congressman mike kelley and others aimed at overturning biden's victory in pennsylvania reads the application for relief presented to justice alito and by him referred to the court is denied. just the one sentence signaling to sign on to the president's scheme to overturn the election. the day began with good news. the first doses of the vaccine being administered in the united kingdom. it is also fitting that one of the first two people to get vaccinated should be named william shakespeare. his namesake was born into the year of the plague that killed about a fifth of the population. today we all hope it will be the end of the outbreak which can't

come too soon. today saw coronavirus infections top the 15 million mark. another 1 million cases that were added in just five days. at least 188 more so far today. today saw president biden layout a plan for controlling feed. this team, this team will help get at the last 100 million vaccines. the third thing i am go to ask in the 100 days, it should be a

national priority to keep our kids in school. all that i can tell you is the truth. we are in a very dark winter. things may get worse before getting better. >> you will be seeing that over the next few months the numbers should skyrocket downward. we are the most exceptional nation in the history of the world. today we are on the verge of another american medical miracle. that is what people are saying. people that are not necessarily big fans of donald trump are saying whether you like him or not this is one of the greatest miracles in the history of modern day medicine or any other medicine or any other age. >> people are saying it. he said so. must be true.

>> the president signed a symbolic order that the united states gets the first covid-19 vaccines. he did not mention that the administration passed on the opportunity to secure more vaccines from pfizer. >> i think the vaccine was our goal. that was the way that it ends. plus you do have an immunity. you develop immunity over a period of time. i am hearing we are close to 15%. that is terrific. a very powerful vaccine in itself. just tremendous progress has been made. one of the reasons that we show so many cases is that we have 200 million tests.

>> except none of what he said there was true. he is a liar to the end. nor was anything true in this answer about why members of the biden health team were not admitted to the event. >> we won in the swing states. there was terrible things that went on. because you can't steal hundreds of thousands of votes. you can't have broad and deposition and all of the things they did and slightly win a swing state. you have to just look at the numbers and what has been on tape and look at all of the corruption and see. you can't win an election like that. >> sure, it is annoying to hear him lie continually. of course it is. if you are sitting at home stewing and boiling about it. so what. it does not matter what he says. the supreme court spoke today. it does not matter what he said.

he is is the old guy at the party that does not have a home to come back to. everyone is leaving he just wants his greatest hits to keep spinning. he will be singing that song about fraud every day for the rest of his life, you know that. table hopping, can you believe what they did to me. total fraud. dental checkups. family dinners with whoever will show up. i would say it must get tiring but clearly it does not for him. he just keeps repeating the same jibe over and over and over again. yeah. it does not matter. it is ivanka's problem now. she will have to deal with it. the supreme court wasn't having it ands it decision under scores how much success they had in any court, anywhere. in a dramatic twist there was word from another ghost of

christmas past. the man that was once rudy giuliani. he has been traveling the country maskless and shouting popped up offering advice on, of course, covid. >> you can overdo the math. everything done in moderation makes much more sense. my advice to people is to get early treatment. the earlier you get treated -- >> he didn't mention 300,000 americans have died. when asked whether the experience has changed him you don't screw around your whole

life because of an illness. more from jim acosta who joins us now. obviously the president knows he has lost. i guess he is trying to rake inasmuch as possible. he wants to keep the lie going for as long as possible. it does seem like the options are over. the trump legal team said they would continue with the legal challenges. trump and his team still want to keep fighting. they knew this would going to happen. i asked if there is any talk of the president conceding behind the scenes and the advisor said

zero. it is not going to add up to anything. the electoral college will meet and certify the elections. >> the president made it clear before the election that because he appointed three of the justices he was optimistic about his ability to challenge the vote tallies if he didn't like him. i don't think anybody is surprised the supreme court justices did not buy into this at all. >> right. the advisor i spoke with earlier in the evening said they didn't think this would happen. the advisor said that trump tested our system. this was a stress test for the american electoral system and that the system held strong. you know, a level of candor that you do not always get from operatives behind the scenes that are spinning you.

the president thought by able to rule in his favor. >> yeah. jim acosta. appreciate it. thanks. now we are joined by the official that got fired by the president after calling the election the most secure in american history. christopher krebs, trump campaign lawyer suggested that he should be killed. mr. krebs who is now suing the attorney and the campaign joins now. i appreciate it. i want to get your reaction to the supreme court ruling rejecting pennsylvania republicans attempt to block the certification of the commonwealth's results.

