burnett. outfront tonight the breaking news, someone is not telling the truth. it's either the president of the united states donald trump or porn star stormy daniels. team trump facing questions after she sued the president claiming $130,000 settlement paid to her to keep quiet about her alleged sexual relationship with trump was no longer valid because trump never signed the agreement. just moments ago stormy daniels attorney, says president michael cohen has further threatened her to keep quiet with a restraining order. and earlier sarah sanders was asked again and again about stormy daniels. >> did the president approve of the payment that was made in october of 2016 by his long time lawyer and adviser michael cohen? >> look, the president has addressed these directly. and made very well clear that

none of these allegations are true. this case has already been won in arbitration and anything beyond that i would refer you to the president's outside counsel. >> you said that there is arbitration that's already been won by whom and when? >> by the president's personal attorneys and for details on that i would refer you to them. >> so you are aware of them. what more can you share? >> i can share that the arbitration was won in president's favor and refer you to the president's outside counsel on any details beyond that. >> daniels attorney, mocking sanders claim that the president won the arbitration as a lie. telling columnist for the "new york times," yeah, he and he also won the popular vote. so when sarah sanders said trump won the arbitration, i guess this is confusing thing. if you are admitting there is arbitration, what else are you admitting? are you also admitting that donald trump knew that the hush money paid to daniels was paid to ensure her silence?

when pressed further, sarah sanders stone walled. >> what do you know about the payment at the time? >> i've addressed this as far as i can go. >> did he know of the payment at the time? >> no that i'm aware of. there was no knowledge of any payments from the president and defied all of thesal gases. pre >> first of all she said not that i'm aware of. here's the thing about this, if you want to find out what team trump has said about daniels, you have to go way far back into ancient dinosaur history in this trump administration. in fact you have to go back to november 4, 2016, four days before the election. at the time, hope hicks then the campaign spokesman denied pa relationship between daniels and trump. but that's far as drum has gone to address this alleged relationship. and never addressed the nondisclosure agreement. and or and this cob the most crucial part, $130,000 in

pushi pushing sarah sanders on these crucial questions. what is the white house saying? >> blending this in with alleged affairs and sexual abuse that the president obviously went through. and that was asked and answered by voters. this is a brand new question. because the white house has refused to answer it. he said the president has viewed it t our view is clear on this. the reality the view isn't clear. and in trying to ens a the questions today, sarah sanders actually opened the door to more questions about the arbitration, specifically she said repeatedly the arbitration has been won. we learned after the briefing that it's not true at least in the view of stormy daniels and her lawyers. so trying to push this aside, we learned several things, one been discussed in the west wing. press secretary said she had a conversation with the president at least one about this specifically. we also know that this is

something that is worry some enough to the president's political organization to have michael cohen still on ts the case here. so i think we end this day, erin with so many more questions on the stormy daniels. and white house has more questions to answer. we'll see if they do in the coming days. but the president i assume will be asked this because he of course knows if he was involved or knew about this payment in november of 2016 more than anyone else. >> of course. so much reporting done. begs the question for the regular person, why would you pay somebody off and sign a nondisclosure agreement if you didn't do anything. let's take a closer look what stormy daniels is climbing in her lawsuit. outfront. >> did she have a sexual relationship with the president? >> yes. >> stormy daniels says president trump knew about the hush money.

>> there is no question the president knew about it at the time. the idea that the attorney would go off on his own without clients knowledge and eniter into this type of agreement i think is ludicrous. >> they argue that the agreement is null and void because it was not by donald trump. daniels lawyer says mr. trump purposely did not sign the agreement so he could disavow any knowledge of the contract and daniels. >> she believes it's important the public know the truth. >> what it refers to as signed four days before the 2016 election by michael cohen and stephanie clipper, just last month admitted to paying $130,000 from personal funds but insisted that the trump organization or the trump campaign was a transaction and

neither reimbursed me for the payment. the adult film star wanted to share her story in 2016 after this "access hollywood" came up. >> when you are a star they let you do it. >> but the lawsuit said trump and the campaign got wind of stormy daniels plan to reach out to the media and wanted to shut her out. the lawsuit says cohen has continued to shut her up and protect president even as recently as february 27 when cohen filed a bogus arbitration proceeding against daniels. but they said this about this arbitration. the designated judge from the arbitration found that miss clifford had violated the agreement and enjoined her from filing this lawsuit. >> now, stormy daniels attorney has responded to what sarah sanders said at the white house saying that trump won this arbitration. he says, look, we have had no

notice. no hearing. no opportunity for stormy daniels to respond and no decision on the merits and completely bogus. we did look through this nondisclosure agreement and basically inside of it it says if the agreement is violated, that for each violation she could have to pay up to a million dollars in penalties plus pay back the $130,000. now all this information is out there. everybody is wondering what that means and what happens next. >> erin. >> all right. thank you very much. i want to go straight to sarah murphy author of justice for some, and april ryan. paul, when you put all this together, you have this back and forth. you have a nondisclosure agreement. and you have a payment. and a regular person saying why would you have those things if nothing occurred. the payment could be a major violation of federal election law, this is important, what's the bottom line? >> well, the bottom line is this

