and a crack in the supreme court nomination strategy. senate leaders say no, but the white house said they are open to a second brett kavanaugh accuser delivering testimony. judge kavanaugh tries to quiet any talk he will bow out. they call it ra democratic congame. >> we never had charges like this. charges come up from 36 years ago that are totally unsubstantiated. watching this as the president of a great country, you must say how is this possible? 36 years ago? nobody ever knew about it or heard about it and now a new charge comes up and she said it may not be him and there were gaps and she was totally inebriated and all messed up and doesn't know if it was him, but it might have been him. oh, gee, let's not make him a supreme court judge because of that.

>> i would say right now it's more of the former with the latter a possibility. it underscores a possibility that people are looking past at this moment. senate republican leaders as hard as they have gone on to the offensive in the wake of the new yorker allegations which they refer to as a smear does not have the votes to confirm brett kavanaugh on the floor. he fully plans on having a floor vote and yes, authorities a possibility the judiciary committee could vote as soon as friday, but they don't have 50 or 51 at this point. when you hear things like this, you recognize what i heard is expressed between rank and file members over the course of the last day or two. frustration. they are unsettled and think more allegations will come out whether they are true or not and don't like to be in this position and they feel like they don't have enough information and most importantly many senators who have said they support brett kavanaugh's

that powered mitch mcconnell and the white house to move forward with the nomination. they need 50 votes and they don't have it. >> the rallying is not going to get brett kavanaugh where he needs to be with the confirmation vote. as we saw with lisa murkowski, it's not enough for her to hear what he has to say and believe him. that has been the position of lindsey graham and others to come forward and say if this is all there is, we should go to a vote. that's not her position and it doesn't seem to be susan collins's position at this point. they want to hear from the accusers and that makes thursday's hearing unpredictable in terms of how it might change the game. they have heard what brett kavanaugh has to say. what really matters is what the accuser has to say and whether they find her credible. how she is perceived by the republican senators. >> you say accuser. that would be christine blasey

democrats in red states where it's risk tow vote against him. now there is a permission structure being built up on the other side that you can point to this and say i'm uneasy. >> i want to come back to that. it's important we do the vote math. this is from deborah ramirez whose attorney said we are in contact to determine the best process to provide information. we remain adamant that this is the only way to get the truth. as of now, the president has to pick up the phone or the majority leader said we want to do it on behalf of the u.s. senate. those are not happening. are republicans comfortable with saying we believe kavanaugh and we are not going to listen. even if it is unsubstantiate and a conjob and conflicting accounts, that they are not going to listen.

years. it's not in democrats' blood to play that game, but another story is brett kavanaugh used television to his advantage last night. a big question mark is what could she do? if they don't have the facts on the ground when they take the vote. she could do a television interview and harm him later. there is benefit to the republicans of knowing what the stories are and not having unknowns later and harm him down the line. >> a lot of republicans would tell you that, but the leaders want the vote as soon as possible and continue the conversation. a vote to confirm brett kavanaugh could come down to just one or two key senators. oh!

are not ready to vote. bob corker questioned the more recent allegations against judge kavanaugh. >> i read the new yorker article and it's pretty thin. no one else remembered any of it. this is getting carried away in my -- it's feeling like a circus. i will look at this open mindedly on thursday. again, i go into it with positive. >> if priority one is held before republicans, make sure no other republicans waiver or crack, but corker sounds like he is with leader mcconnell. where are the other three? >> if you lose two, the red state democrats have all the political dynamics and the permission they need to vote no. they are waiting to see where the republicans come down. it will be collins and murkowski and flake is a key vote on the senate judiciary committee. it's critical to hold these members. mcconnell has shifted messaging

it sounds like from her remarks, obviously the substantive issue she had been grappling with is what he would do on roe v. wade and the other precedents she cares very much about. it sounds like she doesn't believe that's as much of an issue before. most of the way to confirm him. leaving open the possibility that she can hear dr. ford and this other woman now. that came up since that interview, ms. ramirez, and change her mind. that's a very real possibility. the risk here is not only that they need more red state democrats to get him across the finish line. if you have republicans like susan collins and lisa murkowski, the red state democrats will not want to be the deciding votes. >> if they crack you will lose the democrats. if they stay, they have the

tougher choice not just in the kavanaugh context. >> i don't know if they are not there yet or they just want to hear from this person and can't commit ahead of time to saying how they are going to vote. i did not hear continents in that comment on the floor. i heard the voice of a majority leader who thinks every day is syphoning off support of the nominee. the need for speed and move ahead and not to call the other potential witnesses. that's not -- i don't think that was competence. >> to that point, the majority leader is starring to double count and triple check and you get the voices of rush limbaugh, saying don't blink. >> for the republicans do not get this vote and kavanaugh confirmed, you can kiss the mid-terms goodbye and holding the house and you can kiss holding the senate. whatever the democrats think of their base, the one thing i know

is that if you guys fold on this and cave and keep bending over backwards, you have done that enough. if you guys don't conduct this vote in compliance of all this and avenatti gets one foot in the door to tell his story, you can kiss goodbye republican chances in the mid-terms in november. >> pretty honest. this is about power. the description from rush limbaugh. at the minimum, an accomplished person who has a credible allegation. they deserve to be heard and treated fairly, but rush limbaugh is talking about this. you will lose power. >> this is what the dilemma is. it's not a matter of yes, they need moderate swing voters and suburban women who are bleeding support for kavanaugh. including a fox news poll down significantly overall. especially among women.

