dominate the news tonight. at least two effective vaccines against coronavirus. officials meet today who gets the vaccine first. we begin with other big story which is all about something that surrounds it. the deaths are running at a rate of one in every one minute. you may think that should be any president's greatest concerns right now. instead the man is occupied with the white house and what i am sad to say a con game over the election he lost. how is it a con game? well, the president is pedaling the idea it is not true. in exchange, he's taking their money about $170 million which is small dollar donor that's going to legal expenses relating to the election.

it is largely not. that's what a con man does and that's what the president seems to be doing. don't take it from us, take it from republicans and judges and judges he appointed said so. william barr telling the associated press "today we have not seen fraud on a scale that could have affected a different outcome in the election." that's coming from william barr, a guy who bent over backward to backup the president. remember the attorney general back in june validating the president's attack on mail-in ballots. >> foreign countries can print out tens of thousands of ballots and it would be hard for us to protect. >> that was not true then and no evidence to backup that statement. it does show you how willing he's to echo what the president wanted to hear.

the move through widespread critici criticism. with that said for all the controversies surrounding these investigations must have drawn a blank, otherwise, attorney barr centerly would ha certainly would have said so. they are not systematic allegations. those have been run down, they have been run down. he dismissed the claim the president makes accidentalconst. >> the dominion machines where tremendous reporters have been put out. we have affidavits on from many people talking about what

machines. these were glitches. they are fraud. absolute fraud. >> that's made-up. here is what the attorney general told the associated press. there is one assertion that would be systematic fraud and that's the claim that machines were programmed to skew the election results. the department of homeland security looked into that and so far we have not seen anything to substantiate that. nothing. chris krebs, who was fired by the president. >> there is no foreign power that's flipping votes. there is no domestic actor flipping votes. i did it right. we did it right. this was a secure election. >> he got fired for that and death threats and was on the receiving end from the member of

the president's team. >> anybody who thinks this election went well like that guy krebs, that guy is a moron, he should be drawn and quartered taken out at dawn and shot. >> now of course digenova is saying he's speaking in just and just kidding of shooting the public servant for doing his job. in this environment where people have been told the election is stolen or talking about killing people is not anything a responsible person should be doing. in georgia where the president

send goes to the president so-called "defend fund." it is raised $170 million so far. because it is set up as what's called a leadership pact and not a candidate committee. there is no prohibition. that's really important. as one financial official tells "the washington post," if you are talking about an expenditure pact, there is no prohibition on how they use that money. in sort, the president is being handed tens of millions, more than a hundred million dollars after losing the election, telling is supporters that he did not lose the election. he's telling them they can do something about it by sending him more money that goes to a fund that he has a wide

discretion and spends however he wants it. this is another con. you have to wonder which of his collaborator are in on it as well. first, let's go to jim acosta. barr concluded there is no evidence of fraud. what's the white house is saying a about that? is now barr the enemy of the people as well? >> well, they have not gone that far yet. we are waiting to see what the president say about this. white house officials are turning us to the trump campaign and legal team and statements they put out of rudy giuliani being on that trump's team saying in a statement that bill barr and the department of justice have not done, stemming from the 2020 election. that's rigged obviously because rudy giuliani and trump's team have not put forward any

evidence all. anderson, what we are left with is what you were teeing out over the last several minutes, disinformation for dollar scheme that the president is orchestrating right now to a great success. he's raising a lot of money for his future plans to essentially make joe biden's miserable the next four years. >> associates of the president, rudy giuliani maybe asking for pardons? >> that's right. >> i am told by my sources that associates of the president have been pleaing to him, appealing to him for pardons and what are being called preemptive pardons. those associates under the president including rudy giuliani who by the way has been leading up these legal challenges across the country. i am told by a source who's familiar with some of these

discussions that a lot of these associates who are seeking for these pardons, people who think they are in hot water the next four years, they fear what an in coming biden administration means and they see some hostility and what they view as hostility coming from that administration. >> is that a thing? preemptive blanket pardons? >> i am not aware. i don't play one on tv. i think what they are looking for is yes. some sort of blanket immunity for prosecution from here on forward, whether or not that could be tested. t we'll see and hear about the prospect of the president pardoning himself which is constitutional. the president can't do but he busted norms before. talking to my sources, he may try that one, too. >> monopoly, getting out of jail free card.

