i'm brianyanna keilar for w blitzer. it is 9:00 p.m. in moscow and from wherever you are watching, thank you so much for joining us. last minute legal ploy. roy moore issues a new challenge to the out come of the alabama senate race he lost. state officials are set to certify the results. defending u.s. diplomacy, rex tillerson writes an oped on north korea, china and russia. moscow calls it confrontational

and republican retreat. president trump and gop leaders plan to gather at camp david days from now. we will preview to map out the republican agenda. in less than an hour, it will be official. doug jones will be certified the winner of the race. roy moore is not giving up without a fight. he is alleging voter fraud and calling for a delay and certifying the results. the secretary of state said that's not going to happen. we will talk with john merrill in a few minutes. we want to bring in diane gallagher in montgomery, alabama. walk us through the specifics of roy moore's complaint. >> so bryanna, initially the goal of the complaint is first they would like a new election. a do-over. if they can't get that, they would like for the secretary of state to investigate the claims of fraud that they alleged determine if they had an impact
10:02 am
on the special election result a couple of weeks ago. as far as the lawsuit itself, it's a kitchen sink of voter fraught allegations. the crux is on increased voter turn out. it took the experts, one of whom is a experience theorist who peddles ideas about the assassination of jfk and the murder of staffer seth rich to say that in certain areas they used jefferson county as an example and there was this high voter turn out. jefferson county had a 47% voter turn out. it's also 43% african-american. they are sort of tying those together by saying it's unusual the turn out would be so high. they of wanting them to look into people without of state driver's licenses were voting and trying to see whether or not a super pac ad may have caused voter intimidation and shows stuff about damaging his
10:03 am
reputation and ties it all by trying to clear his name, telling everyone he took a polygraph test after the election about the allegations. >> diane gallagher for us. thank you so much. the alabama secretary of state said roy moore's last minute challenge won't change anything and doug jones will be declared the winner an hour from now. a spokes woman for the roy moore campaign said that process should be put on hold until alleged voter fraud is investigated. here's what she said moments ago. >> whether you are republican or whether you are democrat or whether you like roy moore or doug jones, you ought to care that the people of alabama ought to be thes making that choice. this should not be done by's create private company that destroys the ballot images.
10:04 am
by the way it's in violation of federal law. federal law said destroying, muteilating or altering voter records that you could be facing $5,000 or years in jail. >> they have not found evidence that those things have happened. >> we're are presenting that evidence. don't you think that the evidence of 84 pages of experts that have said just one county we found 20 precincts and jefferson county. we found the analysts have done the algo rhythms and they know what districts they targeted. the chances that this was not fraud is one in 15 billion. >> joining us is alabama secretary of state john merrill. what did you think about the claims where she had an incredible ratio that the chance this is not voter fraud is an incredible number. >> bryanna, it's important to note that people are entitled to their own opinion, but not
10:05 am
entitled to their own facts. all of the original bat on thes that people cast their vote preserved for a period of 22 months after the election. the machines are not programmed to capture the digical images to which she prefers. the results show doug jones beat roy noor a margin outside of where there would be a recount. has there been a shift in those results? >> no. we indicated this to your network as well as other news outlets. we had 500 military ballots that were received and processed and we had 5,000 provisional ballots that were evaluated and processed. even if judge moore had received all 5500 of those ballots which he did not, then he still would have trailed by some 14,000 plus
10:06 am
votes. >> roy moore has claimed voter fraud as you heard his representative there saying. what has happened with that? has that been sumarily dismissed? >> certainly yanbryanna. for anyone interested in submitting a complaint, we have a way to capture the complaints through stop voter fraud now.com. any citizen can submit an allegation or a complaint they witnessed or has been reported to them so they can share with us what they like us to investigate. to date by the time i left the office and came over here, we had 115 of those complaints for this particular election. more than 60 of those have already been adjudicated and dismissed, but several of active and we will continue to investigate until they are fuelly adjudicated. >> what are they alleging in
