votes two weeks ago but has refused to concede. in another twist, moore said he took a polygraph test over sexual misconduct allegations and claims this test proves their stories are not true. let's get to diane gallagher live with the breaking details. good morning. >> reporter: good morning, bill. yeah, there's a lot of this 80-page complaint. as it stands right now, the state of alabama is still set to certify the results at 2:00 p.m. eastern this afternoon. we have reached out to the secretary of state to see if this complaint from roy moore changes anything essentially. and i want to read a little part of it from you. it says this action requests the courts to issue an order that a new special election be held or voter fraud be determined with regard to its impact upon the current results. he is asking them to investigate further these allegations of

voter fraud. the secretary of state has stepped up in cases before, specifically talking about a super pac. they told people your neighbors are going to know if you vote for a man who has been accused of these things. people were afraid to vote for them because they didn't want people to know they voted for him. they also talked about irregularities they found in precinc precincts. in jefferson county, 20 different precincts, they didn't find voting matched up with past voting records there. unusually high turnout, they talked about. they had three election experts, one of whom has a past with

conspiracy theories. so they allege in this that potentially they need to look into people being bussed in to vote for doug jones. and then of course there's the extra thing thrown in there. roy moore says after that election he took a polygraph test and he passed it stating that he had nothing to do with any of those allegations against him. again, this is something that he believes that the secretary of state needs to now investigate further. and bill, alisyn, he wants another special election. >> we will see during the course of the three hours whether they have any appetite for that. we have cnn political analysts john avlon and amy barnes. little did we know we would be back talking about roy moore. he is not riding off gently into the night on sassy.

i knew i would work in a sassy reference for you. >> i appreciate it. >> so he says there's been election fraud. and i just want to read one more portion of the letter. here's what his lawyer alleges. all these different examples that they have come up with or think they have come up with about conflicts with exit polls and different anecdotal evidence of voter intimidation. this is what they're hanging their hat on. in his letter he also talks about the polygraph that he took after the election about molestation and assault charges. he said it's hard to get past the double negative. as i had expected the results of the examination reflected that i did not know, nor that i ever had any sexual contact with any of these individuals. is there any press sent for the secretary of state to not certify this today? >> none that i'm remotely aware of.

gener this is a desperate attempt. it is sort of a throw out everything you've possibly got and the kitchen sink to create confusion. it is is almost certainly not going to work. we heard it on "new day" saying doug jones won fair and square. roy moore and supporters have had a hard time getting over it. i think coming up with a lit new of accusations that seem tenuously connected to reality is not a winning strategy. >> some of the things they're winning this on on is a difference between straight party line vote and those who checked for doug jones. you can say that's because of the man and the allegations against him. as dianne pointed out, one of them runs a jfk spurs blog. >> as one does.

>> i wonder if this is a bigger strategy as the president to call into questions elections that are difficult toe come to grips with. >> yeah. in a way no one really expects this to have gone away. it was such a crazy election to begin with. and i think it keeps getting a little crazier even. but i think, yeah, he could have taken the polygraph before the election that would have helped him a little bit. i don't understand why now he feels the need to talk about it after and say he did take it after. maybe he could have talked about it more and discussed it a little more. that could have helped his cause a little. it's a little too little too late. i don't see anything changing. >> well, listen, we'll try to talk to the secretary of state. we'll see what he thinks. if there's any shred of possibility this could happen -- but to bill's point, when you deal in the realm of conspiracy theories, nothing can be trusted. we are in this world right now

where facts are fungible. there is a possibility that a martian came down and voted. conspiracy theories open the door to all of this sort of thing. >> absolutely. once you start drinking from that well of conspiracy theories, everything is negotiable because you live in a very fear-filled world. the problem is those conspiracy theories don't comport with reality. it's our job as analysts and people in the civic look to debate. when people come trodding out conspiracy theories you can confront them and say it may feel true, but it's not. >> the secretary of state of alabama says doug jones will be certified today. the board is supposed to meet at 1:00 p.m. we're not sure if this lawsuit, which was filed late, may throw a wrench into that. stay tuned. let us pivot to the president yesterday who made a

visit to a firehouse in west palm and touted legislative victories that would be great if they were true. he was saying that -- let's hear it. let's let him say it. >> one of the things that people don't understand, we have signed more legislation -- we broke the record of harry truman. >> he said we have signed more legislation since any president of harry truman. >> broke the record of harry truman, he said. we have crunched the numbers. he actually signed less legislation than any president. president trump 96 pieces of legislation. obama, 124. you can go down the list. here we go. the truman presidential library got back to us. it was 240 to 250.