is the kind of thing that would be fatal to any presidential n candidacy, that would be an enormous story, but the president has said, number one, i didn't know anything about this. he didn't know that his own lawyer paid a porn star $130,000? boy, that's some lawyer. remember, michael cohen the lawyer says he paid it out of his own money. ever meet a lawyer who reached into his pocket to pay $130,000 to help a client? i don't think so. and now if it's a false story, why don't we cross examine stormy daniels go public and let sunshine in. instead they go to an arbitrator who issues an order barring her in saying anything ever going into the future. so if you want to cast a little light on this, why don't we hear

everybody's story. >> which, raises the whole question here, you have this whole arbitration thing. now you have this restraining order which i guess is restraining from saying anything, because it's not as if she's trying to bang down the door of the white house, talking about restraining order for her silence. but you have this whole no peterson, donaldson never signed. >> yeah. well, it's an interesting question that a lot of people disagree about. but i think that it's probably okay for the president not to have actually signed the document and for it to still be enforceable. however, he would have had to give enthe power of attorney to his attorney to do that t and that has to be done with his knowledge and consent and intent. and, remember, cohen keeps saying he knew nothing. so that would be at a minimum

unethical and cohen could lose his license in that's what happened. but, look, it was done to give the president plausible deny ability. but from where i sit it's implausible. no way he could not know. not only about the money, but the campaign finance issue, can i say, it's not plausible that this was not done to benefit the campaign and that people in the campaign were not aware of it. it just would make everybody involved committing some level of malpractice, campaign mall practical, legal malpractice for the people not to know. so $130,000 for silence connected to the obvious purpose of not hurting the campaign on the virtual eve of the election, that's serious problem, because it's way beyond the amount given

legally. and from what i know it wasn't reported which is also campaign requirement. so-so many layers of problems here. >> i say that. >> i personally think that doesn't add up at all. i don't think anyone would know that adds up. also a report out there he was complaining why wasn't he being paid back. all i know is he said he knew nothing about it. april, sarah sanders tried to tap dance around the story. you've experienced this being in that press room. you know, trump himself has been silent on this entire issue, which is very interesting, because when it comes for example to women who have accused him of sex ooh you will assault which he admitted to doing on that infamous grab him by the p video, he's happy to speak out. here he is. >> these vicious claims about me of inappropriate conduct with women are totally and absolutely

could have indeed part of an election crime, that's huge. and it's important. particularly when this is supposed to -- the billy bush tape is supposed to have been the em impetus where we clearly heard him saying grab them by the whatever, and impetus for h speak out, and it's only fair to ask that question and fair for the president to speak to the american public on this. because we heard him saying that. we also, and i'm going back to the christian gillibrand thing saying she would do something for anything. it's not without the realm of possibility, hearing this president talk about porn star allegations and hearing him on the tape. so it would only be feasible for president of the united states to come out and make a statement. and particularly as we see his

wife in pain not wanting to be with him when you hear these allegations. it's just something that doesn't sit well. we have done through this movie before. and it didn't end well. >> here's the thing, paul, obviously this is serious h again, if people watch or the american people don't happen to care about the president's character, it matters because if he knew about the payment, it's a violation of campaign finance law and very serious thing. what's at stake for the president? >> well. >> if someone proves michael cohen didn't do it at the goodness of his heart. if they can prove the president knew about the money. >> huge thing, if it was campaign violation, and trump people say it was not campaign violation. look at the case of $900,000 to

we don't know all the details. in your mind does this rise to the level of witness stampering tampering or not, john? >> pretty close particularly when told by his attorneys not to do it for that reason then he went ahead and did it. that suggests he knows what he was doing and that's why they reported it because they didn't want to get them self in ha obstruction situation. >> which is interesting. juliet, what do ynversation tha president had with key witnesses? again i want to emphasize the crucial point here is that the president talked to them after they talked to the special counsel. s so he wanted to know what they talked about and what they told special investigators? i would take it one step further, not only did president trump talk to them about what they may have said in front of murle mueller, someone had notified him they had taken place, people

are protecting themselves and not go down with the ship. two other key points from the great reporting, one is that john kelly is in the room. which i've been on your show, critic of him, i think he sort of gets away with a lot of things. i think we need to kexamine his role. he was in the room and wanted it to be known he was in the room. and second thing is remind people mueller investigation is not about trump. it is about foreign influence in the 2016 campaign. that it keeps leading to the oval office has nothing to do with mueller and everything to do with the evidence. and so just to remind people this is not about -- did not start off about trump but foreign influence in our elections. >> so, john, let me ask you the point that juliet raises about john kelly. the times does report that john kelly ts chief of staff was present for both of these conversations. don mcgahn and priebus which

means somebody told them that. right. i mean, obviously presumably priebus and mcgahn told somebody. what do you think that means? sounds like he didn't try to stop the president from having these conversations? one thing it certainly means, erin, these people have no sense of history. this is one of the things that got nixon in a whole lot of trouble. he's an attorney. nixon was an attorney. and he was openly coaching witnesses. he was coaching. i'm one of those he tried to coach. chief of staff and talked domestic adviser. coached them. and told them how to handle perjury. he was expert of perjury from his days in the house. so history couldn't be a stronger lesson what a president should do in these situations because he was charged for this in his bill of impeachment. and it's remarkable people would

