i'll see you back here tomorrow night. ac 360 starts right now. good evening. we begin keeping them honest over claims about the florida election. the election that's not quite over yet and the push by some of the candidates and the president to wrap things up. >> we have gone through an election. let's get it finished. let's get this election finished. >> that's florida governor rick scott who is running for the senate and happens to be narrowly leading in the vote count. he's saying and i'm kwoequoting there may be rampant fraud in palm beach and broward county. he's been suing in court to get the counmachine impounded. his opponent is going to court on wednesday and several democratic groups filed suit today to make absentee ballots postmarked but not received

eligible to be counted. the league of women voters filed suit to bar scott from any role in the ballot count. clearly each side is doing what it can to improve its chances and there's also a risk that any democrat process that drags out too long will erode trust in the outcome or process. keeping them honest is not what's happening. politicians are using allegations of frauds and misconduct to try to move the finish line up. governor scott is doing it and so is president trump. the florida election should be called in favor of rick scott and rick desantis. an honest vote count is no longer possible. ballots massively infected must go with election night. he says we must go with election night. that tweet was at 8:45 a.m. this morning which is interesting because just two hours later at 10:45 a.m. the republican national committee sent out a fund raising e-mail under the

president's name and it reads please make an immediate triple match contribution to fully fund our grass roots recount fund. the rnc is saying send money for the recount that the president says he wants to end right now. in any case, that's not how things work in florida. on election night none of the overseas ballots, many from service members had been counted. the deadline for them is this friday. on lelection night no one but t pundits called races. they do not certify weeks and sometimes months. the vote counting alone in 2014 and '16, it went on for days. it's not stopping the governor or president trump for alleging wrong doing. what they are not doing is backing up their claims? >> do you have any hard evidence that there was fraud or is fraud going on and if so by whom? >> we have specific election

laws to try to prevent fraud. we had to go to court to force t them to comply with the law which is law is there to prevent fraud. they were not letting party officials review when they were reviewing ballots. >> you heard the focus on heavily democratic broward county. the counties chief judge turned down the governor's request to impound voting machines. he said i'm urging because of the highly public nature of the race to ramp down the rhetoric. if someone in the lawsuit or someone in his county has evidence of voter fraud they should report it to local law enforcement. state officials have denied there's evidence of fraud in broward county or elsewhere in the state. as for any complaints the president may have, it may be worth looking back at hold upw viewed the process when he was a candidate. here he is just a few weeks before the 2016 election.

>> i would like to promise and pledge to all of my voters and supporters and to all of the people of the united states that i will totally accept the results of this great and historic presidential election if i win. >> well, let's get the latest now from the white house. to be clear, has the white house provided any evidence to back up the president's claims of criminal basactivity or voter fraud? >> there's been zero evidence. there's been nothing beyond what the president has been sending out in bits and spurts. he started the morning doing that. zero evidence if here at the white house. zero evidence from the republican national committee which also was responsible for sending out that fund raising

solicitation with the line tai s -- that says stolen. what happens in florida is something that happens in a tight election. it's because of the 2000 recount there are laws there's a mandatory recount happening. this is certainly sloppy and messy but it's what the state law requires. the president making all these assertions. there are few republicans joining him in that argument. as of tonight, zero evidence of any of that. >> obviously this is not the first time the president has cried voter fraud with no evidence to back it up. he had the whole commission which was disbanded without showing anything. >> shortly after he was elected he said he would have won the popular vote which he lost by nearly three million votes. he said he would have won if there wasn't rampant voter fraud in california.

no evidence of that at all. officials saying there's no evidence of that. he said that massachusetts voters were going up into new hampshire voting. no evidence of that either. it's become a conspiracy theory. he was talking about the arizona senate race. he said it was rigged and bad things were happening there. the republican governor in that state said no, no. that did not happen. tonight we're seeing the outcome of that race. as of now the president fixated on this. there's been zero evidence presented by him or anyone here of anything wrong happening in those states. >> no evidence. thank you. more now on exactly how the state of florida will get from where we are today, right now, to where they hope to be in january with the swearing in of a governor and senator. ryan nobles joins us from where some of the ballots being recounted. you're in florida. so far has there been any evidence of fraud that's been