he didn't break the record. >> not even a little bit. that's just the president has been misinformed about somebody. or it is simply an extension of the fact that he always wants to be the biggest and the best but he is not in this measure even by a little bit. what he may have been confused by in his first 100 days he was on a record pace. that fell apart really quickly. if you do the apples to apples comparison, not even close. bottom of the barrel. >> that is probably where the confusion lies. in the first 100 days he signed the most regulatory rollbacks, stuff like that. he is touting it as his first year accomplishment. not true. however, for people who support him, he has done a lot in terms of rolling back regulations. i think that's what he is hanging his hat on. >> you have heard him talk a lot about the economy lately and that he not only has done that but he has actually hpd the

economy and the stock market is all his doing when in fact, a lot of it did come from the obama administration. so there's a little bit of that. he is trying to do the big end of the year wrappup. he started right after he signed the tax bill. he really wants to show that he has done, you know, stuff for the american people. but in fact, i think he, as we have talked about, he hasn't really. >> he actually set the record for the least. if you're just using his metric, he has set the record of 96 for the least amount. >> he hadn't gotten points on the board. he needed it. the party needed it. it's just that simple. >> back when he was beginning in real estate and he was a hype man he used to say he believed in truthful hyperbole. he needs to remember the truthful part of that. it needs to be rooted in something real. >> puffery. it's legal in advertising.

a white house ethics chief slammed the president yesterday. listen. >> we need to honor our civil servants of both parties. they're entitled to their positions. they should not be retaliated against because of the political views. the civil service laws protect them. we don't have purges in the united states of america. that is soviet russia or nazi germany. >> let's bring in john avlon and former federal prosecutor ronaldo marriotti. this sounds like it might be coming from the fringe. you have ben sasse and other republicans saying the mueller investigation should proceed as normal. what do you make for a call for

this purge? is he testing the waters for a new talking point? >> we have seen a drum beat of demonization of the fbi and the mueller investigation from trump surrogates. they're clearly trying to delegitimize. >> don't you think the chorus is getting louder? >> the use of the word "purge" is troubling. we will see if it starts being repeated. the language of purge is something associated with the soviet and the totalitarian regimes. >> even that congressman walked it back a little bit. >> as well he should have. >> he said maybe i was too overheated or hyperbolic. >> that said, this is the danger of trying to demonize an investigation. and demonize the people in it. we have seen that pattern of on surrogates on air comparing the fbi to the kgb which is beyond

disgusting. we have politicized investigations with benghazi, for example. you see the party affiliation just starts seeming absurd because people defend whatever their own side wants to do. we have to hold ourselves to a higher standard. people who defend rule of law need to be consistent about it especially in the context of this administration. >> one of the funny things is that the people who were caught not being impartial. the two fbi officials that were anti-trump, they were reassigned. in other words, the fbi is doing the right thing. when they find out that somebody -- look, everybody has political leanings, political positions. they can still do their job. when it's found out that they are not impartial in a way that may be clouding their judgment, they're reassigned and not part of the investigation. so what more do the republicans

want? >> you know, i don't really think there's any practical steps they want taken. they want to find a hook to delegitimize the fbi. the president repeated does it on twitter. right wing media repeatedly attacks the fbi. there are people in right wing media talking about cleansing the fbi. and i think what they're doing is just trying to find any way to do that. earlier on the show, the last segment you were talking about how facts are more malleable these days. that's what i think is going on here. as you point out, everyone has a partisan political viewpoint. everyone has different political views. the question is just whether or not it interferes in the investigation. these agents have been taken off. there is nothing to show they have influenced the

investigation at all. >> i think the larger point that is troubling, is this a move to delegitimize the results when it comes out. no matter how serious the accusation. the base has already been primed to say this is a corrupt investigation, therefore the results are legitimate. that is the danger. >> there is a reason judges sequester juries and take away their televisions. they don't want to taint the pool. this could be an effort to taint the entire jury pool of public opinion, which is the entire american public and especially the base. let's talk about other news that was made yesterday when michael flynn's brother tweeted a call for clemency. he wrote about time president trump you pardon general flynn who has taken the biggest fall for all of given the ill legitimacy of his confessed

crime in the wake of all of this corruption. he goes on and on. you have said you're surprised he hasn't pardoned him already in your op ed. >> well, that's right. you know, frankly i had -- you asked me a few months ago what will happen with mike al flynn, i would tell you he is not going to cooperate, angle for a pardon and a pardon at the last possible moment. this is the man, if you believe james comey, and i do, that the president told him let it go. comey is a good man were. excuse me, flynn is a good man. if the president feels so strongly about flynn and they are close associates, why not get a pardon. but of course we all know he went a different direction.

he cooperated with mueller. to be coming from somebody who is a close family member of a cooperator. typically when you're on the government's team, you do not try to undermine them at all. this is off message. what this tells me is he obviously loves his brother and he is saying a lot of people around criminal defendants usually say, the prosecutor is unfair. it's all unfair, which of course we have been hearing from many people. >> why hasn't he pardoned michael flynn? he parzed sheridoned sheriff jo. >> it makes the whole thing more complicated. this is thick with interpersonal drama. this was a tweet by a brother asking for clemency or a pardon rather at an odd time. but i don't think -- you know, i

all right. so this morning people are lining up in states like california, new york, new jersey trying to prepay their 2018 property taxes before new year's day because the new tax law limits the amount of money you can deduct in very high tax states for state and local taxes. so people could end up owing a lot more next year. but the prepayments can only be deducted in certain circumstances and that is causing even more confusion. the town clerk of clarkstown, new york, rockland county, with