what do you make of the findings? >> i thought that it was beautiful ins it simplicity. one line, right. what everybody expected. it is just one more nail in the coffin, i think, of the continued efforts to overturn the results of the 2020 presidential election. >> as a republican do you think it would make a difference for other members of the party who have been supporting the president's baseless claims, at least publicly about election fraud and were holding out that somehow the results would be overturned. do you think the supreme court ruling is a turning point or is the turning point when the president actually leaves? >> it is hard to say. i think that there has been a coordinated campaign to intimidate and silence republican officials across the country. look at what is happening down in georgia. the lieutenant governor and the

governor have been targeted. the governor was out in arizona targeted by the president. there is an on going effort to silence republican officials that do not, you know, carry water for the campaign. this was a clean election and straightforward victory by the vice president, joe biden. >> when you came out to say this was the most secure election. did you know how the president -- i mean did you have a sense of how the president would respond to that? >> i don't think we considered the reaction from the president or the candidate. what we did was the right thing. just like filing the lawsuit. the way that i look at it, you know, i kind of have a pattern of standing up for what is right. for myself, my family and

friends. there are costs associated with that. you have to take a stand and stand up for what is right. so then i stood up for democracy. i got fired for it. continued to stand up and defend democracy. got death threats. now we are standing up again for democracy and filing this lawsuit. >> the president spent time today talking about the election, saying let's see whether or not someone has the courage to do what everybody in the country knows what is right. after what you are still going through, what do you make of the choice of language? >> this is part of what we would like to look into a little bit further. you know, whatever the reason, whether he honestly believes that he won which i can't conceive how a rational person

would conclude that or it is an ongoing fundraising effort. more maybe he is just not a gracious loser. in contrary to what jim acosta or the advisor said earlier, democracy held strong. i am a firm believer that democracy is fragile. to have these sorts of internal attacks and domestic threats is dangerous and we cannot have another four years of some type of lost cause effort. we have to put it to rest and move forward as a country. >> the lawsuit thaw filed today accuses them of defamation. he later said the remarks were sarcastic and made in jest. can you talk about why you felt

compelled to take legal action? >> look. i was a public servant in the national security community defending democracy and he accused me of being a traitor. the penalty for treason is what he described. that is exactly how it was intercepted by the community and everyone out there on social media. those are the number of death threats that went off of the charts. look at the threats against the governors here. once you startage tating and really pore kerosene on the fire it is hard to put that out. again, it is haimportant for meo stand up for me and my family. >> your child asked whether you would be executed.

i can't imagine how you deal with that. >> i am not sure that you can, right. those things are hard, you know. i listened to the michigan congresswoman and how she is doing. when you have family members that are brought into this and are collateral damage effectively from these sorts of attack attacks on your character or behavior. that is not how people should act in a civil society. it has to stop. >> how do things change? i mean -- i am still stunned after all of the shamelessness that we have seen over the last four years and all of the lies. i am just stunned at how the president turns on people who

worked very hard for the good of the country, you and others. you know even jeff sessions. he just recused himself. the degree to which this president will turn on people. it is like they are scared of the bully turning on him. they are praising the bully. something has got to give going forward. >> you heard whether it is off the record or background conversations from republicans where they say it is political suicide to go against the president. you know, i guess that i can understand that. for me that is not good enough. you know, i took a stand.

we defended democracy. i would do it a thousand times over. you know, it was an honor to serve in the role as the director. but to a starter point, this has to stop. short of the president acknowledging that he did not win and that vice president bide is the president-elect. there are three branches of government. certainly, particularly in the house they are accepting their own races. we have to move on. >> funny how fraud is always in

someone else's race and not the one you won in your district. christopher, thank you for your service and for talking us tonight. next, reaction from our own legal team and the president's continuing election denial and if there is a chance he can go further than he already has. the new vaccine data and the failure of the administration to take advantage of more doses from pfizer and what happens next if more vaccines come online? at mercedes-benz, it's not just a job, it's our mission. .

returning to the breaking news, the president's supreme court defeat in a case aimed at overturning the results in pennsylvania. now a former top obama advisor, david axelrod and cnn's legal analyst. normally it would give a politician and his allies real pause, time for reflection. obviously this is not a normal time. what happens next? >> the president is likely to keep kicking and screaming. he tried to bully even the supreme court for the past month or so. especially when he was speaking today at the white house. actually calling out the supreme court and pennsylvania legislato legislators challenging the vote. the fact that the supreme court

slapped it down with no dissents, meaning even the three nominees from this president. saying i am with the president or anything at all. that tells you everything that you need to know. this is a lost cause and it has been for some kind. trying to push in the face of basic facts. the president did not win. >> i want to tell you a little bit about what the president was saying before the election back in december. >> i think this will end up in the supreme court and it is important that we have nine justices. it is better that you go before the election. i think the scam the democrats are pulling. it is a scam.

