press conference, the president was asked whether he'll remove them. this is how his answer began. >> there was no collusion and that's been so found as you know by the house intelligence committee. there is no collusion. >> so that's how he began and went on for a while. keep in mind as long as he keeps on saying that, we'll keep on saying this, the mueller investigation is not over. we don't know what they'll find. the republican control committee saying there was no collusion but the democrats say there was more work to do and chaired by nunez. t and to the president's response of firing rosenstein and mueller? >> they have been saying i am going the get rid of them for the last three or four or five

months? >> they have still here. we twoowant the investigation o with and done with and put it behind us. >> it is true that mueller and rosenstein are still there. that does not answer whether he concluded to fire each of them. as we know fortunes and minds can change in a heartbeat in this white house. this is the second time that the president mentioned the russian investigation surrounding drama. the president was doing a little writing himself or rewriting the reason why he, the president, chose to put the former informer n fbi directdirector. the fbi history was not fired by the way, there was no collusion concept by the dems. you have to admit that one tweet, it scratches the fair amount that the -- and a total different version of events from

what the president have said. we know the president fired james comey because the russian investigation. when i say we know it, we know it as much as anything the president says. we know he said it whether it is true, that's entirely different story. we know he said it and he said it clearly that he fired comey because of the russia investigation. we know he said it because there was a camera there pointing right at him. >> regardless of recommendations, i was going to fire comey knowing there was no good time to do it. in fact, when i decided to just do it, i said to myself, i said -- you noknow, this russia thing with trump/russia is a made up story. it is an excuse by the democrats having lost the election. >> that was may 2017 after he fired comey. today he says he did not fire him because of the investigation. if there is anyone involved in this, we would say it is a

messaging problem, the left hand did not know what the white hand was doing. this is the president contradicting himself. the left hand is lying or betting there is enough people who care about the latest version of what he's saying. it was not what he said to lester holt, the president made it clear why when he met with russian officials in the oval office. he told the russians he had just fired the head of the fbi who he described as crazy and a real nut job and said quote, "i face pressure because of russia that's taken off." that came from a document summarized and red to the new york times. no american reporters were allowed in that meeting and this photos came from a news agency. it comes down to what you believe. do you believe what the president said on national television at the time or what he said to the russian officials the day after he fired comey or what he tweeted this morning. on "the view" today comey was
9:05 pm
asked why he think he was fired. >> i don't know. i took him of his words and i read in the media of what he said to the russians the next day at the oval office, i took him to his word. >> i don't follow him on twitter. both of those things cannot be true. i think it illustrates part of the problem that i am trying to bring up. it matters that the president did not committed to the truth of america's values. >> that brings up another possibility that the president cannot keep his own story straight which is a troubling notion as those who don't remember and care about the truth of their own history or prone to rewrite it. >> joining me now is our cnn national security analyst, matthew rosenberg. the idea that he would just revise that now and the rest of us don't remember it seems kind of incredible?
9:06 pm
>> i mean there is a lot about the trump presidency that seems incredible. we are not two years into the thing yet. what we are seeing here and what we saw in the oval office meeting that you made reference to was unusual friendlyness towards russia. >> we are still seeing it. we saw in the refusal and implementing the round of sanctions. i think you know there is a relationship where we don't fully understand or explainable and the president never fully explained it and comey is caught up on the wrong side of that to a degree. >> we found out from our reporting that the president met with russian officials the day he fired comey and echoed what he said if the interview. >> he said that and he told the russian ambassador and the foreign minister that firing comey would leave a great pressure on him and he called comey a nut job. i don't think the president imagine these comments would get
9:07 pm
out. there was twelve pages typed and taken boo iy a note taker in th room. >> we are in the position when the president has time to think what he's saying, well, i didn't fire comey. he's premeditated about it and he points to hillary and other issues. when he's in a private moment or lashes out then it is i fire comey because of the russia investigation. i don't want it and i want it over and firing him relieved the pressure. it did in the end because now we have robert mueller. i think he thought so at a time. >> it contradicted the day comey was fired. i was on the air that night and a lot of white house folks interviewed kellyanne conway were pushed out of cameras in order to say he was fired because of the way he treated clinton. that was the narrative they were pushing and the president reversed that in that interview
9:08 pm
and what he had said to the u russians. i interviewed a white house official two nights ago who said a whole new reason which i never heard. maybe i just missed it. the white house official the other night says the reason comey was fired because comey leaked information. it seems a whole new reason just kind of suddenly popped up with. >> yes, this white house is not great at staying on message. what we saw the first night when comey was fired that they had agreed on what the message was and there was a unusual of officials and general councils and a lot of people involved in making the decision and shaping how it was going to be presented. >> as trump wants to do, he gets on his own and says what's on his mind which was the russian investigation. >> it is been nearly a year. do you have any sense why he would go down this road again? he wants to respond to comey because he cannot help himself, i guess.
9:09 pm
>> i think the conning russia investigation itself which infuriates him. it is comey out there talking and questioning his honesty and he looks at comey and says i am not going to take that, i am going to fight back. when he's being called out as he sees it. he's going to respond. >> thank you matthew rosenberg. thank you for unionijoining me. joining me you is jeffery toobin. >> the president changes his story of why he fired comey. should he stick to one sto r ry? >> he should not say anything about it. it is obvious was the effort to end the investigation. >> that's okay? >> it is not okay, it is no t illegal.
9:10 pm
i don't think it is a crime because the president does have the authority under a unitary executive theory to tell his attorney general to investigate this but not that. i want you to put aaron burn in jail and i want you to put the nazi in the electric chair. i don't want you to investigate that, it is not illegal today under the law. >> sure is. >> this is a fundamental disagreement that allan and i have that you know all those examples of setting investigative priorities are certainly within the president's power. if the president fires the fbi director to stop him from investiga investigating. that's a corrupt mode and the definition of obstruction. >> so you are saying it matters. >> the intent of the whole story. >> it is the whole thing. you are never going to have the crime where the intent is a whole thing. you have to have an illegal act.
9:11 pm
>> alan -- >> you can't have an act that's constitutional under articles one and two and at the same time is criminal. you must have a legal act. it would under cut the power of the president questioning why he pardon and why he fire? >> once he did it, you cannot question, just like you cannot question the senator and a judge for their vote in the supreme court. >> their laws are full of examples of acts that are otherwise legal. >> not by the president. >> but made illegal by the intent insider trading being a perfect example. >> but, you have said this that the president, you know has this unfair ability to act. what's the authority for that? unitary theory, that's controversy that not everybody agrees with. >> the act is trading, having
9:12 pm
information that you obtained improperly and illegally. >> that's the act. i know they did not impeach clinton and did not impeach nixon and did not try to impeach bush or all of them engaged in acts particularly in bush with the alleged corrupt motive. he pardons all these people in order to end the investigation that's going to lead on him. >> on the last day of office? >> that was the conclusion done by the special prosecutor and nobody suggested and nobody knows his story that president bush committed a crime by engaging a pardon to stop an investigation of himself. >> i want to move to other legal matter which is the michael cohen situation. their team is going to be able to review some of these documents. how difficult is it going to be for the defense to prevent at least good parts of these
9:13 pm
documents used boo i ty the fbi. >> attorney/client privilege is a narrow privilege and it applies to certain communications when there is an actual attorney/client relationship. i think a judge is setting up a sensible system where there will be a review covered and those will be excluded and that's proper. most of these documents will not be excluded. >> you recalled that i made that decision and jeffery said it was a terrible idea. >> i said it was unnecessary but it is not a good idea. >> i still think it is a good idea. >> you will have a judge or somebody assigned by the judge to look through the papers. i hope he's right, let the prosecutor see it all and let them prosecute. if they find communications between a lawyer and a client, that are illegitimate.