10:07 am
these complaints? >> there is a number of things. some of those i will touch on. one was that five bus loads of african americans have been broad from mississippi to mobile to vote in the election. that was sumarily dismissed after investigation was conducted. the second thing is there were three van loads of people from mexico that were imported to come and vote and cast their ballot and they have been identify and had been arrested and incarcerated. that too was not true. third, that there was a town that was some 20 miles from birmingham where they had 2200 residents and more than 5,000 people would cast their ballot that would make sense and cause a lot of consternation except there is no town called that name. that was fabricate and made up. last but not least is an individual featured on a local
10:08 am
television station out of mobile at the election night victory party for doug jones who was not identify and indicated he had come to alabama. he had gotten involved in the campaign and he had cast his ballot and other colleagues and friends of his had done the same thing. we were able to have a number of interviews about that particular situation. we asked all the people that conducted interviews to air that clip and hopefully someone would know that young man. it was indicated to us through an individual contact, a concerned citizen who said i know who he is. they connected me with that individual and we were able to identify him and he has been living in alabama for more than a year. he has a job and he's a registered voter and he cav the ballot for the candidate of his choice. they have been dismissed. >> very interesting examples of what you have been getting in terms of complaints of voter
10:09 am
fraud that have been dismissed. >> bryanna, you have absolutely no idea. >> it's pretty wild as you describe it there. >> yes, ma'am. >> have you spoke tone roy moore today? >> no, ma'am. i have spoken to judge roy moore in more than two months. >> and that's customary? have you spoken to his campaign? >> we have spoken to people in his campaign, but i have not personally spoken to anyone in his campaign that i can recall since election night. >> what's the outreach between your team? >> we have outreach with the jones campaign too. that's important for the viewers to know. >> what has the contact been between your team and the moore campaign? is it just updates? >> well, yes. they have asked questions or they have attempted to have questions answered that have been important to them. we supplied them with that information and the same thing with the jones campaign as we moved forward. >> and just to remind our
10:10 am
viewers who have been watching this senate race in alabama, 2:00 p.m. is the time where this is going to become official? >> that's correct. a little bit less than an hour, we will certify the results and doug jones will become the new united states senator from the state of alabama. on january 3rd, he will take his certificate of election and present himself to the members of the body and vice president mike pence will swear him in on january 3rd and he will be the newest member of the united states senate. >> 2:00 p.m. eastern i should say. secretary of state of alabama, we appreciate your state. >> thank you for having me as your guest. >> rex tillerson said his administration has no illusions about the russian regime labeling the relationship poor. now the kremlin is firing back. we have russia's stinging response next. the president timeouts his

neulasta helps reduce infection risk by boosting your white blood cell count, which strengthens your immune system. in a key study, neulasta reduced the risk of infection from 17% to 1%, a 94% decrease. applied the day of chemo, neulasta onpro is designed to deliver neulasta the next day. neulasta is for certain cancer patients receiving strong chemotherapy. do not take neulasta if you're allergic to neulasta or neupogen (filgrastim). ruptured spleen, sometimes fatal as well as serious lung problems, allergic reactions, kidney injuries, and capillary leak syndrome have occurred. report abdominal or shoulder tip pain, trouble breathing or allergic reactions to your doctor right away. in patients with sickle cell disorders, serious, sometimes fatal crises can occur. the most common side effect is bone and muscle ache. so why go back there? if you'd rather be home, ask your doctor about neulasta onpro.

>> confrontational fake news. that's the response from the spokes woman of russia's foreign ministry of rex tillerson's op ed in the new york sometimes. they write the united states has a poor relationship with the resurgent russia that invaded its neighbors in the last decade and undermined the sovereignty of western nations. for more let's bring in our cnn global affairs chief kimberly dozier. what else did rex tillerson say about russia that was of note? >> basically i thought the part about the election was really striking because president trump has never admitted that even though the u.s. intelligence agencies talk about confidence that there was an interference in the election.
