they now face backlash from their liberal members. so what concession did democrats get to end the stalemate? >> they got a deal to make a deal maybe. the truth is the dems got spooked and the gop got a boost because the division that leads to a political shutdown is currency for them. they only funded the government for 16 days, meaning we're only that far away from more brinksmanship. the president's position for d.r.e.a.m.ers has put out that ad that makes them all look like terrorists. so is there a basis to trust he won't play his base and give them the minimums when it comes to d.r.e.a.m.ers. bombshell report. fbi director christopher wray threatened to resign because he felt pressured by the president. this is another case of

president trump taking a victory lap as more than 30 democratic senators joined republicans over a three-day shutdown. let's bring in reporter and editor at large and analyst. great to have both of you. what changed yesterday from friday that allowed democrats to get on board and stop the government shutdown. i think the reality of the shutdown resonating with the american people, people weren't buying the democrats' position. the exit ramp became really unclear. the deal came, look, can we live to fight another day, can we take health insurance off the table and call that a win and

trust mcconnell, big if. it's gamble on all sides. but for moderates, it was a way to support it. >> italians would say they got the nervous stomach. but now they're getting beaten up by the base and i don't know what the gop lost on this other than giving it a short window. they haven't made any real promise do anything on dreamers. this is just a deal to make a deal. >> chuck schumer said yesterday, you know, we've now extracted a promise for mitch mcconnell. he said, i must have missed the memo. again, mcconnell's intention was not, we will have this vote on "x" day on daca. now, let's say best-case scenario mcconnell is good to his word. he's made a great high-profile

play. it passes. they find something that passes. well, the house republicans didn't make any deal with senate democrats and neither did president trump. that to me is the problem. if all you needed to do was pass something through the senate for it to become law, this isn't a terrible deal for senate democrats because you're depending on mcconnell and trusting him. that's only one-third of the piece of the puzzle. >> so we're back here in exactly 16 days? >> mark your calendar. >> start the countdown clock right now. >> the anxiety will rise if they don't have a deal. >> they can't do what they always do which is the only way to get anything done is wait until the last minute and hope the pressure forces compromise. this is an anticipatable problem. this is something where there's been an outline of a big deal. maybe they can -- >> i think you're right. crying wolf won't work as well next time. >> no. >> it's fine. the government shuts down, and

they figure it out three days later. >> to chris's point, the house didn't sign onto this deal, that's a real problem. the far weleft is furious. there are folks furious about this. but if they can take that outline of grand bargain on the deal they had where border security gets funded, the drooerms get legal status if not citizenship -- >> that's the problem. the certainty is on the side of what the republicans want. you said some degree of protection for d.r.e.a.m.ers. if you're a d.r.e.a.m. e, that ain't putting you to sleep tonight. i have not heard that word come out of a gop mouth, certainly not from the president, chris. he ended this. he created a date certain. he said he wanted to help them.

here. frankly, we talked in the last segment, i'm not totally sure what democrats got here. c.h.i.p. was already on the table when chuck schumer said, you know, we can't sep this, we're not going to accept the three-week shutdown, we need a three-week continuing resolution, we need more. i really don't understand what more they got. schumer, by the way, mademy loser's list. and i don't think lindsey graham, joe manchin, and susan collins get in the winner's circle for a certain reason. these people willing to get together in a relatively large group actually, 25 senators, and say let's figure it out. you saw dick durbin, the senate ranking democrat come out and say this is a model for what we can do going forward. i think that would be great.

i don't know if that's true, right? john made this point in the last segment. they're like a kid in college. they only do things when it's due the next day. sometimes they do it after it's due. so i don't know that there's going to be this new bipartisan coalition on everything going forward. but at least amis, keep hope alive. >> i want to put up your winners again. this is who chris thinks are the winners, mitch mcconnell, lindsey graham, 2018 democrats, moderates, and davos. >> when is davos not celebrating with a canape. look, it's true. red states facing tough re-elections. a protracted shutdown would have been bad for them. and democrats on the far left can protest all they want, but they've got to win beyond their base. that's the only path to a real majority. they were looking at the numbers and saw it was a bad deal.

