9:01 pm
and that client is sean hannity. they also shared an attorney. this did not come out willingly in court. coh cohen's attorney says the client asked not to have his name reve revealed. the name was sean hannity. michael cohen's client that we know of is broidy and the president and sean hannity. here is the way he explain it on his radio show after the news broke that sean hannity is michael cohen's client. >> i have known michael a long, long time and let me be very clear to the media, michael never represented me in any matter. i never retained him in the traditional sense as retaining a lawyer. i never received an invoice from
9:02 pm
michael. i never paid legal fees to michael but i have occasionally had brief discussions with him about legal questions about which i wanted his input and perspective. i assumed that those conversations were attorney/client confidential. >> he seems to be saying i am not really a client of cohen. now regardless of the exact nature of their attorney/client relationship even if it is as hannity says on twitter exclusively about real estate. >> hannity reported as if he had no connection to the story on fox news. >> this is a fox news alert, michael cohen just had his office and home and hotel that he was staying in raided by the fbi early morning. what it means that mueller's witch huaunt investigation is a
9:03 pm
run away train without clear tracks. >> oh yeah this guy also represented me, no mention of that and he passes along legal advices. sean hannity also talks about it on his radio show. >> this opens up an era where it seems that there is no limit at all in to the fishing expedition that mueller has now engaged in and access to everything that his personal attorney has. i can only imagine where it could lead. >> one place it may lead is his own name. >> sean hannity, the media is go crazy about this. not disclosing a business or legal relationship with someone that you report on and had him on your guest at least 16 times since donald trump declared his kidnapp candidacy. that does not sound fair.
9:04 pm
>> shimon prokupecz is joining us. >> the fbi wanted to review it and have an opportunity to discuss about what is privilege and what the government should not have access to. today the judge ordered prosecutors, the government here to turn over and make copies of various documents and some ten boxes. it was revealed today in court, the fbi now has with materials that they seized from michael cohen and electronic devices and hard drives. all of that has to be copied and handed over to michael cohen's attorney. >> well, much like everything else since friday with this
9:05 pm
hearing. it has been a little confusing. since friday, the judge has been saying to michael cohen and his attorneys, tell us who cohen represents. there is always been this blurred line. i think this goes to the argument that prosecutor haves be haves -- they are not people that he represented. sort of a vague and sort of line here that prosecutors say it does not mean that these people are his clients. hannity denied that cohen represented him. should not release who their client was and wound up to be sean hannity and certainly and anderson, i can tell you having being in this courtroom when that happened, it was a stunning moment and i mean the audience and people sitting around the courtroom and the reaction was quite audible and many folks
9:06 pm
were certainly shocked after the judge ordered him to release the name of this client, anderson. >> what's the ruling mean in terms of the investigation moving forward, it seems to be a delay. >> yeah, absolutely. this is a delay and the prosecutors did not want this and they have been arguing since friday that this is a stalled tactic by michael cohen and his attorney and the president's attorneys who have now interv e intervened and also want this materials. this prevents investigators from looking any information or documents that were seized in the raid. the t it is now up to the team that's run by the government that has no access of the information to go over materials that's provided to michael cohen's attorney. in terms of this material that were seized, the investigators would not have access until the judge decides on what they'll look at.
9:07 pm
>> shimon, thank you. we'll get to sean hannity thing in a moment. just of the substance of the hearing. who's happier tonight of michael cohen or donald trump's team or stormy daniels. >> i think it is a miss. their first was let us dsecide what's privilege and what is not. we'll give to the government what we don't think is privilege. the government, what the government wants is the ability for their team to review all the materials and push out anything that is questionable to debate with the lawyers for michael cohen and the president. what michael cohen is saying okay, if you don't give it all to us, appoint a special mass or an independent party. >> instead of the team.
9:08 pm
>> the challenge is, it is clear in a case like this that nothing is attorney/client privile privilege --ps the question is will the judge defer to the government would normally be the case. the issue of the special master becomes with timing and it tends to take longer and puts a little delay. she has not decided yet. >> she has not decide who the special master is. >> she asked to have four names given from each side. that's an indication that she's considering. t the lawyer will present those names. >> a former judge or someone that's a u.s. attorney but someone that's very respective. >> does it take some of the pressure off him to cooperate with the government or special counsel? >> well, you know it may because

it is significant for them to get judicial review and as you have been talking about take longer. i was speaking with the source today, a legal source who's close to this case, look, the reason they got the search warrant in the first place leads you to believe that they are close to something. and, so we don't know what they are looking for was key evidence that they need in order to complete their case against michael cohen or whether it is confirming evidence that they would just have liked. if they were close and they want to secure this evidence as additional evidence then maybe they can go, you know, they can do whatever they wanted to do with michael cohen in the first place without waiting for all of this that they could continue to move. on the other hand, if they felt they needed this evidence to indict, then it will take longer and help michael cohen because
9:10 pm

9:11 pm
can you imagine the folks on fox would held anderson shown up as a client in a situation like this? so, you know, i think it is a sticky, if he's not a client why did he lawyer say he was. it raises all kinds of questions. >> if you are paying somebody and uconn suyou consulted them advise. i don't know what the other stuff would have been. can you automatically say it is privileged? >> well, you can still be a client even if you have not paid the lawyer yet. sometimes you will get advise and you will pay later or sometimes you don't pay. the real question is were you asking for legal advise or guidance. the second piece is sean hannity had this conversation with cohen and somebody else in the room then it is not privilege. if they were talking about committing a crime or engaging
9:12 pm