10:16 am
ukraine is really where the two nations have a lot of attention right now and secretary tillerton said until russia makes right with ukraine and implements the agreements especially this one that governs the conflict, it's not going to be business as usual are for how he wanted improved relationships and how he refuses to get tough on rush what and his rhetoric, last week the administration approved for the first time lethal weapons for the military and secretary tillerson said this will condition. >> what are did you think about the tone? >> from the kremlin's point of view and until trump starts tweeting aggressively about them, they are going to make a few statements about it and treat it as the rhetoric of secretary of state who may be on
10:17 am
his way out. even the national security strategy that was very tough on russia said all the right things in terms of condemning it. they don't seem to believe until it comes out of the oval office that it is really real. >> that are i put stock in what president trump said and not rex tillerson says. >> at the same time even past obama officials is that arming ukraine is one of the ones that they had been pushing for behind closed doors and said unless you push back against russian force with force, russia arms proxies said the u.s. needs to arm them to show that each aggressive russian action is going to be met, only then will moscow truly respect the united states and start to stop being like this. park are they need to earn their way back to the negotiating
10:18 am
table. >> this was what the secretary has been saying all along. there noods to be a prolonged period of quiet. the rhetoric flying back and forth, you can kind of just disregard as rhetoric on president trump and again, the president tweeted one thing. his administration is basically implementing the same policy that they have been which is this pressure campaign continuing to ratchet up the sanctions. last week the un security council saying they cut 90% of their oil exports. you saw president trump this morning kind of criticizing china for flaunting sanctions. these are new ones. will china implement the sanctions because they could be a game changer. president trump is tweeting whatever he is tweeting and the policies are quite different.
10:19 am
there is a complete disconnect here between president trump's policies which are seen as the policies of his administrations that one would think he signed off on, right? his twitter feed for the point. >> today he tweeted cochran very disappointed that china is allowing oil in. there will never be a friendly solution if this continues to happen. you look at the tweet and you look at what tillerson said. what do you think? >> the tweet seems to confirm an anonymously sourced south korean media report. does trump have the intelligence to back that up? it's not clear. one of the things that i use as a gauge of how tillerson is being seen is when i talk to foreign diplomats, i asks who are you talking to and what do you trust to tell you what is really going on? we like our state colleagues and we keep in touch with them, but we have to test everything they
10:20 am
tell us against what we hear from the pentagon and most importantly the national security council. secretary of state tillerson doesn't carry a lot of 58 with the people he is meeting with. >> thank you so much to both of you and coming up, a meeting of the minds is set for january. president trump, paul ryan, mitch mcconnell will get together at camp david to plot out the gop agenda for 2018. my experience with usaa has been excellent.

golf. sarah murray is live from west palm beach mere mar a lago. do we know when he is heading back to washington? >> we are expecting him to say here in mar a lago at least through the new year and then going to camp david and meeting with mitch mcconnell and paul ryan about how to move forward with their agenda in the new year. there is plenty of stuff on that list. they left town in washington with a lot left undone including government funding and a fix for the dreamers and disaster reand health insurance bill for children. the president also made clear he wants bipartisan deals done in the new year. now that could include infrastructure and a broader immigration fix and maybe even fixes to obamacare. this could be a little bit far-fetched though. we have seen democrats willing to appear at the white house with the president and sound
10:26 am
open with cooperating with him, but the white house thought they were going to get democrats on board with tax reform and that did not go as they had hoped. what we are seeing as the president is on his florida vacation and he continues to hit the golf course day after day. a little bit of frustration that he hasn't been able to move his legislative agenda further along as he hoped to and he doesn't feel like he is getting the credit he deserves and as usual he is taking that out on twitter. this time he is touting economic numbers that he is successful and having a good first year. this is what he said today. retail sales are at record numbers. we have the economy going better than anyone ever dreamed and you haven't seen anything yet. bryanna? >> thank you so much for that. president trump also touted his accomplishments during a surprise visit to a fire station yesterday. take a listen. >> one of the things that people
10:27 am
don't understand, we have signed more legislation than anyone. we broke the record of harry truman. >> there is a problem with this claim. it's simply not true. trump has signed fewer year in his first year than any president since eisenhower. joining us to discuss this and more is analyst and correspondent for the hilt, white house reporter for bloomberg news and shannon petty piece. he has things he can brag about. why did he pick something that is so easy to fact check and disprove? >> why does donald trump exaggerate what the facts o lou him to do credibly? that's a question we can be asking for years throughout his career. you remember he wrote in a book the whole virtue of hyperbole in business and his business career. >> do you think he meant something else? >> let me give him the benefit
10:28 am
of the doubt for a second. i am sure in his mind got a briefing about all the executive actions and all the deregulation orders he filled out. he put his signature to paper perhaps more often than others. we don't have the ability to track all of that through history, but what he said was totally untrue. he has not signed more legislation into law than his predecessors. there he is once again, the president of the united states is out there speaking a demon strabl untruth. >> there was a busy december, but he wants to make clear that he achieved a lot. >> and he is the master of marketing and branding and to say he was the biggest real estate developer in new york. that was not true. one of his close friends is even a bigger real estate developer than him. he knew that and he was bragging he was a bigger discipliner than a close friend.
