it was ultimately not made and the deal fell apart for a while and ultimately was resurrected and the paeyment was made in lae october. this relates to the first date of the payment in mid-october. now, why is this important to reference in the officer? it appears to be rather innocuous when we look at it. if in fact the payment was being made personally by attorney cohen he wouldn't need an office open in order to the payment. >> and she talking about the trump organization office. >> that is the officer he is clearly referring to. if you put it up on the screen he identifies himself as executive vice president and special council to donald j.

suggesting they transferred money to a checking account at first republic. >> so it was sent to his trump organization e-mail account. >> absolutely. he then turns around and forwards that to his personal e-mail account which is the next e-mail in the string above that. >> so that that's been shown on the screen basically says that the money is in the account. >> correct. it is from the bank employee to mr. cohn. >> why would he then feel the need to forward that e-mail to himself to his private address to communicate with stormy daniels? >> i don't have an explain

say cohen set up this arbitration very quickly. you weren't informed. stormy daniels wasn't informed and they got a ruling that you say is invalid. did you not know that michael cohen was doing this har a by - arbitration if. >> first of all the arbitration was brought not in donald trump's name but in the llc name that attorney cohen had set up. the llc did not have the right or the ability and in legal terms it's called standing to proceed with the arbitration. first of all you the wrong party. second of all mr. cohen was

required by the bar rules to of california to be a licensed attorney in california or to have a licensed attorney as what is called local council. he did neither. that's a misdemeanor under the law. >> so he isn't licensed to practice law in california? >> there's nothing indicating that he is. we haven't been able to find any record of him being licensed in california. if he wasn't licensed in california it's a misdemeanor to be practicing law. it's no different if i came to new york or washington d.c. and attempted to practice law. i'm not licensed if those jurisdictions. that's the second problem with the arbitration. >> we have to take a break but i want to ask you that the bank itself, when they received $130,000 that was going to be movered t moved, they raised a red flag. it is a suspicious activity report. again, the question is where did this money come from?

it revealed that cohen used his trump corporate e-mail account during the transaction, something he is very much down playing moments ago. he showed us a new e-mail referring the officer being closed suggesting if he truly was doing this on his own the office being opened or closed would not be relevant. so one of the things i don't think has gotten a lot of attention, and again, our focus is following the money. for full disclosure i should say i met and talked with your client. there was a report when the bank i guess was first national received $130,000. >> first republic. >> first republic. when they got $130,000 the bank it was a suspicious activity report put up.

can you explain why $130,000 would have triggered a suspicious activity report? >> there are treasury regulations that are in place to guard again money laundering and financial crimes. these regulations hold when a bank determines that a particular financial transaction is suspicious they are obligated under the law to prepare and file what is called a suspicious activity report otherwise known as a sar. first republic bank repaired a sar, suspicious activity report, relating to this incident of the $130,000. they transmitted that sar to the financial crimes enforcement. it is a division of the u.s. treasury. we don't know what happened after that point.

very often they will disregard the sars. some times they will investigate them or send them to the fbi for further we don't know what it shows but we know that the president and his appointee control. they could very easily release this sar. if his story is to be believed then release the sar. it is a fairly brief document. it will be very illuminating related to this transaction. if there's nothing to hide release the sar and let the american people see what happened here.

behavior in an agreement without his client's knowledge. i mean he went after you. he said that you clearly allowed your 15 minutesover fame to effect your conclusions. he shoul evacuate the room he is standing in or seek the attention of a doctor. >> i'm a little under the weather but i don't think i need a doctor. second of all i have been fortunate in my career that i think i exhausted my 15 minutes or maybe 15 years ago. separate apart from that, i want to keep it about the facts and keep it about the truth. anderson, quite honestly, i don't care if you're on the left or right or in the middle the american people deserve straight talk, not spin, on this issue. they deserve facts. they deserve the truth. they deserve evidence. this is not complicated.

