while some are showing decline in new deaths, an average of 1,000 deaths have been reported every day for the last three weeks. 170,000 americans. the cdc out with a new report on covid testing in the nation's prisons and jails. jacqueline. >> reporter: anderson, this cdc report shows nat mass testings can identify thousands of covid-19 cases that would be ms.ed if tests were conducteden people showing symptoms. now, the report looked at 15 facilitiz bfore and after testing was done. all of the facilities identified at least one case based on people having symptoms but the mass testing increased the known number of cases from 642 to more than 8,000.

this report says symptom-based test kg underestimate the true prevalence of covid in prisons and jails. >> for those planning on hopping a plane, our senior medical correspondent joins us. what have we learned? >> reporter: during the pandemic, there have been so many questions about whether or not it's safe to fly in an airplane. sign t scientists at mit decided to do a modeling study and what they found is the chances are 1 in 4300 if everyone is wearing a mask. now, the risk goes down to about one in 7700 if the middle seat is left empty. so, the bottom line is it appears to be, perhaps, safer than some people thought but airli airlines do require you to wear a mask. anderson. >> thanks very much. florida's governor wants schools to open.

the largest teachers union wants to keep schools closed. all the while the coronavirus numbers rising, florida's latest numbers are grim, more than 10,000 have lost their lives to coronavirus and close to 600,000 have the virus. rosa flores is in miami. so, what's happening with this lawsuit? >> reporter: you know, what's going on right now is a temporary injunction hearing that is happening in virtual court. here's the crux of the case. on one side you have the teachers union arguing the state emergency order that requires school districts across the state to reopen for instruction is unconstitutional because it is unsafe to reopen the buildings and have students and teachers go inside these buildings for their education. now, one of their witnesses was a biology teacher from orlando who lives with his wife and his 81-year-old mother in law, who testified that orlando schools reopen for in-person instruction

awaiting former trump campaign advisor, steve bannon, after being arrested and charged with fraud earlier today. they've been accused of defrauding donors to construct trump's donor wall. he is in a long list of former sociates charged. president responded earlier today. >> i feel very badly. i haven't been dealing with him for a long period of time, as most of the people in this room know. he worked for goldman sachs, worked for a lot of companies. but he was involved, likewise, in our campaign and for a small part of the administration. i haven't been dealing with him at all. i know-nothing about the project, although when i read about it, i didn't like it. i said this is for government, not for private people.

and it sounded to me like show boating and i think i let my moin be strong at the time. you'll have to see what happens. i think it's a very sad thing for mr. bannon. >> cnn senior justice correspondent joins us. so, let's talk about the fraud charges and what happens next. >> anderson, steve bannon was on a boat off the coast of connecticut when he was arrested by the u.s. postal service. we're expecting he's going to appear in court in manhattan, perhaps in the next hour or so. but these are fraud charges that arise from a fundraising effort that was led by brian, who is a former air force veteran, who was helping to raise private funds from the gofundme and other places, up to $25 million was fund raised according to the

group, and they promised all of the money was sgoeing to help fund this privately funded wall on the u.s./mexico boarder to avoid the bureaucracy of the government. some of the money was being funneled to colfage and others. it says, bannon, through an nonprofit organization, under his control, received over $1 million through we build the wall, which bannon used to secretly pay kolfage and to cover hundred ochz thousands of dollars in bannon's personal expenses. and according to them, he used to to fund some of his personal lavish lifestyle. again, these are the words of prosecutors in manhattan. four in all, bannon and the three other men, are going to make appearances in the next day or so.

and we'll see more of what defense they can offer. despite what the president says, trying to distance himself from the project, his own son, erick prince, a lot of people close the president were extolling this, appearing on videos trying to help get funds raised for this project. so, despite the president's efforts to say he had nothing to do with it, a lot of his supporters were very much involved. >> evelyn perez, thank you very much. the former fbi deputy director. first of all, your take on these charges. how serious are they? it seems like there's a big paper trail. >> there's so much information in the indictment. it's at once a very simple case. a count of money laundering and

of course wire fraud. but it's complex in that it's backed up with really compelling evidence. you have multiple public statements by the principals involved in which they're telling perspective donors none of the money will be used for personal purposes or all of the funds would go to building the wall. and at the same time, they seem to have communication between the subjects that show they specifically geared those statements, knowing it would lure in more money and then they engaged in scheme to siphon funds out of the charity and into their own pockets. and that is about as basic a fraud as you can get. sounds like one based on significant evidence. so, it's a very serious charge. >> i mean, just the hypocrisy. steve bannon was the one running, along with kellyanne conway, promoting the build a wall, and here he is now,

allegedly, according to prosecutors, profiting by luring people to donate their hard-earned money to something he's skimming money from. >> yeah, i mean the hypocrisy, the profit earring is just kind of reeks off of this indictment. you know, bannon clearly knew the appeal that an issue like build the wall would have to many, many trump supporters. and in fact they were able to collect somewhere in the neighborhood of $25 million from hundreds of thousand of donors. knowing it would cause folks to contribute to something they believed in and they turned around and funneled the money through shell companies and another charity in order to hide it was actually going in their own pockets. it's amazing. >> especially for a guy who claimed, when he ran, knows how to spot talent. gets the smartest minds.

utilities at the home that endangers our community. they say this is the first such drastic action, cutting utilities to a property in order to stop the spread of the virus. to get a better idea of how southern californians feel about wearing masks, they conducted a study in realtime to see how many people wear them properly and in public. here's a quick snap shot of what they found. overall, in the areas they surveyed, outdoors, only 42% wore them correctly, 10% wore them wrong and 47% didn't bother at all. more women put on face coverings and wore them correctly than men. a data and graphics journalist from the "the new york times" who helped conduct the survey. people's behaviors, despite what

shield was okay. that's changed? yes? >> in some districts interested in using plastic face shields. especially teaching staff. then the students can see their whole face. they've made accommodations in some cases, where they're teaching students hearing impyred or teaching phonics, foreign language. things like that. students planned to wear them and some families did get those clear plastic face shields, however, a lot aren't sealed at the bottom and not considered as effective at the cloth mask over the mouth and nose. they were told they would have to wear the cloth mask in addition to the plastic shield, and that was just a step too far for some parents. the ones already unhappy about the mandate mask. >> planning to protest tomorrow? >> yes. st. george, the major city in southern you'utah, parents are planning to protest. a lot of skepticism about the

official advice on coronavirus. so for a lot of people, sounds like a small distinction. plastic shield versus the cloth mask, but it's more of a last-straw situation for a lot of these families. >> how did that plan to fight this legally? >> well, you know, i mean they want to pretest it. initially their school district agreed to let them keep doing the plastic shields. a lot of these folks can jubilant. now that it's changed i'm not sure what the hopes are. a number of parents have already taken their kids out of school because of the mask order. not because of fear of contracting coronavirus but because of the mask order. >> is there a chance the order would be reconsidered or rescinded? >> always a chance. if the governor is persuaded to do that, the mask order will be