claimed? >> no. there's no direct evidence of fraud at this point. republicans are pointing to a series of events that took place where they say that could open the door to fraud taking place. for instance, they falled a lawsuit against the election supervisor in broward and palm beach county. they were declared to be unconstitutional because they weren't enough before they filed their returns on saturday. they are also pointing to fact there was a small number of ballots counted after the noon deadline on saturday. there are examples of the election commissioners and the supervisors in some of these counties not adhering to the law in its full capacity but most of this being adjudicated in a court of law that will decide how this impacts the overall vote. is that is not the bridge you would get to if you want to accuse of frauds or criminal

activity. there's the florida department of law enforcement and the secretary of state who is a republican appointed by governor rick scott who have said explicitly they found no evidence of criminal activity. >> this new lawsuit asking governor scott to recuse himself from the recount process, that's one of many lawsuits filed over this. >> yeah. that's right. that lawsuit could be important. it could have implications beyond 2018. right now it's the governor who is responsible for the administration of elections through the secretary of state that he appoints. also the big lawsuit is the one that's scheduled to be heard on wednesday here in tallahassee. that's a lawsuit filed by the nelson campaign against the secretary of state that really get s into the adjudication of these mail in ballots. these ballots that are tossed out because they have some sort of problem and don't directly add here to florida law. the lead lawyer on the democratic side believes the florida laws violate the u.s. constitution.

he believes that many of these ballots should be brought back into the counting process. that could be bill nelson's last hope. he need to make it clear if he were able to overcome rick scott in this recount, it could be unprecedented in american history. there's never been a vote total of this margin more than 12,000 votes that's been successful. if this batch of ballots that will be discussed in this court hearing are brought into the vote total, that could change the conversation quite a bit. we should point out we don't know how many ballots could be at stake. it could be 20,000 and 100,000. we should get the answers wednesday. >> you raise an important point. in recounts, you're talking about there's a couple hundred vote difference which is obviously not the case here. you're talking about thousands of votes difference. the likelihood is unless there's a massive, some sort of massive mistake or massive number of

ballots that haven't been properly counted that it won't change the outcome given the margin right now. >> that's exactly right. honestly, when you talk to republicans and democrats privately, they are very clear eyed about that prospect. there still needs to be some sort of massive issue with this vote counting process that we have yet to uncover. there's the possibility in a broward county where there was a certain number of under votes and over votes that weren't attributed to the senate race. perhaps that will be uncovered in the recount process. at this point, we need to make it clear, if this thing changes, it would be something that's never happened. >> the deadlines are when? >> thursday will be the machine count recount deadline. they will then take a second look at the numbers.

if it's within a quarter of a percentage point that's when they begin a hand recount of those over votes and under votes. it's likely that only the agriculture commission race that is at stake here and the senate race will meet the standard when the recount is completed on thursday. >> all right. thanks very much. do you expect the counties to make the deadline? >> i know they are working around the clock. there are calculations being done all around the country. in every other location they are being carried out pursuant to law without interference of candidates in this case.

tothd he g today he got a stinging rebuke when the judge said you can't use your state police to seize these voting machines in the middle of the recount process. we have to let this play out. there's a statute that requires it. the efforts by whether it's the president or the governor, senator rubio or others to question this really undermine the people's belief or confidence in our democracy. that has long term damaging implicatio implications. they are doing it because they are worried. he's worried he might lose because he's seen his lead shrink by close to 80%. >> broward county does seem to have problems that other counties in florida don't have. why is that?

>> in fact, the problem that exist in broward county in the spring with destruction of some ballots after the election, long after the election prompted the governor to send inspectors down here. he vowed at the time to do it. there are monitors who have been monitoring what's happen ing in broward county throughout this election and the days after. they have seen no evidence of fraud. the florida department of law enforcement have seen no evidence of fraud. there is absolutely nothing to these assertions other than the conspiracy theories that the president, particularly when it comes to leks thelections that president likes to spend. vladmir putin and the russians, when they interfere they do it to try to cause unrest. to try to make people uncomfortable with the democratic process. that's the results that we're seeing here because of these out