the questions are simple. did mr. trump know about the negotiation of this agreement? did he know about the payment? did he sign the document? did he facilitate or pay the money or did he have somebody else pay the money and what was that relationship? this could be cleared up very very simply. i don't know why it hasn't been cleared up. release the sar, let the american people decide. >> okay. we'll come back with our panel. we'll be right back.

injunk ifr release. that is one problem. i know the judge who issued this i have a great deal of respect for her. i don't know. that's one of the reasons you don't do these reasons just one side. you need both sides to give a judge the issue. the other problem i think they have got just from a practical standpoint is many of the issues that michael has raised in front of the judge and unless they use a challenge she is one of the smartest and ablist people on the bench and my feeling is that when she sees this and sees what happens she is not going to give a whole lot. i don't worry as much about the committee of misdemeanor of practicing law without a licenseme license. i'm sure he will say -- i won't mention the name. i have a good idea who their local council will be. it is somebody he has used before in other litigation. >> what about negotiating a contract involving a third party

that the third party -- he is claiming the third party doesn't know anything about? >> that is a real problem. i have been in a situation where i have had a client that i have represented multiple times where i have told the client he needs to settle or told the client she needs to settle. they have agreed on a subject blessing after i yell or scream at them or something like that. i cannot imagine -- and i'm not in michael's shoes and i feel his pain he has somebody he worked for. he probably feels like he was doing the right thing. no good deed goes unpunished. in this dacase i don't know if would be more upset at trump or my -- >> does it make sense that a sar would be filed? i don't know what the term is, for $130,000, for something banking at their bank somebody

being transferred from one account to another? >> yes. banks and other firms and institutions are required to do these when there is a certain monetary threshold. it might be $5,000 or $10,000. the point is to allow the treasury department to detect patterns of money flow to allow them to see terrorist organizations a that are not detected here. i think you honed in on the bigger problem here which is if you take michael cohen at his word this contract has three parties that were all supposed to be agreeing to the fundamental terms of it. the best case is exactly what daniels is claiming in her lawsuit, that it may not be a valid contract. if there was no meeting that were supposed to part of it then she may be free to talk. that is best case scenario. as we have heard before you have

potential violations of campaign finance law. john edwards was criminally prosecuted by having a third party pay for his mistress in order to help his campaign. so i don't think that this administration really has a good option no matter which way they turn right now. >> michael, what are your ochgss -- options? what do you do next? >> the window will open to start issues subpoenas and trying to find out the who, what, where, when. part of that process will be a pursuit of determining what the president knew and when he knew it. you have identified it before. that will be critical. >> do you know who you would like to subpoena? >> we do. we are putting together a discovery plan and we'll march

forward. they will be trying to drag us into arbitration, to the proceeding that mark referenced. i too know the arbitrator very well. quite honestly i think they pulled the wool over her eyes. we weren't even able to prevent any evidence or engage with her. in fact we don't even know if they disclosed to her who the true parties were. they may have just disclosed to her the aliases. we don't know what story they may have told her. we don't want to pass judgment on her determination. this is a very important point. they don't want this to take place in the public. they don't want the public to know what transpires in connection with this. they want to do it in arbitration, which is a private proceeding in an office building. it has security. you're in a conference room. people are not allowed in.

irony of this, i mentioned that, you know, it's jones versus clinton which is the authority that michael will have. he will not mention who he is going to put on his deposition list. who is front and center is david den dennison. thai it was decided it would not interfere with discharge of his duties and he was subject to civil process. that's a real problem. he can't escape from that unless he says that i wasn't a party to this. if he says i wasn't a party to this, i didn't do this then michael cohen has got issues. i know he feels like it isn't breaking news but it obviously it. it is no different than jones and clinton. >> are there civil violations?