more breaking news, the wall street journal came out reporting one of the president's long time advisers warned him that his lawyer cohen would flip on him if he would face charges. >> first of all, can you tell us who is the adviser is and what is he advising the president about cohen? >> jay goldberg is an attorney and he's been a criminal defense lawyer and a prosecutor and he worked with donald trump for many years. he started in the '90s and 2000s, he's an experienced litigator and he told president trump in a call on friday morning that if michael cohen were charged, he says, mop guys when they face prison time, they flipped, anybody that's facing
9:19 pm
the situation is going to flip. michael cohen is certainly, if he's going to be chargede, he's likely to turn on the president and he told president trump to be careful on that. >> what reason is goldberg is citing backing up his claim? > >> cohen is on a scale of 1 through 100 of the trust worthy scale. >> yes, obviously, you speculate based on his own experience and saying that you know cohen is a family man. he's primarily been a lawyer and a businessman. he's not clearly the kind of career criminal that jake has witnessed in his lifetime. he's essentially saying what a guy like this from what i have seen is almost certainly going to flip. >> it sort of backs up what stormy daniels's attorney,
9:20 pm
michael avenatti have been saying. cohen talks a big game and at one point he'll take a bullet for donald trump and would do anything. the bigger somebody talks, the harder they fall. >> was the president receptive to goldberg's advise that he shares his concerns? >> well, i mean -- president trump says michael is very strong and he has confidence in him and cohen as you said have been tweeting and i am never going to abandon the president. but, we know it is been reported that he called michael cohen the same day as he spoke to james goldberg on friday, it is not clear of the timing if he got off the phone and called cohen after that because he did speak to goldberg in the morning but he did thank him and did give a lot of feedback. i think michael is a strong guy. >> it would be interesting to know the timing if he called
9:21 pm
cohen after talking to goldberg. he talked to your news and my colleague also talked to him and she will join me in a minute. is there any reason that the goldberg had some preexisting beef with cohen? >> no, not at all. he does not have any acrimony with him. we spoke with him this morning, i think he probably wants to make sure that what he's saying is heard loud and clear and if michael cohen calls you or tries to visit you, just be careful he's not wearing a recorder device. i think that's his motivation. >> michael rothfeld. >> thank you for your reporting. >> joining us now. gloria, i know you called jay as soon as the story broke, what
9:22 pm
did he tell you? >> let me give you a little context of jay goldberg and donald trump. jay negotiated both of donald trump's divorces from marla and ivana. they go back a long way. the president does call him from time to time and last friday morning, he was sort of surprise to get this phone call from the president and he flat out saying i know you are close to michael cohen but let me tell you this guy is going to end up cooperating with the prosecutors. anybody that's facing 30 years never stands up without a person facing prison term cooperates. he also warned him that he may also wear a wire and he said to the president do not speak to the special counsel. they can jam you up even if you are telling the truth.
9:23 pm
the president has you know a long standing relationship with jay goldberg and my belief is in his mid-80s. when i asked him what the president say so you, he said he was quiet and not much of a response at all. >> the idea of michael cohen wearing a wire is stunning. he did go have dinner at mar-a-lago two weekends ago if it is correct. was it clooear that goldberg advising the president to remain contact with the president and be careful and watch what you said. >> if it is up to goldberg, the president would not have any conversations with cohen. and he knows and by the way, goldberg knows cohen a little bit. he made the case to me that you know he had nothing against
9:24 pm
cohen but the president have always been his client. he also recommended a lawyer that he thought perhaps should join the president's legal team. he would not tell me who that was. it is from a large firm. and i think that he -- it is interesting to me quite honestly that the president is reaching back to speak with a lawyer that he's known for decades and decades to fill him out on this because he clearly has a comfort level with jay goldberg. >> david, michael cohen, always positions himself as the most loyalest and he'll take a bullet and anything. at least one of the president's allies publicly advising him, be weary of him because everybody flips. >> i am glad you raised with gloria of the mar-a-lago dinner. in watching the cohen/trump