rageo outrageous assertions by the president of the united states and the governor of florida. >> she tweeted she failed to comply with florida law on multiple accounts and called for her removal from office. should she be removed? do you agree with the governor? >> our current governor had that opportunity. he was concerned in the spring which is why he appointed these monitors to come down and monitor this election. it's interesting that this is a job appointed supervisor of election. our governor, throughout his entire tenure has gone out of his way to try to suppress the vote, to pass laws that reduce the early voting sites, that reduce the ability for people to vote early, make it harder to register voters and he tried to purge 200,000 voters from the

rolls. that's what the governor has done here. he's had every opportunity to look at the supervisors. he's been focused on trying to make it harder for people to vote you need to let the voters vote and count the valid votes. >> do you have confidence in this supervisor? >> listen, i want to get through this election. there will be an opportunity to talk about what went right and what went wrong. what i refuse to do is allow the governor and the president to use what's happening now, which is a recount per suursuant to fa law and suggest there's fraud that doesn't exist. there's been challenges in this officer but we have to focus on doing this recount and we can live with whoever wins the election. what we're really uncomfortable with is the effort the governor and the president and senator rubio and others have gone through to try to stand in the way of counting every vote.

>> i appreciate your time. thank you. a major development in the other big outstanding contest. the arizona senate race between krysten sinema and martha mcsally. what did mcsally say? >> she tweeted out congratulations to krysten sinema. this was a long, hard fought campaign by both of these women. mcsally ahead on election night and tonight admitting she had lost. here is what she tweeted out. >> i just called krysten sinema and congratulated her on becoming america's -- arizona first female senator. i wish her the best. i want to say thank you to everybody who voted to me. i'm so thankful to you. we wish we came out with a different result.

i'm so thankful for you. as i traveled around the state i was so inspired by the many people that i met. i'm convinced arizona is the best state in the country and our best days are still yet to come. i'm going to continue to pray for our success. thank you so much. >> a light hearted touch there with her dog boomer next to her. she's traveled with that dog and voted on the same day with her dog. this is a light hearted end to what's been a very ugly race in arizona. >> this is state that president trump won by three and a half points. how did sinema pull it off? >> she made sure she sold a message of moderation. martha mcsally tried to paint her as too progressive. sinema ran a disciplined campaign. focusing on health care and a message for arizona. trying not to sling any mud. that's something she let martha mcsally do.

mcsally ran to trump and in effect that's what did not work here. in suburban phoenix we talked to many women who said they simply did not like the rhetoric coming from the white house and they wanted to punish the republicans by voting against mcsally. i spoke with a lifelong republican and she told me that she simply was turned off by trump. she didn't care that mcsally was a woman. she didn't care she could make history here. she wanted mcsally to pay for trump. breaking news in the russia investigation, a conversation with one congressman who will be out in front of many investigations. later we'll take you to the california fire lines and talk to a firefighter who has been reacting to what the president has been tweets iing. that robert mueller pre-election quiet period is over. his lawyer declined comment. so do spokesman for the special counsel. the role centers on the possibility he served as an intermediary between roger stone and wikileaks. he believes he will be indicted for some form or other of giving false information to the special counsel or to one of the other grand jury or however they want to do the indictment. joining us now someone who may be investigating all of this further when the new congress comes, jerry nadler. thanks for being with us. the fact that roger stone hasn't been contacted by mueller's team, does that tell you something? >> people know more than i do about this thing. it's indicated he may be a target. it may be because you're a

target and they expect perhaps to indict you. >> we're told they have been asking a lot of questions about roger stone and his associates. i want to read you something that acting attorney general said. he said he's fully committed to following all appropriate processes and procedures of the department of justice including consulting with senior ethics officials on his oversight responsibilities and matters that may warrant recusals. he says he will accept any recommendations. it doesn't say he will accept their recommendations. >> he's not going to recuse himself. he should because he's prejudged the issue. he said there's no russian interference in 2016 election. he said the investigation by special counsel is a witch hunt. he said it should be stifled by a lack of funding. all of these things he's said. he's hardly the appropriate person to supervise a fair investigation.

