around the united states. cnn starts right now. ♪ at 5:00 a.m. on the east coast, a controversial candidate is likely to pass from the senate to the high court. protests after alligations of sexual violence admitted against christine blasey ford when the two were in high school. in the meantime, democratic senators have been debating through the night. 501:00 in washington d.c. and democrats on the floor in opposition to kavanaugh's confirmation. their efforts likely will not change the outcome. republicans have enough votes to reach the 50 vote thresh hold. cnn has the very latest from

but senator lisa murkowski quietly voted no. she said it was the most difficult evaluation she had to make saying he's not the right man for the court at this time. now after her speech susan collins told reporters she struggled with this decision even as she went point by point defending brett kavanaugh's record and all the alligations, even questioning whether christine blasey ford, one of kavanaugh's accusers was being used by democrats to derail the nomination. and joe mansion, i asked if he believed christine blasey ford's account and he said he did. but he's not sure it's brett kavanaugh who sexually assaulted her. and he also thinks the fbi investigation was thorough from what he's seen, siding with the republican argument but now the question is how much back lash will those two receive at home?

international politics live for us in our london bureau. this is certainly a big win for president trump who promised to reshape the corts in a more conservative manner. what does the addition of brett kavanaugh mean for the supreme court? >> first all of it means the last two republican presidents who had lost the popular vote as george w. bush and donald trump are now responsible for appointing four of the supreme court justices and what it means is you have a conservative majority. and i think we can look fortwoord a large number of cases coming up to the supreme court which are going to be really toward the right, which is going to effectively free up, if you like, market principals, corporate power and so on and probably diminish welfare rights and workers rights more broadly. and maybe even a challenge to

roe versus wade and the issue of abortion politics as well. i think what we've got is an upswing in the most ultraconservative court in probably 80 or 100 years. >> we also heard from senator lisa murkowski focusing on the process that played out in front of the world. here's the criticism she had of it. >> i hope and i pray that we don't find ourselves in a situation again. but i'm worried. i'm really worried that this becomes the new normal. where we find new and even more creative ways to tear one another down. that good people are just going to say forget it. it's not worth it. >> the concern that she raised,

>> i think that will be thoroughly considered. but probably would be very poor strategy especially after the way in which the opinion polls have shown the direction of movement with regard to the kavanaugh nomination, the fac is that when you steer president trump who has an ambiguous relationship with the law itself, saying you're innocent until proven guilty and there should be due process in the rule of law and who's getting support, then you've lost the momentum, you've lost the high ground and that's what the democrats did at that particular time. any kind of idea about impeachment could thereby galvanize them further behind trump than they would otherwise be. >> live for us in our london bureau. thank you. >> thank you very much.

traumatic event that occurred to them and they can rrm the perpetrator of that traumatic event. so i don't think how they can speak about believing dr. ford but dismissing her credible testimony about who attacked her when she was 15 years old. >> and given the testimony of brett kavanaugh at that hearing, there are questions about whether he can be above politics. we're hearing about the umportance on the high court of impartialiality. >> part of the court's legit maesz depends on people not seeing the court that people see the rest of the governing structures of this country now. in other words think of the court as not politically divided, as not an extension of politics, but instead somehow above the fray. >> kavanaugh just the other day

confirmation hearing he himself said he no longer believed that kavanaugh could serve in the position as a united states supreme court justice. the statements he made demonstrated an inability to be impartial, to be an unbiassed arbter and raised questions about his temperament. that's one of the most important aspects of a judicial officer is his ability to be compozed, to not lose his temper and what we saw was a very angry, belligerent judge kavanaugh during that last hearing. >> look, at this point, fwifben what we've heard fromsonter collins, mangsz and flake, kavanaugh has the votes to be confirmed. what are some of the cases he could have the greatest impact should he be confirmed? >> one of the things i'm particularly concerned about are the issues of civil rights, george.

they may end up at the supreme court. those coss are often brought by political parties. they're brought by tms. so if judge kavanaugh believed this allegation brought by dr. ford was somehow orc strauted or engineered by democratic operative said, how can he be unbiassed in a jerry manderinging case brought by a democratic party e? say in north carolina? so i think there are cases like that where it really begs the question as to whether he can even sit as a judge in those cases. and district courts and no one can tale supreme court justice that he or she must recuse himself or herself. that's a decision they make on their own without oversight or supervision from anyone else. if those cases come before him