it is interesting of the laws he's not being inaugurated again. what's the idea of reinvent inauguration? >> the out going president will go out there and put his arms around inauguration day and wish biden luck. they don't see it is happening. a potential event on inauguration day where president trump will announce some kind of intention in terms of what he may do the next four years. he may hint of a come back run and all of that is up in the air and depending on how the president is doing politically and legally over the next couple of years. it is something being discussed

to steal the limelight from his successor. >> have they said he's not going to the inauguration? >> he was asked but did not answer that question. he wanted in suspense. we go back to those fund raising e-mails you were showing a few moments ago, they were more laughable. >> the cameras are going to be at the inauguration. i think the president is going to be there. i am rolling the dice there. >> some way shape or form. >> jim acosta. thank you very much. >> documents by the washington, d.c. district court is also making headlines. evan perez is joining us you no. >> it says there is an investigation that's been ongoing that appears to show

that tlchere is a bribery schem. someone was trying to funnel money, some kind of campaign donation in exchange for a presidential pardon. we don't know who the campaign donation was going to. from reading the document, we can tell this involves some kind of contact with white house officials, we talked to them, they have no idea what this is about. the law firms that's involved and all of this have been redacted and clearly released by the chief judge here in washington over the objection of the justice department wanted to keep these documents secret. we don't know if it will become public in the way of a court filing of charges. it appears right now no charges have been filed with regards to

that bribery scheme. it does raise a question of who it was and let's try to use access to the president and the white house in order to get a presidential pardon in exchange for campaign finance. >> back in october, bill barr, pointed a council to violate the law. did bar give an indication why decide to do this or why doing it right now? >> he simply says it is in the public interest but this investigation to be completed. keep in mind if you remember. bill barr kept saying that john durham, the attorney in connecticut was finding all source of interesting things. he suggested there may be crimes involved and suggested that there may be some kind of october surprise. something before the november election. the president kept trying to raise the prospect that this was going to happen.

none of it came to pass. we know durham is not done. according to bill barr, he decided to appoint john durham as a special council. durham can't serve in the way robert mueller did. the rule is you have to be someone outside the government. what barr is doing is going around and he's giving durham the power. >> evan perez, i appreciate it. john dean is a cnn contributor and commentator and david

axelrod. so if there is been some sort of, presidential kind of rumbling or presidential bribery scheme, what would it mean legally? i am not clear this means if somebody had given donations in the past or someone given a pardon or somebody giving donations, what do you make of this? >> well, i read the largely redacted argument and as evan says it is hard to glean much from it. they did get a lot of information from a raid that they were authorized. they got several digital materials from iphones and ipads and hard drive from what have you. in that material were e-mails correspondent between the party

involved and an attorney. they apparently had to breach or break that privilege and went to court to get an order that they could confront the people that were involved in the investigation with the fact they had the information and not breaking the privilege. they did so. they did that based on the fact, information that were not attorneys and breaching the attorney client privilege. so this is what happened and the judge who's an experienced season judge said at the out set, i want these documents made public as soon as possible and put its in the original order. the department of justice resisted that to the last minute and filed a request saying we don't want it public. the judge went back at them and said please, i want something in a week we could put release.

she forced the issue that we got the high redacted memo today. >> the investigation indicated that i plan to confront three people as part of their case. vegetables and conduct had not been charged yet, is there any conclusion to be drawn from this? it seems sketchy. >> look, i think the real question is was there any conversation between anyone at the white house or the campaign where the people did not receive any edncourageencouragement. we don't know the answer to that. this pardon situation is a bit of a cesspool. pardons were reviewed by the justice department. there was a rigorous sort of system to make sure --

