let's go out front. good evening, i am erin burnett. it has been five days since andrew brown jr. shot and killed by sheriff deputies in north carolina. that's all the family was shown today. the family expected transparency but what they got instead according to their attorneys is delay and incomplete of information. they were made to wait two hours so the county can blur the faces of some of the people in the video. it has been five days they have been asking for it. the extra two hours wait felt disrespectful. they were shown with their attorney after all of that of a 20 seconds snippet. >> let's be clear, this was an execution. andrew brown was in his drive way. the sheriff blocked him in his

drive way so he would not exit. andrew had his hands-on his steering wheel. they went up to his vehicle and shot pihim. >> they're trying to hide something. they don't want us to see everything. >> you see ben crump there. he was the attorney for floyd's family. it was the context around it. it was the whole 9 minutes and 49 seconds. it was all of that, right? this comes the same day the doj announced federal investigation into louisville, kentucky after the death of breonna taylor who was killed during a raid at her home. officials were criticized for not being transparent. we are hearing the same complaints when it comes to north carolina. we are seeing a familiar scene, protesters beginning to gather and demanding answers. natasha chen is in elizabeth

city for us tonight. if this video is finally release to the public. >> reporter: the city was prepared for a strong reaction from the community if the content of the video were disturbing. the description of it certainly was. what's more disturbing to the people that had been marching around town is that they only seemingly got 20 seconds shown to the family in private. one of the women who was marching tonight said she actually came here, we saw her this morning at 7:00 a.m. in this parking lot. she says today felt like a waste of her time but she will won't continue to come back everyday until there is more transparency. >> what do we want? >> video! >> reporter: more than five full days after andrew brown jr. was killed in elizabeth, north carolina. brown's family viewed body camera footage from the

execution. >> the officers was in no harm of him at all. it is messed up how it happened. >> reporter: the family were shown 20 seconds of the video from one deputy's body camera. there were multiple body cameras worn by deputies on the scene and only after the county attorney made redactions including the blurring of faces. >> he had his hands firmly on the steering wheel and they went up to his vehicle and shoots him. >> sure did. >> he still stood there with his hands in the steering wheel while being shot at. he backs out away from the officer who's still shooting at him. >> reporter: letting the family see only 20 seconds stoked suspicion from browns' family. >> when the video came on, they were already shooting hip.

obviously they're still trying to deflect and hide everything on the video. >> we got fed up. we are hurting. they been getting away with a lot of [ bleep ] and doing dirty [ bleep ] and got caught up in the act. they got to pay the price, too. they're not better than us. >> reporter: the crowd gasped over what the family and the attorney would be seeing and who could be in the room to view the foo footage. >> mr. cot told me a grown black man that he was not going to be bullied. >> reporter: andrew brown jr. died from homicide. cnn obtained the search warrant showed the sheriff deputy has been authorized.

the warrant was marked not executed. >> reporter: the sheriff said they were there to serve an arrest warrant. >> a warrant does not mean you are guilty. a warrant does not mean execution. a warrant does not mean you get shot in the back. >> reporter: the family's attorney describes the 20 seconds video as startling when the shooting was already underway. the sheriff post add video to facebook this evening saying the whole event happens so quickly that was open in 30 seconds. a group of media outlets including cnn had done the same. the hearing will be on wednesday. >> natasha, thank you very much.

obviously that'll be an porn h >> natasha, thank you very much. obviously that'll be an porn h important hearing. >> i want to go to wayne. the whole incident was less than 30 seconds. the clear implication was well, if we gave you 20 seconds, you saw pretty much everything. that's what he's trying to imply. do you believe that the family has seen pretty much everything? the 20 seconds they have? >> well, erin, thank you for having me first of all, we don't know how long it lasted. we were shown or at least when our colleagues was shown 20 seconds. the attorney for the county refused to let myself and ben crump and harry daniels to view the video because we are not barred in the state of north carolina. we felt that was unfair and unjust and certainly outside the bounds of a statue that covers this particular type of disclosure.

we as attorneys for the family and attorneys for mr. brown's personal representatives, we should be allowed to see that video. we don't know how long this incident lasts. it is important to see the entire video from the start to finish. you don't know what happened and there could be extremely important information in that 10 seconds even if it is for 30 seconds. >> so when you look at this, wayne, what are the biggest question you have and obviously now your team is seeing 20 seconds. what is the biggest question you have now that you didn't get answer from that 20 seconds snippet. >> we want to know how this started. they were already shooting when the video started. it is important to know what

commands were given to mr. brown before the shooting starts. they just rolled up on his vehicle which i understand was parked on a parking pad pointing towards the street. we want to know what commands were given. did he or did he not comply with those commands? why did they just show a video after the shooting started and not before the shooting starts. and all during this time they did show it, they were shooting into the vehicle. he was trying to apparently avoid being hit by bullets that were raining down on him. # >> i certainly understand what you are saying and obvious that you are feeling this way. they need to see what happened and we understand why it is absolutely imperative. the family hoped they would see the video on friday.