relationship in this period of time is watching for any cracks in it and so far we have not seen any cracks, you are right. michael cochen is saying i will jump off a building for him and inviting him to have dinner in public view. while the swirl of stormy daniels and all the questions that's still around him and you are looking to see are there going to be any cracks and now you have an old colleague, lawyer and confidante of donald trump and calling him up and trying to crack the relationship. i think we continue to watch if they'll participate in any separation. >> the idea of cohen wearing a wire, is that possible given the secret service screens people coming into contact with if president. >> i highly doubt it. the advice of this old friend of
9:26 pm
president trump is trying to get across is you don't know what he's going to do and face the real threat of a prison term. gloria mentioned that he's calling somebody who he had a relationship for many, many years and who's currently advising him, this speaks to how really nervous the president is and in some ways feel that he has not been served by his team of lawyers he has in the white house and all of these matters. he's got the mueller investigation that he's dealing with now and the raid that has not opened more doors of legal complications for him. he's sort of reverting that to the team of people he had around him for so many decades because he feels that he's no t protected. we know this president wants to be insulated in some way. there is so many avenues that this raid has now opened for him and he's worried about the consequences of that. >> gloria, the elephant in the room is prs pekt ospect of pard.
9:27 pm
>> anyone thinking of flipping on the president. again, whether the president is willing the risk the blow back. frankly, i am not sure among his supporters would be any blow back. >> i asked jay goldberg whether or not the question of pardon came up and he sort of changed the subject. i am not sure if there is a miscommunication or not. it seems to me like it did not come up in this particular conversation. i think what you had was an old friend who did trump's divorces, trump did very well. >> did his divorces and been in touch with him and it is friends with his wife also. i was told he called and the wife answered and taunglked wit the president for five minutes or so and he says you are doing
9:28 pm
dprae great. they had the conversation and to julie's point, the president wants to hear from people he feels that they have his best interest at heart. because he has known them for decade >> he thinks cohen is one of those peoples that's a role that cohen has played. cohen is not just close, anders anderson. michael cohen of the entire relationship is in charge of the weak spots of donald trump or the potential pitch falls. that's -- he's so lawndaoyal. i believe the president may have said that to jay goldberg in one way or another. >> he was generally quiet and listening to this advise.
9:29 pm
>> i think it must be hard for the president to hear that to be honest. >> if michael cohen does flip, would it just be the president who -- he's been at the eppie center at an awful a lot of conversations and deals and rush geemt. who knows what else and what other source of tactivities tha he may be pointing a finger at the other people. >> that's true. >> the point is that, you know the president and his legal team and cohen and his legal team don't know exactly what the prosecutors now have. that was part of what was behind this dispute in court the other day. they really need to know what the prosecutors are working with before they know they can responds. >> that was part of this conversation as they are trying

to divide the tragedy to figure out what to do. you are right, it could be broader than we are imagining now >> do we know who kept michael cohen out of the white house, from working at the white house? >> that's a good question. i premium tsume the president d his family did. i have been told by a source close to michael cohen that michael did not want to go in the white house. he felt he can serve the president better by remaining outside the warehouse. >> of course, he wanted to go serve in the white house. he's a political person and adam by the way, he did want to go in. >> you will hear it sort of both ways but i think the decision was made that it would not be the best thing for the president. thank you, more breaking news. he reiterated his claim, that no