he's clearly, remember, the president's beef with attorney general sessions was not on any policy matter. it's he recused himself upon advice of the ethics people of the justice department. >> sessions probably executed the president more than any members of his cabinet. >> absolutely. the two saw eye to eye on policy except he did the right thing. he recused himself and the president couldn't forgive him and said so. the president was not going to appoint someone he thought would recuse himself. i assume he got some indication that whittaker would not recuse himself. whittaker is unfit to supervise this since he did prejudge the out come and he's a partisan on this. >> the president said he knows matt whittaker and a great guy. then just a couple of days ago he said he doesn't know him. >> that shouldn't be surprising. the president lies all the time. we know that.

he has a pattern of distancing himself from people whether it's michael cohen or other people he's been close to. paul manafort by saying i wasn't close to them when he was. >> there's been a lot of talk from incoming chairs about various ways they hope to investigate president trump. is there a danger in focusing too much on that. are you concerned that democrats will over step? >> i think democrats will be very disciplined. we have priorities. the first priority is to protect the investigation because the investigation is necessary to protect the integrity of our elections. >> how you do that? there's not a lot of appetite on the republican side. >> we can protect it. the first thing in january we'll call mr. whittaker as a witness. we have asked -- we have sent letters asking for document

retention that all documents be retain retained. it will be a criminal matter to destroy them. the first priority is to protect the mueller investigation. we have a lot of other priorities too. we have to enact legislation to deal with voter suppression. we have to deal with the dreamers. we have to have an investigation into how it came about that the united states could tear mothers -- tear children out of arms of their mothers at the border and still have several hundred kids not been reunited. we have to do something about gun control. we have massacre, mass shooting every two weeks in this country. we're told by the nra and others it's a mental health problem. if you look at europe or japan, nobody has more than 150, 170 guys a year. we have 33,000. we're now 10,000 times more mentally ill as the people in japan or europe. that's a sugar landlander on thn

people. >> what about impeachment proceedings? >> that's far down the road. we can't make judgments on that until you see what the mueller i vest ga -- investigation comes up if there's grounds to do that. most of us think that president trump is about as horrible a president as he can imagine but that doesn't mean he should be impeached. you have to show impeachable offenses have been committed. you have to show they rose to the gravity where it threatens the integrity of republican and democratic institutions and threatens the safety of a democratic society. you don't want a situation where you tear up the country for the next 30 years. half the country is saying we won the lelection, you stole it. you have to believe that the evidence is so stark of misdeeds

president of the united states weighed on the wildfires in california over the weekend. his initial response was assigning blame. first the latest on the ground. the fires have left 31 people dead. 29 of them in the camp fire in northern california. about 100 people are unaccounted for and 13 million people are in danger. just moments ago the president tweeted i just approved an expedited request for major disaster declaration for

california. i'm with you all the way. god bless the victims and families affected. bill weir is in malibu. you have been witnessing all this stuff first hand. what have you been seeing there? >> reporter: we came looking for hot spots. firefighters battling those flames. a lot of the fire has been knocked down. they say it's about 20% contained. this is what we're finding. the sun went down. we can show you some tape we shot within the last hour here before sunset in the pacific. the model of malibu is 2 1 mile of malibu. the celebrities and surfers know the price of paradise, mudslides and wildfires. this is as bad as anyone can remember. they say about 340 structures were completely lost. that number could climb. two fatalities and a fire that was 21 miles long and 15 miles wide. as these santa ana winds come

howling up the can yoyons sort turning them into blow torches. you can see as bicycles melt into the earth or the only thing standing in a million dollar home is just the washer and drier just how hot that must have been. you see the pools of water that shows there were firefighters up here trying to save what they could. 3200 firefighters now. you can imagine how exhausted folks from ventura and l.a. county must be after the weekend of fighting the blazes. now firefighters are joining in to try to add resources. the winds expected only to get stronger. tomorrow they are worried about the other fire moving south. there's one that popped up north of here up near semi valley and they were able to contain it. right now it's game of fiery whack a mole. just stopping them as the embers spread and blow all over the

place. just utter devastation. still an evacuation zone but your heartbreaks for folks worried about their homes, pets and everything they have and what kind of destruction they will be coming home too. >> it's incredible how far the embers can be picked up and moved by the wind and deposited elsewhere. the president's tweet varied. his initiate tweet not focusing on the victims. he said there's no reason for these massive and deadly forest fires except that forest management is so poor. million offens of dollars given year. remedy now or no more federal payments. the president's attack was called shameful. he said the president's message attacking california and threat pi in en to with hold aid is ill timed