10:29 am
it's marketing and branding and messaging. it's branding 101. repeat the same things. it was the best year of making america great again and he sticks with the story. that's donald trump the businessman, i think. >> let's talk about president trump golfing. we talk to talk about this because he does it so much and he criticized president obama for doing it much less and he did and the white house likes to keep this under wraps, but not from our prying eyes. the photographer is getting this shot of president trump on the golf course. the white house didn't provide us a chance to do this as we would occasionally get with president obama. it's his third time on the golf course since christmas day. it's back to work in order to make america great again. what do you think about this? >> obviously presidents golf during their vacation and you and i covered the white house and you and i saw president obama doing that quite a bit, but he has actually done this
10:30 am
quite a bit more than president obama. he just doesn't want to own up to it for whatever reason and he wants people to think he is back at work and it's after christmas and he is working again and he is focused on the economy and that's something he will keep pushing in 2018. something that he feels like he is in charge of and that he is on top of. the fact of the matter is that president obama can claim a lot of credit for it because unemployment numbers are something that take quite a bit of time to work through. i think he wants people to know that he is in charge and on top of things and that he is not out there playing golf when in fact he is. >> one of the most interesting shots of president trump playing golf is of president trump not playing golf because we couldn't get it yesterday. if we can show this, as the president came around to this area where he was visible, a truck actually pulled and seemed
10:31 am
to be coordinated. pulled in front of the shot. that became the story. that was a bigger deal than seeing donald trump golfing. clearly someone is worried about the optics. >> yeah, no doubt about it. it begs the question why is the white house so afraid of showing the president golfing. are they concerned about the hypocrisy you were discussing from his previous words? it's a reality we know he is golfing. he knows golf clubs. he goes to them often and nobody begrudges the president the ability to blow off some steam. it's one of the hardest jobs in the world. >> because he has been so critical and he does it so much. he has been so critical of someone doing it a fraction of the amount of time. >> it goes back to the business that is controlling the message. he wants an image of a hardworking president. it's a celebrity who doesn't want a picture of themselves without make up and hair fully
10:32 am
done. >> back to business, i should say. after this trip, we are going to see the president meeting with republican leaders of congress at camp david. what do they need to hammer out. what's on the agenda? >> so much. because there is a log jam that's going to happen. they kick the can down the road and it's going to be a pretty tough start to the new year. there is child health care and there is budget stuff and spending, a government shut down could loom. there is so much to talk about and he hasn't been on the friendliest terms with mitch mcconnell, for in stance throughout last year and this year. he wants to make sure everyone is on the same page and they have momentum because they got the tax bill through. they need to keep focused and make sure 2018 is a priority and
10:33 am
they also need to sell the tax bill. as poll numbers show, it's not entirely popular and they need to do quite a bit of showmanship there as well. >> president trump has been optimistic about the idea of democrats helping out on health care and infrastructure. he has been poking them in the eye last year. what do you think the chances are that there will be some? >> i'm not going to make predictions, but it's unlikely. >> if anything is to get done in the senate it's going to have to have some democratic support. it's a 51-49 senate. unli unlike taxes, they need 60 to get legislative done. what is so important about the meeting with the two congressional leaders and the president, they are not on the same page about the priorities. paul ryan would like entitlement reform. mitch connell said that's off
10:34 am
the table. donald trump campaigned that it wouldn't be. mitch mcconnell wants to not bring up health care again. we know the president does want to see health care repeal and replac replaced. they are not synched up as to what the legislative agenda should be. >> to be a fly on the wall. so interesting. thank you so much to all of you. >> thank you. >> and a deadly suicide attack by isis left more than 40 people dead and dozens injured in kabul. sharp condemn nation pouring in from around the world. we will have details next. your insurance company