axios is reporting that fbi director christopher wray threatened to quit because he felt pressured by attorney general jeff sessions and president trump to fire the fbi's deputy director andrew mccabe. joining us to talk about all of this and more phil mudd and cnn chief analyst jeffrey toobin. let me start with you. if he has made a frequent target, if they and ag sessions think that andrew mccabe is a partisan who lets other partisans have text messages about why they want to bring down trump, why wouldn't they want to pressure him to get rid of an drew mccabe. >> the question is does the fbi director work for the american

people, have independence, or is he an employee like the secretary of education, secretary of the interior? is there something different about the fbi director? traditionally one reason they had ten-year terms, they're supposed to be independent, they're supposed to operate with more of an interest in the law. obviously president trump thinks that the fbi director should be loyal to him. that's why he fired fbi director comey. >> you always have a layer that's relevant. this was attorney general jeff sessions reportedly getting involved with this when he's supposed to be recused from all things russia investigation. how does it smell to you? >> doesn't smell too good. if you're the fbi director, you had no option but to do this. if you're sitting in hoover headquarters on pennsylvania ave you -- i worked there for 4 1/2

years -- and the attorney general comes down and says i don't like one of your employees because he has -- i think, because i don't have any evidence that andrew mccabe is biased -- i think andrew mccabe is biased, you can't not investigate it because people don't like the political smell of it. if you enter the fbi, what do you do? if you're a republican, you can't participate in the investigation of hillary clinton. if you're a democrat, you can't participate in the investigation of president trump. how do we know he's a democrat? because his wife ran a democratic ticket? it doesn't tell me much. >> does it worry you the text messages, peter strzok, lisa

page, they're gone, missing, and the ones we do have show an anti-trump bias. does it worry you that these six months of text messages can't be found? >> not really. i'm sure there will going to be a bunch of conspiracy here. i tell you the dirty secret. when you work in large bureaucracies, and the fbi is about 35,000 people, somebody did something stupid or there's a policy that said we eliminate text messages after a certain number of month, a technology glitch, i guarantee you somebody wasn't sitting there thinking how can i eliminate thousands of messages and lo and be hold if they find out, somebody's going to be fired. >> alisyn, let me raise one point. >> yep. >> whether it shows political bias is an open question. i don't think that's resolved. >> the ones we've seen. >> you've heard one slice of one

president trump gloating on twitter after congress threatened to to shut down the government. cnn anchor jake tapper received an e-mail trump campaign sent to supporters with the headline "democrats caved." joining us now is democrat congressman henry cuellar of texas. he voted yes on the spending deal. does that mean you caved, congressman? >> no, i've been a big believer since the republicans shut down the government in 2013. by the way, he did not gload. he said, let's get back to work. i don't believe you should shut down the government on any

you've got have both the republican leaders and senate leaders agreeing to that. otherwise you're going to leave it open. that's not the way to negotiate. it's the path moving forward, but it's not the way i would negotiate this one. >> that's what pelosi would have been doing. do you think she would have made the same deal? >> i was the one that suggested that what we ought to do is do it that way. i've been saying this for a while. you get the c.r. and you take the vote before. in fact, i told kevin mccarthy this last week and i told him back last year, the same thing. look. if you want to put the goodlatte bill, put the goodlatte bill and then the bipartisan bill and then let the queen of the hill or the king of the hill see where the will of the house goes. and basically what one of those republicans -- it wasn't kevin mccarthy, they said, no, your bill is going to pass because you're probably going to get 30

republicans on board. i said, that's the will of the house. what are you afraid of. put both bills on the floor and see what passes. otherwise we're going to be back on september 8th doing another shutdown or threatening another shutdown. this is not the way to handle the business or the house. >> what do you think is going to happen now? do you think you're going get an up-and-down vote for the dreamers? do you think a pathway to citizenship is even possible? >> well, again, in our bill, there is a pathway, and again all i want is -- i don't want the republicans to be afraid of the will of the house. put goodlatte's bill, put our bill there, let's see what happens, and let the will of the house. but apparently they're afraid that their bill is not going to pass, our bill's going to pass with republicans, and that's what they're afraid of. they're prohibiting -- it's the same thing boehner did some years ago on immigration reform. he said he supported it, he

won't put it for a vote. he said he supports da kachlt put it to the vote. if it fails, it fails. i don't think it's going to fail. it will pass and they're afraid to put it to a vote. that's the bottom line. >> right. but you don't have any leverage. that takes us back to the senate situation. you're the minority. the only leverage you had were these votes the republicans need in the senate even if they get all of their people on board because of the filibuster rule. so now that you showed as democrats -- i know you're in the house, but you're all in the same party. that's why i made the point i made earlier, what is your leverage to get the gop to do anything they don't want to do with the dreamers when the president who was your bestial lie for a minute put out an ad basically saying they're all terrorists. >> the bottom line is you're right. we know he changes. let's go back to congress where we can work this out. we have still got to pass the