and ill informed and demeaning to those who are on the suffering as well as the men and women on the front lines. today tweeted out a thank you and his latest tweet making major disaster declaration as echoed that tone. first of all, i guess when you first heard about the comment from the president, what went through your mind? >> saturday. i didn't think a lot about it and i started getting a lot of calls from the folks that i represent and are you going to do anything. are you going to respond to this? then i read it and tried to digest it. the first part of it without having it in front of me but essentially saying there's no reason for these kind of deadly

fires and to have these over an over and blaming it on forest management, right off the back i can think of three reasons. one, we have incredible weather right now that is just prime for wildfire or fire anywhere. then the second part of it was the withholding of federal relief. being in the middle of the town of paradise which is wiped out, and we have a fatality list, i believe it's 31. there's still close to over 200 reported missing. this will be a human tragedy. my reaction was very guttural. i was angry. i can still get worked up over it. today is monday. things are beginning to change. it's still, for me, the fire, the camp fire started in federal

land. it's federal responsibility area which means that the federal government has responsibility for the land. they gave fire suppression responsibilities to cal fire. they retained all vegetation management responsibilities and where i'm going with this is timber harvesting, forest clearing, the state of k california and other states have been arguing over it at high levels since the 1950s. whether it's logging or fire control. rather than send a tweet out to the entire nation, make this between the president and the governor and attack the problem. it has a direct effect on the moral of the men and women that are fighting the fires and it does many the community too. >> there's a time and a place

for debate and this was the first statement the president made about the fires before talking about the firefighters in the midst of the the he tweeted i just approved an expedited request. wanted to respond quickly to alleviate the incredible suffering. talk a bit about how hard this has been for the men and women who are fighting these fires. the kind of work, the winds they are up against, the size, the fast moving flames. their work is so extraordinary. i think for folks who haven't been on the front lines it's hard to imagine how tough it is. >> up in paradise as a 30 year firefighter, you see when people abandon their cars in the road to run for their lives. the firefighters another the woolsey fire and camp fire spent

the first 40 plus hours saving people. it was firefighters, neighbors helping neighbors that at least in the campfire it literally was a run for your life in many instances. they have only gotten onto the offensive in the last 24 hours. >> it's extraordinary the work all the men and women out there are doing and continue to do and will be forced to continue to do in the days ahead. appreciate it. thanks for being with us. the president also getting a lot of criticism over his trip to france. he skipped a plan visit to northern fallen american soldiers at a cemetery outside paris. the white house blames the weather. homecoming is a safe space

getting criticism to not honor fallen troops in france. white house chief of staff john kelly was there. the president was not. the white house blamed the rain saying the president didn't go because of scheduling and logistical difficulties caused by the weather. i'm wondering what you made of the president cancelling that trip. he did go to another semitoceme but not the one on saturday. >> people have been agonizing about why didn't he go. was it really about the weather. i think the short answer is he didn't feel like it. he wasn't in the mood. didn't want to get his hairdo wet. the soldiers and marines buried in that cemetery, they endured

some far worse weather than that. they endured poison gas, bombardments, seeing their friends kill eed an mutilatmuti. our president couldn't get out of his hotel and take a 75 minute drive to honor those soldiers and marines. tammy duckworth put it perfectly. >> it was interesting and we're going to talk about this a bit later on in the broadcast but the president of france to the president's face spoke out against nationalism and as an enemy of pa trtriotism. i'm wonder what you made of what you witnessed from the president's trip in france this time. >> whiy did he use the taxpayer money to go? why did he bother? he didn't walk with the other world leaders and the french had

the security wrapped tight. i think he's a coward too. above all, he's an embarrassment to our nation with every breath he takes. macron misspoke slightly. he side nationalism was the opposite of patriotism. no it's the perversion of patrioti patriotism. our president is not precise with his language either. i would have to say that the european leaders have largely written trump off. they are trying to work around him. it's hard because we are the leaders of the free world. we are the backbone of western democracy and civilization for that matter. when you have a president who has no shame. not even engaged and not a patriot, the world is being held together can scotch tape. >> it stood out to me in very stark relief given the entire --