some of the highest property taxes. thank you for being here. >> how are you doing? >> i'm doing well. >> i'm good. >> what is the situation like since people got word? >> it started to be discussed on the news. once the bill actually passed, it's gotten very frenzied. people are calling, coming in, they want to know if they can prepay. how can i get this in for 2017. >> you described it as chaos. >> it is is chaotic. we have a certain amount of staff. it's a ton of people. new yorkers are very sensitive to taxes already. so when they hear this, it exacerbated a situation that was already very sore for them. >> by the way, this is a gamble. they're hoping that they can sneak it in before new year's and not have to pay more on their 2018 taxes, but is that decided? >> i don't think so. it would be an irs determination

the spectrum. i honestly didn't see a whole lot of people that were on the high end of the spectrum. i don't know what advice they're getting or it doesn't matter because of the income tax or whatever. all sorts of different people. and a lot of desperation. a lot of confusion. here we made it happen. we can take it in '17 if that's what you want to do. we're trying to do our little part to help them. >> what sorts of things are people asking you? >> a lot of people ask is this going to work, can i take the deduction? i can't answer those questions. i said 50 times yesterday that's a question for our accountant. we try to assure them we will get it in and you will have the receipt and at least you have the evidence you need to try to do it. >> thank you for taking time away from the confusion. >> and right back to it. >> happy new year. >> happy new year. thank you. what about all the folks outside that county? is prepaying tax a good idea?

editor and chief of d.c. report and the author of the forthcoming book "it's even worse than you think" what the trump administration is doing to america. good morning, david. merry choose to you. you wrote an interesting op ed. you tried to give us an answer whether this is smart or mott. >> well, as with all things tax, it depends. the first thing to do is look at your 2016 tax return on line 45. that's the back page of form 1040. that is the alternative minimum tax. if you are paying alternative minimum tax, it doesn't matter, you don't get to deduct state and local taxes anyway. if you didn't pay alternative minimum tax, the next question is you need to find out is, and this is trickier, will paying the 2018 property tax in 2017 push you into the separate and parallel alternative minimum tax

system in which case you wouldn't get any deductions at all for the year 2017. and you can't do that without having some professional advice. >> so the alternative minimum tax hits people in what bracket? $80,000 and up? >> well, in theory it can start lower than that. but essentially if you make over $200,000 and in many cases $100,000 to $150,000 and live in high tax indicates like new york, new jersey, connecticut, california, you are likely to be in the tax system. there is one other thing at play, you can hustle down to your local community foundation today or tomorrow and set up a donor advised fund and prefund the next five years of charitable giving you do every year and you will get a deduction this year that you wouldn't be eligible for next year. or you wouldn't be able to

deduct as much as of it next year. >> let's put up a graphic why you might not want to prepay this week and not worry about it. your local tax authority -- if you pay less than $10,000 in state and local taxes. as you said, if you're affected by the amt. but what about charitable giving? this time of year it's a ritual to give away to the less fortunate and then take the deduction. does that still hold? >> well, if you don't have a mortgage and don't have mortgage interest next year, you're going to get, if you're a married couple, $24,000 standard deduction. if you take $10,000 for state and local taxes, another $14,000 in deductions before you get any tax benefit. which is why i suggest if you don't have a mortgage and you have the capacity to do so, fund today through your community foundation the next five or ten years, whatever you can afford, of your charitable giving. then you dole the money out in

the future but you get the deduction this year in full. but you've got to act fast. you have today and tomorrow. >> okay. interesting. and you say check with your tax professional or do maybe a test run if you use the software. do you think the software systems are updated at this point to account for all the changes? >> close enough that you can see if it tips you into the amt. if you do your own taxes, take your 2016 return, add whatever property taxes you might make to it and see if it tips you into the amt if it doesn't, you're probably fine in that case. the irs says you have to have an assessment from your county. you can't just pay what you think will be the tax next year. now, a number of counties, like the one i love in, monroe county, around rochester, new york, are trying to get tax bills ready tomorrow, the 29th, the last business day of the

contacted less than half the time. cnn reached out to all major usair lines and the industry trade group that represents them. none agreed to go on camera but all released statement witness stand a similar message, passenger safety and security is their priority and they say flight attendants are trained to handle these incidents. none gave a detailed example of guidelines. no federal regulatory agency tracks how many assaults happen nationwide but the fbi does investigate how much it investigates. federal data shows a 66% increase from 2014 to 2017. it is unclear what's behind the rise. but what is clear for these women, flight crews need to do more. at 30,000 feet, there's no escape. i want to thank all four women for sharing their stories with cnn. the four women say they want three things. one, flight crews should always

separate the victim is from the harasser. two, do not allow drunk people on flights. alcohol played a role in a lot of these cases. and, three, call law enforcement to report these cases upon landing every time. they also advise -- try to avoid the middle or window seat if possible. sitting in the aisle allows for an easier getaway if necessary. we do want to point out several lawmakers have been pushing for legislation that would beef up flight crew training and mandate better tracking of these incidents. okay. this is fascinating to me. because this is the upshot, i think, of the me too movement. we have heard so many people say you'll know really it's a watershed moment when it's not just high profile people, when wheu it reaches out to all walks of life. suddenly people feel free to