>> it is hard to read too much into a one liner. >> well, he was wrong. he thought he would be able to influence the court. he certainly tries to influence the court. in this circumstance with the 2020 election, there just wasn't a case to be made. the election was not close. it was not close in the states. there were no incredible allegations of fraud. really this lawsuit and many of the others are simply frivolous, and the supreme court has no reason to insert itself into the 2020 election when the result is so clear. >> when president trump said that we will have to see who the next administration is, you know, obviously people are dealing with facts have known for week who the next administration will be.

supreme court as well. we are not in the president's head. i assume it is for fundraising and him raking as much money he can to use for his personal benefit as long as he sees fit. >> the president is not one of those people. that was the line we heard in the first days of his administration. it has been true throughout. i think that there is madness to his method. i don't think that he can tolerate a loser. there is also a method to the madness. he raised a quarter of a billion that will serve as his political slush fund when he leaves the white house. he sets himself up as the avenger. it was interesting the language he used down in georgia.

they stole it from us, from you. that will be the platform. maybe he will run for president again in 2024. it keeps him in the game. it makes him relevant. secondly, if he should be indicted in new york, which is a real possibility he will depict it as a possibility to keep us from taking the white house back. the third thing mentioned to me the other day by a financer in new york, a savvy guy. high can't get a conventional loan. but if he is still active and talking about running for president again, a pretty good investment whether it is russia or turkey or any other country to make sure that he gets the

money that he needs. i think part of it is that he can't tolerate being a loser. he is making a bet here on a plot that will rally people around him. >> you were talking about this with chris krebs who is really remarkable in how articulate that he is in what he saw internally and what he sees now. the money part of this. it is ping, ping, all day long on your text, on your e-mail. they are just desperate for money. the money is not all going there. almost 25% of it at this point is only going to the legal fund. for all of the reasons that

david just cited, that is the most important thing for the president, to keep his political viability going. includes and under scores that this is a fundraising effort, what he is doing from the oval office, democracy be dammed. >> and that money is money he can use however he wants. >> correct. he can. for the future. >> what state or federal judge will weigh into this and legitimatize the president's baseless claims? >> he has got his team of lawyers willing to go to court and put their name to a lie. those are not lawyers that i would want to work with.

he has people that are willing to do that. there were not incredible allegations of fraud. what the lawyers who are enabling him in doing this and his political allies who are supporting the charade which is really what it is they are really harming the country. there are people that actually believe this. in the interview there with chris krebs. the work that chris krebs did as a director and what his team did before the election. the years they put in there securing the election and working with state and local partners to make sure that the security of the election was in better shape. it was really important. the rumors there coming from the president himself. i think that saved the country

>> tonight's supreme court decision denying an attempt to block pennsylvania's certification of the election results. in delaware, president-elect biden's is forming his government. what is the team's response to the decision? >> reporter: well, anderson, president-elect biden's team has long said that no legal challenge or tweet will be changing the outcome of the election. and the supreme court decision is just the latest in a spring of validations that they have gotten to back up that argument. and a biden campaign spokesman, mike wynn gave us a statement saying dozens have rejected the claims and now the highest court in the land joined them without a single dissent. they add this election is over. joe biden won. and he will be sworn in as president in january. they are keeping an eye on the

legal challenges that the president has put up, but really haven't felt they will change any of the outcomes. so what you have seen biden do is plowing ahead with his transition team, building up the administration that will step in in 43 days when he takes office. certainly welcomed news, but they don't feel it is very surprising. they always thought the legal challenges would fall flat. >> really they have fallen flat. i assume they do not believe there are any legal challenges on the horizon that will stand in the way of the inauguration? >> reporter: no. they really don't. this is really getting to the end of the road for president trump they feel. they will be watching next week when the electoral college votes. they expect to go in their favor as the results were certified across the country. one thing they are keeping an eye on is when republicans will acknowledge the reality that biden is the president-elect and will become president on january 20th. he really tried to give

