from leaders and from it the president in the situation room yesterday with democrats reiterating their demands while talks continue and the president saying he'd be willing to keep the government parlgtially shuttered until he gets funding for the border wall. and won't have the principals this time around. the president is reprising it demands for the $5.6 billion they passed in one of the last acts before the shutdown. and trump is showing increasing flexibility also as to what might qualify as a wall, suggesting he might not need the concrete wall he ran on in 2016 and he's now saying he's considered declaring a national emergency over border security to get funding for his border wall if he's not able to get it

legislatively. here's what he said yesterday. >> we can call a national emergency because of the security of our count ra, abb soloutly. i may do it. i may do it. but we could call a national emergency and build it very quickly. >> reporter: congressional democrats are already expressing their opposition. one threatened -- saying in a statement by abusing this authority president trump would be saying he does not actually believe all the money he requests for our country's defense is needed for legitimate national security purposes. that would raise questions about credibility when he requests his next defense budget from congress. he'd face head winds if he tried to proceed with this but there's not a lot of expectations for a big breakthrough because

which is a very different thing. what do you gleen from the president wanting to reframe or recast this shutdown as a strike? >> he's trying to minimize it, obviously. to say this isn't as bug a deal as some people are making it. this has ramifications. this is going to -- he's going to start hearing from more and more republican law makers increasingly that say this is a problem me and my constituents. my constituents are angry about this. this is a huge chunk of the population. and so i think as this kind of carries on and ticks on, it's going to be increasingly prop lumatic and i think that's why democrats feel they have leverage at this point. >> so watts that's the argument? i just spoke on hr 21 which is the bill that would open and

fund through september 30th. if they could getting a ruculture, interior, h.u.d. and the rest back open. what's the argument for not bringing that bill to the senate? >> because department of homeland security is critical. b i talked to a source who said it's not up to snuff and they're concerned. a lot of people feel it has to include the department of homeland security to move forward. so i think they're holding on to that and seeing how much they can -- what they can build off that. >> thanks so much for being with us this morning. >> thank you. >> i want to bring in another viewpoint. the it gop regional chairman for new york state.

so we just heard -- i want to ask you a question off of what amy was saying there. how long do you think the gop can support president trump in this before congressman and women in the gop are saying look, my constituents aren't going to take this much longer? >> when you're negotiating a deal, you can't tell the other side when you're going to finish negotiating because they would know when it's over and when you cave. so i think the president and it the gop have to hang strong in this endeavor. >> for the sake of their constituents? do you think gop' is going to -- >> it's a matter of national security. 89% of border security agents say it the wall would help

>> that was his whole campaign promise and the reason he got elected. >> but how does he know the people who are suffering through this shutdown agree with him? what evidence is there that all of these people -- he said i really believe these people agree with him, that they agree with what he's doing? >> i think americans want to be kept safe and as i said 89% of border security agents say it's going to help with our national security. we're having huge problems because not only is this a national issue but a domestic security issue. ms 13 gang members commit heinous crimes in this country. >> we know there are people dangerous who come across the border and we know there are people are whoant dangerous coming across. year dealing with with week three of a shutdown.

there are people who can't afford rent, to buy food, clothes, to take care of children. so at the end of the day president trump hasn't had to live paycheck to paycheck. could there be a political vulnerability because of it? >> i sympathize with these people and honestly i feel it's irresponsible on the part of the democrats for passing the legislation on thursday knowing that senate and the president weren't going to vote for it and therefore government was going to stay shutdown for longer and these poor people are going to be out of work for longer and i think there needs to be a compromise? >> at the end of the day, democrats and republicans both say we need secure the border. is it up to the fooz come to the table to say let's agree on a number >> so the border wall would cost 5.6 billion. which is .16% of the government.

half hours or so. the president said he has the option, he's thought about it, not doing it, yet or has not decided to do it to declare a national emergency and go around congress to build the wall. what's congress's recourse and what are you going to do potentially to stop the president if you can? >> this talk about declaring a national emergency is another example of the president throwing throwing up a flair to distract people from what should be a very focussed, steady, diligent process of negotiating and reaching a constructive compromise. i'm encouraged there are people sitting down today that are going to try to find a compromise but it needs to bolster security at the border, not just this obsession the wall we've been hearing over the last

three or four weeks. we've got to get the government open, we've but to get the federal workers aback on the job. let's have a sensible discussion about what makes sense to keep our borders secure. republicans and democrats in congress have reached compromise on this a number of times. it's the president who won't say yes to a solution here. so we hope that he'll do that in the coming days, we can get the government open, get people back to work, we can get decent border security and move on to other things he that need be on the ajndau. >> that's interesting because you say open the government and then we'll discuss border security, the wall. the last time you were on the show, december 23rd, 2017. and democrats were trying to get protection from dreamers.