>> there can be civil and criminal penalties. you know, at the time legal experts debated whether that was an appropriate prosecution to bring. there is precedent and there is essentially, you know, precedent for characterizing this kind of payment as being something to the benefit of the campaign. you know, the president is now facing two different precedents because he has a potential deposition coming up on this and a show down with mueller. and it will not help him challenge that very well either. he has a lot of legal problems coming. >> let me say this as it relates. mark wasn't hanging it out there when he said obviously we will seek to depose the president in

there were plenty of mixed messages. white house pres secretary says deserves all of the credit for what could be a landmark negotiation. still it said north korea had to describe concrete actions to fulfill promises before any meeting could take place.

later white house officials said never mind invitation was accepted. vice president pence chimed in sayi saying north korea should know all of the options are on the table. the president tweeted about it. keeping track of it now from the white house, the president just tweeted what did he say? >> a very busy couple of days. the question still remains on bl the meeting will actually happen. the president said the deal with north korea is very much in the making and will be if completed a very good one for the world. time and place to be determined. so the president trying to close the day or week here saying this meeting he believes will happen. they say by early may some point in may, that's not a lot of time here on what is the biggest diplomatic gamble and certainly

hayden. the white house saying they made no concessions. is it agreeing meeting him in the first place sort of a concession? >> anderson, i think that's a really big deal. it was the first thing i noeltsnoeltticed yesterday. i they made every effort to try to isolate me as a lonely two star so they could make it appear to be a talk between the north koreans and the united states. so they have been driving for dialogue with us, this equality with us, this equivalency with us. i fear that the most powerful image that will come out of this is the president of a real country, ours, standing next to the president of north korea

with him enjoys the legitimacy that our president brings with him. >> is that something that the north korea dpn regime uses to bolster his he jit thlegitimacy? >> absolutely. we want to leverage it. he has 345ed tmade the nuclear a touch stone there. it is about the march to this nuclear reach that they have. so what this is going to appear to be to the north korean people is that they have arrived at their destination and that has caused the american president to make a pilgrimage to talk to their dear and powerful leader. so there are downsides associated with this. i want to be hopeful.

i hope it turns out if this is complicated and we are making seer serious concessions going in. i fear that the wheels will start to fly off and we may make conflict more likely in the long term. anderson, just think now how much both presidents, kim and president trump are invested in this meeting. if the wheels fly off in this meeting, if it ends up in a bad place to what are they going to turn? since it already started they are not going to turn to diplomacy. >> the white house said the president will not have the meeting without concrete and verifiable actions and that the administration is going to verify denuclearization through the intelligence community. north korea has been resisting it for decades. >> that's right. we'll have a problem with

verification for any kind of deal. based on my backedneground and intelligence i would not tell that i could detect cheating. we have a more fundamental problem here. what is the meaning of denuclearization? it means ripping all of the stuff up and tearing the buildings down. i'm convinced that for north koreans it means a long and tourturous process leading to some future in which nuclear weapons will no longer be necessary from their point of view. it is large by because we have given them a peace treaty. largely because we have with drawn our forces. anderson, sad to say, and i really hope i'm wrong, but i don't think we see any significant reduction on the

part of north koreans without changing our equation on the peninsula. >> what's also interesting is there is still unfilled positions in the state department that are key to laying the ground work. no u.s. ambassador to south korea. he was the chief negotiator. >> yes. we are going have to load up the president with an awful lot of knowledge and understanding. he has assumed the rank of chief negotiator because we are starting this at the top. we will want him to be very knowledgeable and very care frl so that he doesn't make a misstep that the north koreans will then exploit. the fact that we have kind of stripped the department of some expertise makes it harder than it would otherwise be. i want to be hopeful but it will be hard.

part of the food-truck series. more breaking news tonight. the nra is suing to block a new gun law signed by florida governor rick scott, saying it prohibits law-biding citizens from exercising their right to keep and bear arms. the new law raises the age to 21 to buy all firearms and adds a three-day waiting period. it also bans the sale of ownership of bump stocks and allows some teachers to be armed in schools. this comes nearly one month of course after 17 students and staffers were killed at stoneman douglas high school. joining me tonight is cameron kasky, a stoneman douglas student, a survivor who pushed for these new gun laws. >> cameron, what's your reaction to governor rick scott signing this legislation today? >> you know, governor scott is trying to look like he's taking a step in the opposite of the direction of the nra, but we know that's not really going to happen.