republicans space saying he wants to give them time to accept the reality. the vote from the electoral college really will solidify his standing heading into the inauguration in 43 days. >> appreciate it. thanks. now more on the supreme court decision and whether it just might, might convince some republicans to acknowledge that joe biden is the incoming president. joining me now, congresswoman, what is your reaction to the supreme court's refusal to take up the challenge from pennsylvania election results? >> well, it is great to be back with you, anderson. let me say this, any case before any court has to have evidence. i tell you what, the evidence is clear and convincing that joe biden won the 2020 election. it does not surprise me what the supreme court decided in this case. there was nothing there. what has surprised me and what has been quite disappointing is

the reaction of my colleagues on the other side of the aisle, if you will. look, the election is over. joe biden won. donald trump lost. and in spite of the president's efforts, his own efforts to try to interfere in this particular election, the evidence is clear as has been stated. the electoral college will meet next weekend. it will be officially certified. the results of the election. i am just hoping that the republicans that have made a conscious decision to play this game with the president that is based on nothing that is real. i hope they will come to their senses and participate in preparing for the next president of the united states. we only have 43 days. >> i mean it is. it is a game to them. it is a game to the president. you know, he is fundraising off of it. obviously that is a huge

motivation for him. he needs money in the years ahead for a whole variety of reasons, politics and legal issues and beyond. you know, it is not a game to a lot of the base of the republican party who supported the president and actually they believed when the president said there was widespread voter fraud, they believe it. they are being played for suckers by the president and the other republicans in congress. behind the scenes, do they at least acknowledge that it is over but i can't say that? what do your colleagues say? they don't really believe that the president has won the election, do they? >> let me say this, anderson. i think all of us know that the current president of the united states will do and say anything and nothing that he does surprises me anymore.

certainly the behavior of my colleagues that said they don't support a lot that the president was doing. they were afraid of the political repercussions and maybe not taking action. maybe stay silent. but the behavior in this case. their behavior in this election is really disgraceful. we know that all of them, i heard, have been asked who won the election. only 27 out of 249 acknowledged that joe biden will be the next president of the united states. two, i understand actually said that donald trump won the election. so, while i don't expect better from the president, i do expect better from the members of congress. i think it is absolutely shameful what they are doing. and we see the results of the totally out of touch with reality behavior that has translated into violent acts. i saw and heard what happened to

the elected official in michigan. we know that there are protests outside of official's homes in georgia. it is disgraceful. for the president not to say anything is bad enough. for the members of congress to participate in it is disgraceful. >> republicans on the inaugural ceremonies blocked a resolution by democrats that would have named president-elect biden and vice president harris as the two people set to be sworn in. this is insane. steny hoyer said, and i quote, the extent to which republicans are refusing to accept the outcome of the election and recognize joe biden and kamala harris as the next president and vice president is astounding. why won't mitch mcconnell acknowledge the biden-harris inauguration is the one being planned. there is no trump-pence inauguration in the works. >> anderson, there is absolutely no excuse for it.

there really isn't. we are dealing with a public health pandemic. over 280,000 people have lost their lives. we have over a million cases here in florida. 20,000 people have lost their lives. the numbers are going up, and not down. we are dealing with a public health pandemic. businesses are closing. people are losing their jobs trying to keep a roof over their heads, and the republicans are playing games by not even acknowledging a support of the resolution, which clearly they understand that joe biden and kamala harris won. i would just hope that the people in their districts that need help and that need help right now and need us to get to work will remember this moment and what their representatives chose to do. >> yeah. i want to ask you about president-elect biden's cabinet picks so far. general austin would be the first black secretary of defense. there is hope the new president would appoint a woman to the

>> breaking news tonight on the pandemic. we mentioned nearly 105,000 people hospitalized with the disease. more than 50 million total cases. upwards of 202,000 today alone and 2,400 people died today. this is the first covid knockulation thknoc meanwhile president-elect biden laid out his team's plans to combat the virus. there is a lot to get to. joining me our cnn medical correspondent, dr. sanjay gupta as well as a member of the president-elect biden's task force.

people in the u.k. being vaccinated. i know you spoke with the fda commissioner here today. what did he tell you? >> he basically said that the fda regulatory framework is the gold standard around the world. it has been long thought of that way. it is a stricter framework from a regulatory standpoint and legal and liability standpoint. he also pointed out as the u.k. authorized the vaccine, the rest of the european union has not yet. they follow some of the same guidelines that the fda does. i think what is really driving this, anderson, you know there is still a fair amount of vaccine hesitancy, something else that dr. hahn mentioned. 51% of people in september said they would take the vaccine, now it is up to 60%. that it is still not high enough.