that's the indication that i got from ben crump. and they did not. they were supposed to see the video at 11:30 a.m. and then it was delayed another two hours after five days in total. the video needed to be blurred. so, what do you make of that? i know the family felt disrespected and after all that time you sit and have to wait for two more hours for the video blurring? >> we had rolling discussions with the county attorney mr. cox for the last several days about being allowed the see this video. yesterday i had a brief conversation with him and the conversation centered around who in the family would be allowed to see the video. they never raised any issues with regards to attorneys, being able to see the video, he never told us we would need to be barred in the state of north

carolina in order to see the video. all of these excuses they came up were excuses. they came up this morning to say well, there is going to be a delayed because we need to redact the video. we don't want to show the faces of the officers that were on the scene engaging in this horrific activity. they also understand blur the weapons that were being used. we know our colleagues were there, what type of weapons being used and they told her it was an ar-15 rifle. why would you need that to execute a warrant? and she said the guy had on assault gear. >> i understand there is a lot that we don't know. the main question that i have

for you is why? do you think they're trying to hide something at this point? or could this be a case of -- i don't know, just that they want to do it their way and they don't want to be pressured into something or do you think they're trying to hide something? >> well, it is obvious to us that they are trying to hide something. i mean obviously no reason to not allow the family to see the entire raw video. i assure you that had andrew brown had been doing something that's in criminating. something that would have justified his shooting, we would have that video the same day just like it was released in the columbus shooting. when the law enforcement officers feel they are justified, they release it

immediately. when they feel they are not justified, then they want to redact and hide the faces and hide their weapons and come up with all of these excuses for not releasing the video and it is clear. this video under north carolina law should be seen by the family members, miss andrew brown. and the law states promptly without delays. >> all right, wayne, i appreciate your time. thank you very much. as i said, wayne kendall is the attorney for mr. brown's family. i want to go to our senior analyst, elie honig. he said the video, the shooting already started when the video started. the whole thing lasted 30 seconds whether it did or how

one counts that, we can't tell because all we have is 20 seconds. all the family has is 20 seconds. the video -- the shooting started when the video starts. any justification? >> the only legitimate justification, something showing the video would tip off the family that's endangering to the investigation. i see no such facts here. the fundamental problem is the local authorities are playing by the old school play book which for a long time in the law enforcement has been we'll show you whatever you want and when ever we want and there is nothing you can do about it. the laws are changing and you end up with the scenario where they lost the family's trust and the public's trust. >> the bacaria seller is representing the family as well.

the case based on the evidence and to avoid media. i trusted if they did that. >> reporter: he trusted the jury there. he added he felt the judge handled all these potential influences correctly. >> as part of your conversation, you did ask him about the path ahead and obviously that hits the appeal and the other officers, what else did he say? >> reporter: well, for starter, he looked at this as one case and what needs to be many cases to actually make meaningful change but in the after math of this verdict, we saw how much even this case meant to so many people. i showed them a video that we took in george floyd's square seconds after the verdict came down from the minneapolis area and he saw a little bit of himself in that video.

them. texas is going to gain two states in the house. colorado, florida and montana and north carolina and oregon will each gain a seat. this is really significant how this country structured its power for so long. california and new york is going to lose a seat and illinois, michigan, ohio and pennsylvania and west virginia. chuck schumer with new york whose state lost a seat by a margin of majority leader of 89 people. all in red states gaining blue states. if they just counted 89 more people in new york, you would not have lost that seat. that's got to burn. >> look, erin, i have not yet seen and study the census since it came out this afternoon so i am not going to make detailed comments until i take a look at

civil lawsuits and republicans don't. some democrats draw a starke line in the sand with this. here are two. >> we compromise on so much, you know we compromise, we die. we compromise, we die. >> qualified immunity has in many instances become the hood for bad police officers to in fact add as modern day k ku klux klan members. it has got to stop. >> are you open to senator scott's compromise that would keep protection for individual officers but would allow lawsuits against police departments? >> look, i am not getting into the details. i met with cory booker for 45 minutes an hour ago. i encouraged him to see what we can do.

obviously it is a very serious problem that must be dealt with in a strong way. a systematic bias in policing and in law enforcement and we have to do everything we can to erase it. cory booker believes he's making good progress and i think we have a decent chance of getting a strong bipartisan bill. >> do you think there is some immunity required if you want to attract great people to be police officers and not have them be afraid? >> i am not going to prejudge what corey and tim and others are working on. i have told them we want a bill, we want it to be a strong bill, this is a very, very serious issue and we have to -- we need strong medicine. >> the other issue is as president biden talks about his hyu hun hundred days in office, we know it is expected to cost

$2 trillion which would bring the total to $4 trillion. the second half is expected to cost the same. it appears you and the president both support using reconciliation getting it done. you passed it with 65 votes. my colleague dana bash asked joe manchin if he support to pass any of the reconstruction bill, here is how he answered her question. >> no. if people would just think about, if we go through the process that we are supposed to. we never used to use filibuster and reconciliation zone is only used for budget. we have to get back to getting it into the committees, let the committee chair and the members of those committee work it. >> bottom line, we need big, bold action. we want to do much of that as we

overall daily vaccinations waivering, appearing to the hesitants are crucial. >> we always have to meet people where they are and messages are tailored. what are your particular concerns? >> reporter: politics always come into play. 15% of republican men say tla n they are not likely to take the vaccine. what would you say to them? >> i would say crazy. the people that say hey, we want to get rid of these masks and open up businesses, the only way that we'll get life back to normal is we get enough people to get that vaccine. >> reporter: why not explain the reward of vaccination earlier. >> if what we are saying is get vacc vaccinated, it is great. by the way, you can't really change much of you wr daily activities. i don't think they understand what's in it for them. >> it was a major mistake not to