this train station is not the only thing they are naming after donald trump. tell us more about this rather bit of a frenzy we are seeing to honor the u.s. president. >> it does seem like a frenzy. it's not just in jerusalem, but they are naping projects after president donald trump and a few weeks ago, trump recognized jerusalem as the capital of israel. the big and we will come back to this, but the high speed rail stop planned for the old city of jerusalem. that's the most controversial, but not the only one. they want to rename the street one of the major arteries to the old city. he wants to rename that donald trump street. they want to name a park after president trump and construction of that park starts next month and a city of southern israel wants to name a new street trump declaration street. they feel it's important to the

city of israel. it is the train station that is by far the most controversial. it's the most sensitive part of the conflict. the station would be 50 to 60 meters under ground with an exit that puts passengers close to the person wall where trump just a few months ago became the first u.s. sitting president to visit and that becomes the most fortunate israelis. they bring about an immediate and angry response. the senior muslim cleric said naming a high speed rail line none of that changes that east jerusalem is occupied territory. this is still a few years away and another year of planning and a few more years of construction, but you get the idea of how much president trump means to israelis and how much he has angered palestinians. >> a very controversial decision. thank you so much. alabama officials are standing by as we speak to certify democrat doug jones as the

10:49 am
number seven, tough on crime makes a come back. once alabama senator jeff sessions was sworn in as attorney general, he set out to make his mark on the justice system. >> i new era of justice begins and begins right now. >> what a difference a year makes. elections really do have consequences. >> in may they delivered the stiffest possible charge in all criminal cases. >> this could severely change the sentencing procedures in the united states. >> up sending a push to phase out long prison sentences for long violent prison sentences. >> drugs and crime go hand in hand. they just do. the facts prove it. >> number six. immigration crack down. sessions also 0ed in on immigration laws taking aim at sanctuary cities going after
10:50 am
undocumented immigrants nationwide and linking hotly debated policies to recent acts of terrorism. >> as yesterday's new york events showed in the starkish terms, the failure in immigrations systems are a national security issue. >> number five, transgender rights. sessions directed his division to but at the same time the attorney general reversed obama era rule that allowed transgender students to use the bathroom. while defending in court a new policy that trump denounced in a series of tweets. >> he just took a major stance he will ban transgender people serving in the u.s. military. >> a policy several federal judges have blocked. one calling the tweets capricious and arbitrary.
10:51 am
>> number four, when tweets haunt the president in court, trump hits back. federal judges across the country pointed to the president's tweets when sizing up his travel ban restricting people from several must lulim majority countries. >> costing him in court. >> as the justice department tried to defend it in court national security grounds and fears protest and almost immediately blocked. >> who then trump called a so-called judge, and later tweeted, if something happens, blame him in the court system. people pouring in, bad. >> number three, reshaping the courts. aside from tweets, president trump's impact on the federal courts will far out last his presidency. >> the president has been enormously successful in filling vacancies on the federal bench with lifetime appointments, people who are very conservative

on the courts of appeals. and these people are going to serve long after donald trump is gone from the presidency. >> trump election win secured the appointment of relatively young judge called kneel gorsuch to the presupreme court. >> first one hundred days in office. >> president also tackled the lower courts, primarily white nominees to the courts at a break neck pace. >> untold story but as you think about it, mitch and i were saying, that has consequences 40 years out, depending on the age of the judge. >> number two, the president's attacks on the justice department and the fbi. the president's frustration with attorney general sessions was palpable. >> a lot of people disappointed with the justice department, including me. >> but caught some surprise when he slammed the fbi.
10:53 am