republicans worry the voters are not going to turn out if they don't get the nominee through. if i that are not able to get a conservative judge and republican senate, why would they show up? that's the question they are asking when the promise is yes, we want a judge who will overturn roe vs. wade. >> the big difference between mcconnell's statements last week, we are going to ram this through, that was before we knew that dr. ford was going to testify. i think a big part was trying to have some effect that she wouldn't. the best chance of getting kavanaugh through is she wouldn't come forward and now she is. it comes down to what she said and how she appears. a lot of these senators are waiting for this to somehow bail them out. somehow to be so decisive that the decision does become clear. mcconnell is going to come on thursday and mcconnell's tone changed. that was the biggest question mark. the biggest chip they had on their side. >> a remarkable 48 hours.

predator. jean casarez is following the story. what does it mean for cosby and when do we get the details about the sentencing? >> reporter: well, what this means for cosby is a lot. first of all, that he will have to be a lifetime registrar of the offender list. number two, that he will be required to take courses and also to seek help, whether he is in prison or if he is on the outside for this personality disorder. number three, that the community is notified that a sexually violent predator, bill cosby is amongst them. when will we hear the sentence? in about an hour at 1:30. we know exactly what the state and the defense wants the common wealth. they are asking for state prison for bill cosby. they said there are geriatric facilities in every state. a medical unit, particularly at one that aides should not hamper this. they are asking for the maximum

sentence of 10 years. the range is 5 to 10 years, meaning five years before he could ever go before a parole board, but they are asking for special consideration. they want bill cosby to have to take a psychological assessment in prison. something he did not do, chose not to do after his conviction with the state. he then wants a requirement that bill cosby must comply with the requirements from that assessment before he would ever be released to the public. the defense saying home confi confineme confinement. he is 81 years old and blind. there is not a risk at this point that he will ever reoffend again. john? >> the sentencing continues. let's bring in our expert. bill cosby designated a sexually violent predator and the hard

line in pushing for the penalty. put that legal significance. >> we know that the team has been pursuing this argument that because of his age and because of his illness that he should not serve jail time. the prosecution has been pushing back and saying just because he is old and allegedly blind, he shouldn't get a pass. this shouldn't be celebrity just as we we heard it described. these are very serious allegations. he was convicted on three very serious counts and he should not get a pass. he should serve the maximum prison time. thing that happened is cosby did not take the witness stand and ask for forgiveness or express remorse or apologize. his legal team made a strategic move. we know they are appealing and filed an appeal with respect to the trial and the convictions. some lawyers take the position

might see him lash out in other ways on other issues and on twitter. to be laughed at will be the most memorable take away in this speech. >> he said previously before he came on the scene, we were laughed at and the united states was such a laughingstock. the justification for so many of the anti-globalism policies that we tried to implement or talk about is we were being laughed at before we were taken advantage of. now we take things in our own hands and not being laughed at. when in fact they were laughing and this is not an audience that is used to this bluster from him. supporters certainly are. we have seen that it's having repercussions. i wouldn't be surprised if that was a kavanaugh situation. he doesn't like to be in the position where people are ridiculing him. >> for may not may not be connected, but he is tweeting

allies praising his un speech. >> when you get to the familiar has familiar grievances, what has change and what is it he likes to talk about. >> this is a dramatic change. he is reshaping iran on the fly saying that despite their requests, he turned out and offers to meet with the iranian president. that is being reshape and he talked about the sanctions coming into play that will be important to see in november. when he talks about reshaping, that was last year. we are not sure we have seen steps on that. when he talks about pairing back to un peace keeping expenses. that is not particularly new. some of these things seem dramatic in the moment.

more seats moving towards the blue. look at the beginning of the year. 175 solid seats at the beginning of the year with our new rankings 153. you sense what's happened. since january happening again as we get closer to the election. the climate moving towards the democrats, making it more likely with seats is in play to take back the house. what's moving right now? all of these seats moving to the democrats. from toss up to lean democrat. lean republican to toss up. improving the battlefield with more pieces of the basket where democrats pick up the 23 they need to pin. all republican-held seats from likely to lean in these cases and solid to likely there. only one seat, florida 27 goes from lean democrat to toss up. the climate is improving for the democrats and you have the president saying do not be complacent.