>> is there a thing as a preemptive pardon? >> gerald ford provided a pardon for richard nixon but it was not for a crime he committed. john, you can correct me if i am wrong. it was specific to crimes associated with the investigations that were ongoing. from his inauguration to his resignation. that was more the exception that proves the rule. it is highly unusual. and also rudy giuliani is out there flagging the president's fantasy fraud cases and asking for $20,000 a day and he's apparently talking about a preemptive pardon. >> we are going to take a break. we'll have more david and john, standby, we want to ask about the new reporting from "the new

request. i am joined tonight of people seeking pardons by the president. president trump discussed with advisers whether to grant preemptive pardon to his children, son-in-law and to his own personal lawyer, rudy giuliani. back now with john dean and david axelrod. "the new york times" is saying there. is there any historical parallel

note of this granting pardons of his kids and son-in-law and rudy giuliani? >> i can't find any historical parallel to this. the family particularly. i can't think of any family ever involved in the process of the presidency as the trump family have been. i think this is a trial balloon to see what the reaction is. i would be surprise if he does not than he does. it is something you would expect to see in some country where that has a ruling family and they're looking for a way out without being haul into prison. >> it is, anderson.

the president does not respect the rule of law, he has not from the beginning. it is not at all surprising. he'll pardon himself by the time this is done. he can't pardon for state crimes. there are two active investigations by new york, one by the attorney general and the district attorney of manhattan that's looking into the trump organization. these pardons will not protect himself or his children. he's worried that biden administration will go after his family. that's the kind of thing he would do. biden indicated that he's not interested in that. i think that's a rational that he'll use if he goes ahead with

these pardons. >> rudy giuliani reportedly lying of the preemptive pardon which rudy giuliani denied doing that. there is only a handful of that in u.s. history. you talk about president ford pardoning richard nixon which was controversial. this is a whole other level from that. >> yes, we got a sample today of his pardon style, filing by general flynn. it is so loose and not specific to open us up to challenge questions. as far as rudy, they'll try to give a blanket sort of immunity against all kinds of activities. that has been done in the past.

in our common law, you have to have some specificity in what you are doing and you can't use these blanket efforts to immunize people. it could get challenge in court if he gets too goosey. >> john, you have to be specific. i am here by pardon rudy giuliani or any activities of 2016 or 2020. >> no. >> or ukraine or where ever he's been traveling to. >> you have to have some specificity as to what the offenses are. he did it with flynn. anything coming out of the grand jury investigated by the special council in the district of columbia or the eastern district of virginia.

bruins eaking news of the coronavirus vaccine, the first doses will be delivered three weeks from today, december 15th. this vaccine, pfizer, the cdc voted 13-1 of healthcare workers to be first in line of the vaccination. more than 98,000 hospitalizations which is a new high. joining us is dr. sanjay gupta and dr. william shaffner, among those advisers to the cdc. >> dr. shaffner, can you tell us the decisions that was made? >> sure, anderson. this was a combination of

several months of discussions of focused groups and modelling illness to see which groups ought to go first, second and third. we took that first step and voted for healthcare workers, people who take care of everyone, we need them there in case we get even more of a surge which we anticipate. also, it was added the residents of long-term care facilities were added to that group. that's about 27 million people round and about across the united states. if we can get the vaccine started in that group that'll be a good first step. >> sanjay, what do you make of the cdc's recommendations? >> it was expected and you look at nursing homes long-term care

facility and especially back in the spring. that's 40% of the deaths. that's an obvious place to begin. this is how they break it down. roughly about 3 million people in long-term care facilities and 21 million or so healthcare folks. it is not enough vaccine by the end of the year in the first couple months or so. next year we should be able to do this. i also talked to some folks at operation warp speed, people who are in the hospitals, these are these institutions where the vaccines will be given so there is a pragmatic and logistic major of this as well. >> dr. shaffner can you explain what rules states and cities will have and how will it square

with what the cdc is recommending. >> absolutely. we have been working on this committee and preparing for what the acip was going to bring for. much of what they did bring with nursing homes and healthcare workers were where we were. the fact they included the nursing home residents and as importantly the people who work at the nursing home is critical. those individuals are going home to their families and they're potentially spreading it in the community. 50% of healthcare workers who die from the virus were people of color. majority was african-american. >> dr. shaffner, the single vote that came from one of your

