking soldier, according to the south korean military. now, they say he crossed the border just after 8:00 a.m. local time. they say an hour and a half later the south korean military fired 20 shots because they saw north korean soldiers approaching the demarkation line, obviously trying to find him. they didn't realize potentially he had been missing for that time. about 40 minutes later, shots were heard on the north korean side. there was no direct military engagement between north korea and south korea. but the fact is you do not want shots fired on such a tense border. just last month we saw there was that defector that made that daring dash across the dmz. and certainly that was an almost deadly dash, shot multiple times by his former comrades. the question now we are being

virginia's legislature is in limbo this morning. there was a recount after democrat shelly simonds won over yancey. the final tally is a tie. 11,608 votes each. virginia's former attorney general ken cuccinelli joins us now. ken, what are the chances? >> very, very low. this has never happened at the state level before. now, this has happened in local elections in virginia in the past. but it has never happened for the house delegates.

of course what adds so much drama to all of this is right now without this race the state house of delegates is 50 republicans, 49 democrats. so if -- essentially a coin toss. it is not really a coin toss. i'll explain in a moment. a republican with a 50/50 chance, they are up 51-49. simonds, a democrat, wins it, it's 50/50 tie and they go into power sharing. >> let me tell you something. surely there is a very sophisticated high-tech way of determining how to break this tie. so let's take our viewers there. >> there is. >> let me just put up what we have learned. the candidate's names will be printed on a separate sheet of paper. the names will be cut up and placed into a separate film canister. >> old film canister.

among the many funny things. the loser after pulling the name out of a recoue hat, can demand recount. here's a strange suggestion. is there any way they can have a job-sharing agreement or just call it a tie and figure out how to move on? >> no, no, no, no. no. and look, it is funny in part because it's so rare. but the most important thing for what they do right now is that they follow the rules, the law established before this happened. because any change in this going forward that affects this race looks like and probably is programmed to effect the race. so everybody knew what the rules were coming in. yes, you're right, we have nephew had an absolute tie before. nonetheless, the most important thing for confidence in the

system is to follow the rules that were in place. it this is fair. it is weird, but it is fair in the sense that it is even for both sides. no one has an advantage. many years ago when i was an intern in the governor's office way back in college, you remember watching a freshman delegate come in to actually change this law. the law used to say 30 years ago that in a contested election the house could award the seat to the person with the most votes or in a tie to either of the tying candidates or to a candidate with less votes, believe it or not. i mean, the law used to law them to award the race to the loser. now, surely this process looks a whole lot better than that. >> so, ken -- >> virginia is closely tied now. >> when do you predict there

will be an official winner after all of these iterations of recounts? >> right. well, the drawing will take place next week. the date hasn't been set yet. and then as you note, someone will likely sue afterwards. but really the votes have moved. you noted the democrat was ahead by one vote going into this. on election night, the republican was ahead by 10. so at ever point since election day, this race has been within 10 votes. they have moved slightly as much as 11 and back one. so i don't think after this, even though the loser will probably sue, i do not new it will change the outcome. i believe, as a matter of law, that the drawing will determine the final holder of this seat the next two years. >> ken cuccinelli, this is a great reminder that every vote counts. >> every vote counts. >> there you go.