and this is what you said about the leverage and strategy democrats would use to get d.a.c.a. protications. watch. >> i think important thing is the leverage we think we have when it comes to an ultimate deal on the budget and year going to be coming back to that in january, we still have that leverage, i think we're still going to press to make sure the d.a.c.a. situation is addressed. >> the leverage you had was the budget and we know the government was shut down to try to get the d.a.c.a. protections. it says republicans are resolute. no talk on d.a.c.a. until democrats give them enough votes to reopen the government. we could flip that. no talk on the wall until the president reopens the government. what's different from what the president is doing now and what you said is your leverage a year

ago? >> if this was a real discussion about border security instead of the president being stuck on idea of a wall, which is something that doesn't make sense, then we could have that kind of a leverage discussion. but the wall is a nonstarter. it's a nonstarter practically, in term oz of good pallacy. most americans understand if you want good border security, you need a combination of efforts. some physical barriers in some places. but there's a lot of other measures thad need to be taken. let's take that wall off the table -- >> the argument you just made before i play the sound bite was we should open up the government and then have the conversation. in 2017 what you said is we will use the it budget as our leverage to get what we want. >> what i said today is we can have a conversation about border

security as part of getting the government open, but not wall. the wall is not going to be a barging chip for purposes of opening a government because it's not a policy proposal that makes any sense. let's focus on the things that hopefully they're focusing on today in these discussions, which is things that can actually strengthen border security. but thes for the last three or four weeks, all he's been wanting to talk about is the wall. forget about the politics of it for a moment. as a policy matter, it does not make sense in terms of securing the border to put all of those g dollars behind the wall. >> in 2017 was pure politics. leverage, getting what you want and how you get there. >> but the leverage is there if policy and politic its match up,

then that's appropriate leverage. >> so you talked about border security. what type of border security will you support? >> well, look there's been discussion of how you strengthen investing in our border patrol and i have concerns because they don't have the resources they should. so we could put dollars into that. electronic surveillance. in some places fencing is appropriate and frankly there, are places along the border where you have that combination of measures. so let's look at what has been effective up to this point, put that on the table as part of the discussion, which is what the democrats have been doing. and by the way it's not just the democrats. as i say democrats and republicans have agreed on measures for border security. they put those forward. it's the president stuck on this

idea of a wall. >> you say there are places where the fencing is appropriate. so you'd be behind funding fencing? >> everybody's stuck on the semantics of this thing. smart border security is the standard. you want a standard of smart border security. barriers plus other measures that make sense. >> but there are areas where you would support extending physical barriers. they call it more fencing, would you support aitidditional moneyr a barrier? >> i bet you today in these discussions that are happening, i guess at the whiesz from congress from the white house and vice president pence, they're talking about hopefully

a combination that includes some physical barriers. they understand in some places you need that plus other measures. but this idea that all these billions are going to support a wall, that doesn't make any sense. that's not a good place to start if you're the president of the united states in terms of coming forward smart, sound policy to fix this issue of border security. so let's see where we land, let's get the government open so that these workers, including people in my district can get back on their job and serve the american people as they're sworn to do. >> thanks so much for being with us on "new day." >> thank you. there's manhunt going on for the gun man who killed 7-year-old jazmine barnes. >> you took my baby.

hundreds of transportation security officers who are working without pay are calling out sick. at least three major airports are being impacted here. a spokesman says security effectiveness will not be compromised and performance standards will not change. a cnn transportation analyst and former inspector general at the department of transportation. >> when you have this many out sick, you have to assume this is organized to some it degree, yes? >> well, one would assume but let's hope not and remember there's a lawsuit filed about the furloughs. someone would hope it's not to violate the employment standards of the federal department. but it appears to be so. i think people are going to find other work to temporarily pay their bills.

i went through a lot shutdowns including the longest in history with president clintm. keep your furlough money on hand. ford, clinton, carter, bush, regan. they all had shutdowns. but the tsa is relatively new. so a lot of people haven't been through a shutdown and they're not familiar with it. but this happens -- the clintsen one was five days followed by 21 days. but we didn't have it the tsa back then. airlines did airport security. >> do you feel security's going to be comp rumerchandiromised? >> certainly. when you don't have your full work force there and putting their heart into it, of korgs. a safe transportation system is what allows our nation to work.