making it clear to the american people that the regulatory process is not being short cut here is really important. that is part of the reason it is taking so long. it should be ready in the next couple of days that we hear something. >> ahead of thursday's meeting to grant pfizer's emergency authorization, the fda highlighted the efficacy of the pfizer vaccine. in your view how promising is the vaccine? >> well, the data looks quite good. and while we can't make any conclusions based on the data that was submitted to the fda, even after one dose it seems like you are seeing pretty good immunity. you would have to look at this in larger numbers. but it is certainly possible that you might see changes in guidance about how the vaccine is utilized as we learn more about it. >> that is interesting. i mean sanjay, president biden said he wanted to aim for 100 million americans to be vaccinated in the first 100 days. is that realistic? >> it is interesting.

he said 100 million doses. if it is 100 million doses that may be different than 100 million people. it is often two doses per person. if it is we've put the numbers together. we've been talking to the various vaccine companies. as you know, potentially by the end of the year, if both pfizer and moderna become authorized, that would be some 40 million doses available. the screen that you're looking at now, by the way, is different numbers, but these are the overall numbers of vaccines that were purchased by operation warp speed. but as far as the calendar goes over the next, the hundred days after the inauguration, it is possible to get 100 million doses if other vaccines come online like astrazeneca and johnson & johnson in particular. those are two i was told last week are likely to go into emergency use application phase at the end of january, early

february. then i think we can get to those numbers. but a lot of things have got to go right. right now we don't have any authorized vaccines. it looks promising, but we've got to get there. >> warning states that current vaccines won't reduce the spread of covid until late spring. how is the biden administration going to address this and do local health departments have enough resources to vaccinate their residents? >> a very good question. i think we really do have to double down on many of the public health measures we have been promoting all along, the mask wearing, the social distancing, if you're going to be around other people, do so outdoors or in a well-ventilated space with windows and doors open. that needs to continue. while we have vaccine and there is light at the end of the tunnel, there is still a long tunnel ahead. as for vaccine distribution, i think state and local health departments really do need extra

help and funding here in order to distribute the vaccine. it's not just about nursing homes, which are fairly easy to target. but to get to people in the community is a much, much bigger effort. >> i also want to bring in sharon, an investigative reporter with "the new york times" who broke the story that the white house declined to buy more doses. what are you learning about what happened between the trump administration and the pfizer? >> i think what happened was pfizer was very eager to offer the trump administration as many doses really as they wanted to buy because pfizer is an american company and the bulk of its customers are american. and they did not want to get in a situation where it was basically vaccinating people overseas while americans were waiting for its vaccine. but two or three times, pfizer officials were told, really

urged the trump administration to buy more than just 100 million doses. like, don't you want more? you don't have to pay for it up front. there's not a lot of risk for you here. make too big of a bet on pfizer, even though it was not money out of pocket. they basically bet on 100 million doses from each of them with pfizer included as part of the crash program to develop the vaccine. >> we just showed the list of all the different companies, and it looks like astrazeneca, they bought a lot more of astrazeneca than any others. the others were kind of in the 100 million range. i guess i don't quite y for astrazeneca they purchased 300 million. everybody else, they purchased 100 million. do you have any idea why? >> yes, because astrazeneca is a low-cost vaccine, and it's basically -- i think they were selling it at no profit.

so, the amount of money that the government was clunking down was about the same. but astrazeneca also is not -- there are some questions about its data, its transparency. its trial in the u.s. is not in the same position as pfizer and moderna. what we have in hand ruth now is 100 million doses from moderna, 100 million doses from pfizer. and these are both two-dose regimes, right? so, together they're going to cover 100 million americans. and the question is, you know, who's going to cover the other 230 million. >> sanjay, that is a great question. on good morning america, they said it would not be reasonable to purchase more doses over the summer. another official said that decision was made as plan to diversify the nation's vaccine arsenal. do you buy that? >> you know, i've been talking

to mansaf since he was appointed chief adviser for operation warp speed. they were having to make a lot of bets on these vaccines. these vaccines, which are pfizer and moderna, one thing is that we've never had that type of vaccine before. so, the results now we're seeing look to be pretty remarkable as saleen was just talking about. at the time it wasn't clear they were going to be that efficacious. and i also talked to mansef a few days ago and it wasn't clear that pfizer was going to be able to deliver the vaccines they would need to make up the shortfall. i think there are lots of different decisions points here astrazeneca and johnson and johnson are in phase three. just ahead, the first people in the west to get the pfizer vaccine today. what it means in their words to no longer live in fear when we return.