ignore this history. >> that's a crucial point john makes. on a certain level though i guess you could look at this as a citizen wouldn't be natural to find out what the special counsel talked to someone about, right, that it would be sort of a normal instinct to have that conversation. it sounds like nobody was able to stop the president or at the least stop him. perhaps even counsel him not to do this. >> right. or, look, erin, probably they are counseling him, he doesn't listen. i think you are seeing the consequences of a person, donald trump, who does not accept no or just thinks that the rules don't apply to him. and then the interesting thing about this is as president he may have thought, wow, none of the rules apply to me. i'm president. and in fact he's finding himself actually subject to much more rig v rigorous rule systems because the special counsel exists. and that does sort of make me

times" reporting president trump has talked to key witnesses in the russian investigation about what they had shared with the special counsel with bob mueller's team. and, also, that bob mueller is aware that the president then had these conversations. and we are also learning tonight that cnn that a key trump associate may have misled the house intelligence community a vieder, thvie insider, and trump associate that was there with putin money man prince, brother of the education secretary betsy devos. manu raju is outfront breaking this. why do they believe prince at the very least misled them? >> during this house with the

house intelligence committee last november, prince was questioned about that meeting, whether it was effort back channel between the trump administration and kremlin. he denied. he said he had two pleat ings wh meetings with uae officials and russian banker. met separately with russian banker at a bar had a beer and that was it. didn't talk any policy whatsoever. we heard from nader businessman someone middle east expertise ties and cooperating with robert mueller in russian meddling, also at the meeting with the uae officials. now no where in this testimony, erin, did eric prince reveal that nader was at this meeting. did not mention that at all.

we looked through all 105 pages of publicly released transcript and did not reveal this. and they are saying if he did meet with nader during this meeting then he lied to this committee under oathment and they say this is something they need to investigate further. republicans are not going that far. but prince spokesman telling us tonight, erin, that the public can review testimony himself. that he did meet with some advisers to the uae and others. but when asked specifically did he meet with george nader while he was there, he did not say, declining to comment any further. >> manu, thank you very much. and this breaking news, coming of course as we are following the breaking story also, "the new york times" reporting president trump has spoken to key witnesses and special counsel robert mueller investigation. after he talked to the investigators he called them and wanted to find out what happened. obviously raising questions whether that is improper witness

tampering. outfront on the oversight committees. a lot to talk to you about, congressman. as happens every day, this news moves fast and furious and changes every moment. what is your reaction, first, to the "new york times" report, that the president reached out to key witnesses after they had talked to robert mueller's investigators? >> that report is deeply troubling. the president knows there is an ongoing investigation by special counsel. it is completely improper for him to interrogate witnesses after they have provided testimony to the special counsel. you know, we saw this before in watergate. and richard nixon was accused of perjury. you can't interrogate witnesses and can't counsel them on what they should say next time they are called before the special counsel. this is far beyond in discreet. this is active interference with an ongoing investigation.

>> all right. so you do see it as active interference. >> absolutely. >> i want to turn, if i may, congressman, to the other breaking news at this moment. you heard manu raju reporting that prince, black water founder, who was a trump associate and brother of the education secretary may have misled the house intelligence committee meeting. they are saying prince did not say george nader was atmeeting. also reporting adviser to the trump at some point. nader is now cooperating with mueller investigation. what do you make of this, congressman? >> two problems there with eric prince behavior. one is you tell the truth, the whole truth, and nothing but the truth when you are under oath before a committee in congress, especially intelligence committee that has own separate investigation with foreign interference in our election. prince did not do that.

he didn't tell the whole truth. and that's misleading the committee at best. and could be construed as perjury at worst. the second problem with prince, however, over and above that was his involvement with david nunes, the chairman of the house intelligence committee who had to recuse himself from entire russia investigation of his own committee because he was providing intelligence to the president and the white house on the fly. and mr. prince met with mr. nunes and i thisnk we need to know what transpired in the conversations was nunes counseling you before you testify before the committee. we don't know. but it is another very troubling aspect of mr. prince's behavior. and frankly mr. nunes behavior. >> and we do need more answers to understand this. and i want to be very explicit on george nader, uae adviser who had ties to advisers to trump. so that's his link. i said adviser to the campaign.

go ahead. >> and he's not cooperating with mr. mueller, which means mr. prince will have a witness who will fully explain the nature of that conversation to the special counsel. >> right. and that meeting and of course what the purpose of it was, obviously, in january of 2017, middle of the indian ocean, you have prince and this russian fund adviser close to putin. obviously an important meeting. i want to ask you also, congressman, about the jared kushner. senior adviser and son-in-law. you delivered a letter and asked him for an emergency hearing for kushner security clearance. what was trey response to you? >> i have not heard from him yet. i was giving him thisler and wh this letter and what it was about. as we speak mr. jajared kushner