appropriation bill. the d.r.e.a.m. act is one issue. we've still got to get the top line numbers. we've still got to get how we divide the numbers. we still need that appropriations, otherwise we're going to continue to stay with the cr, and we have to get those numbers. the numbers and the appropriations is what the topline numbers are that are important and that's the leverage. >> look. i hear that from a lot of people in the house. maybe that's why in the end it was the democratic conclusion to separate the two issues, daca and the appropriations. nancy pelosi said the same thing, the minority leader yesterday, that the budget concerns loom even larger than the daca problem. henry cuellar, thank you so much. >> thank you so much. now to this story. more than 100 girls and young women have testified in the sentencing hearing of disgraced usa gymnastics doctor larry nassar. he's admitted to sexually

abusing them in his care. first let's get to jean casarez. what's the latest? >> reporter: the reason so many can speak in court is not only because the victims are allowed, parents are allowed, it's all because of the plea agreement and the plea agreement says other act witnesses, those young women filing reports who say they, too, were sexually assaulted by larry nassar. >> i have never wanted to hate someone in my life, but my hate toward you is uncontrollable. larry nassar, i hate you. >> a fifth day of emotional testimony filled with anger. >> what you have done is despicable. what you have done you can never erase. but i find more peace in knowing that one day you're going to die and when you do, your pain will not subside. >> and tears. >> i feel my own sense of guilt

larry nassar. kaylee lawrence is a gymnast. and we have a diver. thank you so much. sterling, let me start with you. i understand you plan to make your victim impact statement tomorrow to the court. what do you plan to say directly to larry nassar? >> yes, that's correct. i'll be speaking tomorrow. you know, the whole purpose of this is really to explain our story, to tell our truth, reclaim our voice and just make sure the court and larry and all of his enabelers understand we're not standing for this. we're putting an end to this sexual abuse. >> kaylee, as i understand you were suctionually abused on your 13th birthday. what do you plan to say to him and to the court? >> you know, i would like the court and larry and everybody to

know how his actions have affected me since the time i was 13 and how this has affected my future. and going through this process of testifying in court, you know, being questioned by his defense attorneys, i want everyone to know how difficult it can be. >> kaylee, can you tell us? how did it affect your future? >> i have a hard time trusting anybody. knowing what's right and what's wrong. sometimes i question myself. i can't go to the doctor by myself anymore because i'm afraid that another doctor will betray me just like larry did because he made it us think he was our friend and got us to trefts from the very beginning. >> stir ling, this is such a great point.

hoe was trusted as a miracle worker because he could fix your bad back or bad knees or bad feet. how you do think it was possible he was able to perpetrate this against so many girls? i mean the count is now up to at least 144. >> he was a master manipulator. he was -- he groomed us. he groomed us to think that he was that saint, that miracle work e. he would give us gifts, talk to us like he was our best friend and he allowed us to trust him to make sure we could get back to training, get back to the sport we loved, and we were brainwashed. we were manipulated and brainwashed, and it's grooming

on a whole new level. >> kaylee, the chairman of usa gymnastics and two other high-level board members resigned. do you think they knew what was happening? >> you know, i think that there are certain people who knew. i don't think that there's any way that nobody knew what was going on. >> who do you think did know? >> you know, it's hard to pinpoint exactly who i think knew for sure. but i think that there's no way that this just went completely unknowing. there's just no way that that can be possible. >> sterling, what do you think? who do you think knew, and did you try to over the years tell anyone? >> you know, i did not tell

anyone. quite honestly, i didn't know it was a sexual assault until that report broke back in 2016. but when you look at the facts and the stories and the history of these women and stories they did tell, you know there were multiple people at michigan state who knew this was happening. we have reason to believe there were 14 people at michigan state who knew he was sexually abusing women and did nothing about it and they know there were women who reported to usag and they took weeks and months to communicate that and they never protected their athletes and the young women who were involved in the sport. so it really is -- it's a shame to think so many people were putting their understand substitution and their brand and reputation ahead of our lives. >> well, obviously they are forced to listen to your voices now. best of luck tomorrow when you give these victim impact statements, and we'll be