colleagues said she was worried the vaccine was not studied. is that a concern? >> well, nothing is perfect at this length of time. it is true. by the time we initiate immunizations, we'll not have information of residents of long-term care facility. not in long-term care facilities per se. we would like to have that information going forward but we don't anticipate reaction being more. we need someone less in this group according to preliminary data. we think this is a good idea vaccinating, the nursing home residents because this has been a group in which there has been large outbreaks of infections particularly at the beginning o the outbreak but they continue.

so reaching out to them is a good idea. >> cdc vaccine advisers were told that federal officials having 40 million doses by december. it is not going to be available all at once. how that t dodoes that change t? >> it is an important point. having enough stock supply of whatever therapeutic or vaccine in this case. so we have surge demand so we can meet those demands. at the time pfizer may start actually vaccinating people closer to 6.5 million doses at that point and producing 3 million per week. the exatipectation is moderna w

trauma. we can't forget the folks who were transporting patients or emptying garbage cans. those healthcare personnels are equally important. again, the 65 and up, that's more our phase one b and one c. just to be careful of that. 15,000 people we tested, the groups that were positive wereless than 65 and only 22% had covid conditions. we just have to be careful with that criteria. that's what excluded a lot of people from getting tested before is that as we go through and i know it is dynamic and it is changing and we'll keep looking at the evidence is that we don't exclude those certain groups. they are your employees that are transmitting it and they're bringing it home and they're most affected.

extending around the country, what does it mean going forward for the trump campaign? what does it forshadow for governing under president biden. reaction now from van jones, clearly some of the neighborhoods where gary spoke to people that really believed that the president can turn things around. >> well, they think that because they have a media ecosystem that reinforces that, and frankly they have the president of the united states continuing to insist upon that. in some ways it is not unusual. when obama was president, donald trump was trying to delegitimate him. when trump was president, you have people saying the electoral college shouldn't seat donald trump. the difference is you never had a sitting president or former president out there whipping stuff up. one thing with grassroots people

and marginal media people saying stuff like this. never anyone like joe biden has come into office with a president in waiting, president in exile, a political martyr out there willing every single day possibly to try to undermine his ability to govern. it is not unusual for people having a hard time accepting the results. but it is unusual for a president or candidate to participate the way that he is doing it. >> the idea that the president would not attend the inauguration, and who knows. you can make the argument there will be a lot of camera there is and doesn't want to miss out on that. it is extraordinary that i am stunned. this is how he wants his legacy to end. david axelrod said he doesn't care about his legacy, and maybe that is true. it could have gone such a different direction. >> listen, if donald trump fails to appear, that will be the first time you have had that

level of rejection of the american people and the american democracy and american system by an american president. we have been in unprecedented waters since coming down the escalator five years ago. but that is a category beyond. you are dealing with a potentially disloyal movement in the country, led by one of the most famous people in the world and led by someone that can at least access millions of dollars. it is a dangerous, destabilizing possibility. you have to ask yourself the question, why are people so willing to go along with this? the level of willful -- wishful thinking that you are seeing is very, very frightening. i think it has to do that flou we are in such different media environments. you listen to right wing media, there is a ton of evidence that they talk about and that they discuss. you go down the rabbit hole.

you say it sounds very convincing. if it is that convincing why are not republican lawmakers and governors and secretary of states doing anything about it? it is mostly made up. you need to know the extra piece not presented in court to get yourself out of it. i try to take it as seriously as i can. it is a deep rabbit hole with millions of people down there. >> the election is over. president biden will be sworn in january 20th. you hear the reporting that president trump may hold his own event that week. maybe announcing a 2024 run. you wonder how that will play with the republican party with all of the people that themselves want to be president and they will have to be beholden to him. van jones, thanks. cnn's all-star tribute in a year we desperately needed them. two they are and how you can help. that is coming up when we come back.
